<title id="HA62B037348A54D9EB2D6D599BDFB5AB2"><enum>I</enum><header>General Provisions</header> 
<section id="HB83E625C792E4030A559E6274A79FB03" commented="no"><enum>101.</enum><header>Sense of Congress regarding water resources development bills</header><text display-inline="no-display-inline">It is the sense of Congress that, because the missions of the Corps of Engineers for navigation, flood control, beach erosion control and shoreline protection, hydroelectric power, recreation, water supply, environmental protection, restoration, and enhancement, and fish and wildlife mitigation benefit all Americans, and because water resources development projects are critical to maintaining the country’s economic prosperity, national security, and environmental protection, Congress should consider a water resources development bill not less often than once every Congress.</text></section> 
<section id="H9BFFC43BB5DF45D9AB4EF64D891A85C7"><enum>102.</enum><header>Assessment of harbors and inland harbors</header><text display-inline="no-display-inline">Section 210(e) of the Water Resources Development Act of 1986 (33 U.S.C. 2238) is amended—</text> 
<paragraph id="H41AC6E1D20A04A08A5353DDEFD8E81A4"><enum>(1)</enum><text>in paragraph (1), by striking <quote>shall assess the</quote> and inserting <quote>shall assess, and issue a report to Congress on, the</quote>; and</text></paragraph> 
<paragraph id="HE961789B0CAF4140B26BE6B57BAC0630"><enum>(2)</enum><text>in paragraph (2), by adding at the end the following:</text> 
<quoted-block style="OLC" id="H7D078419524A48488DF7BE9C1349EE1D" display-inline="no-display-inline"> 
<subparagraph id="HC9F3A38C51BA496EB18707DB50CCDF07"><enum>(C)</enum><header>Opportunities for beneficial use of dredged materials</header><text display-inline="yes-display-inline">In carrying out paragraph (1), the Secretary shall identify potential opportunities for the beneficial use of dredged materials obtained from harbors and inland harbors referred to in subsection (a)(2), including projects eligible under section 1122 of the Water Resources Development Act of 2016 (130 Stat. 1645; 33 U.S.C. 2326 note).</text></subparagraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section> 
<section id="H082AA28EDC5C47D785DF126B34D7D288"><enum>103.</enum><header>Levee safety initiative reauthorization</header><text display-inline="no-display-inline"> Title IX of the Water Resources Development Act of 2007 (33 U.S.C. 3301 et seq.) is amended—</text> 
<paragraph id="H7F5D88C99B3A4134A6114F7154361577"><enum>(1)</enum><text display-inline="yes-display-inline">in section 9005(g)(2)(E)(i), by striking <quote>2015 through 2019</quote> and inserting <quote>2019 through 2023</quote>; and</text></paragraph> 
<paragraph id="H210D9FA366AE43EB8F4444E75747065B"><enum>(2)</enum><text>in section 9008, by striking <quote>2015 through 2019</quote> each place it appears and inserting <quote>2019 through 2023</quote>.</text></paragraph></section> 
<section id="HAB706EF8AFD744F4B89DAED2124E7850"><enum>104.</enum><header>Dam safety</header><text display-inline="no-display-inline">Section 14 of the National Dam Safety Program Act (33 U.S.C. 467j) is amended by striking <quote>2015 through 2019</quote> each place it appears and inserting <quote>2019 through 2023</quote>.</text></section> 
<section id="H22133E8C516B49C1BF6BB6C8F0086DD3" display-inline="no-display-inline"><enum>105.</enum><header>Rehabilitation of Corps of Engineers constructed dams</header><text display-inline="no-display-inline">Section 1177 of the Water Resources Development Act of 2016 (33 U.S.C. 467f–2 note) is amended—</text> 
<paragraph id="H93E2E8521CCD480DA5DEB870D3682748"><enum>(1)</enum><text>in subsection (e), by striking <quote>$10,000,000</quote> and inserting <quote>$40,000,000</quote>; and</text></paragraph> 
<paragraph id="HFCDC3EC268494701BC445E15A0214F45"><enum>(2)</enum><text>in subsection (f), by striking <quote>$10,000,000</quote> and inserting <quote>$40,000,000</quote>.</text></paragraph></section> 
<section id="HD87A4333C1A841CCB2FBA8B489AB38A2"><enum>106.</enum><header>Forecast-informed reservoir operations</header> 
<subsection id="HAEE3E5FBFBBA42898F9A1E6016171F83"><enum>(a)</enum><header>Report on forecast-Informed reservoir operations</header><text>Not later than one year after the date of completion of the forecast-informed reservoir operations research study pilot program at Coyote Valley Dam, Russian River Basin, California (authorized by the River and Harbor Act of 1950 (64 Stat. 177)), the Secretary shall issue a report to the Committee on Transportation and Infrastructure of the House of Representatives and the Committee on Environment and Public Works of the Senate on the results of the study pilot program.</text></subsection> 
<subsection id="HDD0DB41CE166433292F37CFB65C24397"><enum>(b)</enum><header>Contents of report</header><text>The Secretary shall include in the report issued under subsection (a)—</text> 
<paragraph id="H482635AB7A684FB4848EBA9C7476B64A"><enum>(1)</enum><text display-inline="yes-display-inline">an analysis of the use of forecast-informed reservoir operations at Coyote Valley Dam, California;</text></paragraph> 
<paragraph id="HDDCB09AF33AB4D25AF5C97E476A83E1F"><enum>(2)</enum><text>an assessment of the viability of using forecast-informed reservoir operations at other dams owned or operated by the Secretary;</text></paragraph> 
<paragraph id="HDADF50FDA73043BC8B2961E8E6967F79"><enum>(3)</enum><text>an identification of other dams owned or operated by the Secretary where forecast-informed reservoir operations may assist the Secretary in the optimization of future reservoir operations; and</text></paragraph> 
<paragraph id="H550E2F6A45BF46EE81A19E68D5D23CFD"><enum>(4)</enum><text>any additional areas for future study of forecast-informed reservoir operations.</text></paragraph></subsection></section> 
<section id="H6529FFA52921405EA82BE5F9D8B075AF" display-inline="no-display-inline" section-type="subsequent-section"><enum>107.</enum><header>Identification of nonpowered dams for hydropower development</header> 
<subsection id="H1D7D62CEBFC44EA1B8C7748557643334"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 18 months after the date of enactment of this section, the Secretary shall develop a list of existing nonpowered dams owned and operated by the Corps of Engineers that have the greatest potential for hydropower development.</text></subsection> 
<subsection id="H78E2FA3320544DA39A60B280C55095C5"><enum>(b)</enum><header>Considerations</header><text display-inline="yes-display-inline">In developing the list under subsection (a), the Secretary may consider the following:</text> 
<paragraph id="HF4E370A7342341E4AD60A52F1C5B4510"><enum>(1)</enum><text>The compatibility of hydropower generation with existing purposes of the dam.</text></paragraph> 
<paragraph id="H148EDEB6B1BF4B1E817C39178A90CE09"><enum>(2)</enum><text>The proximity of the dam to existing transmission resources.</text></paragraph> 
<paragraph id="H64705EF67BD24081A3D563344F2357A5"><enum>(3)</enum><text>The existence of studies to characterize environmental, cultural, and historic resources relating to the dam.</text></paragraph> 
<paragraph id="H11673D0DCB50466589344EA2A61DD30E"><enum>(4)</enum><text>Whether hydropower is an authorized purpose of the dam.</text></paragraph></subsection> 
<subsection id="H152840E573BD4FC18C7587A2FADCDDB7"><enum>(c)</enum><header>Availability</header><text display-inline="yes-display-inline">The Secretary shall provide the list developed under subsection (a) to the Committee on Transportation and Infrastructure of the House of Representatives and the Committee on Environment and Public Works of the Senate, and make such list available to the public.</text></subsection></section> 
<section id="H4036B7BF1040447CBD169C16B7A8804E"><enum>108.</enum><header>Emergency response to natural disasters</header> 
<subsection id="HCD3BB8FC42C54D60A4EF667A2E2A40B8"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Section 5(a)(1) of the Act of August 18, 1941 (33 U.S.C. 701n(a)(1)) is amended in the first sentence— </text> 
<paragraph id="H3BF5C0B387C7414FAD70AFF1CF950238"><enum>(1)</enum><text>by striking <quote>strengthening, raising, extending, or other modification thereof</quote> and inserting <quote>strengthening, raising, extending, realigning, or other modification thereof</quote>; and</text></paragraph> 
<paragraph id="HA53159F133CC4407A0C5DA0B37286804"><enum>(2)</enum><text>by striking <quote>structure or project damaged or destroyed by wind, wave, or water action of other than an ordinary nature to the design level of protection when, in the discretion of the Chief of Engineers,</quote> and inserting <quote>structure or project damaged or destroyed by wind, wave, or water action of other than an ordinary nature to either the pre-storm level or the design level of protection, whichever provides greater protection, when, in the discretion of the Chief of Engineers,</quote>.</text></paragraph></subsection> 
<subsection id="HEB39822F685D4016BBB67E6A2BE2E189"><enum>(b)</enum><header>Duration</header><text display-inline="yes-display-inline">Section 156(e) of the Water Resources Development Act of 1976 (42 U.S.C. 1962d–5f(e)) is amended by striking <quote>6 years</quote> and inserting <quote>9 years</quote>.</text></subsection></section> 
<section id="HB1430C666E9B4EAC9F531C18326EFDA3"><enum>109.</enum><header>Integrated water resources planning</header><text display-inline="no-display-inline"> In carrying out a water resources development feasibility study, the Secretary shall consult with local governments in the watershed covered by such study to determine if local water management plans exist, or are under development, for the purposes of stormwater management, water quality improvement, aquifer recharge, or water reuse.</text></section> 
<section id="HF4DA14F47E584670978080688FB8F28A"><enum>110.</enum><header>Mitigation banks</header> 
<subsection id="H9D27153D90AC4102BE8CE5D337FF68C7" commented="no"><enum>(a)</enum><header>Definition of mitigation bank</header><text>In this section, the term <term>mitigation bank</term> has the meaning given that term in section 332.2 of title 33, Code of Federal Regulations.</text></subsection> 
<subsection id="H37DA2DB35E334E1D9CEEF676F2B44B9F"><enum>(b)</enum><header>Guidance</header><text>The Secretary shall issue guidance on the use of mitigation banks to meet requirements for water resources development projects in order to update mitigation bank credit release schedules to—</text> 
<paragraph id="HBA2EA5EEC5EC44A8B3A00875ABA64AFD"><enum>(1)</enum><text>support the goal of achieving efficient permitting and maintaining appropriate environmental protections; and</text></paragraph> 
<paragraph id="H9ECAA43F9EA34EE393996FA0C73A94BB"><enum>(2)</enum><text>promote increased transparency in the use of mitigation banks.</text></paragraph></subsection> 
<subsection id="H62660939947B4E17B37DE538C3B36C18"><enum>(c)</enum><header>Requirements</header><text>The guidance issued under subsection (b) shall—</text>

<subsection id="HA0F7AB460038480CA4E01CADBE6C779C" commented="no"><enum>(b)</enum><header>John Day Dam, Washington and Oregon</header> 
<paragraph id="HCAFAEA9EE11D4D2E8A4DD3025AC1F7FF" commented="no"><enum>(1)</enum><header>In general</header><text>The Secretary shall, not later than 180 days after the date of enactment of this Act, and in consultation with the Secretary of the Interior, conduct a study to determine the extent to which Indian Tribes have been displaced as a result of the construction of the John Day Dam, Columbia River, Washington and Oregon, as authorized by section 204 of the Flood Control Act of 1950 (64 Stat. 179), including an assessment of effects related to housing and related improvements. </text></paragraph> 
<paragraph id="H22DFD29997FC4C41B0DA2FF3472BDD78" commented="no"><enum>(2)</enum><header>Additional actions</header><text display-inline="yes-display-inline">If the Secretary determines, based on the study under paragraph (1), that assistance is required, the Secretary may use all existing authorities of the Secretary to provide assistance, which may include housing and related improvements, to Indian Tribes displaced as a result of the construction of the John Day Dam, Columbia River, Washington and Oregon.</text></paragraph> 
<paragraph id="HA5A825C6A2174913A9897B852372F3C6" commented="no"><enum>(3)</enum><header>Repeal</header><text>Section 1178(c)(2) of the Water Resources Development Act of 2016 (130 Stat. 1675) is repealed.</text></paragraph></subsection> 
<subsection id="HB1EE9ADA592B4D74ACDE9330AAE4EE89" commented="no"><enum>(c)</enum><header>The Dalles Dam, Washington and Oregon</header><text display-inline="yes-display-inline">The Secretary, in consultation with the Secretary of the Interior, shall complete a village development plan for any Indian Tribe displaced as a result of the construction of the Dalles Dam, Columbia River, Washington and Oregon, as authorized by section 204 of the Flood Control Act of 1950 (64 Stat. 179). </text></subsection></section> 
<section id="H1F10B05BBCF6491B8E80FCD73973C261"><enum>113.</enum><header>Dissemination of information</header> 
<subsection id="H6AA4CDC85D9D4074AC99041A63F48DC5" commented="no"><enum>(a)</enum><header>Findings</header><text>Congress finds the following:</text> 
<paragraph id="HF99FE87EE69C44E0850280FD22B35AF3" commented="no"><enum>(1)</enum><text>Congress plays a central role in identifying, prioritizing, and authorizing vital water resources infrastructure activities throughout the United States.</text></paragraph> 
<paragraph id="HEFD88CA894D043418FBB2940A026D4AC" commented="no"><enum>(2)</enum><text>The Water Resources Reform and Development Act of 2014 (Public Law 113–121) established a new and transparent process to review and prioritize the water resources development activities of the Corps of Engineers with strong congressional oversight.</text></paragraph> 
<paragraph id="H6FF8B5F2ABA9468E886563B96B45BC91" commented="no"><enum>(3)</enum><text>Section 7001 of the Water Resources Reform and Development Act of 2014 (33 U.S.C. 2282d) requires the Secretary to develop and submit to Congress each year a Report to Congress on Future Water Resources Development and, as part of the annual report process, to—</text> 
<subparagraph id="HB962A43278004DED826A7F2201541F9D" commented="no"><enum>(A)</enum><text>publish a notice in the Federal Register that requests from non-Federal interests proposed feasibility studies and proposed modifications to authorized water resources development projects and feasibility studies for inclusion in the report; and</text></subparagraph> 
<subparagraph id="HBDD94CEF6DBF4FE69A8EACCD34BEA9AC" commented="no"><enum>(B)</enum><text>review the proposals submitted and include in the report those proposed feasibility studies and proposed modifications that meet the criteria for inclusion established under such section 7001.</text></subparagraph></paragraph> 
<paragraph id="H7E6C7026948D4E4EA8D7B13B6B2D4D96" commented="no"><enum>(4)</enum><text>Congress will use the information provided in the annual Report to Congress on Future Water Resources Development to determine authorization needs and priorities for purposes of water resources development legislation.</text></paragraph> 
<paragraph id="H2E3F748667FF4C6EAD7C97D728986DBE" commented="no"><enum>(5)</enum><text>To ensure that Congress can gain a thorough understanding of the water resources development needs and priorities of the United States, it is important that the Secretary take sufficient steps to ensure that non-Federal interests are made aware of the new annual report process, including the need for non-Federal interests to submit proposals during the Secretary’s annual request for proposals in order for such proposals to be eligible for consideration by Congress.</text></paragraph></subsection> 
<subsection id="H9982365419EE4EB9999AD6DFDADF0DD1"><enum>(b)</enum><header>Dissemination of process information</header><text>The Secretary shall develop, support, and implement education and awareness efforts for non-Federal interests with respect to the annual Report to Congress on Future Water Resources Development required under section 7001 of the Water Resources Reform and Development Act of 2014 (33 U.S.C. 2282d), including efforts to—</text> 
<paragraph id="HC6BF80A360A64536922B65DADB4D149C"><enum>(1)</enum><text>develop and disseminate technical assistance materials, seminars, and guidance on the annual process as it relates to non-Federal interests;</text></paragraph> 
<paragraph id="HBB330B10F1A34216B62ADC54823ADF58"><enum>(2)</enum><text>provide written notice to local elected officials and previous and potential non-Federal interests on the annual process and on opportunities to address local water resources challenges through the missions and authorities of the Corps of Engineers;</text></paragraph> 
<paragraph id="H62E951E31F7D45928806653E71440F8B"><enum>(3)</enum><text>issue guidance for non-Federal interests to assist such interests in developing proposals for water resources development projects that satisfy the requirements of such section 7001; and</text></paragraph> 
<paragraph id="H113073EA0116489B87C327DF56C881E1"><enum>(4)</enum><text>provide, at the request of a non-Federal interest, assistance with researching and identifying existing project authorizations and Corps of Engineers decision documents.</text></paragraph></subsection></section> 
<section id="HD42DEC2412D343DEBFEF7BF5AF61D15B"><enum>114.</enum><header>Non-Federal engagement and review</header> 
<subsection id="H7270FDF7E9474D87A5B7DABDE47F8496"><enum>(a)</enum><header>Public notice</header> 
<paragraph id="H4699FCD3B9024108A49BA37F1150CC4A"><enum>(1)</enum><header>In general</header><text>Prior to developing and issuing any new or revised implementation guidance for a covered water resources development law, the Secretary shall issue a public notice that—</text> 
<subparagraph id="H01E1289B9B8B4181A453A37CC61C8008"><enum>(A)</enum><text>informs potentially interested non-Federal stakeholders of the Secretary’s intent to develop and issue such guidance; and</text></subparagraph> 
<subparagraph id="H0279E89C4F0B4C32ABF3B235B6ABA15B"><enum>(B)</enum><text>provides an opportunity for interested non-Federal stakeholders to engage with, and provide input and recommendations to, the Secretary on the development and issuance of such guidance.</text></subparagraph></paragraph> 
<paragraph id="HA68A075F00D845D78ACC0998C9D8559D" commented="no"><enum>(2)</enum><header>Issuance of notice</header><text display-inline="yes-display-inline">The Secretary shall issue the notice under paragraph (1) through a posting on a publicly accessible website dedicated to providing notice on the development and issuance of implementation guidance for a covered water resources development law.</text></paragraph></subsection> 
<subsection id="H6B623D4EE100485DBD6572FFBDF013C4"><enum>(b)</enum><header>Stakeholder engagement</header> 
<paragraph id="H034CA860D3D94859A966B5D5DA6333B2"><enum>(1)</enum><header>Input</header><text display-inline="yes-display-inline">The Secretary shall allow a minimum of 60 days after issuance of the public notice under subsection (a) for non-Federal stakeholders to provide input and recommendations to the Secretary, prior to finalizing implementation guidance for a covered water resources development law.</text></paragraph> 
<paragraph id="H5071C92DB07B45BFB2A3CAFF1097CD05"><enum>(2)</enum><header>Outreach</header><text display-inline="yes-display-inline">The Secretary may, as appropriate (as determined by the Secretary), reach out to non-Federal stakeholders and circulate drafts of implementation guidance for a covered water resources development law for informal feedback and recommendations.</text></paragraph></subsection> 
<subsection id="H7B9FD17AA15D4921894223DA49694273"><enum>(c)</enum><header>Development of guidance</header><text display-inline="yes-display-inline">When developing implementation guidance for a covered water resources development law, the Secretary shall take into consideration the input and recommendations received from non-Federal stakeholders, and make the final guidance available to the public on-line on a publicly accessible website.</text></subsection> 
<subsection id="H0CD232EC5C4046A8A749D68AF80F0413"><enum>(d)</enum><header>Covered water resources development law</header><text>In this section, the term <term>covered water resources development law</term> means—</text> 
<paragraph id="H7A9ADD5BDA1949FC8AE41F1394DF74F8"><enum>(1)</enum><text display-inline="yes-display-inline">the Water Resources Reform and Development Act of 2014;</text></paragraph> 
<paragraph id="H214EC393CF4F48E6A36A1ECC51040F90"><enum>(2)</enum><text display-inline="yes-display-inline">the Water Resources Development Act of 2016;</text></paragraph> 
<paragraph id="H707EE5D696844B608015EAB2F21D37FE"><enum>(3)</enum><text>this Act; and</text></paragraph> 
<paragraph id="HCDEF8142D5324A24B679CBF5AC45A25C"><enum>(4)</enum><text>any Federal water resources development law enacted after the date of enactment of this Act. </text></paragraph></subsection></section> 
<section id="HFE3658F8D54047F4B3EE0EA780ED4993"><enum>115.</enum><header>Comprehensive backlog report</header><text display-inline="no-display-inline">Section 1001(b)(4) of the Water Resources Development Act of 1986 (33 U.S.C. 579a(b)(4)) is amended—</text> 
<paragraph id="H45EF096C45AD4525AEEAE8EB77E31BAF"><enum>(1)</enum><text>in the header, by inserting <quote><header-in-text level="paragraph" style="OLC">and operation and maintenance</header-in-text></quote> after <quote><header-in-text level="paragraph" style="OLC">backlog</header-in-text></quote>;</text></paragraph> 
<paragraph id="H02E04B2EA6B746348998BB7C369F3224"><enum>(2)</enum><text display-inline="yes-display-inline">by amending subparagraph (A) to read as follows:</text>

<paragraph id="H28C904269C47492DB79A8A63B26338F3" commented="no"><enum>(3)</enum><text>in subparagraph (B)—</text>

<clause id="H8B36F1BBBA914CA0A624BE55E7BB6375"><enum>(iv)</enum><text>an estimate of unmet or deferred operation and maintenance needs at the project or property.</text></clause></subparagraph><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph> 
<paragraph id="H66E0976C547E49388B5F1A92AB8CA89B"><enum>(5)</enum><text>in subparagraph (D), as so redesignated—</text>

<section id="HB30CC444EBD64D3BB7B5B07A1FF12A61"><enum>117.</enum><header>Transparency in administrative expenses</header><text display-inline="no-display-inline">Section 1012(b)(1) of the Water Resources Reform and Development Act of 2014 (33 U.S.C. 2315a(b)(1)) is amended by striking <quote>The Secretary</quote> and inserting <quote>Not later than 1 year after the date of enactment of the <short-title>Water Resources Development Act of 2018</short-title>, the Secretary</quote>.</text></section> 
<section id="H0952B67D5B584A32A2F7583E4D68107A"><enum>118.</enum><header>Study of the future of the United States Army Corps of Engineers</header> 
<subsection id="HA890EEB8110341F9B2AAE0EF16C1844F"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary shall enter into an agreement with the National Academy of Sciences to convene a committee of experts to carry out a comprehensive study on—</text> 
<paragraph id="HBAAB0DF96162443A8333903281C1B0C7"><enum>(1)</enum><text>the ability of the Corps of Engineers to carry out its statutory missions and responsibilities, and the potential effects of transferring the functions (including regulatory obligations), personnel, assets, and civilian staff responsibilities of the Secretary relating to civil works from the Department of Defense to a new or existing agency or subagency of the Federal Government, including how such a transfer might affect the Federal Government’s ability to meet the current statutory missions and responsibilities of the Corps of Engineers; and</text></paragraph> 
<paragraph id="HD85B5323112B4B6BA65280D9BF40FFCC"><enum>(2)</enum><text display-inline="yes-display-inline">improving the Corps of Engineers’ project delivery processes, including recommendations for such improvements, taking into account factors including—</text> 
<subparagraph id="H919F5A4B3E5B47789D451F25452654E8"><enum>(A)</enum><text>the effect of the annual appropriations process on the ability of the Corps of Engineers to efficiently secure and carry out contracts for water resources projects and perform regulatory obligations; </text></subparagraph> 
<subparagraph id="H97B91F349AC140C7AAB1C6FAACB918E1"><enum>(B)</enum><text display-inline="yes-display-inline">the effect that the current Corps of Engineers leadership and geographic structure at the division and district levels has on its ability to carry out its missions in a cost-effective manner; and</text></subparagraph> 
<subparagraph id="H7EFC2ECCC92445FD9AE490B29354F1C4"><enum>(C)</enum><text display-inline="yes-display-inline">the effect of the frequency of rotations of senior leaders of the Corps of Engineers and how such frequency affects the function of the district.</text></subparagraph></paragraph></subsection> 
<subsection id="HAF6B1612528C4FB1BC0B56AF05027498"><enum>(b)</enum><header>Considerations</header><text>The study carried out under subsection (a) shall include consideration of—</text> 
<paragraph id="H635126A67C7A4AC3964BA068C5B55A17"><enum>(1)</enum><text>effects on the national security of the United States;</text></paragraph> 
<paragraph id="H9E95CFDC1A41407CB9C623E72D116A63"><enum>(2)</enum><text>the ability of the Corps of Engineers to maintain sufficient engineering capability and capacity to assist ongoing and future operations of the United States armed services; and</text></paragraph> 
<paragraph id="H9FAF8D62D0394E9295061F44A1C0CC32"><enum>(3)</enum><text>emergency and natural disaster response obligations of the Federal Government that are carried out by the Corps of Engineers.</text></paragraph></subsection> 
<subsection id="H63346A3B6F80441BB88D40FE31C6A55E"><enum>(c)</enum><header>Consultation</header><text>The agreement entered into under subsection (a) shall require the National Academy to, in carrying out the study, consult with—</text> 
<paragraph id="H0AC2C3A385D64FB195E179144E8E54B4"><enum>(1)</enum><text>the Department of Defense, including the Secretary of the Army and the Assistant Secretary of the Army for Civil Works;</text></paragraph> 
<paragraph id="HE293E94879DE456A923CA649A582B669"><enum>(2)</enum><text>the Department of Transportation;</text></paragraph> 
<paragraph id="HF718D5ADFDF440208D43889EDA3230D9"><enum>(3)</enum><text>the Environmental Protection Agency;</text></paragraph> 
<paragraph id="H041EC9E481174D88A3A6C9FB86BF69D4"><enum>(4)</enum><text>the Department of Homeland Security;</text></paragraph> 
<paragraph id="HDC2E6E03601B4F9293C3DCE770F5201B"><enum>(5)</enum><text>the Office of Management and Budget;</text></paragraph> 
<paragraph id="H3B9814535E6348CFBBD56265F5E5ACE7"><enum>(6)</enum><text>other appropriate Federal agencies;</text></paragraph> 
<paragraph id="HC70A753D2FD74B53B5E118407D187113"><enum>(7)</enum><text>professional and nongovernmental organizations; and</text></paragraph> 
<paragraph id="HE544CE949E634DECACDD42A8F5C9864B"><enum>(8)</enum><text>the Committee on Transportation and Infrastructure of the House of Representatives and the Committee on Environment and Public Works of the Senate.</text></paragraph></subsection> 
<subsection id="H1C1C5C4486A741028D7AA7BDCA532C80"><enum>(d)</enum><header>Submission to Congress</header><text>The Secretary shall submit the final report of the National Academy containing the findings of the study carried out under subsection (a) to the Committee on Transportation and Infrastructure of the House of Representatives and the Committee on Environment and Public Works of the Senate not later than 2 years after the date of enactment of this Act.</text></subsection></section> 
<section id="HE0F56352971048A796710DE8DC93B552" commented="no"><enum>119.</enum><header>Acknowledgment of credit</header><text display-inline="no-display-inline">Section 7007(a) of the Water Resources Development Act of 2007 (121 Stat. 1277; 128 Stat. 1226) is amended by adding at the end the following: <quote>Notwithstanding section 221(a)(4)(C)(i) of the Flood Control Act of 1970 (42 U.S.C. 1962d–5b(a)(4)(C)(i)), the Secretary may provide credit for work carried out during the period beginning on November 8, 2007, and ending on the date of enactment of the <short-title>Water Resources Development Act of 2018</short-title> by the non-Federal interest for a project under this title if the Secretary determines that the work is integral to the project and was carried out in accordance with the laws specified in section 5014(i)(2)(A) of the Water Resources Reform and Development Act of 2014 (128 Stat. 1331) and all other applicable Federal laws.</quote>.</text></section> 
<section id="HDCE914DA84D043F89A6B443584196E4C"><enum>120.</enum><header>Non-Federal implementation pilot program</header><text display-inline="no-display-inline">Section 1043(b)(8) of the Water Resources Reform and Development Act of 2014 (33 U.S.C. 2201 note(b)(8)) is amended by striking <quote>2015 through 2019</quote> and inserting <quote>2019 through 2023</quote>.</text></section> 
<section id="HEB98FCC0EEA34B298CA9083420B4AB19"><enum>121.</enum><header>Study of water resources development projects by non-Federal interests</header><text display-inline="no-display-inline">Section 203 of the Water Resources Development Act of 1986 (33 U.S.C. 2231) is amended—</text> 
<paragraph id="H3449F288F6044E63802029F03C16D651"><enum>(1)</enum><text>in subsection (a)(1), by inserting <quote>federally authorized</quote> before <quote>feasibility study</quote>;</text></paragraph> 
<paragraph id="HA2458CE1F76340EDA3A363EDA24736BA"><enum>(2)</enum><text>by amending subsection (c) to read as follows:</text>

<paragraph id="H16B3A1257A2A4AA98251F9B7875AFDB4"><enum>(1)</enum><header>Review and submission of studies to Congress</header><text display-inline="yes-display-inline">Not later than 180 days after the date of receipt of a feasibility study of a project under subsection (a)(1), the Secretary shall submit to the Committee on Environment and Public Works of the Senate and the Committee on Transportation and Infrastructure of the House of Representatives a report that describes—</text> 
<subparagraph id="HD63A5245176F4F23A1C09B2F2868F034"><enum>(A)</enum><text>the results of the Secretary’s review of the study under subsection (b), including a determination of whether the project is feasible;</text></subparagraph> 
<subparagraph id="HE86DD34896094C4485DD17D13364A645"><enum>(B)</enum><text>any recommendations the Secretary may have concerning the plan or design of the project; and</text></subparagraph> 
<subparagraph id="HFCBA0984DE9C4DD5847461F3DA28AB9C"><enum>(C)</enum><text>any conditions the Secretary may require for construction of the project.</text></subparagraph></paragraph> 
<paragraph id="H6CB42488951746CB9A5538670115C234"><enum>(2)</enum><header>Limitation</header><text display-inline="yes-display-inline">The completion of the review by the Secretary of a feasibility study that has been submitted under subsection (a)(1) may not be delayed as a result of consideration being given to changes in policy or priority with respect to project consideration.</text></paragraph></subsection><after-quoted-block>; and</after-quoted-block></quoted-block></paragraph> 
<paragraph id="HB3DBAF2813A347B8848B4990FBC4FD03"><enum>(3)</enum><text>by amending subsection (e) to read as follows:</text>

<subsection id="H4FF635DB30A640479DE1785950967B53"><enum>(e)</enum><header>Review and technical assistance</header> 
<paragraph id="H25D6516479534FD99DA25C00C994945A" commented="no"><enum>(1)</enum><header>Review</header><text>The Secretary may accept and expend funds provided by non-Federal interests to undertake reviews, inspections, certifications, and other activities that are the responsibility of the Secretary in carrying out this section.</text></paragraph> 
<paragraph id="H7E077B9ED0B745B3AEFD42D1A7186446"><enum>(2)</enum><header>Technical assistance</header><text>At the request of a non-Federal interest, the Secretary shall provide to the non-Federal interest technical assistance relating to any aspect of a feasibility study if the non-Federal interest contracts with the Secretary to pay all costs of providing such technical assistance.</text></paragraph> 
<paragraph id="H38ED14B65CEA45CE9917FDCDFCA7C494"><enum>(3)</enum><header>Limitation</header><text>Funds provided by non-Federal interests under this subsection shall not be eligible for credit under subsection (d) or reimbursement.</text></paragraph> 
<paragraph id="HDDBC00899E92431EBF94D8863B07A0B1"><enum>(4)</enum><header>Impartial decisionmaking</header><text>In carrying out this section, the Secretary shall ensure that the use of funds accepted from a non-Federal interest will not affect the impartial decisionmaking of the Secretary, either substantively or procedurally.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></section> 
<section id="H475AA3A9FBB04736B6ADD8534666C392" commented="no"><enum>122.</enum><header>Construction of water resources development projects by non-Federal interests</header><text display-inline="no-display-inline">Section 204 of the Water Resources Development Act of 1986 (33 U.S.C. 2232) is amended—</text> 
<paragraph id="H2B067C8E0D6C4D14A875CA40BC995AB6" commented="no"><enum>(1)</enum><text>in subsection (b)—</text> 
<subparagraph id="HE882E58B09A845259232151006D307DB"><enum>(A)</enum><text>in paragraph (1), in the matter preceding subparagraph (A), by inserting <quote>federally authorized</quote> before <quote>water resources development project</quote>;</text></subparagraph> 
<subparagraph id="H92CBA9FE8B344D7EA211ACE872B6841B"><enum>(B)</enum><text>in paragraph (2)(A), by inserting <quote>, except as provided in paragraph (3)</quote> before the semicolon; and</text></subparagraph> 
<subparagraph id="HE77FB36CC67A443395907863758B3752"><enum>(C)</enum><text>by adding at the end the following:</text>

<paragraph id="HA9BC471690274793A5BCC738973054CA"><enum>(3)</enum><header>Permit exception</header> 
<subparagraph id="H9E70158879FA4CB79EBDBA26A7DA0410"><enum>(A)</enum><header>In general</header><text display-inline="yes-display-inline">For a project described in subsection (a)(1) or subsection (a)(3), or a separable element thereof, with respect to which a written agreement described in subparagraph (B) has been entered into, a non-Federal interest that carries out a project under this section shall not be required to obtain any Federal permits or approvals that would not be required if the Secretary carried out the project or separable element unless significant new circumstances or information relevant to environmental concerns or compliance have arisen since development of the project recommendation.</text></subparagraph> 
<subparagraph id="HD3DD164E2EB5489FB4088A47DD59E0BD"><enum>(B)</enum><header>Written agreement</header><text display-inline="yes-display-inline">For purposes of this paragraph, a written agreement shall provide that the non-Federal interest shall comply with the same legal and technical requirements that would apply if the project or separable element were carried out by the Secretary, including all mitigation required to offset environmental impacts of the project or separable element as determined by the Secretary.</text></subparagraph> 
<subparagraph id="H9F930BE2689448A99935A49D0E457539"><enum>(C)</enum><header>Certifications</header><text display-inline="yes-display-inline">Notwithstanding subparagraph (A), if a non-Federal interest carrying out a project under this section would, in the absence of a written agreement entered into under this paragraph, be required to obtain a certification from a State under Federal law to carry out the project, such certification shall still be required if a written agreement is entered into with respect to the project under this paragraph.</text></subparagraph></paragraph><after-quoted-block>; and</after-quoted-block></quoted-block></subparagraph></paragraph> 
<paragraph id="HE0E28D794A934950A1F260579E8904ED" display-inline="no-display-inline"><enum>(2)</enum><text display-inline="yes-display-inline">in subsection (d)—</text>

<subsection id="H44C168E5D4D741658CEE339CE1AE9269"><enum>(a)</enum><header>Contributions by States and political subdivisions for immediate use on authorized flood-Control work; repayment</header><text display-inline="yes-display-inline">The Act of October 15, 1940 (54 Stat. 1176; 33 U.S.C. 701h–1) is amended—</text> 
<paragraph id="H496C0602E20F43B2BC9E78699C1088C6"><enum>(1)</enum><text>by striking <quote>a flood-control project duly adopted and authorized by law</quote> and inserting <quote>a federally authorized water resources development project,</quote>;</text></paragraph> 
<paragraph id="H9258CCA8362C45D2A2C74444D32CCF03"><enum>(2)</enum><text>by striking <quote>such work</quote> and inserting <quote>such project</quote>;</text></paragraph> 
<paragraph id="H4E9077464C2F4FC5A6047FD1B5B9268F"><enum>(3)</enum><text display-inline="yes-display-inline">by striking <quote>from appropriations which may be provided by Congress for flood-control work</quote> and inserting <quote>if appropriations are provided by Congress for such purpose</quote>; and</text></paragraph> 
<paragraph id="H751E87E67C954DFB8981E44B1B711738"><enum>(4)</enum><text>by adding at the end the following: <quote>For purposes of this Act, the term <term>State</term> means the several States, the District of Columbia, the commonwealths, territories, and possessions of the United States, and Indian tribes (as defined in section 4(e) of the Indian Self-Determination and Education Assistance Act (25 U.S.C. 5304(e))).</quote>.</text></paragraph></subsection> 
<subsection id="H562358FC33384C128E93FEC46B8BA339"><enum>(b)</enum><header>No adverse effect on processes</header><text display-inline="yes-display-inline">In implementing any provision of law that authorizes a non-Federal interest to provide, advance, or contribute funds to the Secretary for the development or implementation of a water resources development project (including sections 203 and 204 of the Water Resources Development Act of 1986 (33 U.S.C. 2231, 2232), section 5 of the Act of June 22, 1936 (33 U.S.C. 701h), and the Act of October 15, 1940 (33 U.S.C. 701h–1)), the Secretary shall ensure, to the maximum extent practicable, that the use by a non-Federal interest of such authorities does not adversely affect—</text> 
<paragraph id="H9DC2B6E82C594B1FBDFFE0C03DA5FDF5"><enum>(1)</enum><text display-inline="yes-display-inline">the process or timeline for development and implementation of other water resources development projects by other non-Federal entities that do not use such authorities; or</text></paragraph> 
<paragraph id="H181DC8CEB95B4054B7C131087E3E471E"><enum>(2)</enum><text>the process for including such projects in the President’s annual budget submission to Congress under section 1105(a) of title 31, United States Code.</text></paragraph></subsection> 
<subsection id="HE1DB615F689945D0A35B2F3A6F0182B2"><enum>(c)</enum><header>Advances by private parties; repayment</header><text display-inline="yes-display-inline">Section 11 of the Act of March 3, 1925 (Chapter 467; 33 U.S.C. 561) is repealed.</text></subsection></section> 
<section id="H4CF7E7BD93534F8C9F6B6CA9ED7069A7"><enum>124.</enum><header>Funding to process permits</header><text display-inline="no-display-inline">Section 214(a) of the Water Resources Development Act of 2000 (33 U.S.C. 2352(a)) is amended—</text> 
<paragraph id="H665B26C23CF743D29958FAB5B1DCF91A"><enum>(1)</enum><text>in paragraph (3), by striking <quote>10 years</quote> and inserting <quote>12 years</quote>; and</text></paragraph> 
<paragraph id="H840E1D19F5C84980A4B2BC3074B8ED77"><enum>(2)</enum><text>in paragraph (5)—</text> 
<subparagraph id="H622DA9A3BC674BD9B1467406AE1FBF97"><enum>(A)</enum><text>by striking <quote>4 years after the date of enactment of this paragraph</quote> and inserting <quote>December 31, 2022</quote>; and</text></subparagraph> 
<subparagraph id="H16114231C7BC471BA8784AD8D4F96C41"><enum>(B)</enum><text>by striking <quote>carry out a study</quote> and inserting <quote>carry out a followup study</quote>.</text></subparagraph></paragraph></section> 
<section id="HC996545ED69F4684888D58DA0648B2AE" commented="no"><enum>125.</enum><header>Study on economic and budgetary analyses</header> 
<subsection id="H3D374CE298F34F5B9AB61972F8C938DD" commented="no"><enum>(a)</enum><header>In general</header><text>Not later than 180 days after the date of enactment of this Act, the Secretary shall enter into an agreement with the National Academy of Sciences to—</text> 
<paragraph id="H5C6FF122BA414EFC99A096D4254558B1" commented="no"><enum>(1)</enum><text>carry out a study on the economic principles and analytical methodologies currently used by or applied to the Corps of Engineers to formulate, evaluate, and budget for water resources development projects; and</text></paragraph> 
<paragraph id="HC97A0EBBB8544E82B1A4B9C4682DA6DD" commented="no"><enum>(2)</enum><text>make recommendations to Congress on potential changes to such principles and methodologies to improve transparency, return on Federal investment, cost savings, and prioritization, in the formulation, evaluation, and budgeting of such projects.</text></paragraph></subsection> 
<subsection id="H0108A4FD74B24179901F80E2622A3A9B" commented="no"><enum>(b)</enum><header>Considerations</header><text>The study under subsection (a) shall include—</text> 
<paragraph id="H2EAFEEBA70B64BFD8522A5A1096BB2B6" commented="no"><enum>(1)</enum><text>an analysis of the current economic principles and analytical methodologies used by or applied to the Corps of Engineers in determining the total benefits and total costs during the formulation of, and plan selection for, a water resources development project;</text></paragraph> 
<paragraph id="H624FCB46AAF34D79B0A7D45862FA684D" commented="no"><enum>(2)</enum><text display-inline="yes-display-inline">an analysis of improvements or alternatives to how the Corps of Engineers utilizes the National Economic Development, Regional Economic Development, Environmental Quality, and Other Social Effects accounts developed by the Institute for Water Resources of the Corps of Engineers in the formulation of, and plan selection for, such projects;</text></paragraph> 
<paragraph id="H386A6CF86AC2416B96E28C4D22B5938C" commented="no"><enum>(3)</enum><text>an analysis of whether such principles and methodologies fully account for all of the potential benefits of project alternatives, including any reasonably associated benefits of such alternatives that are not contrary to law, Federal policy, or sound water resources management;</text></paragraph> 
<paragraph id="H372A87D44F124286B97C2DFE74BE0FF1" commented="no"><enum>(4)</enum><text display-inline="yes-display-inline">an analysis of whether such principles and methodologies fully account for all of the costs of project alternatives, including potential societal costs, such as lost ecosystem services, and full lifecycle costs for such alternatives; and</text></paragraph> 
<paragraph id="H8D866C43E7904BBB9FA60A1F2EDEE017" commented="no"><enum>(5)</enum><text>an analysis of the methodologies utilized by the Federal Government in setting and applying discount rates for benefit-cost analyses used in the formulation, evaluation, and budgeting of Corps of Engineers water resources development projects.</text></paragraph></subsection> 
<subsection id="HA9D7F6E5CC654CE598B96E5078CE8C6D" commented="no"><enum>(c)</enum><header>Publication</header><text>The agreement entered into under subsection (a) shall require the National Academy of Sciences to, not later than 30 days after the completion of the study—</text> 
<paragraph id="H9634366592A24504ADFED7379C53367E" commented="no"><enum>(1)</enum><text>submit a report containing the results of the study and the recommendations to the Committee on Environment and Public Works of the Senate and the Committee on Transportation and Infrastructure of the House of Representatives; and</text></paragraph> 
<paragraph id="H2C270A180EA34100AC000954123DF952" commented="no"><enum>(2)</enum><text>make a copy of such report available on a publicly accessible website.</text></paragraph></subsection> 
<subsection id="H34FAB4562CA347D0969ABD1F2075EEEF" commented="no"><enum>(d)</enum><header>Sense of Congress on budgetary evaluation metrics and transparency</header><text>It is the sense of Congress that the President, in the formulation of the annual budget request for the U.S. Army Corps of Engineers (Civil Works), should submit to Congress a budget that—</text> 
<paragraph id="HA6475C132CCB4C939018D636C79D15D8" commented="no"><enum>(1)</enum><text>aligns the assessment of the potential benefit-cost ratio for budgeting water resources development projects with that used by the Corps of Engineers during project plan formulation and evaluation pursuant to section 80 of the Water Resources Development Act of 1974 (42 U.S.C. 1962d–17); and</text></paragraph> 
<paragraph id="H8FAD4F4733884B9CAE1DE7FCF33624D3" commented="no"><enum>(2)</enum><text>demonstrates the transparent criteria and metrics utilized by the President in the evaluation and selection of water resources development projects included in the budget request.</text></paragraph></subsection></section> 
<section id="H82D527A1491B498380D3D096A6616F5D" display-inline="no-display-inline" section-type="subsequent-section"><enum>126.</enum><header>Study of corrosion management at Corps of Engineers projects</header> 
<subsection id="H769F1749694841B5A58F1FB5880EED31"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">Not later than 1 year after the date of enactment of this Act, the Comptroller General of the United States shall submit to the Committee on Transportation and Infrastructure of the House of Representatives and the Committee on Environment and Public Works of the Senate a study of corrosion management efforts at projects and properties under the control of the Corps of Engineers.</text></subsection> 
<subsection id="HFF0BF64279FE49B381ADA7F3E4050687"><enum>(b)</enum><header>Requirements</header><text>The study under subsection (a) shall include—</text> 
<paragraph id="HFFB16F8E5C2F42B9B9AC71BDF7FCE437"><enum>(1)</enum><text>an analysis of—</text> 
<subparagraph id="HBB00FBD132064ACCB049B3C43276C09C"><enum>(A)</enum><text>asset management protocols that are utilized by the Corps of Engineers, including protocols that examine both asset integrity and the integration of corrosion management efforts within the asset lifecycle, which includes the stages of design, manufacturing and construction, operation and maintenance, and decommissioning;</text></subparagraph> 
<subparagraph id="HB54F4BE3091A4E4E9E8382C3A75ACD8C"><enum>(B)</enum><text display-inline="yes-display-inline">available corrosion prevention technologies that may be used at projects and properties under the control of the Corps of Engineers;</text></subparagraph> 
<subparagraph id="H127E711E11B540D8AE91E5BC72E3D04B"><enum>(C)</enum><text display-inline="yes-display-inline">corrosion-related asset failures and the management protocols of the Corps of Engineers to incorporate lessons learned from such failures into work and management practices;</text></subparagraph> 
<subparagraph id="HF098D83B0F8249A3805ED7051709CC45"><enum>(D)</enum><text display-inline="yes-display-inline">training of Corps of Engineers employees with respect to, and best practices for, identifying and preventing corrosion at projects and properties under the control of the Corps of Engineers; and </text></subparagraph> 
<subparagraph id="H68F1BA5470074EF686F53C04897FA35D"><enum>(E)</enum><text>the estimated costs and anticipated benefits, including safety benefits, associated with the integration of corrosion management efforts within the asset lifecycle; and</text></subparagraph></paragraph> 
<paragraph id="H69554700B2114EB5A4473892CF3C2CB6"><enum>(2)</enum><text display-inline="yes-display-inline">a description of Corps of Engineers, stakeholder, and expert perspectives on the effectiveness of corrosion management efforts to reduce the incidence of corrosion at projects and properties under the control of the Corps of Engineers.</text></paragraph></subsection></section> 
<section id="HE32F05EF8395415BAAE015F6DD633BB7" commented="no" display-inline="no-display-inline" section-type="subsequent-section"><enum>127.</enum><header>Costs in excess of Federal participation limit</header><text display-inline="no-display-inline">Section 14 of the Flood Control Act of 1946 (33 U.S.C. 701r) is amended by inserting <quote>, and if such amount is not sufficient to cover the costs included in the Federal cost share for a project, as determined by the Secretary, the non-Federal interest shall be responsible for any such costs that exceed such amount</quote> before the period at the end.</text></section> 
<section id="H4F4DF4A16A35495F9997B0DCA70E31C9" display-inline="no-display-inline" section-type="subsequent-section"><enum>128.</enum><header>Report on innovative materials</header><text display-inline="no-display-inline">Not later than 1 year after the date of enactment of this Act, the Secretary shall submit to Congress a report that describes activities conducted by the Corps of Engineers at centers of expertise, technology centers, technical centers, research and development centers, and similar facilities and organizations relating to the testing, research, development, identification, and recommended uses for innovative materials in water resources development projects.</text></section> 
<section id="HA840FD6E29E946D5A37D961B5ACF232D" display-inline="no-display-inline" section-type="subsequent-section"><enum>129.</enum><header>Study on Corps of Engineers</header><text display-inline="no-display-inline">Not later than 180 days after the date of enactment of this Act, the Comptroller General of the United States shall submit to Congress a report that—</text> 
<paragraph id="H1CEA363E63234716BC3C25FEB585EF01"><enum>(1)</enum><text>describes the capacity and preparedness of the Corps of Engineers workforce, including challenges related to diversity, recruitment, retention, retirements, credentialing, professional development, on-the-job training, and other readiness-related gaps in ensuring a fully prepared 21st century Corps of Engineers workforce; and</text></paragraph> 
<paragraph id="H2D5F953A92D84BE69526D2E83AEB4B1C"><enum>(2)</enum><text>contains an assessment of the existing technology used by the Corps of Engineers, the effects of inefficiencies in the Corps’ current technology usage, and recommendations for improved technology or tools to accomplish its missions and responsibilities.</text></paragraph></section> 
<section id="H8DD70F43ACE34C46A6EF22B62CBED8A7" display-inline="no-display-inline" section-type="subsequent-section"><enum>130.</enum><header>GAO study</header> 
<subsection id="H2427832A68D741E985AF72DB76F16AA7"><enum>(a)</enum><header>In general</header><text>Not later than 2 years after the date of enactment of this Act, the Comptroller General of the United States shall submit to the Committee on Environment and Public Works of the Senate and the Committee on Transportation and Infrastructure of the House of Representatives a study of the consideration by the Corps of Engineers of natural features and nature-based features in the study of the feasibility of projects for flood risk management, hurricane and storm damage reduction, and ecosystem restoration.</text></subsection> 
<subsection id="HD45823189A2742D4AFFBBD1C11322F08"><enum>(b)</enum><header>Considerations</header><text>The study under subsection (a) shall include—</text> 
<paragraph id="HDA3A1D8C322543BA9A08F573F75BC7A8"><enum>(1)</enum><text>a description of guidance or instructions issued, and other measures taken, by the Secretary and the Chief of Engineers to consider natural features and nature-based features in project feasibility studies;</text></paragraph> 
<paragraph id="H123444A650314E2B9198A37EF819EC38"><enum>(2)</enum><text>an assessment of the costs, benefits, impacts, and trade-offs associated with natural features and nature-based features recommended by the Secretary for flood risk reduction, hurricane and storm damage reduction, and ecosystem restoration projects, and the effectiveness of those natural features and nature-based features;</text></paragraph> 
<paragraph id="H91089FBE4FC44268BFDED4543A40A4B1"><enum>(3)</enum><text>a description of any statutory, fiscal, regulatory, or other policy barriers to the appropriate consideration and use of a full array of natural features and nature-based features; and</text></paragraph> 
<paragraph id="HCF5D6DF4C12944B9ACA96BD798EC8200"><enum>(4)</enum><text>any recommendations for changes to statutory, fiscal, regulatory, or other policies to improve the use of natural features and nature-based features by the Corps of Engineers.</text></paragraph></subsection> 
<subsection id="HD446C813D4AC427190C9B54F677076C6"><enum>(c)</enum><header>Definitions</header><text display-inline="yes-display-inline">In this section, the terms <term>natural feature</term> and <term>nature-based feature</term> have the meanings given such terms in section 1184 of the Water Resources Development Act of 2016 (33 U.S.C. 2289a).</text></subsection></section> 
<section id="HBF0711C44EAF4B959E7DBB8F08B48CF8"><enum>131.</enum><header>GAO report on Alaska Native village relocation efforts due to flooding and erosion threats</header> 
<subsection id="H907C5A45D33C4415AFDCF3571243F65A"><enum>(a)</enum><header>Definition of Alaska Native village</header><text>In this section, the term <term>Alaska Native village</term> means a Native village that has a Village Corporation (as those terms are defined in section 3 of the Alaska Native Claims Settlement Act (43 U.S.C. 1602)).</text></subsection> 
<subsection id="HE6CBFD6DF7564895AD1A3E606EEABB28"><enum>(b)</enum><header>Report</header><text>The Comptroller General of the United States shall submit to Congress a report on efforts to relocate Alaska Native villages due to flooding and erosion threats that updates the report of the Comptroller General entitled <quote>Alaska Native Villages: Limited Progress Has Been Made on Relocating Villages Threatened by Flooding and Erosion</quote>, dated June 2009.</text></subsection> 
<subsection id="HAB6D1706648046DCA5654FB2F3AE5649"><enum>(c)</enum><header>Inclusions</header><text>The report under subsection (b) shall include—</text> 
<paragraph id="H298FDC3C4B334A32B0C9B0E371B369DB"><enum>(1)</enum><text>a summary of flooding and erosion threats to Alaska Native villages throughout the State of Alaska, based on information from—</text> 
<subparagraph id="H093008D0886E44A390D22026958FBC14"><enum>(A)</enum><text>the Corps of Engineers;</text></subparagraph> 
<subparagraph id="HF189526C33A24926849829C25E83B135"><enum>(B)</enum><text>the Denali Commission; and</text></subparagraph> 
<subparagraph id="H6D434D65ADD74A848D2E5A24FF7AF661"><enum>(C)</enum><text>any other relevant sources of information as the Comptroller General determines to be appropriate;</text></subparagraph></paragraph> 
<paragraph id="H9A90C131AA4E4FD1BC4007A64DCEB100"><enum>(2)</enum><text>the status of efforts to relocate Alaska Native villages due to flooding and erosion threats; and</text></paragraph> 
<paragraph id="HB9187AD8A66046A5BB74B657217ACA1D"><enum>(3)</enum><text>any other issues relating to flooding and erosion threats to, or relocation of, Alaska Native villages, as the Comptroller General determines to be appropriate.</text></paragraph></subsection></section> 
<section id="H98DEC29E407B4744AD6714B5E14FF82D"><enum>132.</enum><header>Study and report on expediting certain waiver processes</header><text display-inline="no-display-inline">Not later than 1 year after the date of enactment of this Act, the Secretary shall complete and submit to the Committee on Environment and Public Works of the Senate and the Committee on Transportation and Infrastructure of the House of Representatives a report based on the results of a study on the best options available to the Secretary to implement the waiver process for the non-Federal cost share under section 116 of the Energy and Water Development and Related Agencies Appropriations Act, 2010 (Public Law 111–85; 123 Stat. 2851).</text></section> 
<section id="H47A322B06146466D93A9D5119B8D485D" display-inline="no-display-inline" section-type="subsequent-section"><enum>133.</enum><header>Corps of Engineers continuing authorities program</header><text display-inline="no-display-inline">Section 107 of the River and Harbor Act of 1960 (33 U.S.C. 577) is amended—</text> 
<paragraph id="H1D99876943744E8BBE685E11A96B34E4"><enum>(1)</enum><text>in subsection (a), by striking <quote>$50,000,000</quote> and inserting <quote>$62,500,000</quote>; and</text></paragraph>

<subsection id="HDA2D568C1BB74C3782CFCC177D11218B"><enum>(a)</enum><header>Requests for credits</header><text display-inline="yes-display-inline">With respect to an authorized flood damage reduction project, or separable element thereof, that has been constructed by a non-Federal interest under section 211 of the Water Resources Development Act of 1996 (33 U.S.C. 701b–13), or an authorized coastal navigation project that has been constructed by the Corps of Engineers pursuant to section 11 of the Act of March 3, 1925, before the date of enactment of the Water Resources Development Act of 2018, the Secretary may provide to the non-Federal interest, at the request of the non-Federal interest, a credit in an amount equal to the estimated Federal share of the cost of the project or separable element, in lieu of providing to the non-Federal interest a reimbursement in that amount.</text></subsection> 
<subsection id="H609FA665DCD1420BBB4762BC8E5D4A73"><enum>(b)</enum><header>Application of credits</header><text display-inline="yes-display-inline">At the request of the non-Federal interest, the Secretary may apply such credit to the share of the cost of the non-Federal interest of carrying out other flood damage reduction and coastal navigation projects or studies.</text></subsection></section><after-quoted-block>.</after-quoted-block></quoted-block></section> 
<section id="HCEDFBFC6B1E547E981BF7EE9254465B0"><enum>135.</enum><header>Lake Okeechobee regulation schedule review</header><text display-inline="no-display-inline">The Secretary, acting through the Chief of Engineers, shall expedite completion of the Lake Okeechobee regulation schedule to coincide with the completion of the Herbert Hoover Dike project, and may consider all relevant aspects of the Comprehensive Everglades Restoration Plan described in section 601 of the Water Resources Development Act of 2000 (114 Stat. 2680).</text></section> 
<section id="H90188736F0074FF2923B8CBE2E620A05" section-type="subsequent-section"><enum>136.</enum><header>Missouri River</header> 
<subsection id="H0E882C7F4FFE4BABB95135D6410CC741"><enum>(a)</enum><header>IRC report</header><text display-inline="yes-display-inline">Not later than 18 months after the date of enactment of this Act, the Secretary shall submit to the Committee on Transportation and Infrastructure of the House of Representatives and the Committee on Environment and Public Works of the Senate a report regarding the impacts of interception-rearing complex construction on the navigation, flood control, and other authorized purposes set forth in the Missouri River Master Manual, and on the population recovery of the pallid sturgeon.</text></subsection> 
<subsection id="HF0B7AA1439BB48C1A00E94B3993FE54B"><enum>(b)</enum><header>No additional IRC construction</header><text display-inline="yes-display-inline">Until the report under subsection (a) is submitted, no additional interception-rearing complex construction is authorized.</text></subsection></section> 
<section id="H6AD9354F16304B23855527ABA4F85A15" display-inline="no-display-inline" section-type="subsequent-section"><enum>137.</enum><header>Access to real estate data</header> 
<subsection id="HA72964D2336A4853BA933CB344E4FCCC"><enum>(a)</enum><header>In general</header><text>As soon as is practicable, using available funds, the Secretary shall make publicly available, including on a publicly accessible website, information relating to all real property with respect to which the Corps of Engineers holds an interest. The information shall include standardized real estate plat descriptions and geospatial information.</text></subsection> 
<subsection id="HD75AEDF0027D47B7BDC1B82B3CCD426C"><enum>(b)</enum><header>Limitation</header><text>Nothing in this section may be construed to compel or authorize the disclosure of data or other information determined by the Secretary to be confidential, privileged, national security, or personal information, or information the disclosure of which is otherwise prohibited by law.</text></subsection></section> 
<section id="H7A426F91F2D94E6FB12C2436988D618C"><enum>138.</enum><header>Aquatic invasive species research</header> 
<subsection id="HBE4E1684DB3C449F985AB782D0FA8D37"><enum>(a)</enum><header>In General</header><text>As part of the ongoing activities of the Engineer Research and Development Center to address the spread and impacts of aquatic invasive species, the Secretary shall undertake research on the management and eradication of aquatic invasive species, including Asian carp and zebra mussels.</text></subsection> 
<subsection id="H59256511D60146889232694E7C47598F"><enum>(b)</enum><header>Locations</header><text>In carrying out subsection (a), the Secretary shall work with Corps of Engineers district offices representing diverse geographical regions of the continental United States that are impacted by aquatic invasive species, such as the Atlantic, Pacific, and Gulf coasts and the Great Lakes.</text></subsection> 
<subsection id="HFA0E3A320D9C4AA587A2CE1E9D653DFF"><enum>(c)</enum><header>Report</header><text>Not later than 180 days after the date of enactment of this section, the Secretary shall submit to the Committee on Transportation and Infrastructure of the House of Representatives and the Committee on Environment and Public Works of the Senate a report recommending a plan to address the spread and impacts of aquatic invasive species.</text></subsection></section> 
<section id="HE2B5CBBC711644E2BC315E730A17ACC3" section-type="subsequent-section"><enum>139.</enum><header>Harmful algal bloom technology demonstration</header> 
<subsection id="H6E304CD3637646EAACFCA44A9E6A5676"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary, acting through the Engineer Research and Development Center of the Chief of Engineers, shall implement a 5-year harmful algal bloom technology development demonstration under the Aquatic Nuisance Research Program. To the extent practicable, the Corps of Engineers shall support research that will identify and develop improved strategies for early detection, prevention, and management techniques and procedures to reduce the occurrence and effects of harmful algal blooms in the Nation’s water resources.</text></subsection> 
<subsection id="H25D62F8E1F1F460BA928F0A4969BD314"><enum>(b)</enum><header>Scalability requirement</header><text display-inline="yes-display-inline">The Secretary shall ensure that technologies identified, tested, and deployed under the harmful algal bloom program technology development demonstration have the ability to scale up to meet the needs of harmful-algal-bloom-related events.</text></subsection></section> 
<section id="H018B6F162D884D19BA5D1342DD7B4140" display-inline="no-display-inline" section-type="subsequent-section"><enum>140.</enum><header>Bubbly Creek, Chicago ecosystem restoration</header><text display-inline="no-display-inline">The Secretary shall enter into a memorandum of understanding with the Administrator of the Environmental Protection Agency to facilitate ecosystem restoration activities at the South Fork of the South Branch of the Chicago River (commonly known as Bubbly Creek).</text></section>

<section id="H4418B16848374C1481B2D9A6B59736A9"><enum>203.</enum><header>Expedited completion of reports for certain projects</header> 
<subsection id="H47E7B180AF654052B5DB31B1A9FA2EC8"><enum>(a)</enum><header>Feasibility reports</header><text>The Secretary shall expedite the completion of a feasibility study for each of the following projects, and if the Secretary determines that the project is justified in a completed report, may proceed directly to preconstruction planning, engineering, and design of the project:</text>

<subsection id="HA7E3BDF74AAB4374B554E3242EB594AC"><enum>(c)</enum><header>Post-authorization change reports</header><text>The Secretary shall expedite completion of a post-authorization change report for the following projects:</text>

<subsection id="HC0B0C011516B4A7E83B984BAB6A351F6"><enum>(d)</enum><header>Considerations</header><text display-inline="yes-display-inline">In carrying out a disposition study with respect to the Upper St. Anthony Falls Lock and Dam, including a disposition study under section 216 of the Flood Control Act of 1970 (33 U.S.C. 549a), the Secretary may not complete such study until the Secretary considers, and issues a report to the Committee on Transportation and Infrastructure of the House of Representatives and the Committee on Environment and Public Works of the Senate on—</text> 
<paragraph id="HF74BF99F25504AB8BB16D68B3AE3A1BE"><enum>(1)</enum><text>the feasibility of carrying out modifications to the Upper St. Anthony Falls Lock and Dam to—</text> 
<subparagraph id="H2B940175B23C422B90E347027D6A1042"><enum>(A)</enum><text>preserve and enhance recreational opportunities and the health of the ecosystem; and</text></subparagraph> 
<subparagraph id="H38CB92B4D7144409A652F1ACAA9B2B23"><enum>(B)</enum><text>maintain the benefits to the natural ecosystem and human environment; and</text></subparagraph></paragraph> 
<paragraph id="H5B6AC1404D6647709AD082D356427B88"><enum>(2)</enum><text>the preservation of any portion of the Upper St. Anthony Falls Lock and Dam necessary to maintain flood control.</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section></title> 
<title id="HF6BCA9DCBDA34D3F8A6B3D012D347426"><enum>III</enum><header>Deauthorizations, Modifications, and Related Provisions</header> 
<section id="HC5DBBC63233A4C3DBE800BD5500AFA34" commented="no"><enum>301.</enum><header><italic/>Deauthorization of inactive projects</header> 
<subsection id="HD474A087F87B49B78A7E37D995AB5262" commented="no"><enum>(a)</enum><header>Purposes</header><text display-inline="yes-display-inline">The purposes of this section are—</text> 
<paragraph id="HC7033A984CFD4AE78BE8DB580609A7F6" commented="no"><enum>(1)</enum><text>to identify $3,000,000,000 in water resources development projects authorized by Congress that are no longer viable for construction due to—</text> 
<subparagraph id="HBC73940FBB124664A0F7446D0B86CA41" commented="no"><enum>(A)</enum><text>a lack of local support;</text></subparagraph> 
<subparagraph id="H7C26005151EF4C5AAEE3D237B277303C" commented="no"><enum>(B)</enum><text>a lack of available Federal or non-Federal resources; or</text></subparagraph> 
<subparagraph id="H5FA63E0628624CBDB6C43950501DA9B3" commented="no"><enum>(C)</enum><text>an authorizing purpose that is no longer relevant or feasible;</text></subparagraph></paragraph> 
<paragraph id="H47F079B3187849EF928DE3D39935A5BF" commented="no"><enum>(2)</enum><text>to create an expedited and definitive process for Congress to deauthorize water resources development projects that are no longer viable for construction; and</text></paragraph> 
<paragraph id="H6A046E40DCB040D98D3161CF2B6B3440" commented="no"><enum>(3)</enum><text>to allow the continued authorization of water resources development projects that are viable for construction.</text></paragraph></subsection> 
<subsection id="HEB238E076E344B95B62178A1D422BB39" commented="no"><enum>(b)</enum><header>Interim deauthorization list</header> 
<paragraph id="H7591D96E0CD244F1B17EE4242669F461" commented="no"><enum>(1)</enum><header>In general</header><text display-inline="yes-display-inline">The Secretary shall develop an interim deauthorization list that identifies—</text> 
<subparagraph id="HF2E4C0F4681A4D37BF3086BBD0512E84" commented="no"><enum>(A)</enum><text>each water resources development project, or separable element of a project, authorized for construction before November 8, 2007, for which—</text> 
<clause id="H5C4974D0BA194D538B3BF1D8556C1048" commented="no"><enum>(i)</enum><text>planning, design, or construction was not initiated before the date of enactment of this Act; or</text></clause> 
<clause id="H05D02BF62CFA4437A082B7FD378CF2A5" commented="no"><enum>(ii)</enum><text>planning, design, or construction was initiated before the date of enactment of this Act, but for which no funds, Federal or non-Federal, were obligated for planning, design, or construction of the project or separable element of the project during the current fiscal year or any of the 6 preceding fiscal years; </text></clause></subparagraph> 
<subparagraph id="HBB05284CE08E4A6FAEB6699218ED3F05" commented="no"><enum>(B)</enum><text>each project or separable element identified and included on a list to Congress for deauthorization pursuant to section 1001(b)(2) of the Water Resources Development Act of 1986 (33 U.S.C. 579a(b)(2)); and</text></subparagraph> 
<subparagraph id="HD80EFE8AF0F841068169EA2DBF5F5CC3"><enum>(C)</enum><text display-inline="yes-display-inline">any project or separable element for which the non-Federal sponsor of such project or separable element submits a request for inclusion on the list.</text></subparagraph></paragraph> 
<paragraph id="H4F2B2BCF4C98417AA30D24B56F3F5FDA" commented="no"><enum>(2)</enum><header>Public comment and consultation</header> 
<subparagraph id="HF164C22FA58341B0B76DC4ACC49769E2" commented="no"><enum>(A)</enum><header>In general</header><text>The Secretary shall solicit comments from the public and the Governors of each applicable State on the interim deauthorization list developed under paragraph (1).</text></subparagraph> 
<subparagraph id="HB894EB5CEBF94FA0A0F1AA8601AB8B52" commented="no"><enum>(B)</enum><header>Comment period</header><text>The public comment period shall be 90 days.</text></subparagraph></paragraph> 
<paragraph id="HE2320B4780734E7BB3F82F557548722C" commented="no"><enum>(3)</enum><header>Submission to Congress; publication</header><text>Not later than 90 days after the date of the close of the comment period under paragraph (2), the Secretary shall—</text> 
<subparagraph id="H075084D98F3346C6A38E8D118140E8FC" commented="no"><enum>(A)</enum><text>submit a revised interim deauthorization list to the Committee on Environment and Public Works of the Senate and the Committee on Transportation and Infrastructure of the House of Representatives; and</text></subparagraph> 
<subparagraph id="H935C3BB578FD4E2391DD1ED51C7DF4D9" commented="no"><enum>(B)</enum><text>publish the revised interim deauthorization list in the Federal Register.</text></subparagraph></paragraph></subsection> 
<subsection id="H548CFB54841E40E4AD26869DE0F55E86" commented="no"><enum>(c)</enum><header>Final deauthorization list</header> 
<paragraph id="H736CDA1412C7427EAACE4BA8112368EB" commented="no"><enum>(1)</enum><header>In general</header><text>The Secretary shall develop a final deauthorization list of water resources development projects, or separable elements of projects, from the revised interim deauthorization list described in subsection (b)(3).</text></paragraph> 
<paragraph id="H2FBC0CF7159548AA9269E3580091A9BF" commented="no"><enum>(2)</enum><header>Deauthorization amount</header> 
<subparagraph id="H144B0BDEFFC048E3B5A1E9A870798E2F" commented="no"><enum>(A)</enum><header>Proposed final list</header><text>The Secretary shall prepare a proposed final deauthorization list of projects and separable elements of projects that have, in the aggregate, an estimated Federal cost to complete that is at least $3,000,000,000.</text></subparagraph> 
<subparagraph id="H73082083948B440189EFA319A2A5A666" commented="no"><enum>(B)</enum><header>Determination of Federal cost to complete</header><text>For purposes of subparagraph (A), the Federal cost to complete shall take into account any allowances authorized by section 902 of the Water Resources Development Act of 1986 (33 U.S.C. 2280), as applied to the most recent project schedule and cost estimate.</text></subparagraph></paragraph> 
<paragraph id="H5C067315DF804ACD91FD3DE33763E283" commented="no"><enum>(3)</enum><header>Identification of projects</header> 
<subparagraph id="H5CCDDF898B384D099318ECE66E7EC672" commented="no"><enum>(A)</enum><header>Sequencing of projects</header> 
<clause id="H3C8B4490D6524D6C9014BEA84A895467" commented="no"><enum>(i)</enum><header>In general</header><text>The Secretary shall identify projects and separable elements of projects for inclusion on the proposed final deauthorization list according to the order in which the projects and separable elements of the projects were authorized, beginning with the earliest authorized projects and separable elements of projects and ending with the latest project or separable element of a project necessary to meet the aggregate amount under paragraph (2)(A).</text></clause> 
<clause id="H37EAD93CCC004571B4A897461B8CEDB5" commented="no"><enum>(ii)</enum><header>Factors to consider</header><text>The Secretary may identify projects and separable elements of projects in an order other than that established by clause (i) if the Secretary determines, on a case-by-case basis, that a project or separable element of a project is critical for interests of the United States, based on the possible impact of the project or separable element of the project on public health and safety, the national economy, or the environment.</text></clause> 
<clause id="H00DFB800C47643EAAD33A35A64FA9406" commented="no"><enum>(iii)</enum><header>Consideration of public comments</header><text>In making determinations under clause (ii), the Secretary shall consider any comments received under subsection (b)(2).</text></clause></subparagraph> 
<subparagraph id="H152CE945E9BE42DB92A9ED5F1D3E863F" commented="no"><enum>(B)</enum><header>Appendix</header><text>The Secretary shall include as part of the proposed final deauthorization list an appendix that—</text> 
<clause id="HC0350FB87BC04B30A0A03FC6DDF0D042" commented="no"><enum>(i)</enum><text>identifies each project or separable element of a project on the interim deauthorization list developed under subsection (b) that is not included on the proposed final deauthorization list; and</text></clause> 
<clause id="H6EC45B27E21D4ADABF4C2AC26FAAF1B0" commented="no"><enum>(ii)</enum><text>describes the reasons why the project or separable element is not included on the proposed final list.</text></clause></subparagraph></paragraph> 
<paragraph id="HE1BC8F6FF3EE40DD907993878B1B2F7B" commented="no"><enum>(4)</enum><header>Public comment and consultation</header> 
<subparagraph id="H17F788C1901C4331A3996F9BA4402F34" commented="no"><enum>(A)</enum><header>In general</header><text>The Secretary shall solicit comments from the public and the Governor of each applicable State on the proposed final deauthorization list and appendix developed under paragraphs (2) and (3).</text></subparagraph> 
<subparagraph id="H8C124F96775D455990B800636B0DD7F7" commented="no"><enum>(B)</enum><header>Comment period</header><text>The public comment period shall be 90 days.</text></subparagraph></paragraph> 
<paragraph id="HE13FD96C7F7D4FCE91D9B06EB16CB0C0" commented="no"><enum>(5)</enum><header>Submission of final list to Congress; publication</header><text>Not later than 120 days after the date of the close of the comment period under paragraph (4), the Secretary shall—</text> 
<subparagraph id="H7BBF14E34E8542DBBF55173192F770C3" commented="no"><enum>(A)</enum><text>submit a final deauthorization list and an appendix to the final deauthorization list in a report to the Committee on Environment and Public Works of the Senate and the Committee on Transportation and Infrastructure of the House of Representatives; and</text></subparagraph> 
<subparagraph id="H67AF5B23F8E14A1CAA4BD3A676F8620D" commented="no"><enum>(B)</enum><text>publish the final deauthorization list and the appendix to the final deauthorization list in the Federal Register.</text></subparagraph></paragraph></subsection> 
<subsection id="HA2C15DFB41384549A8A4518FBD34C435" commented="no"><enum>(d)</enum><header>Deauthorization; Congressional review</header> 
<paragraph id="HD38DB7795D064B77A5E8F563B3091D9C" commented="no"><enum>(1)</enum><header>In general</header><text>After the expiration of the 180-day period beginning on the date of submission of the final deauthorization list and appendix under subsection (c), a project or separable element of a project identified in the final deauthorization list is hereby deauthorized, unless Congress passes a joint resolution disapproving the final deauthorization list prior to the end of such period.</text></paragraph> 
<paragraph id="H5CD4085F680B4234837E3C2C1E22C502" commented="no"><enum>(2)</enum><header>Non-Federal contributions</header> 
<subparagraph id="H42F6AF7E47DF4410A207D43E1BAF2D3B" commented="no"><enum>(A)</enum><header>In general</header><text>A project or separable element of a project identified in the final deauthorization list under subsection (c) shall not be deauthorized under this subsection if, before the expiration of the 180-day period referred to in paragraph (1), the non-Federal interest for the project or separable element of the project provides sufficient funds to complete the project or separable element of the project.</text></subparagraph> 
<subparagraph id="H903ADF448EE248EDA2AC3EF854F96597" commented="no"><enum>(B)</enum><header>Treatment of projects</header><text>Notwithstanding subparagraph (A), each project and separable element of a project identified in the final deauthorization list shall be treated as deauthorized for purposes of the aggregate deauthorization amount specified in subsection (c)(2)(A).</text></subparagraph></paragraph> 
<paragraph id="H8BDB4A06EB164F94BC4DB2B5BCA350C1" commented="no"><enum>(3)</enum><header>Projects identified in appendix</header><text>A project or separable element of a project identified in the appendix to the final deauthorization list shall remain subject to future deauthorization by Congress.</text></paragraph></subsection> 
<subsection id="H94C0A4FFA1F440509D2BD4F8BE06727A" commented="no"><enum>(e)</enum><header>Special rule for projects receiving funds for post-authorization study</header><text display-inline="yes-display-inline">A project or separable element of a project may not be identified on the interim deauthorization list developed under subsection (b), or the final deauthorization list developed under subsection (c), if the project or separable element received funding for a post-authorization study during the current fiscal year or any of the 6 preceding fiscal years.</text></subsection> 
<subsection id="H1E8ECD8C72AF4DDE93F25A85BE45B0F7" commented="no"><enum>(f)</enum><header>General provisions</header> 
<paragraph id="H585EF77C8C6A4E6C9152952C696DF312" commented="no"><enum>(1)</enum><header>Definitions</header><text>In this section, the following definitions apply:</text> 
<subparagraph id="HBEE758A0BA274429965AAFA6A373EF52" commented="no"><enum>(A)</enum><header>Post-authorization study</header><text>The term <term>post-authorization study</term> means—</text> 
<clause id="H07FE58BABA3C49E28C2BE601582DD581" commented="no"><enum>(i)</enum><text>a feasibility report developed under section 905 of the Water Resources Development Act of 1986 (33 U.S.C. 2282);</text></clause> 
<clause id="HF9C5320C24A045948D2845729705255A" commented="no"><enum>(ii)</enum><text>a feasibility study, as defined in section 105(d) of the Water Resources Development Act of 1986 (33 U.S.C. 2215(d)); or</text></clause> 
<clause id="H0056B784BC3748BCB6A683AF6B33CF7E" commented="no"><enum>(iii)</enum><text>a review conducted under section 216 of the Flood Control Act of 1970 (33 U.S.C. 549a), including an initial appraisal that—</text> 
<subclause id="H7287D0DD30F34D1185CAF5425AA0AC0F" commented="no"><enum>(I)</enum><text>demonstrates a Federal interest; and</text></subclause> 
<subclause id="H446ED4E6CC9C49F69B41F8E1C0B08CC3" commented="no"><enum>(II)</enum><text>requires additional analysis for the project or separable element.</text></subclause></clause></subparagraph> 
<subparagraph id="HD298A15127E34F20B75004C8DFD3A37E" commented="no"><enum>(B)</enum><header>Water resources development project</header><text>The term <term>water resources development project</term> includes an environmental infrastructure assistance project or program of the Corps of Engineers.</text></subparagraph></paragraph> 
<paragraph id="H511DD5D4280C40AEB73D789B1081F558" commented="no"><enum>(2)</enum><header>Treatment of project modifications</header><text>For purposes of this section, if an authorized water resources development project or separable element of the project has been modified by an Act of Congress, the date of the authorization of the project or separable element shall be deemed to be the date of the most recent modification.</text></paragraph></subsection></section> 
<section id="H9D3477B8C14F43A38C78332DE5212A19"><enum>302.</enum><header>Backlog prevention</header> 
<subsection id="H2A011FCEF90946DEAC82CFBF3F4758C4"><enum>(a)</enum><header>Project deauthorization</header> 
<paragraph id="H8449E7B7319B4E4AA2BDCB3F96F03AFF"><enum>(1)</enum><header>In general</header><text>A water resources development project, or separable element of such a project, authorized for construction by this Act shall not be authorized after the last day of the 10-year period beginning on the date of enactment of this Act unless—</text> 
<subparagraph id="H4AF7654B72D04CB9B82F7759EAE8D5BF"><enum>(A)</enum><text>funds have been obligated for construction of, or a post-authorization study for, such project or separable element during that period; or</text></subparagraph> 
<subparagraph id="HD9F0CD60E20C447DAAA58D81B3F5D197" commented="no"><enum>(B)</enum><text>the authorization contained in this Act has been modified by a subsequent Act of Congress.</text></subparagraph></paragraph> 
<paragraph id="HADE846F7831B49698213495EAD9CF0FA"><enum>(2)</enum><header>Identification of projects</header><text>Not later than 60 days after the expiration of the 10-year period referred to in paragraph (1), the Secretary shall submit to the Committee on Environment and Public Works of the Senate and the Committee on Transportation and Infrastructure of the House of Representatives a report that identifies the projects deauthorized under paragraph (1).</text></paragraph></subsection> 
<subsection id="HD66BB797141F4570A4E214FDC3E131B1"><enum>(b)</enum><header>Report to Congress</header><text>Not later than 60 days after the expiration of the 12-year period beginning on the date of enactment of this Act, the Secretary shall submit to the Committee on Environment and Public Works of the Senate and the Committee on Transportation and Infrastructure of the House of Representatives, and make available to the public, a report that contains—</text> 
<paragraph id="H5778757C317A43128067EDB8922AE092"><enum>(1)</enum><text>a list of any water resources development projects authorized by this Act for which construction has not been completed during that period;</text></paragraph>

<paragraph id="H3ADA010C0FD04A7F8F4E920006B3E3C7"><enum>(1)</enum><header>Conveyance authorized</header><text>The Secretary may convey, without consideration, to the City of Nashville, Tennessee (in this subsection referred to as the <quote>City</quote>), all right, title, and interest of the United States in and to the real property covered by Lease No. DACW62–1–84–149, including any improvements thereon, at the Riverfront Park Recreational Development, consisting of approximately 5 acres, subject to the right of the Secretary to retain any required easements in the property.</text></paragraph> 
<paragraph id="HCC10966182AE48CEBED2E351176AC3BE"><enum>(2)</enum><header>Conveyance agreement</header><text>A quit claim deed shall be used to convey real property under this subsection upon the terms and conditions mutually satisfactory to the Secretary and the City. The deed shall provide that in the event the City, its successors, or assigns cease to maintain improvements for recreation included in the conveyance or otherwise utilize the real property conveyed for purposes other than recreation and compatible flood risk management, the City, its successor, or assign shall repay to the United States the Federal share of the cost of constructing the improvements for recreation under the agreement between the United States and the City dated December 8, 1981, increased as necessary to account for inflation.</text></paragraph></subsection> 
<subsection id="H38A69EAB1A6942D7882BF0459956AE6B"><enum>(c)</enum><header>Generally applicable provisions</header><text/> 
<paragraph id="H2D0EFCFED44C410F929639C7C42C427C"><enum>(1)</enum><header>Survey to obtain legal description</header><text>The exact acreage and the legal description of any real property to be conveyed under this section shall be determined by a survey that is satisfactory to the Secretary.</text></paragraph> 
<paragraph id="H4E61E7FCAC9043788D93ECAE426334FD"><enum>(2)</enum><header>Applicability of property screening provisions</header><text>Section 2696 of title 10, United States Code, shall not apply to any conveyance under this section.</text></paragraph> 
<paragraph id="HE8FBEE3341B84D5EAC1D7C8D3AE90C81" commented="no"><enum>(3)</enum><header>Additional terms and conditions</header><text display-inline="yes-display-inline">The Secretary may require that any conveyance under this section be subject to such additional terms and conditions as the Secretary considers necessary and appropriate to protect the interests of the United States.</text></paragraph> 
<paragraph id="HC49B6CA1BEC542CB9192089B483E2649"><enum>(4)</enum><header>Costs of conveyance</header><text display-inline="yes-display-inline">An entity to which a conveyance is made under this section shall be responsible for all reasonable and necessary costs, including real estate transaction and environmental documentation costs, associated with the conveyance.</text></paragraph> 
<paragraph id="HD2F18CAC2E104174A84006A3EC8802C8"><enum>(5)</enum><header>Liability</header><text display-inline="yes-display-inline">An entity to which a conveyance is made under this section shall hold the United States harmless from any liability with respect to activities carried out, on or after the date of the conveyance, on real property conveyed. The United States shall remain responsible for any liability with respect to activities carried out, before such date, on the real property conveyed.</text></paragraph></subsection></section> 
<section id="H672EDE38B23E447ABBC0D284D185CA3C" section-type="subsequent-section" commented="no"><enum>307.</enum><header>Clatsop County, Oregon</header><text display-inline="no-display-inline">The portions of the project for raising and improving existing levees of Clatsop County Diking District No. 13, in Clatsop County, Oregon, authorized by section 5 of the Act of June 22, 1936 (49 Stat. 1590), that are referred to as Christensen No. 1 Dike No. 42 and Christensen No. 2 Levee No. 43 are no longer authorized beginning on the date of enactment of this Act.</text></section> 
<section id="H5F5F8B915488463397337367487B2D41" commented="no"><enum>308.</enum><header>Kissimmee River Restoration, Central and Southern Florida</header><text display-inline="no-display-inline">Subject to a determination by the Secretary that the costs are reasonable and allowable and that the work for which credit is requested was carried out in accordance with the laws specified in section 5014(i)(2)(A) of the Water Resources Reform and Development Act of 2014 (128 Stat. 1331) and all other applicable Federal laws, the Secretary may credit toward the non-Federal share of the cost of the Kissimmee River project, authorized in section 101(8) of the Water Resources Development Act of 1992 (106 Stat. 4802), the value of in-kind contributions made by the non-Federal interest with respect to the six following actions, as described in the final report of the Director of Civil Works on the Central and Southern Florida Project, Kissimmee River Restoration Project, dated April 27, 2018:</text>

<section id="HD734D1F359A449DF8860796154AD8665" section-type="subsequent-section"><enum>309.</enum><header>Lytle and Cajon Creeks, California</header><text display-inline="no-display-inline">That portion of the channel improvement project, Lytle and Cajon Creeks, California, authorized to be carried out as a part of the project for the Santa Ana River Basin, California, by the Act of December 22, 1944 (Chapter 665; 58 Stat. 900) that consists of five earth-filled groins commonly referred to as <quote>the Riverside Avenue groins</quote> is no longer authorized as a Federal project beginning on the date of enactment of this Act. </text></section> 
<section id="H33155FD058EB4E02B00DD96670E07F17"><enum>310.</enum><header>Yuba River Basin, California</header> 
<subsection id="HA7CD073629E94FF7AD38222FB0A82CE0"><enum>(a)</enum><header>In general</header><text>The project for flood damage reduction, Yuba River Basin, California, authorized by section 101(a)(10) of the Water Resources Development Act of 1999 (113 Stat. 275) is modified to allow a non-Federal interest to construct a new levee to connect the existing levee with high ground.</text></subsection> 
<subsection id="HE766953DB5504883964011FBBC1F87DA"><enum>(b)</enum><header>Project description</header><text>The levee to be constructed shall tie into the existing levee at a point Northing 2186189.2438, Easting 6703908.8657, thence running east and south along a path to be determined to a point Northing 2187849.4328, Easting 6719262.0164.</text></subsection> 
<subsection id="HFAC0A9285CF747199C87A75C035AB4A9"><enum>(c)</enum><header>Cooperation agreement</header><text>The Secretary shall execute a conforming amendment to the Memorandum of Understanding Respecting the Sacramento River Flood Control Project with the State of California dated November 30, 1953, that is limited to changing the description of the project to reflect the modification.</text></subsection> 
<subsection id="H9775AD04A752447C82299579E24B5F1F"><enum>(d)</enum><header>No Federal cost</header> 
<paragraph id="HCEDA05F12369439C80B614AF286EEFA7"><enum>(1)</enum><header>Review costs</header><text>Before construction of the levee described in subsection (b), the Secretary may accept and expend funds received from a non-Federal interest to review the planning, engineering, and design of the levee described in subsection (b) to ensure that such planning, engineering, and design complies with Federal standards.</text></paragraph> 
<paragraph id="H335B1F65FE9240969BC56A6D3BD312DE"><enum>(2)</enum><header>Non-Federal share</header><text>The non-Federal share of the cost of constructing the levee shall be 100 percent.</text></paragraph></subsection></section></title>
