<subsection id="H2B6B04B1E6E545C3977847EA4634A695"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Funds are hereby authorized to be appropriated for fiscal year 2018 for the conduct of the intelligence and intelligence-related activities of the following elements of the United States Government:</text>

<subsection id="H1B510F831D694BA09BABB46675DBE77F"><enum>(b)</enum><header>Certain specific authorization</header><text display-inline="yes-display-inline">Funds appropriated by the Department of Defense Missile Defeat and Defense Enhancements Appropriations Act, 2018 (division B of Public Law 115–96) for intelligence or intelligence-related activities are specifically authorized by the Congress for purposes of section 504 of the National Security Act of 1947 (50 U.S.C. 3094), as specified in the classified Schedule of Authorizations pursuant to section 1102, and are subject to such section 504.</text></subsection></section> 
<section id="H06E1297EF06140DB92A2DA37FABA679C"><enum>1102.</enum><header>Classified Schedule of Authorizations</header> 
<subsection id="H3FA837B2D3A344AFABB2D430DFF443DF"><enum>(a)</enum><header>Specifications of amounts</header><text display-inline="yes-display-inline">The amounts authorized to be appropriated under section 1101 and, subject to section 1103, the authorized personnel ceilings as of September 30, 2018, for the conduct of the intelligence activities of the elements listed in paragraphs (1) through (16) of section 1101, are those specified in the classified Schedule of Authorizations prepared to accompany this division.</text></subsection> 
<subsection id="HB3C3BE6FCED34ED2A6CC8E315773D323"><enum>(b)</enum><header>Availability of classified schedule of authorizations</header> 
<paragraph id="H83785186EC5A4604A1D97397E71CA710"><enum>(1)</enum><header>Availability</header><text>The classified Schedule of Authorizations referred to in subsection (a) shall be made available to the Committee on Appropriations of the Senate, the Committee on Appropriations of the House of Representatives, and to the President.</text></paragraph> 
<paragraph id="HA739EA8C392542C1B4305C16AC8671C7"><enum>(2)</enum><header>Distribution by the President</header><text>Subject to paragraph (3), the President shall provide for suitable distribution of the classified Schedule of Authorizations referred to in subsection (a), or of appropriate portions of such Schedule, within the executive branch.</text></paragraph> 
<paragraph id="HD1B3B6FB6BEB4656B949259B8394B143"><enum>(3)</enum><header>Limits on disclosure</header><text>The President shall not publicly disclose the classified Schedule of Authorizations or any portion of such Schedule except—</text> 
<subparagraph id="H5AA607F92EF44FB9A8EE2E145AEF6B50"><enum>(A)</enum><text>as provided in section 601(a) of the Implementing Recommendations of the 9/11 Commission Act of 2007 (50 U.S.C. 3306(a));</text></subparagraph> 
<subparagraph id="HEBB7DFD8D8E2494BB674B82EEF345060"><enum>(B)</enum><text>to the extent necessary to implement the budget; or</text></subparagraph> 
<subparagraph id="H17FEEDE1657B472196261D19F4BF58CD"><enum>(C)</enum><text>as otherwise required by law.</text></subparagraph></paragraph></subsection></section> 
<section commented="no" display-inline="no-display-inline" id="H5BC0E809E5454BA0BF3DD1CECC47F210" section-type="subsequent-section"><enum>1103.</enum><header>Personnel ceiling adjustments</header> 
<subsection commented="no" display-inline="no-display-inline" id="H84897353C1FB423D9974CE11DCAB3F16"><enum>(a)</enum><header>Authority for increases</header><text>The Director of National Intelligence may authorize employment of civilian personnel in excess of the number authorized for fiscal year 2018 by the classified Schedule of Authorizations referred to in section 1102(a) if the Director of National Intelligence determines that such action is necessary to the performance of important intelligence functions, except that the number of personnel employed in excess of the number authorized under such section may not, for any element of the intelligence community, exceed—</text> 
<paragraph commented="no" id="HB96D78DC9E074D45932D0B236A35DD42"><enum>(1)</enum><text>3 percent of the number of civilian personnel authorized under such schedule for such element; or</text></paragraph> 
<paragraph commented="no" id="H9E82EE4276E6463F9999985206C1AA30"><enum>(2)</enum><text>10 percent of the number of civilian personnel authorized under such schedule for such element for the purposes of converting the performance of any function by contractors to performance by civilian personnel.</text></paragraph></subsection> 
<subsection commented="no" id="H6211A2CB43274A9F80CD8B9FF5AB34BE"><enum>(b)</enum><header>Treatment of certain personnel</header><text>The Director of National Intelligence shall establish guidelines that govern, for each element of the intelligence community, the treatment under the personnel levels authorized under section 1102(a), including any exemption from such personnel levels, of employment or assignment in—</text> 
<paragraph commented="no" id="HC9EE70B79399404AA073CC65E097D7C3"><enum>(1)</enum><text>a student program, trainee program, or similar program;</text></paragraph> 
<paragraph commented="no" id="HD4E283C6FC1C49C2BD80F4B65162C919"><enum>(2)</enum><text>a reserve corps or as a reemployed annuitant; or</text></paragraph> 
<paragraph commented="no" id="H9D34465580304D6DB966AFEEF15C87B9"><enum>(3)</enum><text>details, joint duty, or long-term, full-time training.</text></paragraph></subsection> 
<subsection commented="no" id="HD7666B85D0D144DAAF2712DB3C6D0C64"><enum>(c)</enum><header>Notice to congressional intelligence committees</header><text display-inline="yes-display-inline">Not later than 15 days prior to the exercise of an authority described in subsection (a), the Director of National Intelligence shall submit to the congressional intelligence committees—</text> 
<paragraph id="H6DAD841BB0D04D4C8B6C8F864D96EA9E"><enum>(1)</enum><text display-inline="yes-display-inline">a written notice of the exercise of such authority; and</text></paragraph> 
<paragraph id="HCE341E644A854124AC357C798DBD6F0F"><enum>(2)</enum><text display-inline="yes-display-inline">in the case of an exercise of such authority subject to the limitation in subsection (a)(2), a written justification for the contractor conversion that includes a comparison of whole-of-Government costs.</text></paragraph></subsection></section> 
<section commented="no" display-inline="no-display-inline" id="H4C417B9720A84E428801F0DE8CA86014" section-type="subsequent-section"><enum>1104.</enum><header display-inline="yes-display-inline">Intelligence Community Management Account</header> 
<subsection commented="no" display-inline="no-display-inline" id="HE08DC2C445CB453F925988EED9EAB2BD"><enum>(a)</enum><header display-inline="yes-display-inline">Authorization of appropriations</header><text display-inline="yes-display-inline">There is authorized to be appropriated for the Intelligence Community Management Account of the Director of National Intelligence for fiscal year 2018 the sum of $546,900,000.</text></subsection> 
<subsection commented="no" display-inline="no-display-inline" id="H05B57A0554EE47098D769B0E3B4DB776"><enum>(b)</enum><header>Authorized personnel levels</header><text>The elements within the Intelligence Community Management Account of the Director of National Intelligence are authorized 797 positions as of September 30, 2018. Personnel serving in such elements may be permanent employees of the Office of the Director of National Intelligence or personnel detailed from other elements of the United States Government.</text></subsection> 
<subsection commented="no" display-inline="no-display-inline" id="HAE8511414CFC4DCABD82A59B5612F97B"><enum>(c)</enum><header display-inline="yes-display-inline">Classified authorizations</header> 
<paragraph commented="no" display-inline="no-display-inline" id="HA93DD8BF7B9347DF8DF5DF3644085CA5"><enum>(1)</enum><header>Authorization of appropriations</header><text display-inline="yes-display-inline">In addition to amounts authorized to be appropriated for the Intelligence Community Management Account by subsection (a), there are authorized to be appropriated for the Intelligence Community Management Account for fiscal year 2018 such additional amounts as are specified in the classified Schedule of Authorizations referred to in section 1102(a).</text></paragraph> 
<paragraph commented="no" display-inline="no-display-inline" id="H54AC3C699D074863B47978EC782E36AA"><enum>(2)</enum><header>Authorization of personnel</header><text display-inline="yes-display-inline">In addition to the personnel authorized by subsection (b) for elements of the Intelligence Community Management Account as of September 30, 2018, there are authorized such additional personnel for the Community Management Account as of that date as are specified in the classified Schedule of Authorizations referred to in section 1102(a).</text></paragraph></subsection></section></title> 
<title commented="no" id="HA624B9F0542F4775A99FE0EFAB74D9B6" level-type="subsequent"><enum>II</enum><header display-inline="yes-display-inline">Central Intelligence Agency Retirement and Disability System</header> 
<section commented="no" display-inline="no-display-inline" id="HD070806B8D404387AF2B830D48EF6787" section-type="subsequent-section"><enum>1201.</enum><header display-inline="yes-display-inline">Authorization of appropriations</header><text display-inline="no-display-inline">There is authorized to be appropriated for the Central Intelligence Agency Retirement and Disability Fund for fiscal year 2018 the sum of $514,000,000.</text></section> 
<section id="H549A85E744054FEAAEE7F855CBEE14EF"><enum>1202.</enum><header>Computation of annuities for employees of the Central Intelligence Agency</header> 
<subsection id="HFA8ED5978DC949F6A769CC75430030E2"><enum>(a)</enum><header>Computation of annuities</header> 
<paragraph id="H7ACE930AB8A24F7A93FC6B5A833154D3"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Section 221 of the Central Intelligence Agency Retirement Act (50 U.S.C. 2031) is amended—</text> 
<subparagraph id="H3CE05D93B22948379E4073A13503632F"><enum>(A)</enum><text display-inline="yes-display-inline">in subsection (a)(3)(B), by striking the period at the end and inserting <quote>, as determined by using the annual rate of basic pay that would be payable for full-time service in that position.</quote>;</text></subparagraph> 
<subparagraph id="H3B630D8B677B4589A6333EC9EAB8BE22"><enum>(B)</enum><text display-inline="yes-display-inline">in subsection (b)(1)(C)(i), by striking <quote>12-month</quote> and inserting <quote>2-year</quote>;</text></subparagraph> 
<subparagraph id="HF7190379960F48D793016BDB292AF97E"><enum>(C)</enum><text>in subsection (f)(2), by striking <quote>one year</quote> and inserting <quote>two years</quote>;</text></subparagraph> 
<subparagraph id="HA154003DA7CB481EAB9E490EF2771E4A"><enum>(D)</enum><text>in subsection (g)(2), by striking <quote>one year</quote> each place such term appears and inserting <quote>two years</quote>;</text></subparagraph>

<paragraph id="H455857AD01494E67896B33CDDC2611F8"><enum>(1)</enum><header> Authority to make designation</header><text>Subject to the rights of former spouses under subsection (b) and section 222, at the time of retirement a married participant found by the Director to be in good health may elect to receive an annuity reduced in accordance with subsection (f)(1)(B) and designate in writing an individual having an insurable interest in the participant to receive an annuity under the system after the participant's death, except that any such election to provide an insurable interest survivor annuity to the participant's spouse shall only be effective if the participant's spouse waives the spousal right to a survivor annuity under this Act. The amount of the annuity shall be equal to 55 percent of the participant's reduced annuity.</text></paragraph> 
<paragraph id="HC21CD4E27A024789A676BADEE0CCA47E"><enum>(2)</enum><header>Reduction in participant's annuity</header><text>The annuity payable to the participant making such election shall be reduced by 10 percent of an annuity computed under subsection (a) and by an additional 5 percent for each full 5 years the designated individual is younger than the participant. The total reduction under this subparagraph may not exceed 40 percent.</text></paragraph> 
<paragraph id="HD466EFFE54BF435FB05E7803EDE95096"><enum>(3)</enum><header>Commencement of survivor annuity</header><text>The annuity payable to the designated individual shall begin on the day after the retired participant dies and terminate on the last day of the month before the designated individual dies.</text></paragraph> 
<paragraph id="HD9FC53D00BA141F9AA6F75F3E4128F58"><enum>(4)</enum><header>Recomputation of participant's annuity on death of designated individual</header><text>An annuity which is reduced under this subsection shall, effective the first day of the month following the death of the designated individual, be recomputed and paid as if the annuity had not been so reduced.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph>

<subsection id="HB606CD5280554CC88D2EC6B0DEDAE15E"><enum>(a)</enum><header>Length of period of assignment</header><text>Subsection (a) of section 502 of the Foreign Service Act of 1980 (22 U.S.C. 3982) is amended by adding at the end the following new paragraph:</text>

<paragraph id="H0ABF25628CB84B3386FB4E192A83470B"><enum>(1)</enum><header>In general</header><text>The Secretary of State, with the assistance of other relevant officials, shall require all members of the Service who receive foreign language training in Arabic, Farsi, Chinese (Mandarin or Cantonese), Turkish, Korean, and Japanese by the institution or otherwise in accordance with subsection (b) to serve three successive tours in positions in which the acquired language is both relevant and determined to be a benefit to the Department.</text></paragraph> 
<paragraph id="HC6869027E02D4A6ABC8F048EB9FBB9EE"><enum>(2)</enum><header>Overseas deployments</header><text>In carrying out paragraph (1), at least one of the three successive tours referred to in such paragraph shall be an overseas deployment.</text></paragraph> 
<paragraph id="H33E039B60DE346E4A0AF06A39597BC81"><enum>(3)</enum><header>Waiver</header><text>The Secretary of State may waive the application of paragraph (1) for medical or family hardship or in the interest of national security.</text></paragraph> 
<paragraph id="H3E104863C4054BF182AEF77534D4FD5B"><enum>(4)</enum><header>Congressional notification</header><text>The Secretary of State shall notify the Committees on Appropriations and Foreign Affairs of the House of Representatives and Committees on Appropriations and Foreign Relations of the Senate at the end of each fiscal year of any instances during the prior twelve months in which the waiver authority described in paragraph (3) was invoked.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection></section> 
<section id="HDF422E7499E94CD3AB9195B3D9DF779C" section-type="subsequent-section"><enum>1502.</enum><header>Assessment of significant Russian influence campaigns directed at foreign elections and referenda</header> 
<subsection id="H536C6953CF464CF0BBF5D78C03728539"><enum>(a)</enum><header>Assessment required</header><text display-inline="yes-display-inline">Not later than 60 days after the date of the enactment of this Act, the Director of National Intelligence shall submit to the congressional intelligence committees a report containing an analytical assessment of the most significant Russian influence campaigns, if any, conducted during the 3-year period preceding the date of the enactment of this Act, as well as the most significant current or planned such Russian influence campaigns, if any. Such assessment shall include—</text> 
<paragraph id="H154EE48595F744E69283A97420305AEA"><enum>(1)</enum><text display-inline="yes-display-inline">a summary of such significant Russian influence campaigns, including, at a minimum, the specific means by which such campaigns were conducted, are being conducted, or likely will be conducted, as appropriate, and the specific goal of each such campaign;</text></paragraph> 
<paragraph id="H485CB6B2B20E4343866B75CAA98130F5"><enum>(2)</enum><text>a summary of any defenses against or responses to such Russian influence campaigns by the foreign state holding the elections or referenda;</text></paragraph> 
<paragraph id="H32AF7F2E2E5042C292812AB9CDBB3127"><enum>(3)</enum><text display-inline="yes-display-inline">a summary of any relevant activities by elements of the intelligence community undertaken for the purpose of assisting the government of such foreign state in defending against or responding to such Russian influence campaigns; and</text></paragraph> 
<paragraph id="H1B207D514B334BA2B174A89E728E76E5"><enum>(4)</enum><text>an assessment of the effectiveness of such defenses and responses described in paragraphs (2) and (3).</text></paragraph></subsection> 
<subsection id="HC5659421217843ECA0438A353E835812"><enum>(b)</enum><header>Form</header><text display-inline="yes-display-inline">The report required by subsection (a) may be submitted in classified form, but if so submitted, shall contain an unclassified summary.</text></subsection> 
<subsection id="H76EF40FC7DE24FA38466F662C0AF5577"><enum>(c)</enum><header>Russian influence campaign defined</header><text display-inline="yes-display-inline">In this section, the term <term>Russian influence campaign</term> means any effort, covert or overt, and by any means, attributable to the Russian Federation directed at an election, referendum, or similar process in a country other than the Russian Federation or the United States.</text></subsection></section> 
<section id="H18DA03E497D8462B91ECD90739AFC28F" section-type="subsequent-section"><enum>1503.</enum><header>Foreign counterintelligence and cybersecurity threats to Federal election campaigns</header> 
<subsection id="HC1AAC1163EEE47219EE684CFAF836DA9"><enum>(a)</enum><header>Reports required</header> 
<paragraph id="HB742F73713024FD9B54D91FD3B8DD0B1"><enum>(1)</enum><header>In general</header><text>As provided in paragraph (2), for each Federal election, the Director of National Intelligence, in coordination with the Under Secretary of Homeland Security for Intelligence and Analysis and the Director of the Federal Bureau of Investigation, shall make publicly available on an internet website an advisory report on foreign counterintelligence and cybersecurity threats to election campaigns for Federal offices. Each such report shall include, consistent with the protection of sources and methods, each of the following:</text> 
<subparagraph id="H6992092B1F2E4EA8955E17E70A79DF58"><enum>(A)</enum><text display-inline="yes-display-inline">A description of foreign counterintelligence and cybersecurity threats to election campaigns for Federal offices.</text></subparagraph> 
<subparagraph id="H54A0DC95B72D45F2AD027768A0E8C5FC"><enum>(B)</enum><text>A summary of best practices that election campaigns for Federal offices can employ in seeking to counter such threats.</text></subparagraph> 
<subparagraph id="H2BBADF02D7934093856D54C4F3893A21"><enum>(C)</enum><text>An identification of any publicly available resources, including United States Government resources, for countering such threats.</text></subparagraph></paragraph> 
<paragraph id="H43A4641A2C0B4A94A463211614E373FA"><enum>(2)</enum><header>Schedule for submittal</header><text>A report under this subsection shall be made available as follows:</text> 
<subparagraph id="H30C9D1DBC9154CF6AAE7AF4ED31348E6"><enum>(A)</enum><text>In the case of a report regarding a special election held for the office of Senator or Member of the House of Representatives during 2019, not later than the date that is 60 days before the date of such special election.</text></subparagraph> 
<subparagraph id="H314F0E2EBCD74AD2B77A2AD863FD3BA6"><enum>(B)</enum><text>In the case of a report regarding an election for a Federal office during any subsequent year, not later than the date that is 1 year before the date of the election.</text></subparagraph></paragraph> 
<paragraph id="HC2FF66C7FEBB4037B340ED7EAD04C723"><enum>(3)</enum><header>Information to be included</header><text>A report under this subsection shall reflect the most current information available to the Director of National Intelligence regarding foreign counterintelligence and cybersecurity threats.</text></paragraph></subsection> 
<subsection id="H8D7ED65F2CEE402DB88066F97E176219"><enum>(b)</enum><header>Treatment of campaigns subject to heightened threats</header><text display-inline="yes-display-inline">If the Director of the Federal Bureau of Investigation and the Under Secretary of Homeland Security for Intelligence and Analysis jointly determine that an election campaign for Federal office is subject to a heightened foreign counterintelligence or cybersecurity threat, the Director and the Under Secretary, consistent with the protection of sources and methods, may make available additional information to the appropriate representatives of such campaign.</text></subsection></section> 
<section display-inline="no-display-inline" id="HA19E4459A5CA44F882E8276016219FCA" section-type="subsequent-section"><enum>1504.</enum><header>Intelligence community reports on security clearances</header> 
<subsection id="H61B6B4BC7DE642858EF36F65FBDBAE1F"><enum>(a)</enum><header>Sense of Congress</header><text display-inline="yes-display-inline">It is the sense of Congress that—</text> 
<paragraph id="H2E9D189A6E774500977ECAE7C0315AAC"><enum>(1)</enum><text display-inline="yes-display-inline">despite sustained efforts by Congress and the executive branch, an unacceptable backlog in processing and adjudicating security clearances persists, both within elements of the intelligence community and in other departments of the Federal Government, with some processing times exceeding a year or even more;</text></paragraph> 
<paragraph id="H98732076DE4D43BEBC967CD561EBDA1A"><enum>(2)</enum><text display-inline="yes-display-inline">the protracted clearance timetable threatens the ability of elements of the intelligence community to hire and retain highly qualified individuals, and thus to fulfill the missions of such elements;</text></paragraph> 
<paragraph id="HD1D77BB6C29C413795D563885BF34430"><enum>(3)</enum><text>the prospect of a lengthy clearance process deters some such individuals from seeking employment with the intelligence community in the first place, and, when faced with a long wait time, those with conditional offers of employment may opt to discontinue the security clearance process and pursue different opportunities;</text></paragraph> 
<paragraph id="HE2F058C7C335422B9C24EB9D50E48EF8"><enum>(4)</enum><text display-inline="yes-display-inline">now more than ever, therefore, the broken security clearance process badly needs fundamental reform; and</text></paragraph> 
<paragraph id="HE58491DEC4D9457B8B5051B3C1BDDC03"><enum>(5)</enum><text display-inline="yes-display-inline">in the meantime, to ensure the ability of elements of the intelligence community to hire and retain highly qualified personnel, elements should consider, to the extent possible and consistent with national security, permitting new employees to enter on duty immediately or nearly so, and to perform, on a temporary basis pending final adjudication of their security clearances, work that either does not require a security clearance or requires only a low-level interim clearance. </text></paragraph></subsection> 
<subsection id="H023FCB6E20D845DCB212D9773043CE38"><enum>(b)</enum><header>In general</header><text display-inline="yes-display-inline">Section 506H of the National Security Act of 1947 (50 U.S.C. 3104) is amended—</text>

Each such report shall separately identify security clearances processed for Federal employees and contractor employees sponsored by each such element.</text></paragraph> 
<paragraph id="H77A7182C62C44E77A03726032064E49B" indent="up1"><enum>(2)</enum><text>Each report submitted under paragraph (1) shall include each of the following for each element of the intelligence community for the fiscal year covered by the report:</text> 
<subparagraph id="H82E30EFEDF134750857C595B61BC9EE8"><enum>(A)</enum><text>The total number of initial security clearance background investigations sponsored for new applicants.</text></subparagraph> 
<subparagraph id="H5FD19048C93C401FA05D27B4D849EC6C"><enum>(B)</enum><text>The total number of security clearance periodic reinvestigations sponsored for existing employees.</text></subparagraph> 
<subparagraph id="H1A6F659695A049A1B7F55A5ABF35B0E5"><enum>(C)</enum><text display-inline="yes-display-inline">The total number of initial security clearance background investigations for new applicants that were adjudicated with notice of a determination provided to the prospective applicant, including—</text> 
<clause id="H4495E27AC386435280FA1A8C87C79E7F"><enum>(i)</enum><text display-inline="yes-display-inline">the total number that were adjudicated favorably and granted access to classified information; and</text></clause> 
<clause id="HA4497B52679B4D489DEA71C3F42404DD"><enum>(ii)</enum><text>the total number that were adjudicated unfavorably and resulted in a denial or revocation of a security clearance.</text></clause></subparagraph> 
<subparagraph id="HCA4B536C8D754491B1000EB03D7F76E8"><enum>(D)</enum><text display-inline="yes-display-inline">The total number of security clearance periodic background investigations that were adjudicated with notice of a determination provided to the existing employee, including—</text> 
<clause id="H45305CD6653D413BBFCF9AA0410EF30D"><enum>(i)</enum><text display-inline="yes-display-inline">the total number that were adjudicated favorably; and</text></clause> 
<clause id="HA3700275D571469CAB47C2C1D0B9ADED"><enum>(ii)</enum><text>the total number that were adjudicated unfavorably and resulted in a denial or revocation of a security clearance.</text></clause></subparagraph> 
<subparagraph id="H8AAF479F84EB4278B53CD75ED31FCABF"><enum>(E)</enum><text display-inline="yes-display-inline">The total number of pending security clearance background investigations, including initial applicant investigations and periodic reinvestigations, that were not adjudicated as of the last day of such year and that remained pending as follows:</text> 
<clause id="HD96D12FDA8D2453CA901A40FC092E528"><enum>(i)</enum><text display-inline="yes-display-inline">For 180 days or less.</text></clause> 
<clause id="HA1A01AB2A4104B73A9CB860D9E762D73"><enum>(ii)</enum><text>For 180 days or longer, but less than 12 months.</text></clause> 
<clause id="HC4BC1D29F7FE4A2A856AA5C05E05455F"><enum>(iii)</enum><text>For 12 months or longer, but less than 18 months.</text></clause> 
<clause id="H76F14BC119F04E628BE897E891B50CD8"><enum>(iv)</enum><text>For 18 months or longer, but less than 24 months.</text></clause>

<clause id="H4A63A9B411C94B62B3B06B1B2139F52E"><enum>(i)</enum><text>an explanation of the causes for the delays incurred during the period covered by the report; and</text></clause> 
<clause id="HCC6A22028761409A9977A0B4CD6B04D4"><enum>(ii)</enum><text>the number of such delays involving a polygraph requirement.</text></clause></subparagraph> 
<subparagraph id="HB659D0DDFC4C48EFAC5DE460EDECCEB7"><enum>(G)</enum><text>The percentage of security clearance investigations, including initial and periodic reinvestigations, that resulted in a denial or revocation of a security clearance.</text></subparagraph> 
<subparagraph id="H0AB7DFA45BAC45DFBCBDB4781CC11767"><enum>(H)</enum><text>The percentage of security clearance investigations that resulted in incomplete information.</text></subparagraph> 
<subparagraph id="H7AE29C061C514F54BE91089C0D5E8CC8"><enum>(I)</enum><text>The percentage of security clearance investigations that did not result in enough information to make a decision on potentially adverse information.</text></subparagraph></paragraph> 
<paragraph id="H77ECE2BCF6824F44BB63AF11ECD7D6FC" indent="up1"><enum>(3)</enum><text>The report required under this subsection shall be submitted in unclassified form, but may include a classified annex.</text></paragraph></subsection><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph> 
<paragraph id="H204EE941EA6A4D68B32E74E238EA0414"><enum>(4)</enum><text>in subsection (c), as redesignated by paragraph (2), by striking <quote>subsection (a)(1)</quote> and inserting <quote>subsections (a)(1) and (b)</quote>.</text></paragraph></subsection></section> 
<section id="HA212247C147C4183A69FF39D88971438"><enum>1505.</enum><header>Assessment of threat finance relating to Russia</header> 
<subsection id="H80057D38FA94498B959FCA23F0748EA8"><enum>(a)</enum><header>Report required</header><text display-inline="yes-display-inline">Not later than 60 days after the date of the enactment of this Act, the Director of National Intelligence, in coordination with the Assistant Secretary of the Treasury for Intelligence and Analysis, shall submit to the congressional intelligence committees a report containing an assessment of Russian threat finance. The assessment shall be based on intelligence from all sources, including from the Office of Terrorism and Financial Intelligence of the Department of the Treasury.</text></subsection> 
<subsection id="HBFF98F866C664927A8BF9921AEA906DE"><enum>(b)</enum><header>Elements</header><text display-inline="yes-display-inline">The report required by subsection (a) shall include each of the following:</text> 
<paragraph id="HE9D74FEC9F3B42E0A8FE24A21DA54313"><enum>(1)</enum><text display-inline="yes-display-inline">A summary of leading examples from the 3-year period preceding the date of the submittal of the report of threat finance activities conducted by, for the benefit of, or at the behest of—</text> 
<subparagraph id="H4A847F0ACA134765A12DF75BE1E7DC5B"><enum>(A)</enum><text>officials of the Government of Russia;</text></subparagraph> 
<subparagraph id="H7E89A98150A14D208B8FD456CD20A7CF"><enum>(B)</enum><text>persons subject to sanctions under any provision of law imposing sanctions with respect to Russia;</text></subparagraph> 
<subparagraph id="HC120CD64995B4FD2AE649CDB292040F1"><enum>(C)</enum><text>Russian nationals subject to sanctions under any other provision of law; or</text></subparagraph> 
<subparagraph id="H45777217ADC340CCA916A0EE7DC34A3D"><enum>(D)</enum><text>Russian oligarchs or organized criminals.</text></subparagraph></paragraph> 
<paragraph id="H1C1C192539F44169836526386777B81F"><enum>(2)</enum><text display-inline="yes-display-inline">An assessment with respect to any trends or patterns in threat finance activities relating to Russia, including common methods of conducting such activities and global nodes of money laundering used by Russian threat actors described in paragraph (1) and associated entities.</text></paragraph> 
<paragraph id="HDEC9F6E4A23B433E9A05E3C26B92D68E"><enum>(3)</enum><text display-inline="yes-display-inline">An assessment of any connections between Russian individuals involved in money laundering and the Government of Russia.</text></paragraph> 
<paragraph id="H7F2EFF53180740FF97295540119492C0"><enum>(4)</enum><text>A summary of engagement and coordination with international partners on threat finance relating to Russia, especially in Europe, including examples of such engagement and coordination.</text></paragraph> 
<paragraph id="HDE77DBDC86AE4937AE0FF0F8EE4FEC48"><enum>(5)</enum><text>An identification of any resource and collection gaps.</text></paragraph> 
<paragraph id="H6152AAD967EB44358DAC3702F61FA7A0"><enum>(6)</enum><text display-inline="yes-display-inline">An identification of—</text> 
<subparagraph id="HD0E65A8F7ED14693B59FF1346081845F"><enum>(A)</enum><text>entry points of money laundering by Russian and associated entities into the United States;</text></subparagraph> 
<subparagraph id="H8CC34C443904470DA4CE78B89C9A8284"><enum>(B)</enum><text>any vulnerabilities within the United States legal and financial system, including specific sectors, which have been or could be exploited in connection with Russian threat finance activities; and</text></subparagraph> 
<subparagraph id="HF741DC9C90EC40538E8A4B7E5767AEEA"><enum>(C)</enum><text>the counterintelligence threat posed by Russian money laundering and other forms of threat finance, as well as the threat to the United States financial system and United States efforts to enforce sanctions and combat organized crime.</text></subparagraph></paragraph> 
<paragraph id="H4129A108720943D4B4107629DEC892DC"><enum>(7)</enum><text>Any other matters the Director determines appropriate.</text></paragraph></subsection> 
<subsection id="H849506117C894D65A9EE820B36CCB852"><enum>(c)</enum><header>Form of report</header><text display-inline="yes-display-inline">The report required under subsection (a) may be submitted in classified form.</text></subsection> 
<subsection id="H6092D8C46DEC4892B8AD25DAFCA6E7F1"><enum>(d)</enum><header>Threat finance defined</header><text>In this section, the term <term>threat finance</term> means—</text> 
<paragraph id="HEA72FCB0D8AC4F1CA302A4F88D756237"><enum>(1)</enum><text display-inline="yes-display-inline">the financing of cyber operations, global influence campaigns, intelligence service activities, proliferation, terrorism, or transnational crime and drug organizations;</text></paragraph> 
<paragraph id="HDA430BF5D25948FF8E2604C81C5549ED"><enum>(2)</enum><text>the methods and entities used to spend, store, move, raise, conceal, or launder money or value, on behalf of threat actors;</text></paragraph> 
<paragraph id="HE62BEF31238F48EEAB635F5196BB38D1"><enum>(3)</enum><text>sanctions evasion; and</text></paragraph> 
<paragraph id="HA3CD68E5004045DB88F149EED7A647A1"><enum>(4)</enum><text>other forms of threat finance activity domestically or internationally, as defined by the President.</text></paragraph></subsection></section> 
<section id="HA844E404205D4456B98BB709BA5F886F" section-type="subsequent-section"><enum>1506.</enum><header>Report on cyber exchange program</header> 
<subsection id="H796CB946F48546CD9AD565C99D1198B7"><enum>(a)</enum><header>Report</header><text display-inline="yes-display-inline">Not later than 90 days after the date of the enactment of this Act, the Director of National Intelligence shall submit to the congressional intelligence committees a report on the potential establishment of a fully voluntary exchange program between elements of the intelligence community and private technology companies under which—</text> 
<paragraph id="H6B53E3C6D8E747398F7846EE79479D15"><enum>(1)</enum><text display-inline="yes-display-inline">an employee of an element of the intelligence community with demonstrated expertise and work experience in cybersecurity or related disciplines may elect to be temporarily detailed to a private technology company that has elected to receive the detailee; and</text></paragraph> 
<paragraph id="HE3EA00B18815416F93A7F01E2FC723F3"><enum>(2)</enum><text display-inline="yes-display-inline">an employee of a private technology company with demonstrated expertise and work experience in cybersecurity or related disciplines may elect to be temporarily detailed to an element of the intelligence community that has elected to receive the detailee.</text></paragraph></subsection> 
<subsection id="H10481BD9D70344D797C8A41C72EF7A9A"><enum>(b)</enum><header>Elements</header><text>The report under subsection (a) shall include the following:</text> 
<paragraph id="H4ED45021375143E0A11537962BFB9A1A"><enum>(1)</enum><text>An assessment of the feasibility of establishing the exchange program described in such subsection.</text></paragraph> 
<paragraph id="H00BC6A0DE11647BBB248DAEA3B8494BC"><enum>(2)</enum><text>Identification of any challenges in establishing the exchange program.</text></paragraph> 
<paragraph id="H0909897493B349B388C5C5DEAA264CD0"><enum>(3)</enum><text>An evaluation of the benefits to the intelligence community that would result from the exchange program.</text></paragraph></subsection></section> 
<section id="HCFF8E76C9FF24629B04F8D7BA44BA339" section-type="subsequent-section"><enum>1507.</enum><header>Review of Intelligence Community whistleblower matters</header> 
<subsection id="H11DDFEB6A0F64A37BDB76FF9DE2CF764"><enum>(a)</enum><header>Review of whistleblower matters</header><text display-inline="yes-display-inline">The Inspector General of the Intelligence Community, in consultation with the inspectors general for the Central Intelligence Agency, the National Security Agency, the National Geospatial-Intelligence Agency, the Defense Intelligence Agency, and the National Reconnaissance Office, shall conduct a review of the authorities, policies, investigatory standards, and other practices and procedures relating to intelligence community whistleblower matters, with respect to such inspectors general.</text></subsection> 
<subsection id="HE0A355E5B28042559E6EFA504E0028E9"><enum>(b)</enum><header>Objective of review</header><text display-inline="yes-display-inline">The objective of the review required under subsection (a) is to identify any discrepancies, inconsistencies, or other issues, which frustrate the timely and effective reporting of intelligence community whistleblower matters to appropriate inspectors general and to the congressional intelligence committees, and the fair and expeditious investigation and resolution of such matters.</text></subsection> 
<subsection id="HCC8F7CC7FDCB43A3AB146E76E3AD8825"><enum>(c)</enum><header>Conduct of review</header><text display-inline="yes-display-inline">The Inspector General of the Intelligence Community shall take such measures as the Inspector General determines necessary in order to ensure that the review required by subsection (a) is conducted in an independent and objective fashion.</text></subsection> 
<subsection id="H9D2C180A634A4D7CB43A844F5E73DD3A"><enum>(d)</enum><header>Report</header><text display-inline="yes-display-inline">Not later than 270 days after the date of the enactment of this Act, the Inspector General of the Intelligence Community shall submit to the congressional intelligence committees a written report containing the results of the review required under subsection (a), along with recommendations to improve the timely and effective reporting of intelligence community whistleblower matters to inspectors general and to the congressional intelligence committees and the fair and expeditious investigation and resolution of such matters.</text></subsection></section> 
<section id="H422BE6BD097E4744846AD99B482656EC" section-type="subsequent-section"><enum>1508.</enum><header>Report on role of Director of National Intelligence with respect to certain foreign investments</header> 
<subsection id="H855376BBCE6B45B1977DE3B9168BC5D1"><enum>(a)</enum><header>Report</header><text display-inline="yes-display-inline">Not later than 180 days after the date of the enactment of this Act, the Director of National Intelligence, in consultation with the heads of the elements of the intelligence community determined appropriate by the Director, shall submit to the congressional intelligence committees a report on the role of the Director in preparing analytic materials in connection with the evaluation by the Federal Government of national security risks associated with potential foreign investments into the United States.</text></subsection> 
<subsection id="H4F93DAED634945498F8F58C1357FB419"><enum>(b)</enum><header>Elements</header><text>The report under subsection (a) shall include—</text> 
<paragraph id="H73B3F96748024F5481A531A27F181B0F"><enum>(1)</enum><text display-inline="yes-display-inline">a description of the current process for the provision of the analytic materials described in subsection (a);</text></paragraph> 
<paragraph id="H83B0497BB0BB42ABB73D72D2C9980DD7"><enum>(2)</enum><text display-inline="yes-display-inline">an identification of the most significant benefits and drawbacks of such process with respect to the role of the Director, including the sufficiency of resources and personnel to prepare such materials; and</text></paragraph> 
<paragraph id="H260EB9E7F958430E8A4F71043D560D9F"><enum>(3)</enum><text>recommendations to improve such process.</text></paragraph></subsection></section> 
<section id="H4644E74AD12C4397AF624F35D0FA9035"><enum>1509.</enum><header>Semiannual reports on investigations of unauthorized disclosures of classified information</header> 
<subsection id="HFC886694495C41938D57F95B07361B30"><enum>(a)</enum><header>In general</header><text>Title XI of the National Security Act of 1947 (50 U.S.C. 3231 et seq.) is amended by adding at the end the following new section:</text>

<subsection id="H3C345FF1245B405CBED4940D0C4BC368"><enum>(a)</enum><header>Intelligence community reporting</header> 
<paragraph id="H98D9F489F4FB4B3EB121BADA6D041E63"><enum>(1)</enum><header>In general</header><text>Not less frequently than once every 6 months, each covered official shall submit to the congressional intelligence committees a report on investigations of unauthorized public disclosures of classified information.</text></paragraph> 
<paragraph id="H332193C6D8054719953E2DAB034F280C"><enum>(2)</enum><header>Elements</header><text>Each report submitted under paragraph (1) shall include, with respect to the preceding 6-month period, the following:</text> 
<subparagraph id="H6347EA79F6DE42C486793AA9E8CE53AF"><enum>(A)</enum><text>The number of investigations opened by the covered official regarding an unauthorized public disclosure of classified information.</text></subparagraph> 
<subparagraph id="HD9D9631709604D0181039272A0B2B619"><enum>(B)</enum><text>The number of investigations completed by the covered official regarding an unauthorized public disclosure of classified information.</text></subparagraph> 
<subparagraph id="H35361927728A41CFA61BB5AFB0501AA9"><enum>(C)</enum><text>Of the number of such completed investigations identified under subparagraph (B), the number referred to the Attorney General for criminal investigation.</text></subparagraph></paragraph></subsection> 
<subsection id="H1A798E1B8E1746129C3451B6C0DA4069"><enum>(b)</enum><header>Department of Justice reporting</header> 
<paragraph id="HE4465FB5DA9945C98CB1DF01572A8A0A"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Not less frequently than once every 6 months, the Assistant Attorney General for National Security of the Department of Justice, in consultation with the Director of the Federal Bureau of Investigation, shall submit to the congressional intelligence committees, the Committee on the Judiciary of the Senate, and the Committee on the Judiciary of the House of Representatives a report on the status of each referral made to the Department of Justice from any element of the intelligence community regarding an unauthorized disclosure of classified information made during the most recent 365-day period or any referral that has not yet been closed, regardless of the date the referral was made.</text></paragraph> 
<paragraph id="HBA60B1B108B24DFBA4E76478C2F6C154"><enum>(2)</enum><header>Contents</header><text>Each report submitted under paragraph (1) shall include, for each referral covered by the report, at a minimum, the following:</text> 
<subparagraph id="H0F6D066B12904AD590B425DFCCB1140B"><enum>(A)</enum><text>The date the referral was received.</text></subparagraph> 
<subparagraph id="H9D30E2838A344D95AF334E6B514705F2"><enum>(B)</enum><text>A statement indicating whether the alleged unauthorized disclosure described in the referral was substantiated by the Department of Justice.</text></subparagraph> 
<subparagraph id="HE7C9FD99C35B4CA8A88224ACE6035155"><enum>(C)</enum><text>A statement indicating the highest level of classification of the information that was revealed in the unauthorized disclosure.</text></subparagraph> 
<subparagraph id="HA84ABDAA234E46BAAAB63774AB8F4737"><enum>(D)</enum><text>A statement indicating whether an open criminal investigation related to the referral is active.</text></subparagraph> 
<subparagraph id="H47F0EEB92C904856842D4D15A5BBDEA1"><enum>(E)</enum><text>A statement indicating whether any criminal charges have been filed related to the referral.</text></subparagraph> 
<subparagraph id="H2C9582FDDE3D43A4B8AA352C8DFA04A0"><enum>(F)</enum><text>A statement indicating whether the Department of Justice has been able to attribute the unauthorized disclosure to a particular entity or individual.</text></subparagraph></paragraph></subsection> 
<subsection id="HD4143369724E4A0D952BE4CCE523F8BC"><enum>(c)</enum><header>Form of reports</header><text>Each report submitted under this section shall be submitted in unclassified form, but may have a classified annex.</text></subsection> 
<subsection id="H783DA7667EB8405B95449A75F07676F7"><enum>(d)</enum><header>Definitions</header><text>In this section:</text> 
<paragraph id="H61F65A1716F2494184D4A51206FACE51"><enum>(1)</enum><header>Covered official</header><text>The term <term>covered official</term> means—</text> 
<subparagraph id="H4EE8647195FD434F9820EF453FD50EF9"><enum>(A)</enum><text>the heads of each element of the intelligence community; and</text></subparagraph>

<paragraph id="H33AC8F95F2934F9E9CEA31EF0D44718A"><enum>(2)</enum><header>Investigation</header><text>The term <term>investigation</term> means any inquiry, whether formal or informal, into the existence of an unauthorized public disclosure of classified information.</text></paragraph> 
<paragraph id="H7506A1B358154A488739713009111B39"><enum>(3)</enum><header>Unauthorized disclosure of classified information</header><text>The term <term>unauthorized disclosure of classified information</term> means any unauthorized disclosure of classified information to any recipient.</text></paragraph> 
<paragraph id="HDEE72788CF1A41BABF5ECB81A3CE6746"><enum>(4)</enum><header>Unauthorized public disclosure of classified information</header><text>The term <term>unauthorized public disclosure of classified information</term> means the unauthorized disclosure of classified information to a journalist or media organization.</text></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection>

<paragraph id="HBFDF6E086A6E4E0FB2C00B161273FD2F"><enum>(1)</enum><header>In general</header><text>Not later than 90 days after the date of the enactment of this Act, the Director of National Intelligence shall submit to the congressional intelligence committees a written report describing—</text> 
<subparagraph id="H0AD5E354DC8842D79A8DE11CAEE8FF29"><enum>(A)</enum><text>with respect to each element of the intelligence community—</text> 
<clause id="H0236F84EAC034AE780D6BF506BF09349"><enum>(i)</enum><text>the title of the official or officials responsible for determining whether, pursuant to criteria contained in the Vulnerabilities Equities Policy and Process document or any successor document, a vulnerability must be submitted for review under the Vulnerabilities Equities Process; and</text></clause>

<subparagraph id="H6B03E1EA10C2449E8CC46F40608EB00D"><enum>(B)</enum><text>the number of vulnerabilities described in subparagraph (A) disclosed to each vendor responsible for correcting the vulnerability, or to the public, pursuant to the Vulnerabilities Equities Process; and</text></subparagraph> 
<subparagraph id="HE1E6C967692E4E39890778166F2765F4"><enum>(C)</enum><text display-inline="yes-display-inline">the aggregate number, by category, of the vulnerabilities excluded from review under the Vulnerabilities Equities Process, as described in paragraph 5.4 of the Vulnerabilities Equities Policy and Process document.</text></subparagraph></paragraph> 
<paragraph id="H62558A3BC20049DF88F5A3BDDE75ADFA"><enum>(2)</enum><header>Unclassified information</header><text>Each report submitted under paragraph (1) shall include an unclassified appendix that contains—</text>

<subsection id="HD3546FAB3BDE4EA99CB15243496A761A"><enum>(b)</enum><header>Sense of Congress</header><text display-inline="yes-display-inline">It is the sense of Congress that—</text>

<subsection id="HFCAC591063D847BBA596FAACEDB2E663"><enum>(a)</enum><header>Specifications of amounts</header><text display-inline="yes-display-inline">The amounts authorized to be appropriated under section 2101 for the conduct of the intelligence activities of the elements listed in paragraphs (1) through (16) of section 2101, are those specified in the classified Schedule of Authorizations prepared to accompany this division.</text></subsection> 
<subsection id="HB1CB3F8EC77C4C16B1F3BC33295BDCB9"><enum>(b)</enum><header>Availability of classified schedule of authorizations</header> 
<paragraph id="H90C66F272C14464E90F17D0C80029F8E"><enum>(1)</enum><header>Availability</header><text>The classified Schedule of Authorizations referred to in subsection (a) shall be made available to the Committee on Appropriations of the Senate, the Committee on Appropriations of the House of Representatives, and to the President.</text></paragraph> 
<paragraph id="HF8F16AB0CFBC45AB9DA94BCA77B6908D"><enum>(2)</enum><header>Distribution by the President</header><text>Subject to paragraph (3), the President shall provide for suitable distribution of the classified Schedule of Authorizations referred to in subsection (a), or of appropriate portions of such Schedule, within the executive branch.</text></paragraph> 
<paragraph id="H5FCBAD8B61524F488136937950B4DDC5"><enum>(3)</enum><header>Limits on disclosure</header><text>The President shall not publicly disclose the classified Schedule of Authorizations or any portion of such Schedule except—</text> 
<subparagraph id="HA33A6106109E434E8559C02AFBFC09E2"><enum>(A)</enum><text>as provided in section 601(a) of the Implementing Recommendations of the 9/11 Commission Act of 2007 (50 U.S.C. 3306(a));</text></subparagraph> 
<subparagraph id="H173B776B4D6444B780D67AAA6094567C"><enum>(B)</enum><text>to the extent necessary to implement the budget; or</text></subparagraph> 
<subparagraph id="H722FFB2146484F009FA62F8AE9319E37"><enum>(C)</enum><text>as otherwise required by law.</text></subparagraph></paragraph></subsection></section>

<subsection commented="no" display-inline="no-display-inline" id="H27B29282F2774BA6A6A142AC0F5F553A"><enum>(a)</enum><header display-inline="yes-display-inline">Authorization of appropriations</header><text display-inline="yes-display-inline">There is authorized to be appropriated for the Intelligence Community Management Account of the Director of National Intelligence for fiscal year 2019 the sum of $514,524,000. Within such amount, funds identified in the classified Schedule of Authorizations referred to in section 2102(a) for advanced research and development shall remain available until September 30, 2020.</text></subsection> 
<subsection commented="no" display-inline="no-display-inline" id="HE70A83D0D5C942348131C714D0DB0E11"><enum>(b)</enum><header display-inline="yes-display-inline">Classified authorizations</header><text display-inline="yes-display-inline">In addition to amounts authorized to be appropriated for the Intelligence Community Management Account by subsection (a), there are authorized to be appropriated for the Intelligence Community Management Account for fiscal year 2019 such additional amounts as are specified in the classified Schedule of Authorizations referred to in section 2102(a).</text></subsection></section></title>

<section commented="no" display-inline="no-display-inline" id="H9239AE009F7A48F19220F118E81BA7C9" section-type="subsequent-section"><enum>2201.</enum><header display-inline="yes-display-inline">Authorization of appropriations</header><text display-inline="no-display-inline">There is authorized to be appropriated for the Central Intelligence Agency Retirement and Disability Fund for fiscal year 2019 the sum of $514,000,000.</text></section></title> 
<title id="H4E5BCE0441D6476F9B8AACF1ADD74A7A"><enum>III</enum><header>General Intelligence Community Matters</header> 
<section commented="no" display-inline="no-display-inline" id="H9DFF655F46EF4DE8930B974DD4058E70" section-type="subsequent-section"><enum>2301.</enum><header>Restriction on conduct of intelligence activities</header><text display-inline="no-display-inline">The authorization of appropriations by this division shall not be deemed to constitute authority for the conduct of any intelligence activity which is not otherwise authorized by the Constitution or the laws of the United States.</text></section> 
<section display-inline="no-display-inline" id="H519F6C6FEE7E46859CE576A2F1655D31"><enum>2302.</enum><header>Increase in employee compensation and benefits authorized by law</header><text display-inline="no-display-inline">Appropriations authorized by this division for salary, pay, retirement, and other benefits for Federal employees may be increased by such additional or supplemental amounts as may be necessary for increases in such compensation or benefits authorized by law.</text></section> 
<section display-inline="no-display-inline" id="HAC9D0D8EA5E94469819D107CCC185188"><enum>2303.</enum><header>Modification of special pay authority for science, technology, engineering, or mathematics positions and addition of special pay authority for cyber positions</header><text display-inline="no-display-inline">Section 113B of the National Security Act of 1947 (50 U.S.C. 3049a) is amended—</text> 
<paragraph display-inline="no-display-inline" id="H6577B033C7AB4BD1A46C688E669D2859"><enum>(1)</enum><text display-inline="yes-display-inline">by amending subsection (a) to read as follows:</text>

<subparagraph commented="no" display-inline="no-display-inline" id="H56DB8099AB3142BC9306E8D337154277"><enum>(A)</enum><text display-inline="yes-display-inline">establish higher minimum rates of pay; and</text></subparagraph> 
<subparagraph commented="no" display-inline="no-display-inline" id="H81F5083E36824EECAFAF3CBE83EEA3BF"><enum>(B)</enum><text display-inline="yes-display-inline">make corresponding increases in all rates of pay of the pay range for each grade or level, subject to subsection (b) or (c), as applicable.</text></subparagraph></paragraph> 
<paragraph commented="no" display-inline="no-display-inline" id="H71556962DF224057836ADEE0BF0C537A"><enum>(2)</enum><header>Treatment</header><text display-inline="yes-display-inline">The special rate supplements resulting from the establishment of higher rates under paragraph (1) shall be basic pay for the same or similar purposes as those specified in section 5305(j) of title 5, United States Code.</text></paragraph></subsection><after-quoted-block>;</after-quoted-block></quoted-block></paragraph> 
<paragraph display-inline="no-display-inline" id="H773DDE5BECE747C8B204DB0964531D27"><enum>(2)</enum><text>by redesignating subsections (b) through (f) as subsections (c) through (g), respectively;</text></paragraph>

<subparagraph id="H32904EED4235431CBD9C3424F3ECF2A6"><enum>(A)</enum><text>not to exceed the rate of basic pay payable for level II of the Executive Schedule under section 5313 of title 5, United States Code, if the Director certifies to the Under Secretary of Defense for Intelligence, in consultation with the Under Secretary of Defense for Personnel and Readiness, that the rate of pay is for positions that perform functions that execute the cyber mission of the Agency; or</text></subparagraph> 
<subparagraph id="H4D8B02652BD2425D88EA520738FDA164"><enum>(B)</enum><text>not to exceed the rate of basic pay payable for the Vice President of the United States under section 104 of title 3, United States Code, if the Director certifies to the Secretary of Defense, by name, individuals that have advanced skills and competencies and that perform critical functions that execute the cyber mission of the Agency.</text></subparagraph></paragraph> 
<paragraph id="H28F5D33F506548DD9935339C3E79238D"><enum>(2)</enum><header>Pay limitation</header><text>Employees receiving a special rate under paragraph (1) shall be subject to an aggregate pay limitation that parallels the limitation established in section 5307 of title 5, United States Code, except that—</text> 
<subparagraph id="H117B3704AFBC4DFDAD33FBD7B4CAD6B3"><enum>(A)</enum><text display-inline="yes-display-inline">any allowance, differential, bonus, award, or other similar cash payment in addition to basic pay that is authorized under title 10, United States Code, (or any other applicable law in addition to title 5 of such Code, excluding the Fair Labor Standards Act of 1938 (29 U.S.C. 201 et seq.)) shall also be counted as part of aggregate compensation; and</text></subparagraph> 
<subparagraph id="H41843EDDD9AA4426BCF943C2C72A3549"><enum>(B)</enum><text>aggregate compensation may not exceed the rate established for the Vice President of the United States under section 104 of title 3, United States Code.</text></subparagraph></paragraph> 
<paragraph id="H867EDFF23B304F719CBE10724C5F33EE"><enum>(3)</enum><header>Limitation on number of recipients</header><text>The number of individuals who receive basic pay established under paragraph (1)(B) may not exceed 100 at any time.</text></paragraph> 
<paragraph id="H4019BE74A7734C0AB114FC15561B673B"><enum>(4)</enum><header>Limitation on use as comparative reference</header><text>Notwithstanding any other provision of law, special rates of pay and the limitation established under paragraph (1)(B) may not be used as comparative references for the purpose of fixing the rates of basic pay or maximum pay limitations of qualified positions under section 1599f of title 10, United States Code, or section 226 of the Homeland Security Act of 2002 (6 U.S.C. 147).</text></paragraph></subsection><after-quoted-block>;</after-quoted-block></quoted-block></paragraph>

<section id="HB3F74182DB2A4A869ACC77C866F3F7B2" section-type="subsequent-section"><enum>2305.</enum><header>Permanent enhanced procurement authority to manage supply chain risks</header><text display-inline="no-display-inline">Section 309 of the Intelligence Authorization Act for Fiscal Year 2012 (Public Law 112–87; 125 Stat. 1875; 50 U.S.C. 3329 note) is amended by striking subsection (g). </text></section> 
<section id="HB296077A719B4F9B9B21CA4FF6A9A620"><enum>2306.</enum><header>Intelligence community information technology environment</header> 
<subsection id="H3A873029039B438781A3AA4A7A134D30"><enum>(a)</enum><header>Roles and responsibilities</header> 
<paragraph id="HD0C76C4EEE664C5A8A99C0E18A1B9401"><enum>(1)</enum><header>Director of National Intelligence</header><text display-inline="yes-display-inline">The Director of National Intelligence shall be responsible for coordinating the performance by elements of the intelligence community of IC ITE, including each of the following:</text> 
<subparagraph id="HB9C4AA0A29EA42E8BCA0413E1317E094"><enum>(A)</enum><text>Ensuring compliance with all applicable IC ITE rules and regulations.</text></subparagraph> 
<subparagraph id="H283BDB79352A49C487507E9945C2DE73"><enum>(B)</enum><text>Ensuring IC ITE measurable performance goals exist.</text></subparagraph> 
<subparagraph id="H63B63190CB154D57B49D5835B8650F29"><enum>(C)</enum><text>Documenting IC ITE standards and practices.</text></subparagraph> 
<subparagraph id="H1DEF9754719D43CC8E7C283D368AFE01"><enum>(D)</enum><text>Acting as an arbiter among elements of the intelligence community related to any disagreements arising out of the implementation of IC ITE.</text></subparagraph> 
<subparagraph id="H373A52DD1F9A4816B74F133455293533"><enum>(E)</enum><text>Delegating responsibilities to the elements of the intelligence community and carrying out such other responsibilities as are necessary for the effective implementation of IC ITE.</text></subparagraph></paragraph> 
<paragraph id="HD4451CB9ED324FCC9C327E058A4CCB8B"><enum>(2)</enum><header>Key service providers</header><text>Key service providers shall be responsible for—</text> 
<subparagraph id="H3F42F71F7D8446C18F63EDB90D44FCC3"><enum>(A)</enum><text>providing key services, in coordination with the Director of National Intelligence; and</text></subparagraph> 
<subparagraph id="H7836E2ABFAA1404DBD6C606DADDB18F3"><enum>(B)</enum><text>providing the Director with information requested and required to fulfill the responsibilities of the Director under paragraph (1).</text></subparagraph></paragraph> 
<paragraph id="H6CF55319714D45FC87858F304BAECB1A"><enum>(3)</enum><header>Use of key services</header> 
<subparagraph id="H74CEE698C7F74E4DA1E740BF90650ACD"><enum>(A)</enum><header>In general</header><text>Except as provided in subparagraph (B), each element of the intelligence community shall use key services when such services are available.</text></subparagraph> 
<subparagraph id="H74E95E11299348689C38A02096BCD473"><enum>(B)</enum><header>Exception</header><text>The Director of National Intelligence may provide for a written exception to the requirement under subparagraph (A) if the Director determines there is a compelling financial or mission need for such exception.</text></subparagraph></paragraph></subsection> 
<subsection id="H7E5E901B7EEF488C859185EFCC890EFB"><enum>(b)</enum><header>Management accountability</header><text>Not later than 90 days after the date of the enactment of this Act, the Director of National Intelligence shall designate and maintain one or more accountable IC ITE executives to be responsible for—</text> 
<paragraph id="H280E2E39888448EBACEFEA497E5CF409"><enum>(1)</enum><text>IC ITE management, financial control, and integration;</text></paragraph> 
<paragraph id="H59DE98BDF23A418EBAB0DF8172BAB20A"><enum>(2)</enum><text>ensuring the performance of each key service, including establishing measurable service requirements and schedules;</text></paragraph> 
<paragraph id="H80D9BC29748B4CD48F88AC097D0C3C02"><enum>(3)</enum><text display-inline="yes-display-inline">ensuring independent testing of each IC ITE core service, including testing by the intended users, to evaluate performance against measurable service requirements and to ensure the capability meets user requirements; and</text></paragraph> 
<paragraph id="HB1F2C591B5DC45E2AE06BAA25FB13509"><enum>(4)</enum><text>coordinate IC ITE transition or restructuring efforts, including phase out of legacy systems.</text></paragraph></subsection> 
<subsection id="H6F4974FE48BF4AAEB6368F50C5A998F9"><enum>(c)</enum><header>Security plan</header><text>Not later than 180 days after the date of the enactment of this Act, the Director of National Intelligence shall develop and maintain a security plan for IC ITE.</text></subsection> 
<subsection id="H92A48993FE404557B15E97B4793EC318"><enum>(d)</enum><header>Long-term roadmap</header><text>Not later than 180 days after the date of the enactment of this Act, and during each of the second and fourth fiscal quarters thereafter, the Director of National Intelligence shall submit to the congressional intelligence committees a long-term roadmap that shall include each of the following:</text> 
<paragraph id="HF650277525594BA0B841F2D3D61E7392"><enum>(1)</enum><text>A description of the minimum required and desired key service requirements, including—</text> 
<subparagraph id="H05B1DEAC7C49470FA7B12712FC620CFE"><enum>(A)</enum><text>key performance parameters; and</text></subparagraph> 
<subparagraph id="H1F80C5F7371E430991FEA6C20C87F6A4"><enum>(B)</enum><text>an assessment of current, measured performance.</text></subparagraph></paragraph> 
<paragraph id="H69B177F89F0241E8936A85F3E71800F1"><enum>(2)</enum><text>IC ITE implementation milestones, including each of the following:</text> 
<subparagraph id="H1D1C37B774F540F0B6CE5F33FE98ECE0"><enum>(A)</enum><text>A schedule for expected deliveries of key service capabilities during each of the following phases:</text> 
<clause id="HEA83EB46AD3E4957B625C3C2166BEA9F"><enum>(i)</enum><text>Concept refinement and technology maturity demonstration.</text></clause> 
<clause id="HEB16D50AE069472DB76AAAE9CF3769AD"><enum>(ii)</enum><text>Development, integration, and demonstration,</text></clause> 
<clause id="H0B81D2BEBEC346BCA621330F39FF640B"><enum>(iii)</enum><text>Production, deployment, and sustainment.</text></clause> 
<clause id="H3094D8D9EBE84F6D9F515C7F4C7A5F98"><enum>(iv)</enum><text>System retirement.</text></clause></subparagraph> 
<subparagraph id="H10F487B02A9F4FFF829404BDBE2B3C9B"><enum>(B)</enum><text>Dependencies of such key service capabilities.</text></subparagraph> 
<subparagraph id="H16137B3B06904ADAA879EE3956FC8CCE"><enum>(C)</enum><text>Plans for the transition or restructuring necessary to incorporate key service capabilities.</text></subparagraph> 
<subparagraph id="HB948478A09754D59824DD71A3AD6266E"><enum>(D)</enum><text>A description of any legacy systems and discontinued capabilities to be phased out.</text></subparagraph></paragraph> 
<paragraph id="H6206625C204D4B16B291D7AC8264F416"><enum>(3)</enum><text>Such other matters as the Director determines appropriate.</text></paragraph></subsection> 
<subsection id="HBB63220215CE42F9933872022278132D"><enum>(e)</enum><header>Business plan</header><text>Not later than 180 days after the date of the enactment of this Act, and during each of the second and fourth fiscal quarters thereafter, the Director of National Intelligence shall submit to the congressional intelligence committees a business plan that includes each of the following:</text> 
<paragraph id="HD66B63E7ADCD4D13A209313FFF58573C"><enum>(1)</enum><text>A uniform approach to identify IC ITE key service funding requests within the proposed budget, including multiyear plans to implement the long-term roadmap required by subsection (d).</text></paragraph> 
<paragraph id="H74D2F50EE3E8422AA830DE9656D4232C"><enum>(2)</enum><text>A uniform approach by which each element of the intelligence community shall identify the cost of legacy information technology or alternative capabilities where IC ITE services will also be available.</text></paragraph> 
<paragraph id="H8A48FAD593B446748B89AC94ED367506"><enum>(3)</enum><text>A uniform effort by which each element of the intelligence community shall identify transition and restructuring costs for new, existing, and retiring IC ITE services, as well as IC ITE services that have changed designations among core service, service of common concern, and agency unique service.</text></paragraph> 
<paragraph id="H20A5D9530C2C4F09AE4F05D662781602"><enum>(4)</enum><text>A fair and equitable rate structure for use of IC ITE.</text></paragraph></subsection> 
<subsection id="H164D37DDDD954FE9B550E1CBDF4FEC3D"><enum>(f)</enum><header>Quarterly presentations</header><text>Beginning not later than 180 days after the date of the enactment of this Act, the Director of National Intelligence shall provide to the congressional intelligence committees quarterly updates regarding ongoing implementation of IC ITE as compared to the requirements in the most recently submitted security plan required by subsection (c), long-term roadmap required by subsection (d), and business plan required by subsection (e).</text></subsection> 
<subsection id="H802948DBB215403580897BAFCB74C7A3"><enum>(g)</enum><header>Additional notifications</header><text>The Director of National Intelligence shall provide timely notification to the congressional intelligence committees regarding any policy changes related to or affecting IC ITE, new initiatives or strategies related to or impacting IC ITE, and changes or deficiencies in the execution of the security plan required by subsection (c), long-term roadmap required by subsection (d), and business plan required by subsection (e).</text></subsection> 
<subsection id="HD00CE063E618493D95A9C325E7AEF46A"><enum>(h)</enum><header>Definitions</header><text>In this section:</text> 
<paragraph id="HC92BB56B2D9A430D811D77F112BAE50C"><enum>(1)</enum><text>The term <term>agency unique service</term> means a capability that is unique to and used only within one element of the intelligence community.</text></paragraph> 
<paragraph id="H987B096726A04094BB926CCFFDACABD2"><enum>(2)</enum><text>The term <term>core service</term> means a capability that is available to multiple elements of the intelligence community and required for consistent operation of IC ITE.</text></paragraph> 
<paragraph id="H91EAC803324C4B53A6BD82AC729C01FB"><enum>(3)</enum><text>The term <term>intelligence community information technology environment</term> or <term>IC ITE</term> means all of the information technology services across the intelligence community, including the data sharing and protection environment across multiple classification domains.</text></paragraph> 
<paragraph id="HA7DD9184F17140DE935BB6ABC4C51BFB"><enum>(4)</enum><text>The term <term>key service</term> is a core service or service of common concern, but is not an agency unique service.</text></paragraph> 
<paragraph id="H9D29179B326D4C9A92550C6097CF8924"><enum>(5)</enum><text>The term <term>key service provider</term> is the entity responsible and accountable for implementing a key service within the IC ITE.</text></paragraph> 
<paragraph id="H4E5B804EEAAB4D3FB12B7832948E604C"><enum>(6)</enum><text>The term <term>service of common concern</term> means a capability available across IC ITE that is of interest to two or more elements of the intelligence community.</text></paragraph></subsection> 
<subsection id="H663C628DFD2049698E7CB8C944A34193"><enum>(i)</enum><header>Sunset</header><text>The section shall have no effect on or after September 30, 2024.</text></subsection></section> 
<section id="H59635833208842CF92C3AE3CE9B53CD3" section-type="subsequent-section"><enum>2307.</enum><header>Development of secure cellular voice solution for intelligence community</header> 
<subsection id="H664E747EE4234236B50D68B14BFC5BD1"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The Director of National Intelligence shall certify and approve the operation of a National Intelligence Program enterprise-wide secure voice cellular solution that leverages commercially available technology and operates on existing commercial cellular networks.</text></subsection> 
<subsection id="HF5A31A2EE5D245208242768CE89F8978"><enum>(b)</enum><header>Policy</header><text display-inline="yes-display-inline">The Director of National Intelligence shall establish an intelligence community policy for the cellular voice solution required by subsection (a) that addresses each of the following:</text> 
<paragraph id="H0FA77B89BFEE4CC882B121C13ADAD7F0"><enum>(1)</enum><text>Determinations regarding eligibility to use a device covered by such cellular voice solution.</text></paragraph> 
<paragraph id="HC9B53FFB065B426094A03C74E7CDC292"><enum>(2)</enum><text>The appropriate classification levels associated with the use of secure cellular phones.</text></paragraph> 
<paragraph id="H2D2AE601385A40D5A41BF88E2B4C770B"><enum>(3)</enum><text>Measures that should be taken prior to initiating or receiving a secure cellular call.</text></paragraph> 
<paragraph id="HEADBF4A0BFD246C5BF053735BB1ED080"><enum>(4)</enum><text>Appropriate methods for storage of secure devices when not in the physical possession of an authorized user.</text></paragraph> 
<paragraph id="H136A0E1F349247938C4A08682A4108AB"><enum>(5)</enum><text>Such other matters as the Director determines appropriate.</text></paragraph></subsection> 
<subsection id="H2D842F25629F457FA48F66F634E920B8"><enum>(c)</enum><header>Costs</header><text display-inline="yes-display-inline">The Director of National Intelligence shall ensure that annual operating costs of the secure cellular solution requirement in subsection (a), excluding initial development and deployment, are born on a cost-reimbursable basis by each relevant element of the intelligence community.</text></subsection></section> 
<section id="H74E26D6FA6E54DFD902F9613EEA54EB7" section-type="subsequent-section"><enum>2308.</enum><header>Policy on minimum insider threat standards</header> 
<subsection id="H2223028BAD8F4A0CBE94214DE99CE0CB"><enum>(a)</enum><header>Policy required</header><text display-inline="yes-display-inline">Not later than 60 days after the date of the enactment of this Act, the Director of National Intelligence shall establish a policy for minimum insider threat standards.</text></subsection> 
<subsection id="H42B372C935714F899D3F8828205DCC49"><enum>(b)</enum><header>Implementation</header><text display-inline="yes-display-inline">Not later than 180 days after the date of the enactment of this Act, the head of each element of the intelligence community shall implement the policy established under subsection (a).</text></subsection></section> 
<section id="H81E4A46B94D14371BE78AE0FE56F3004" section-type="subsequent-section"><enum>2309.</enum><header>Submission of intelligence community policies</header> 
<subsection id="H887EF4B79B134BD89BE46C7BF85396D5"><enum>(a)</enum><header>Submission of policies</header> 
<paragraph id="HB33111BF988447F7A4419A47EBF4529F"><enum>(1)</enum><header>Current policy</header><text display-inline="yes-display-inline">Not later than 180 days after the date of the enactment of this Act, the Director of National Intelligence shall submit to the congressional intelligence committees using the electronic repository all non-publicly available policies, directives, and guidance issued by the Director of National Intelligence for the intelligence community that are in effect as of the date of the submission.</text></paragraph> 
<paragraph id="HCE9A0BB4412F429DA78FB543E24343B0"><enum>(2)</enum><header>Continuous updates</header><text display-inline="yes-display-inline">Not later than 15 days after the date on which the Director of National Intelligence issues, modifies, or rescinds a policy, directive, or guidance of the intelligence community, the Director shall—</text> 
<subparagraph id="HB90BA96BDB584D1B87E38718A3B63F43"><enum>(A)</enum><text>notify the congressional intelligence committees of such addition, modification, or removal; and</text></subparagraph> 
<subparagraph id="HA63341A5251249E080306728C66EE1CF"><enum>(B)</enum><text display-inline="yes-display-inline">update the electronic repository with respect to such addition, modification, or removal.</text></subparagraph></paragraph></subsection> 
<subsection id="H5DB7B7B065354F0DAA4DBA40F4F56F3D" commented="no"><enum>(b)</enum><header>Electronic repository defined</header><text display-inline="yes-display-inline">In this section, the term <term>electronic repository</term> means the electronic distribution mechanism, in use as of the date of the enactment of this Act, or any successor electronic distribution mechanism, by which the Director of National Intelligence submits to the congressional intelligence committees information.</text></subsection></section></title>

<subtitle id="HCEA162D87F5F4E2EB76BCDDFEBBAA57E"><enum>A</enum><header>Office of the Director of National Intelligence</header> 
<section id="H77F3CA1C0AAF4BCEB83DB0E5AB8ED0D4" section-type="subsequent-section"><enum>2401.</enum><header>Chief Financial Officer of the Intelligence Community</header><text display-inline="no-display-inline">Section 103I(a) of the National Security Act of 1947 (50 U.S.C. 3034(a)) is amended by adding at the end the following new sentence: <quote>The Chief Financial Officer shall report directly to the Director of National Intelligence.</quote>.</text></section>

<subsection id="HC38AC3AF8D2C42928F3336F81494102A" commented="no" display-inline="no-display-inline"><enum>(a)</enum><header>Adjustment of compensation for certain injuries</header> 
<paragraph id="H3684FF6848A54200AFC73A073A7DFC4D" commented="no" display-inline="no-display-inline"><enum>(1)</enum><header>Increase</header><text display-inline="yes-display-inline">The Director of the Central Intelligence Agency may increase the amount of monthly compensation paid to a covered employee under section 8105 of title 5, United States Code. Subject to paragraph (2), the Director may determine the amount of each such increase by taking into account—</text> 
<subparagraph id="H10E80BB64F604109935473C4C596E0FC" commented="no" display-inline="no-display-inline"><enum>(A)</enum><text>the severity of the qualifying injury;</text></subparagraph> 
<subparagraph id="H0FA95B078C2A428EA250DD454B011D7D" commented="no" display-inline="no-display-inline"><enum>(B)</enum><text display-inline="yes-display-inline">the circumstances by which the covered employee became injured; and</text></subparagraph> 
<subparagraph id="HC9DFD8B042C24F288390FFCBB8D9A390" commented="no" display-inline="no-display-inline"><enum>(C)</enum><text display-inline="yes-display-inline">the seniority of the covered employee.</text></subparagraph></paragraph> 
<paragraph id="H6020AAFE448043B595CC5560D7C04B5D" indent="up2" commented="no" display-inline="no-display-inline"><enum>(2)</enum><header>Maximum</header><text display-inline="yes-display-inline">Notwithstanding chapter 81 of title 5, United States Code, the total amount of monthly compensation increased under paragraph (1) may not exceed the monthly pay of the maximum rate of basic pay for GS–15 of the General Schedule under section 5332 of title 5, United States Code.</text></paragraph></subsection> 
<subsection id="H0439C27511304623BAE000B27F5C2DBD"><enum>(b)</enum><header>Costs for treating qualifying injuries</header><text display-inline="yes-display-inline">The Director may pay the costs of treating a qualifying injury of a covered employee, a covered individual, or a covered dependent, or may reimburse a covered employee, a covered individual, or a covered dependent for such costs, that are not otherwise covered by chapter 81 of title 5, United States Code, or other provision of Federal law.</text></subsection> 
<subsection id="HCE3258F4221C4940BEB012C45BB37208" commented="no"><enum>(c)</enum><header>Treatment of amounts</header><text display-inline="yes-display-inline">For purposes of section 104 of the Internal Revenue Code of 1986, amounts paid pursuant to this section shall be treated as amounts paid under chapter 81 of title 5, United States Code.</text></subsection> 
<subsection id="HA3318202BCF84915981DA60C9D8B29BF" commented="no"><enum>(d)</enum><header>Definitions</header><text display-inline="yes-display-inline">In this section:</text> 
<paragraph id="H2ECB34B6D002417397C2F767B828F06A"><enum>(1)</enum><header>Covered dependent</header><text>The term <term>covered dependent</term> means a family member of a covered employee who, on or after September 11, 2001—</text> 
<subparagraph id="H61C3BE42D2664B2A8B8F2D04179AE41B"><enum>(A)</enum><text>accompanies the covered employee to an assigned duty station in a foreign country; and</text></subparagraph> 
<subparagraph id="H04ED19F19E4647ABB75A77249C5FD40C"><enum>(B)</enum><text display-inline="yes-display-inline">becomes injured by reason of a qualifying injury.</text></subparagraph></paragraph> 
<paragraph id="HF298FBE5A8F042BB923024993B74D29C"><enum>(2)</enum><header>Covered employee</header><text>The term <term>covered employee</term> means an officer or employee of the Central Intelligence Agency who, on or after September 11, 2001, becomes injured by reason of a qualifying injury.</text></paragraph> 
<paragraph id="HEF0B02C074FD423583EA72F913FC1166"><enum>(3)</enum><header>Covered individual</header><text display-inline="yes-display-inline">The term <term>covered individual</term> means an individual who—</text> 
<subparagraph id="HEAD0F3546D4444BE8B62B435E5BE3011"><enum>(A)</enum> 
<clause id="H7C2A46288E91473BA09C8398B3DD8765" display-inline="yes-display-inline"><enum>(i)</enum><text display-inline="yes-display-inline">is detailed to the Central Intelligence Agency from other agencies of the United States Government or from the Armed Forces; or</text></clause> 
<clause id="HA8DB2608E22649868B71F88E2C3BA6CE" indent="up1"><enum>(ii)</enum><text display-inline="yes-display-inline">is affiliated with the Central Intelligence Agency, as determined by the Director; and</text></clause></subparagraph> 
<subparagraph id="H8E4A40961C704138BD7FFD16E79865FA"><enum>(B)</enum><text>who, on or after September 11, 2001, becomes injured by reason of a qualifying injury.</text></subparagraph></paragraph> 
<paragraph id="H42ACFC595F06498DA1D9D4393E0D1058" commented="no"><enum>(4)</enum><header>Qualifying injury</header><text display-inline="yes-display-inline">The term <term>qualifying injury</term> means the following:</text> 
<subparagraph id="H250F9FC9D569404EA6F54F4C7FAE58FA"><enum>(A)</enum><text display-inline="yes-display-inline">With respect to a covered dependent, an injury incurred—</text> 
<clause id="H66F43DBC00B44246B205FB100EA61806"><enum>(i)</enum><text display-inline="yes-display-inline">during war, insurgency, hostile act, or terrorist activities occurring during a period in which the covered dependent is accompanying the covered employee to an assigned duty station in a foreign country; and</text></clause> 
<clause id="H493838EC7730494BBA5A057B1A14DBF3"><enum>(ii)</enum><text display-inline="yes-display-inline">that was not the result of the willful misconduct of the covered dependent.</text></clause></subparagraph> 
<subparagraph id="H7371B3A8958E41DC8BFF1E6CD348C830"><enum>(B)</enum><text display-inline="yes-display-inline">With respect to a covered employee or a covered individual, an injury incurred—</text> 
<clause id="HCA610950E02942C89ECD80E2E79E488E"><enum>(i)</enum><text display-inline="yes-display-inline">during war, insurgency, hostile act, or terrorist activities occurring during a period of assignment to a duty station in a foreign country; and</text></clause> 
<clause id="HCE7F8E73382044D39C731E306C20A30A" commented="no"><enum>(ii)</enum><text display-inline="yes-display-inline">that was not the result of the willful misconduct of the covered employee or the covered individual.</text></clause></subparagraph></paragraph></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="H6BB3E494FE094E2C946E6B4761F2CCCA"><enum>(b)</enum><header>Regulations</header><text display-inline="yes-display-inline">Not later than 120 days after the date of the enactment of this Act, the Director of the Central Intelligence Agency shall—</text> 
<paragraph id="H77261A44312E41C7ACE14854AC741930"><enum>(1)</enum><text>prescribe regulations ensuring the fair and equitable implementation of section 19A of the Central Intelligence Agency Act of 1949, as added by subsection (a); and</text></paragraph> 
<paragraph id="H7DE3B980CFBD417997E774B6311919D1"><enum>(2)</enum><text>submit to the congressional intelligence committees such regulations.</text></paragraph></subsection> 
<subsection id="H4F139D787EC341FEB51690714001B1C6"><enum>(c)</enum><header>Application</header><text display-inline="yes-display-inline">Section 19A of the Central Intelligence Agency Act of 1949, as added by subsection (a), shall apply with respect to—</text> 
<paragraph id="HAE3E393732964AF78AA3296031185D6E"><enum>(1)</enum><text display-inline="yes-display-inline">payments made to covered employees (as defined in such section) under section 8105 of title 5, United States Code, beginning on or after the date of the enactment of this Act; and</text></paragraph> 
<paragraph id="H983BB8693C024C7E838F9BBAB740469E"><enum>(2)</enum><text>treatment described in subsection (b) of such section 19A occurring on or after the date of the enactment of this Act.</text></paragraph></subsection></section> 
<section id="H1CC219C56DD448B58613BD7FEF7B73E3"><enum>2413.</enum><header>Expansion of security protective service jurisdiction of the Central Intelligence Agency</header><text display-inline="no-display-inline">Subsection (a) of section 15 of the Central Intelligence Act of 1949 (50 U.S.C. 3515(a)) is amended—</text>

<paragraph id="H1CDE6E59624A4A5888EE87E86033086F" display-inline="yes-display-inline"><enum>(1)</enum><text display-inline="yes-display-inline">The head of the Office shall be the Director of the Office of Intelligence and Counterintelligence, who shall be an employee in the Senior Executive Service, the Senior Intelligence Service, the Senior National Intelligence Service, or any other Service that the Secretary, in coordination with the Director of National Intelligence, considers appropriate. The Director of the Office shall report directly to the Secretary.</text></paragraph> 
<paragraph id="HFB22C3595C3940E580B2487639A4E4D6" indent="up1"><enum>(2)</enum><text>The Secretary shall select an individual to serve as the Director from among individuals who have substantial expertise in matters relating to the intelligence community, including foreign intelligence and counterintelligence.</text></paragraph></subsection> 
<subsection id="H107389EDD8C84CCCA2D48D82EB913D1D"><enum>(c)</enum><header>Duties</header> 
<paragraph id="HE639F5DCC5F948BFA07C508DE3B35A88" display-inline="yes-display-inline"><enum>(1)</enum><text display-inline="yes-display-inline">Subject to the authority, direction, and control of the Secretary, the Director shall perform such duties and exercise such powers as the Secretary may prescribe.</text></paragraph> 
<paragraph id="H0E160EEC57A14FF3813798974413B4CC" indent="up1"><enum>(2)</enum><text display-inline="yes-display-inline">The Director shall be responsible for establishing policy for intelligence and counterintelligence programs and activities at the Department.</text></paragraph></subsection> 
<subsection id="HA1B28F2CD05343E0B2DC723CFB4AD1AB"><enum>(d)</enum><header>Definitions</header><text display-inline="yes-display-inline">In this section, the terms <term>intelligence community</term> and <term>National Intelligence Program</term> have the meanings given such terms in section 3 of the National Security Act of 1947 (50 U.S.C. 3003).</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="H623461CE6B3B4E7DBC60E8C41785FE9E"><enum>(b)</enum><header>Conforming repeal</header><text display-inline="yes-display-inline">Section 216 of the Department of Energy Organization Act (42 U.S.C. 7144c) is hereby repealed.</text></subsection>

<paragraph id="HF00A3E3292FF4C30B42CB39CC18BC9BD" indent="up1"><enum>(2)</enum><text display-inline="yes-display-inline">In establishing the Energy Infrastructure Security Center, the Director of the Office of Intelligence and Counterintelligence shall address the following missions and objectives to coordinate and disseminate intelligence relating to the security of the energy infrastructure of the United States:</text> 
<subparagraph id="H1888CB9C8AD74C54B0EBDAA3452949C6"><enum>(A)</enum><text display-inline="yes-display-inline">Establishing a primary organization within the United States Government for analyzing and integrating all intelligence possessed or acquired by the United States pertaining to the security of the energy infrastructure of the United States.</text></subparagraph> 
<subparagraph id="H7C445DC3CC5647388674B39CA22EF526"><enum>(B)</enum><text display-inline="yes-display-inline">Ensuring that appropriate departments and agencies have full access to and receive intelligence support needed to execute the plans or activities of the agencies, and perform independent, alternative analyses.</text></subparagraph> 
<subparagraph id="HB31F4E3B3F9A499E8FEA16EC7E70217D"><enum>(C)</enum><text display-inline="yes-display-inline">Establishing a central repository on known and suspected foreign threats to the energy infrastructure of the United States, including with respect to any individuals, groups, or entities engaged in activities targeting such infrastructure, and the goals, strategies, capabilities, and networks of such individuals, groups, or entities.</text></subparagraph> 
<subparagraph id="H8077C3E54F8644FE8D41A6D10F6BCC38"><enum>(D)</enum><text display-inline="yes-display-inline">Disseminating intelligence information relating to the security of the energy infrastructure of the United States, including threats and analyses, to the President, to the appropriate departments and agencies, and to the appropriate committees of Congress.</text></subparagraph></paragraph> 
<paragraph id="H078A31D0983F4FCE9E05AD68E0C0EA2C" indent="up1"><enum>(3)</enum><text>The President may waive the requirements of this subsection, and any parts thereof, if the President determines that such requirements do not materially improve the ability of the United States Government to prevent and halt attacks against the energy infrastructure of the United States. Such waiver shall be made in writing to Congress and shall include a description of how the missions and objectives in paragraph (2) are being met.</text></paragraph> 
<paragraph id="H674587DA4D1D4D4B9DA777159E03CAEC" indent="up1"><enum>(4)</enum><text>If the President decides not to exercise the waiver authority granted by paragraph (3), the President shall submit to Congress from time to time updates and plans regarding the establishment of an Energy Infrastructure Security Center.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section> 
<section id="H49DEBD96889D45908B226457161339E8" section-type="subsequent-section"><enum>2423.</enum><header>Repeal of Department of Energy Intelligence Executive Committee and budget reporting requirement</header><text display-inline="no-display-inline">Section 214 of the Department of Energy Organization Act (42 U.S.C. 7144a) is amended—</text> 
<paragraph id="HE195AA9720254597A7499E27A2D31F52"><enum>(1)</enum><text>by striking <quote>(a) <header-in-text level="subsection" style="OLC">Duty of Secretary.—</header-in-text></quote>; and </text></paragraph>

<section id="H5CA42617C4EA404DAD57C5E208C3D69E" section-type="subsequent-section"><enum>2431.</enum><header>Collocation of certain Department of Homeland Security personnel at field locations</header><text display-inline="no-display-inline">Not later than 18 months after the date of the enactment of this Act, the Under Secretary of Homeland Security for Intelligence and Analysis shall transfer not less than 40 personnel who are stationed, as of the date of the enactment of this Act, at the Department of Homeland Security headquarters located at Nebraska Avenue Northwest, Washington, District of Columbia, to locations at least 30 miles from such headquarters in order to collocate such personnel with and provide support for Department of Homeland Security operational units from Customs and Border Protection, the Transportation Security Administration, Immigration and Customs Enforcement, or other elements of the Department of Homeland Security.</text></section> 
<section id="H29DAB54FAC634353932C491D8D3BCDF4" section-type="subsequent-section"><enum>2432.</enum><header>Framework for roles, missions, and functions of Defense Intelligence Agency</header> 
<subsection id="H96DC01CA212D44939960B24FE476E0B2"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The Director of National Intelligence and the Secretary of Defense shall jointly establish a framework to ensure the appropriate balance of resources for the roles, missions, and functions of the Defense Intelligence Agency in its capacity as an element of the intelligence community and as a combat support agency. The framework shall include supporting processes to provide for the consistent and regular reevaluation of the responsibilities and resources of the Defense Intelligence Agency to prevent imbalanced priorities, insufficient or misaligned resources, and the unauthorized expansion of mission parameters.</text></subsection> 
<subsection id="H0B6B4166B8F94B8A85C228936DFC22F6"><enum>(b)</enum><header>Matters for inclusion</header><text>The framework required under subsection (a) shall include each of the following:</text>

<subparagraph id="H807EA4931F2046F1B7655851B52D0D60"><enum>(A)</enum><text display-inline="yes-display-inline">A justification for the addition, transfer, or elimination of a mission, role, or function.</text></subparagraph> 
<subparagraph id="H6C62297B1012478B8141E92546201A59"><enum>(B)</enum><text>The identification of which, if any, element of the Federal Government performs the considered mission, role, or function.</text></subparagraph> 
<subparagraph id="H6C540D3BFAD74862AB584F9E03B3666D"><enum>(C)</enum><text>In the case of any new mission, role, or functions—</text> 
<clause id="H50179F6D6D744ED48E68B390A3385BF6"><enum>(i)</enum><text>an assessment of the most appropriate agency or element to perform such mission, role, or function, taking into account the resource profiles, scope of responsibilities, primary customers, and existing infrastructure necessary to support such mission, role, or function; and</text></clause> 
<clause id="HE99E3BC1958441199B5E3106982F3D3C"><enum>(ii)</enum><text>a determination of the appropriate resource profile and an identification of the projected resources needed and the proposed source of such resources over the future-years defense program, to be provided in writing to any elements of the intelligence community or the Department of Defense affected by the assumption, transfer, or elimination of any mission, role, or function.</text></clause></subparagraph> 
<subparagraph id="H6A02B21668994D15922FECDB80B37E04"><enum>(D)</enum><text> In the case of any mission, role, or function proposed to be assumed, transferred, or eliminated, an assessment, which shall be completed jointly by the heads of each element affected by such assumption, transfer, or elimination, of the risks that would be assumed by the intelligence community and the Department if such mission, role, or function is assumed, transferred, or eliminated.</text></subparagraph> 
<subparagraph id="H7DDB6F673D9A43119551B37C9855CF02"><enum>(E)</enum><text>A description of how determinations are made regarding the funding of programs and activities under the National Intelligence Program and the Military Intelligence Program, including—</text> 
<clause id="H4DCD37F48C7D4572AF455FFF7916FEE9"><enum>(i)</enum><text>which programs or activities are funded under each such Program;</text></clause> 
<clause id="H6AB62DC2A8B84BAA93B635760ACF9A71"><enum>(ii)</enum><text>which programs or activities should be jointly funded under both such Programs and how determinations are made with respect to funding allocations for such programs and activities; and</text></clause> 
<clause id="H7E94D632C0F14E94B617EDD39BB8E125"><enum>(iii)</enum><text>the thresholds and process for changing a program or activity from being funded under one such Program to being funded under the other such Program.</text></clause></subparagraph></paragraph></subsection></section> 
<section id="H024066266C214B18A81B8D452AC65F36" section-type="subsequent-section"><enum>2433.</enum><header>Consultation by Secretary of Defense with Director of National Intelligence for certain functions</header><text display-inline="no-display-inline">Section 105(b) of the National Security Act of 1947 (50 U.S.C. 3038(b)) is amended in the matter preceding paragraph (1) by inserting <quote>, in consultation with the Director of National Intelligence,</quote> after <quote>the Secretary of Defense</quote>.</text></section> 
<section id="H403F3DE2F93B42A8A58AD4D20EFF0319" section-type="subsequent-section"><enum>2434.</enum><header>Construction of National Security Agency East Campus Building 3</header> 
<subsection id="H02D20F076BF3493EA87DC79F607875B5"><enum>(a)</enum><header>Sense of Congress</header><text display-inline="yes-display-inline">It is the sense of Congress that in carrying out the construction at the National Security Agency East Campus, the Director of the National Security Agency should prioritize the consolidation of national intelligence mission activities on such campus and away from disparate leased facilities in the Washington-Baltimore region.</text></subsection> 
<subsection id="H5D80D9D0B52E471A87D85A1F44DEF920"><enum>(b)</enum><header>Incremental construction of East Campus Building 3</header> 
<paragraph id="H33E4D916DB924606B5478CFA2FE64261"><enum>(1)</enum><header>In general</header><text>The Director of the National Security Agency may provide for the construction of East Campus Building 3, as authorized in section 2102, in increments, subject to annual appropriations, except that the total amount expended on the construction of East Campus Building 3 may not exceed $775,000,000.</text></paragraph> 
<paragraph id="H0DA3899CE02847F09F295EAD6CAF70FA"><enum>(2)</enum><header>Fiscal year 2019</header><text>The authorization of appropriations for East Campus Building 3 under section 2102 is an authorization to proceed with the construction of East Campus Building 3. The Director of the National Security Agency shall conduct necessary activities during fiscal year 2019 to avoid delays in project completion.</text></paragraph></subsection> 
<subsection id="H5282FD6FAB12439B8A4419BD9F2F0FEB"><enum>(c)</enum><header>Report</header><text display-inline="yes-display-inline">Not later than 180 days after the date of the enactment of this Act, the Director of the National Security Agency shall submit to the congressional intelligence committees a plan for the construction of East Campus Building 4 and East Campus Building 5. Such plan shall include—</text> 
<paragraph id="H21827C22A41044ECBA41064FFC7C510D"><enum>(1)</enum><text>a list of commercial leases in the Washington-Baltimore region that could be terminated if Congress authorizes the construction of East Campus Building 4 and East Campus Building 5; and</text></paragraph> 
<paragraph id="H5979A239E08A4876828AAB9E5DFD57BA"><enum>(2)</enum><text>an analysis of options to accelerate East Campus construction efforts.</text></paragraph></subsection></section> 
<section id="H70B87097BCB941CE888DDA391CE946E0" section-type="subsequent-section"><enum>2435.</enum><header>Establishment of advisory board for National Reconnaissance Office</header> 
<subsection id="H4C518F374C6042C68BAF13B1240A6D18"><enum>(a)</enum><header>Establishment</header><text display-inline="yes-display-inline">Section 106A of the National Security Act of 1947 (50 U.S.C. 3041a) is amended by adding at the end the following new subsection:</text>

<paragraph id="HE942875C169346FAA9CE7D52FBE4718C"><enum>(1)</enum><header>Establishment</header><text display-inline="yes-display-inline">There is established in the National Reconnaissance Office an advisory board (in this section referred to as the <quote>Board</quote>).</text></paragraph> 
<paragraph id="H0A2724902D8E4EAD9A81CEA94C1D02AA"><enum>(2)</enum><header>Duties</header><text>The Board shall—</text> 
<subparagraph id="H7E33376C8E824B10AE58D9A58EF5657C"><enum>(A)</enum><text display-inline="yes-display-inline">study matters relating to the mission of the National Reconnaissance Office, including with respect to space, overhead reconnaissance, acquisition, and other matters; and</text></subparagraph> 
<subparagraph id="H8DB863010B9F4623ABEBEDC362EC2DBD"><enum>(B)</enum><text>advise and report directly the Director with respect to such matters.</text></subparagraph></paragraph> 
<paragraph id="H1C26022A08E54916BA0A8F09BE198EBA"><enum>(3)</enum><header>Members</header> 
<subparagraph id="HA9C9E177BC2F4B54B9FED986498DB07C"><enum>(A)</enum><header>Number and appointment</header><text display-inline="yes-display-inline">The Board shall be composed of 5 members appointed by the Director from among individuals with demonstrated academic, government, business, or other expertise relevant to the mission and functions of the National Reconnaissance Office.</text></subparagraph> 
<subparagraph id="H4E84E584A2404C229F0E480BC053FD1F"><enum>(B)</enum><header>Terms</header><text>Each member shall be appointed for a term of 2 years. Except as provided by subparagraph (C), a member may not serve more than 3 terms.</text></subparagraph> 
<subparagraph id="H86A204B15E4D4B0E9AF063CA12EA7319"><enum>(C)</enum><header>Vacancy</header><text display-inline="yes-display-inline"><italic/>Any member appointed to fill a vacancy occurring before the expiration of the term for which the member’s predecessor was appointed shall be appointed only for the remainder of that term. A member may serve after the expiration of that member’s term until a successor has taken office.</text></subparagraph> 
<subparagraph id="H56829CC663004437891242D0C9AB2F50"><enum>(D)</enum><header>Chair</header><text>The Board shall have a Chair, who shall be appointed by the Director from among the members.</text></subparagraph> 
<subparagraph id="H061266DDC2F7444EABFCA3307D8B7707"><enum>(E)</enum><header>Travel expenses</header><text display-inline="yes-display-inline">Each member shall receive travel expenses, including per diem in lieu of subsistence, in accordance with applicable provisions under subchapter I of chapter 57 of title 5, United States Code.</text></subparagraph> 
<subparagraph id="HF6041FD069554760A489FBD8ABC9D1AF"><enum>(F)</enum><header>Executive Secretary</header><text display-inline="yes-display-inline">The Director may appoint an executive secretary, who shall be an employee of the National Reconnaissance Office, to support the Board.</text></subparagraph></paragraph> 
<paragraph id="H9AB415CC614343AFA5DBE6810083173B"><enum>(4)</enum><header>Meetings</header><text>The Board shall meet not less than quarterly, but may meet more frequently at the call of the Director.</text></paragraph> 
<paragraph id="H77ACBBB9121249CB8526BF6A91B2F467"><enum>(5)</enum><header>Reports</header><text>Not later than March 31 of each year, the Board shall submit to the Director and to the congressional intelligence committees a report on the activities of the Board during the preceding year.</text></paragraph> 
<paragraph id="HCCAE6FAB21EA4B4E91AA5A0915056916"><enum>(6)</enum><header>Nonapplicability of certain requirements</header><text display-inline="yes-display-inline">The Federal Advisory Committee Act (5 U.S.C. App.) shall not apply to the Board.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection> 
<subsection id="HE1CC59B4815C466F9C29FEA18A0044CB"><enum>(b)</enum><header>Initial appointments</header><text display-inline="yes-display-inline">Not later than 180 days after the date of the enactment of this Act, the Director of the National Reconnaissance Office shall appoint the initial 5 members to the advisory board under subsection (d) of section 106A of the National Security Act of 1947 (50 U.S.C. 3041a), as added by subsection (a).</text></subsection></section></subtitle></title>

<subsection id="HF4F3A76079AF49DD907FE3889E3B60A4"><enum>(a)</enum><header>Determinations of significant foreign cyber intrusions and active measures campaigns</header><text display-inline="yes-display-inline">The Director of National Intelligence, the Director of the Federal Bureau of Investigation, and the Secretary of Homeland Security shall jointly carry out subsection (b) if such Directors and the Secretary jointly determine—</text> 
<paragraph id="HAC99B535AA3D403F9D6FFF37811817FA"><enum>(1)</enum><text>that on or after the date of the enactment of this Act, a significant foreign cyber intrusion or active measures campaign intended to influence an upcoming election for any Federal office has occurred or is occurring; and</text></paragraph> 
<paragraph id="H2F7F4D92D35C474F90D05CF13A7A8172"><enum>(2)</enum><text>with moderate or high confidence, that such intrusion or campaign can be attributed to a foreign state or to a foreign nonstate person, group, or other entity.</text></paragraph></subsection> 
<subsection id="H4E7C49F11D2F42DD95B0FB440E25A066"><enum>(b)</enum><header>Briefing</header> 
<paragraph id="HCB9BCE98D3F94893968DC13207D028E8"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 14 days after making a determination under subsection (a), the Director of National Intelligence, the Director of the Federal Bureau of Investigation, and the Secretary of Homeland Security, shall jointly provide a briefing to the congressional leadership, the congressional intelligence committees and, consistent with the protection of sources and methods, the other appropriate congressional committees. The briefing shall be classified and address, at a minimum, the following:</text> 
<subparagraph id="HE36A67DBADAD4B76A8D072F7BD59C2FA"><enum>(A)</enum><text display-inline="yes-display-inline">A description of the significant foreign cyber intrusion or active measures campaign, as the case may be, covered by the determination.</text></subparagraph> 
<subparagraph id="H210BB822CD3B4A84A0C838578ED4FB9D"><enum>(B)</enum><text display-inline="yes-display-inline">An identification of the foreign state or foreign nonstate person, group, or other entity, to which such intrusion or campaign has been attributed.</text></subparagraph> 
<subparagraph id="H11975EE77FFA49E9AB71DA38A4AE9F8D"><enum>(C)</enum><text display-inline="yes-display-inline">The desirability and feasibility of the public release of information about the cyber intrusion or active measures campaign.</text></subparagraph> 
<subparagraph id="H8C5917EFE2D640ECA908E94AB9E2501E"><enum>(D)</enum><text>Any other information such Directors and the Secretary jointly determine appropriate.</text></subparagraph></paragraph> 
<paragraph id="HE815A8EA90374219A7E13A45C1EEBF81"><enum>(2)</enum><header>Electronic election infrastructure briefings</header><text display-inline="yes-display-inline">With respect to a significant foreign cyber intrusion covered by a determination under subsection (a), the Secretary of Homeland Security, in consultation with the Director of National Intelligence and the Director of the Federal Bureau of Investigation, shall offer to the owner or operator of any electronic election infrastructure directly affected by such intrusion, a briefing on such intrusion, including steps that may be taken to mitigate such intrusion. <paragraph commented="no" id="H46634ECE864244D0BD706397F1D4F09B"><enum>(2)</enum><header>Candidate, election, and political party</header><text display-inline="yes-display-inline">The terms <term>candidate</term>, <term>election</term>, and <term>political party</term> have the meanings given those terms in section 301 of the Federal Election Campaign Act of 1971 (52 U.S.C. 30101).</text></paragraph>

<paragraph commented="no" id="HC5DDC942D13042B69D6F8E54CE2F3570"><enum>(5)</enum><header>Electronic election infrastructure</header><text display-inline="yes-display-inline">The term <term>electronic election infrastructure</term> means an electronic information system of any of the following that is related to an election for Federal office:</text>

<subparagraph commented="no" id="H74C2B266147A42E4B2729F4D61157C5C"><enum>(D)</enum><text display-inline="yes-display-inline">The election campaign of a candidate.</text></subparagraph></paragraph>

<subparagraph id="H209F026DD3DC48419E09203345818D7B"><enum>(A)</enum><text>the Committee on Armed Services and the Committee on Homeland Security and Governmental Affairs of the Senate; and</text></subparagraph> 
<subparagraph id="H53C31BA9692F44E49153FD8C81FC633B"><enum>(B)</enum><text>the Committee on Armed Services and the Committee on Homeland Security of the House of Representatives.</text></subparagraph></paragraph></subsection></section> 
<section id="HDBFBD6457DB44D1589896D40A16136B7" display-inline="no-display-inline" section-type="subsequent-section"><enum>2504.</enum><header>Reports on intelligence community loan repayment and related programs</header> 
<subsection id="H0159F689673448E58E2AF847E92AC04A"><enum>(a)</enum><header>Sense of Congress</header><text display-inline="yes-display-inline">It is the sense of Congress that—</text> 
<paragraph id="HBCB975F0AF2B4D6B877DA2810B68FAB0"><enum>(1)</enum><text display-inline="yes-display-inline">there should be established, through the issuing of an Intelligence Community Directive or otherwise, an intelligence community-wide program for student loan repayment, student loan forgiveness, financial counseling, and related matters, for employees of the intelligence community;</text></paragraph> 
<paragraph id="HB68BE3787F9A4968BBFA75E8A4EA9854"><enum>(2)</enum><text display-inline="yes-display-inline">creating such a program would enhance the ability of the elements of the intelligence community to recruit, hire, and retain highly qualified personnel, including with respect to mission-critical and hard-to-fill positions;</text></paragraph> 
<paragraph id="H81C6FE23115C4CD1A06A50C650BD0762"><enum>(3)</enum><text>such a program, including with respect to eligibility requirements, should be designed so as to maximize the ability of the elements of the intelligence community to recruit, hire, and retain highly qualified personnel, including with respect to mission-critical and hard-to-fill positions; and</text></paragraph> 
<paragraph id="H6117ACE77D8F44E8BE65B4878CF754FF"><enum>(4)</enum><text display-inline="yes-display-inline">to the extent possible, such a program should be uniform throughout the intelligence community and publicly promoted by each element of the intelligence community to both current employees of the element as well as to prospective employees of the element.</text></paragraph></subsection> 
<subsection id="H3C6DC97F02A34428BA3FE5C0FB8150AC"><enum>(b)</enum><header>Report on potential intelligence community-wide program</header> 
<paragraph id="H70044B6CC7394D038D97592DA134ACDE"><enum>(1)</enum><header>In general</header><text>Not later than 180 days after the date of the enactment of this Act, the Director of National Intelligence, in cooperation with the heads of the elements of the intelligence community and the heads of any other appropriate department or agency of the Federal Government, shall submit to the congressional intelligence committees a report on potentially establishing and carrying out an intelligence community-wide program for student loan repayment, student loan forgiveness, financial counseling, and related matters, as described in subsection (a).</text></paragraph> 
<paragraph id="H8ECDB671348C40A3853ACF3E3174E875"><enum>(2)</enum><header>Matters included</header><text>The report under paragraph (1) shall include, at a minimum, the following:</text> 
<subparagraph id="H21E9E3A22DC34E7D9B2BB21499B1A24F"><enum>(A)</enum><text>A description of the financial resources that the elements of the intelligence community would require to establish and initially carry out the program specified in paragraph (1).</text></subparagraph> 
<subparagraph id="H5E1A402BBC5246DF9042AF8CF6C0C80C"><enum>(B)</enum><text display-inline="yes-display-inline">A description of the practical steps to establish and carry out such a program.</text></subparagraph> 
<subparagraph id="HA8EDCA2642E9458EB227A7EA608E31C0"><enum>(C)</enum><text>The identification of any legislative action the Director determines necessary to establish and carry out such a program.</text></subparagraph></paragraph></subsection> 
<subsection id="HDC8DD1666DF242C1BDD85FDE0E9610F8"><enum>(c)</enum><header>Annual reports on established programs</header> 
<paragraph id="H7FB82B42329C4232BD166BD0CAB12A2F"><enum>(1)</enum><header>In general</header><text>The Director of National Intelligence shall annually submit to the congressional intelligence committees a report on the covered programs. Each such report shall include, with respect to the period covered by the report, the following:</text> 
<subparagraph id="HD222BF3BEB9048518EF9EFB1E789E7B7"><enum>(A)</enum><text>The number of personnel from each element of the intelligence community who used each covered program.</text></subparagraph> 
<subparagraph id="HFEAFEA12066348C8A1187AB3481DB2D0"><enum>(B)</enum><text>The total amount of funds each element expended for each such program.</text></subparagraph> 
<subparagraph id="H1CACF075D98B4253960B808F811F3BB4"><enum>(C)</enum><text display-inline="yes-display-inline">A description of the efforts made by each element to promote each covered program pursuant to both the personnel of the element of the intelligence community and to prospective personnel.</text></subparagraph></paragraph> 
<paragraph id="H17AF96E3F9C444EB8B15AF4D8945033C"><enum>(2)</enum><header>Covered programs defined</header><text display-inline="yes-display-inline">In this subsection, the term <term>covered programs</term> means any loan repayment program, loan forgiveness program, financial counseling program, or similar programs, established pursuant to title X of the National Security Act of 1947 (50 U.S.C. 3191 et seq.) or any other provision of law that may be administered or used by an element of the intelligence community.</text></paragraph></subsection></section> 
<section id="HA5B3C379A3D644F7B9CA74F14F72D119" commented="no"><enum>2505.</enum><header>Comptroller General of the United States report on senior executives of the Office of the Director of National Intelligence</header> 
<subsection id="H28A2EBA7EC404465B407CEE8F2F559EA" commented="no"><enum>(a)</enum><header>Report</header><text display-inline="yes-display-inline">Not later than 180 days after the date of the enactment of this Act, the Comptroller General of the United States shall submit to the congressional intelligence committees a report on the number of Senior Executive Service positions in the Office of the Director of National Intelligence.</text></subsection> 
<subsection id="HCD38B69ECA5849EE98478B8C395F4488" commented="no"><enum>(b)</enum><header>Matters included</header><text>The report under subsection (a) shall include the following:</text> 
<paragraph id="H102152002D9E48FD9A1A06485882B52D" commented="no"><enum>(1)</enum><text display-inline="yes-display-inline">The number of required Senior Executive Service positions for the Office of the Director of National Intelligence. </text></paragraph> 
<paragraph id="HA9B0020101FD4FE382E60755AA60A48C"><enum>(2)</enum><text>Whether such requirements are reasonably based on the mission of the Office.</text></paragraph> 
<paragraph id="H7E5C1A4479A244C6BA0749AAF36C8CF4"><enum>(3)</enum><text display-inline="yes-display-inline">A discussion of how the levels of the Senior Executive Service positions in the Office compare to the number of senior positions at other elements of the intelligence community.</text></paragraph></subsection> 
<subsection id="HB14AB2CCB6AB43B98BCD17D17CB6D503"><enum>(c)</enum><header>Cooperation</header><text display-inline="yes-display-inline">The Director of National Intelligence shall provide to the Comptroller General any information requested by the Comptroller General to carry out this section by not later than 5 business days after the date on which the Comptroller General makes such request.</text></subsection> 
<subsection id="H019A8A37418844699759085C496971D3" commented="no"><enum>(d)</enum><header>Senior Executive Service position defined</header><text display-inline="yes-display-inline">In this section, the term <term>Senior Executive Service position</term> has the meaning given that term in section 3132(a)(2) of title 5, United States Code, and includes any position above the GS–15, step 10, level of the General Schedule under section 5332 of such title.</text></subsection></section> 
<section id="H5BF21B5AD50940338C26BDCA4A072D70"><enum>2506.</enum><header>Briefings on counterintelligence activities of the Federal Bureau of Investigation</header> 
<subsection id="H884C734E3DDE4B508D2A2F55101F1338"><enum>(a)</enum><header>Quarterly briefings</header><text display-inline="yes-display-inline">Not later than 90 days after the date of the enactment of this Act, and on a quarterly basis thereafter, the Director of the Federal Bureau of Investigation shall provide to the congressional intelligence committees a briefing on the counterintelligence activities of the Federal Bureau of Investigation. Such briefings shall include, at a minimum, an overview and update of—</text> 
<paragraph id="H7943B15BA35E4EAF8052695E3C2AF59E"><enum>(1)</enum><text display-inline="yes-display-inline">the counterintelligence posture of the Bureau;</text></paragraph> 
<paragraph id="HB5235D4631F7411EB6E691B95F63B288"><enum>(2)</enum><text>matters of counterintelligence concern; and</text></paragraph> 
<paragraph id="H4F0C48A2ABEE4729A78E43BAE889AD40"><enum>(3)</enum><text display-inline="yes-display-inline">any other information relating to the counterintelligence activities of the Bureau that the Director determines necessary to keep the congressional intelligence committees fully and currently informed as required by section 501 of the National Security Act of 1947 (50 U.S.C. 3091).</text></paragraph></subsection> 
<subsection id="H3AD11884EE9C4EC39DE7900A5E1C625A"><enum>(b)</enum><header>Guidelines</header><text display-inline="yes-display-inline">The Director, in coordination with the Attorney General and in consultation with the congressional intelligence committees, shall develop guidelines governing the scope of the briefings provided under subsection (a).</text></subsection></section> 
<section id="H25ADBFA5053C472F881EE137619B8264"><enum>2507.</enum><header>Briefing on FBI offering permanent residence to sources and cooperators</header><text display-inline="no-display-inline">Not later than 30 days after the date of the enactment of this Act, the Director of the Federal Bureau of Investigation shall provide to the congressional intelligence committees a briefing on the ability of the Federal Bureau of Investigation to offer, as an inducement to assisting the Bureau, permanent residence within the United States to foreign individuals who are sources or cooperators in counterintelligence or other national security-related investigations. The briefing shall address the following:</text> 
<paragraph id="HFE22D5486306432D9C312FB157599018"><enum>(1)</enum><text>The extent to which the Bureau may make such offers, whether independently or in conjunction with other agencies and departments of the United States Government, including a discussion of the authorities provided by section 101(a)(15)(S) of the Immigration and Nationality Act (8 U.S.C. 1101(a)(15)(S)), section 7 of the Central Intelligence Agency Act (50 U.S.C. 3508), and any other provision of law under which the Bureau may make such offers.</text></paragraph> 
<paragraph id="H19BF7A55C2064596A160EA7D16016105"><enum>(2)</enum><text>An overview of the policies and operational practices of the Bureau with respect to making such offers.</text></paragraph> 
<paragraph id="H78CDC1F80B0B4A53A8F2ED2B9935B3C1"><enum>(3)</enum><text>The sufficiency of such policies and practices with respect to inducing individuals to cooperate with, serve as sources for such investigations, or both.</text></paragraph> 
<paragraph id="H816FDB5822F244BAB78BC3398915C000"><enum>(4)</enum><text>Whether the Director recommends any legislative actions to improve such policies and practices, particularly with respect to the counterintelligence efforts of the Bureau.</text></paragraph></section>
