<section id="H481997A77A434BFDA2A8A34012A230C9" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Forced Arbitration Injustice Repeal Act</short-title></quote> or the <quote><short-title>FAIR Act</short-title></quote>.</text></section> 
<section id="HEA506C511A0F40C5B82A01324A52CC18"><enum>2.</enum><header>Purposes</header><text display-inline="no-display-inline">The purposes of this Act are to—</text> 
<paragraph id="H5F55763F9B53462189D2FE227AEACAFD"><enum>(1)</enum><text>prohibit predispute arbitration agreements that force arbitration of future employment, consumer, antitrust, or civil rights disputes, and</text></paragraph> 
<paragraph id="H92EBEFCA9FC74AF1BBE6A51006A7F66D"><enum>(2)</enum><text>prohibit agreements and practices that interfere with the right of individuals, workers, and small businesses to participate in a joint, class, or collective action related to an employment, consumer, antitrust, or civil rights dispute.</text></paragraph></section> 
<section id="HBB7BDEC0BCEF441687517990F81F37F6"><enum>3.</enum><header>Arbitration of employment, consumer, antitrust, and civil rights disputes</header> 
<subsection id="H1D290F50E21A4F80984A1EF4FAFF2452"><enum>(a)</enum><header>In general</header><text>Title 9 of the United States Code is amended by adding at the end the following:</text>

<chapter id="H98B8EFC2AAD04288ACAC211D6C630D12"><enum>4</enum><header>Arbitration of Employment, Consumer, Antitrust, and Civil Rights Disputes</header> 
<toc container-level="chapter-container" idref="H98B8EFC2AAD04288ACAC211D6C630D12" lowest-bolded-level="division-lowest-bolded" lowest-level="section" quoted-block="no-quoted-block" regeneration="yes-regeneration"> 
<toc-entry idref="HD6FB5BEFF18749C69D7D9E53C314CD81" level="section">401. Definitions.</toc-entry> 
<toc-entry idref="H97EA5B25023F4EBAAFFBA25274D81DCD" level="section">402. No validity or enforceability.</toc-entry></toc> 
<section id="HD6FB5BEFF18749C69D7D9E53C314CD81"><enum>401.</enum><header>Definitions</header><text display-inline="no-display-inline">In this chapter—</text> 
<paragraph id="HFCCAEE6F7F334D26ACFC74531C5CC9F7"><enum>(1)</enum><text>the term <quote>antitrust dispute</quote> means a dispute—</text> 
<subparagraph id="H81D3EF5D19CC4456BE8C4ED9EAAC3EB6"><enum>(A)</enum><text>arising from an alleged violation of the antitrust laws (as defined in subsection (a) of the first section of the Clayton Act) or State antitrust laws; and</text></subparagraph> 
<subparagraph id="H7177A1F0C56A4C108F918A54CEA91B8C"><enum>(B)</enum><text>in which the plaintiffs seek certification as a class under rule 23 of the Federal Rules of Civil Procedure or a comparable rule or provision of State law;</text></subparagraph></paragraph> 
<paragraph id="HAB6761B455FD47A79FEC073BB90E3D5B"><enum>(2)</enum><text>the term <quote>civil rights dispute</quote> means a dispute—</text> 
<subparagraph id="HD1B8BC578005429B9BDB5AFF7FB5A802"><enum>(A)</enum><text>arising from an alleged violation of—</text> 
<clause id="HEDB1EA9D3EA6462DA4B096C37EC213FE"><enum>(i)</enum><text>the Constitution of the United States or the constitution of a State;</text></clause> 
<clause id="H54117C0439714B8286C180F71B77EEDB"><enum>(ii)</enum><text>any Federal, State, or local law that prohibits discrimination on the basis of race, sex, age, gender identity, sexual orientation, disability, religion, national origin, or any legally protected status in education, employment, credit, housing, public accommodations and facilities, voting, veterans or servicemembers, health care, or a program funded or conducted by the Federal Government or State government, including any law referred to or described in section 62(e) of the Internal Revenue Code of 1986, including parts of such law not explicitly referenced in such section but that relate to protecting individuals on any such basis; and</text></clause></subparagraph> 
<subparagraph id="HA89F10A7F11A40BCA2376881CF2C2C97"><enum>(B)</enum><text>in which at least 1 party alleging a violation described in subparagraph (A) is one or more individuals (or their authorized representative), including one or more individuals seeking certification as a class under rule 23 of the Federal Rules of Civil Procedure or a comparable rule or provision of State law;</text></subparagraph></paragraph> 
<paragraph id="H4CF892B1C8C847E8BA17FFBE08548F12"><enum>(3)</enum><text>the term <quote>consumer dispute</quote> means a dispute between—</text> 
<subparagraph id="HCC11AA935DDE4BA2861DB21B0C02F307"><enum>(A)</enum><text>one or more individuals who seek or acquire real or personal property, services (including services related to digital technology), securities or other investments, money, or credit for personal, family, or household purposes including an individual or individuals who seek certification as a class under rule 23 of the Federal Rules of Civil Procedure or a comparable rule or provision of State law; and</text></subparagraph> 
<subparagraph id="H4FB483BAFDB044C89620F8FE89C948C6"><enum>(B)</enum> 
<clause commented="no" display-inline="yes-display-inline" id="HE2A7A80796C843E1A17344F6277DB261"><enum>(i)</enum><text>the seller or provider of such property, services, securities or other investments, money, or credit; or</text></clause> 
<clause id="H95E461116E1749DCB33D148E18517CE5" indent="up1"><enum>(ii)</enum><text>a third party involved in the selling, providing of, payment for, receipt or use of information about, or other relationship to any such property, services, securities or other investments, money, or credit;</text></clause></subparagraph></paragraph> 
<paragraph id="HF5CABED8CE194A0280714B28F350E5A5"><enum>(4)</enum><text>the term <quote>employment dispute</quote> means a dispute between one or more individuals (or their authorized representative) and a person arising out of or related to the work relationship or prospective work relationship between them, including a dispute regarding the terms of or payment for, advertising of, recruiting for, referring of, arranging for, or discipline or discharge in connection with, such work, regardless of whether the individual is or would be classified as an employee or an independent contractor with respect to such work, and including a dispute arising under any law referred to or described in section 62(e) of the Internal Revenue Code of 1986, including parts of such law not explicitly referenced in such section but that relate to protecting individuals on any such basis, and including a dispute in which an individual or individuals seek certification as a class under rule 23 of the Federal Rules of Civil Procedure or as a collective action under section 16(b) of the Fair Labor Standards Act, or a comparable rule or provision of State law;</text></paragraph> 
<paragraph id="H5507D30703144216ABF354FA05E5B0C7"><enum>(5)</enum><text>the term <quote>predispute arbitration agreement</quote> means an agreement to arbitrate a dispute that has not yet arisen at the time of the making of the agreement; and</text></paragraph> 
<paragraph id="H8149FE9EFF474F3AA6F1A6AA0A44866D"><enum>(6)</enum><text>the term <quote>predispute joint-action waiver</quote> means an agreement, whether or not part of a predispute arbitration agreement, that would prohibit, or waive the right of, one of the parties to the agreement to participate in a joint, class, or collective action in a judicial, arbitral, administrative, or other forum, concerning a dispute that has not yet arisen at the time of the making of the agreement.</text></paragraph></section> 
<section id="H97EA5B25023F4EBAAFFBA25274D81DCD"><enum>402.</enum><header>No validity or enforceability</header> 
<subsection id="H8D973ED94FC248E0AC2CE460CFAF0E9C"><enum>(a)</enum><header>In general</header><text>Notwithstanding any other provision of this title, no predispute arbitration agreement or predispute joint-action waiver shall be valid or enforceable with respect to an employment dispute, consumer dispute, antitrust dispute, or civil rights dispute.</text></subsection> 
<subsection id="HC3461B491A524A1184AFCCF4B972E230"><enum>(b)</enum><header>Applicability</header> 
<paragraph id="HFFE281970B794140939174CFDB646E43"><enum>(1)</enum><header>In general</header><text>An issue as to whether this chapter applies with respect to a dispute shall be determined under Federal law. The applicability of this chapter to an agreement to arbitrate and the validity and enforceability of an agreement to which this chapter applies shall be determined by a court, rather than an arbitrator, irrespective of whether the party resisting arbitration challenges the arbitration agreement specifically or in conjunction with other terms of the contract containing such agreement, and irrespective of whether the agreement purports to delegate such determinations to an arbitrator.</text></paragraph> 
<paragraph id="H81717D7E07254EBE955623C2ECB22D03"><enum>(2)</enum><header>Collective bargaining agreements</header><text>Nothing in this chapter shall apply to any arbitration provision in a contract between an employer and a labor organization or between labor organizations, except that no such arbitration provision shall have the effect of waiving the right of a worker to seek judicial enforcement of a right arising under a provision of the Constitution of the United States, a State constitution, or a Federal or State statute, or public policy arising therefrom.</text></paragraph></subsection></section></chapter><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="HA8701CC7843D4B088F016B11F18CC674"><enum>(b)</enum><header>Technical and conforming amendments</header> 
<paragraph id="H6533BE609ED1499CAFB39DF60458951C"><enum>(1)</enum><header>In general</header><text>Title 9 of the United States Code is amended—</text> 
<subparagraph id="H44BE612A8499447FA2C5E91A8ADF7335"><enum>(A)</enum><text>in section 1 by striking <quote>of seamen,</quote> and all that follows through <quote>interstate commerce,</quote> and inserting in its place <quote>of individuals, regardless of whether such individuals are designated as employees or independent contractors for other purposes</quote>,</text></subparagraph> 
<subparagraph id="H2C0DAB3DC8D74F799447DBAE88F4F455"><enum>(B)</enum><text>in section 2 by inserting <quote>or as otherwise provided in chapter 4</quote> before the period at the end,</text></subparagraph> 
<subparagraph id="HED0F3644AAF14EBBB019AFB8FA5C1CC4"><enum>(C)</enum><text>in section 208—</text> 
<clause id="H081A982B59EC438CAB3A15EB9390F932"><enum>(i)</enum><text>in the section heading by striking <quote><header-in-text level="section" style="OLC">Chapter 1; residual application</header-in-text></quote> and inserting <quote><header-in-text level="section" style="OLC">Application</header-in-text></quote>, and</text></clause> 
<clause id="HCB6293B0E37D447E852ED6434F072572"><enum>(ii)</enum><text>by adding at the end the following: <quote>This chapter applies to the extent that this chapter is not in conflict with chapter 4.</quote>, and</text></clause></subparagraph> 
<subparagraph id="HF45ED8918A2F4A83974BEB91BE07FFD1"><enum>(D)</enum><text>in section 307—</text> 
<clause id="H7F51DDA2D47C4F21B37F4B6FF130BB58"><enum>(i)</enum><text>in the section heading by striking <quote><header-in-text level="section" style="OLC">Chapter 1; residual application</header-in-text></quote> and inserting <quote><header-in-text level="section" style="OLC">Application</header-in-text></quote>, and</text></clause>
