<section id="H6310175DC304466D9CCBBE28B7215944" section-type="section-one"><enum>1.</enum><header>Short title</header><text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Blocking Regulatory Interference from Closing Kilns Act of 2017</short-title></quote>.</text></section> 
<section id="H92BF48F68B6B4F4D910092A84E5EEECD"><enum>2.</enum><header>Extending compliance dates (pending judicial review) of rules addressing national emission standards for hazardous air pollutants for brick and structural clay products manufacturing or clay ceramics manufacturing</header> 
<subsection id="H10C0D44E2EF643409FA2BC0B0724B2EE"><enum>(a)</enum><header>Extension of compliance dates</header> 
<paragraph id="H82F6B3B2751E4615AC87785CC2B897C0"><enum>(1)</enum><header>Extension</header><text>Each compliance date of any final rule described in subsection (b) is deemed to be extended by the time period equal to the time period described in subsection (c).</text></paragraph> 
<paragraph id="H593AE85EA5B64D2599C724AB292F54EB"><enum>(2)</enum><header>Definition</header><text>In this subsection, the term <term>compliance date</term> means, with respect to any requirement of a final rule described in subsection (b), the date by which any State, local, or tribal government or other person is first required to comply.</text></paragraph></subsection> 
<subsection id="H864189E680CD416593A91BA3C3976AF3"><enum>(b)</enum><header>Final rules described</header><text>A final rule described in this subsection is any final rule to address national emission standards for hazardous air pollutants (NESHAP) for brick and structural clay products manufacturing or clay ceramics manufacturing under section 112 of the Clean Air Act (42 U.S.C. 7412), including—</text> 
<paragraph id="H52025126AE954BEA81AF076FCA1047A3"><enum>(1)</enum><text>the final rule entitled <quote>NESHAP for Brick and Structural Clay Products Manufacturing; and NESHAP for Clay Ceramics Manufacturing</quote> published at 80 Fed. Reg. 65469 (October 26, 2015);</text></paragraph> 
<paragraph id="HC495887497284F249D564FDBCD00C13F"><enum>(2)</enum><text>the final rule entitled <quote>NESHAP for Brick and Structural Clay Products Manufacturing; and NESHAP for Clay Ceramics Manufacturing: Correction</quote> published at 80 Fed. Reg. 75817 (December 4, 2015); and</text></paragraph> 
<paragraph id="HDA12C959F8024C9ABE640177CEA798FB"><enum>(3)</enum><text>any final rule that succeeds or amends the rule described in paragraph (1) or (2).</text></paragraph></subsection> 
<subsection id="H14B8B894DA96458E873B89B2193E8169"><enum>(c)</enum><header>Period described</header><text>The time period described in this subsection is the period of days that—</text> 
<paragraph id="HA694883F81DC4E45AD267C315175B273"><enum>(1)</enum><text>begins on the date that is 60 days after the day on which notice of promulgation of a final rule described in subsection (b) appears in the Federal Register; and</text></paragraph> 
<paragraph id="H78C7B85AC6F8401B834E1C9489D7413C"><enum>(2)</enum><text>ends on the date on which judgment becomes final, and no longer subject to further appeal or review, in all actions (including actions that are filed pursuant to section 307 of the Clean Air Act (42 U.S.C. 7607))—</text> 
<subparagraph id="H5706DA39B38849E1BE374DAD396ADD66"><enum>(A)</enum><text>that are filed during the 60 days described in paragraph (1); and</text></subparagraph> 
<subparagraph id="H8FA4971A6BCC44FC95C62D3AF98FC336"><enum>(B)</enum><text>that seek review of any aspect of such rule.</text></subparagraph></paragraph></subsection></section> 
<section id="H0579953EC9CD4D59AF18B7E6056F7B2D" section-type="subsequent-section"><enum>3.</enum><header>Step 2 compliance date for standards of performance for new residential wood heaters, new residential hydronic heaters, and forced-air furnaces</header> 
<subsection id="H11CAA78366C4447EB505663DA968C555"><enum>(a)</enum><header>In general</header><text display-inline="yes-display-inline">The Step 2 compliance date (as such term is used in the final rule entitled <quote>Standards of Performance for New Residential Wood Heaters, New Residential Hydronic Heaters and Forced-Air Furnaces</quote> published at 80 Fed. Reg. 13672 (March 16, 2015)) is deemed to be May 15, 2023.</text></subsection> 
<subsection id="H6B41966180C74DBAAED3FA2B12E9D564"><enum>(b)</enum><header>Conforming changes</header><text display-inline="yes-display-inline">Not later than 60 days after the date of enactment of this Act, the Administrator of the Environmental Protection Agency shall make such technical and conforming changes to rules and guidance documents as may be necessary to implement subsection (a).</text></subsection></section>
