<title id="H5EC470D39DAC4D69954A92B1C774E2F9"><enum>I</enum><header>Enhancements to foreign intelligence collection and safeguards, accountability, and oversight</header> 
<section id="HDA2E0FD8F49C40D1816D2886D5ECC622"><enum>101.</enum><header>Querying procedures required</header> 
<subsection id="H3544B8AD48314D1EBD47E62B3D61CF7B"><enum>(a)</enum><header>Querying procedures</header> 
<paragraph id="H38415A3380C04C3C98E1BFD9373ADC34"><enum>(1)</enum><header>In general</header><text>Section 702 (50 U.S.C. 1881a) is amended—</text> 
<subparagraph id="H72ABBDDE98C942BEBE27B18B661761FD"><enum>(A)</enum><text>by redesignating subsections (f) through (l) as subsections (g) through (m), respectively; and</text></subparagraph> 
<subparagraph id="HA16A13DED2204E17861EDD93081A9D3D"><enum>(B)</enum><text>by inserting after subsection (e) the following new subsection:</text>

<subsection id="H06792BBEC4134E068C23497781658563"><enum>(f)</enum><header>Queries</header> 
<paragraph id="H2A7A697A15D54614A12E49EE66F4A6C2"><enum>(1)</enum><header>Procedures required</header> 
<subparagraph id="HBDCEC6C3907F4A5D9A906E163537AB28"><enum>(A)</enum><header>Requirement to adopt</header><text display-inline="yes-display-inline">The Attorney General, in consultation with the Director of National Intelligence, shall adopt querying procedures consistent with the requirements of the fourth amendment to the Constitution of the United States for information collected pursuant to an authorization under subsection (a).</text></subparagraph> 
<subparagraph id="HB4E9058A479540EB9F5183C0D7B8031D"><enum>(B)</enum><header>Record of United States person query terms</header><text display-inline="yes-display-inline">The Attorney General, in consultation with the Director of National Intelligence, shall ensure that the procedures adopted under subparagraph (A) include a technical procedure whereby a record is kept of each United States person query term used for a query.</text></subparagraph> 
<subparagraph id="H29C476CE95444E5092B47FB303BAE72E"><enum>(C)</enum><header>Judicial review</header><text display-inline="yes-display-inline">The procedures adopted in accordance with subparagraph (A) shall be subject to judicial review pursuant to subsection (j).</text></subparagraph></paragraph> 
<paragraph id="HC12AEB1382434F30B4376C17A06B3050"><enum>(2)</enum><header>Access to results of certain queries conducted by FBI</header> 
<subparagraph id="H0AD513099E2A42DABFF9FEABB9681BA1"><enum>(A)</enum><header>Court order required for FBI review of certain query results in criminal investigations unrelated to national security</header><text display-inline="yes-display-inline">Except as provided by subparagraph (E), in connection with a predicated criminal investigation opened by the Federal Bureau of Investigation that does not relate to the national security of the United States, the Federal Bureau of Investigation may not access the contents of communications acquired under subsection (a) that were retrieved pursuant to a query made using a United States person query term that was not designed to find and extract foreign intelligence information unless—</text> 
<clause id="H968FDCEAAA8647FA847746DD3582A234"><enum>(i)</enum><text display-inline="yes-display-inline">the Federal Bureau of Investigation applies for an order of the Court under subparagraph (C); and</text></clause> 
<clause id="H9E9A3A1CB81944499CC30BF710921D9B"><enum>(ii)</enum><text>the Court enters an order under subparagraph (D) approving such application.</text></clause></subparagraph> 
<subparagraph id="H7A0759145AAD44DA951B8C880EB9B6CB"><enum>(B)</enum><header>Jurisdiction</header><text display-inline="yes-display-inline">The Court shall have jurisdiction to review an application and to enter an order approving the access described in subparagraph (A).</text></subparagraph> 
<subparagraph id="H2F79F4881BAE4990B9A3DAC2C6E1A34B"><enum>(C)</enum><header>Application</header><text display-inline="yes-display-inline">Each application for an order under this paragraph shall be made by a Federal officer in writing upon oath or affirmation to a judge having jurisdiction under subparagraph (B). Each application shall require the approval of the Attorney General based upon the finding of the Attorney General that the application satisfies the criteria and requirements of such application, as set forth in this paragraph, and shall include—</text> 
<clause id="HBB3939F2E8C74156B78AABC8CDE02FE1"><enum>(i)</enum><text display-inline="yes-display-inline">the identity of the Federal officer making the application; and</text></clause> 
<clause id="H58DD772D4ED84669A919498BC10CE6FE"><enum>(ii)</enum><text display-inline="yes-display-inline">an affidavit or other information containing a statement of the facts and circumstances relied upon by the applicant to justify the belief of the applicant that the contents of communications described in subparagraph (A) covered by the application would provide evidence of—</text> 
<subclause id="H5C1C03F50653435B85FB22A4576A0DE9"><enum>(I)</enum><text display-inline="yes-display-inline">criminal activity;</text></subclause> 
<subclause id="H38BA156CE172444B8711F45C3FCAF73C"><enum>(II)</enum><text>contraband, fruits of a crime, or other items illegally possessed by a third party; or</text></subclause> 
<subclause id="H8C77676476954A91A2D3CC4F83F24C4C"><enum>(III)</enum><text>property designed for use, intended for use, or used in committing a crime.</text></subclause></clause></subparagraph> 
<subparagraph id="H6004C02C94DB48BC97D3289886F42193"><enum>(D)</enum><header>Order</header><text display-inline="yes-display-inline">Upon an application made pursuant to subparagraph (C), the Court shall enter an order approving the accessing of the contents of communications described in subparagraph (A) covered by the application if the Court finds probable cause to believe that such contents would provide any of the evidence described in subparagraph (C)(ii).</text></subparagraph> 
<subparagraph id="H5243F46AACF64A53B6BA365B74109C33"><enum>(E)</enum><header>Exception</header><text display-inline="yes-display-inline">The requirement for an order of the Court under subparagraph (A) to access the contents of communications described in such subparagraph shall not apply with respect to a query if the Federal Bureau of Investigation determines there is a reasonable belief that such contents could assist in mitigating or eliminating a threat to life or serious bodily harm.</text></subparagraph> 
<subparagraph id="H12EC69AF2E124EB0B5A879661D3A52FA" commented="no"><enum>(F)</enum><header>Rule of construction</header><text display-inline="yes-display-inline">Nothing in this paragraph may be construed as—</text> 
<clause id="HBE16E75769494826B344D0B2FAF4A956"><enum>(i)</enum><text display-inline="yes-display-inline">limiting the authority of the Federal Bureau of Investigation to conduct lawful queries of information acquired under subsection (a);</text></clause> 
<clause id="H311C17CE45DD4DCB972EF25C4F51B1F9"><enum>(ii)</enum><text display-inline="yes-display-inline">limiting the authority of the Federal Bureau of Investigation to review, without a court order, the results of any query of information acquired under subsection (a) that was reasonably designed to find and extract foreign intelligence information, regardless of whether such foreign intelligence information could also be considered evidence of a crime; or</text></clause> 
<clause id="H232FCB2FF7644B2983F91DDE6DB731C3"><enum>(iii)</enum><text display-inline="yes-display-inline">prohibiting or otherwise limiting the ability of the Federal Bureau of Investigation to access the results of queries conducted when evaluating whether to open an assessment or predicated investigation relating to the national security of the United States.</text></clause></subparagraph></paragraph> 
<paragraph id="H9FA4B1F200E74A2BBA89E4A10CC3031D"><enum>(3)</enum><header>Definitions</header><text display-inline="yes-display-inline">In this subsection:</text> 
<subparagraph id="HCB41BAE96CB14770A818DE23FF7C9D7B"><enum>(A)</enum><text display-inline="yes-display-inline">The term <quote>contents</quote> has the meaning given that term in section 2510(8) of title 18, United States Code.</text></subparagraph> 
<subparagraph id="H1812AC39EC93400291E15DAE26D52832"><enum>(B)</enum><text>The term <term>query</term> means the use of one or more terms to retrieve the unminimized contents or noncontents located in electronic and data storage systems of communications of or concerning United States persons obtained through acquisitions authorized under subsection (a).</text></subparagraph></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph> 
<paragraph id="H01CFC8F893AF478FAA5B8AB6A6D9DCA6"><enum>(2)</enum><header>Application</header><text display-inline="yes-display-inline">Subsection (f) of section 702 of the Foreign Intelligence Surveillance Act of 1978 (50 U.S.C. 1881a), as added by paragraph (1), shall apply with respect to certifications submitted under subsection (h) of such section to the Foreign Intelligence Surveillance Court after January 1, 2018.</text></paragraph></subsection> 
<subsection id="H3CA130C45864409FB1B6A9BB488ABB30"><enum>(b)</enum><header>Conforming amendments</header>

<subclause id="H7A7D75BB3AFD4C99A3805C37682AE359" commented="no"><enum>(I)</enum><text>the criminal proceeding affects, involves, or is related to the national security of the United States; or</text></subclause> 
<subclause id="H4DD8E75F408744C48C415B08F61C1BAD" commented="no"><enum>(II)</enum><text>the criminal proceeding involves—</text> 
<item id="H813CF1E17AF4472F8ED02FC32CADFAFA" commented="no"><enum>(aa)</enum><text>death;</text></item> 
<item id="HD6180AA82FD04027BC43B6758D7F9009" commented="no"><enum>(bb)</enum><text>kidnapping;</text></item> 
<item id="H43C812C802BC4E25B339AF5BA7995416" commented="no"><enum>(cc)</enum><text>serious bodily injury, as defined in section 1365 of title 18, United States Code;</text></item> 
<item id="H0F7CCCDCF69C4F169AEDD3E2F7345B98" commented="no"><enum>(dd)</enum><text>conduct that constitutes a criminal offense that is a specified offense against a minor, as defined in section 111 of the Adam Walsh Child Protection and Safety Act of 2006 (34 U.S.C. 20911);</text></item> 
<item id="H035B50521D1A4FFE992A9EF8520C591F" commented="no"><enum>(ee)</enum><text>incapacitation or destruction of critical infrastructure, as defined in section 1016(e) of the USA PATRIOT Act (42 U.S.C. 5195c(e));</text></item> 
<item id="HBE7B048DBACD40688EC669B53B75F0C5" commented="no"><enum>(ff)</enum><text>cybersecurity, including conduct described in section 1016(e) of the USA PATRIOT Act (42 U.S.C. 5195c(e)) or section 1029, 1030, or 2511 of title 18, United States Code;</text></item> 
<item id="H23EEBEBBFAA347829186C9F5C3EBB6D2" commented="no"><enum>(gg)</enum><text>transnational crime, including transnational narcotics trafficking and transnational organized crime; or</text></item> 
<item id="H5227F5D03E18405A9A1092E05EF8E003" commented="no"><enum>(hh)</enum><text>human trafficking.</text></item></subclause></clause></subparagraph> 
<subparagraph commented="no" id="H79146D810A3E4B2D89E0EB3FE669014D"><enum>(B)</enum><header>No judicial review</header><text>A determination by the Attorney General under subparagraph (A)(ii) is not subject to judicial review.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></paragraph></subsection>

<subsection id="H244E7F91871E46849F5322A0AB2EC9D1"><enum>(b)</enum><header>Congressional review and oversight of abouts collection</header> 
<paragraph id="H936608E149264DB6A8CD8AF4EF57B22C"><enum>(1)</enum><header>Definitions</header><text>In this subsection:</text> 
<subparagraph id="H4B6B037C7752483DA13AEA11FB096CFB"><enum>(A)</enum><text display-inline="yes-display-inline">The term <term>abouts communication</term> means a communication that contains a reference to, but is not to or from, a target of an acquisition authorized under section 702(a) of the Foreign Intelligence Surveillance Act of 1978 (50 U.S.C. 1881a(a)).</text></subparagraph> 
<subparagraph id="HD9F41E7E352D497386265CA9749224D1"><enum>(B)</enum><text>The term <term>material breach</term> means significant noncompliance with applicable law or an order of the Foreign Intelligence Surveillance Court concerning any acquisition of abouts communications.</text></subparagraph></paragraph> 
<paragraph id="HC30D603958D04425AF146E6A2171B065"><enum>(2)</enum><header>Submission to Congress</header> 
<subparagraph id="H415EF72166C1400487067FBF21561057"><enum>(A)</enum><header>Requirement</header><text>Notwithstanding any other provision of law, and except as provided in paragraph (4), if the Attorney General and the Director of National Intelligence intend to implement the authorization of the intentional acquisition of abouts communications, before the first such implementation after the date of enactment of this Act, the Attorney General and the Director of National Intelligence shall submit to the Committee on the Judiciary and the Select Committee on Intelligence of the Senate and the Committee on the Judiciary and the Permanent Select Committee on Intelligence of the House of Representatives a written notice of the intent to implement the authorization of such an acquisition, and any supporting materials in accordance with this subsection.</text></subparagraph> 
<subparagraph id="H97DFB8D5CB614E92B672E46785FB0F15"><enum>(B)</enum><header>Congressional review period</header><text>During the 30-day period beginning on the date written notice is submitted under subparagraph (A), the Committee on the Judiciary and the Select Committee on Intelligence of the Senate and the Committee on the Judiciary and the Permanent Select Committee on Intelligence of the House of Representatives shall, as appropriate, hold hearings and briefings and otherwise obtain information in order to fully review the written notice.</text></subparagraph> 
<subparagraph id="HB09DE9495BFD4A1E9809A4FEC4B8CD5D"><enum>(C)</enum><header>Limitation on action during congressional review period</header><text display-inline="yes-display-inline">Notwithstanding any other provision of law, and subject to paragraph (4), unless the Attorney General and the Director of National Intelligence make a determination pursuant to section 702(c)(2) of the Foreign Intelligence Surveillance Act of 1978 (50 U.S.C. 1881a(c)(2)), the Attorney General and the Director of National Intelligence may not implement the authorization of the intentional acquisition of abouts communications before the end of the period described in subparagraph (B).</text></subparagraph></paragraph> 
<paragraph id="H178A5AA5599B4BC083270066A6B6AEF3"><enum>(3)</enum><header>Written notice</header><text>Written notice under paragraph (2)(A) shall include the following:</text> 
<subparagraph id="HB4F8ED73124E4F5497B96E82029C1348"><enum>(A)</enum><text display-inline="yes-display-inline">A copy of any certification submitted to the Foreign Intelligence Surveillance Court pursuant to section 702 of the Foreign Intelligence Surveillance Act of 1978 (50 U.S.C. 1881a), or amendment thereto, authorizing the intentional acquisition of abouts communications, including all affidavits, procedures, exhibits, and attachments submitted therewith.</text></subparagraph> 
<subparagraph commented="no" display-inline="no-display-inline" id="HA84EA5E629494623A72DF9157090F3CA"><enum>(B)</enum><text display-inline="yes-display-inline">The decision, order, or opinion of the Foreign Intelligence Surveillance Court approving such certification, and any pleadings, applications, or memoranda of law associated with such decision, order, or opinion.</text></subparagraph> 
<subparagraph commented="no" id="H9B6A2DD4768E4751BE9BFBD34210CE6E"><enum>(C)</enum><text>A summary of the protections in place to detect any material breach.</text></subparagraph> 
<subparagraph id="H3028141957664E55B7143AD103BAC0C6"><enum>(D)</enum><text display-inline="yes-display-inline">Data or other results of modeling, simulation, or auditing of sample data demonstrating that any acquisition method involving the intentional acquisition of abouts communications shall be conducted in accordance with title VII of the Foreign Intelligence Surveillance Act of 1978 (50 U.S.C. 1881 et seq.), if such data or other results exist at the time the written notice is submitted and were provided to the Foreign Intelligence Surveillance Court.</text></subparagraph> 
<subparagraph id="HC8EB917E828C4257B3D54CFE07C387F3"><enum>(E)</enum><text>Except as provided under paragraph (4), a statement that no acquisition authorized under subsection (a) of such section 702 shall include the intentional acquisition of an abouts communication until after the end of the 30-day period described in paragraph (2)(B).</text></subparagraph></paragraph> 
<paragraph id="HC3B1025C25574AF684DFCBDEFC4B44F8"><enum>(4)</enum><header>Exception for emergency acquisition</header> 
<subparagraph id="H2B052E05025447A68C4B93D146CEEC73"><enum>(A)</enum><header>Notice of determination</header><text display-inline="yes-display-inline">If the Attorney General and the Director of National Intelligence make a determination pursuant to section 702(c)(2) of the Foreign Intelligence Surveillance Act of 1978 (50 U.S.C. 1881a(c)(2)) with respect to the intentional acquisition of abouts communications, the Attorney General and the Director of National Intelligence shall notify the Committee on the Judiciary and the Select Committee on Intelligence of the Senate and the Committee on the Judiciary and the Permanent Select Committee on Intelligence of the House of Representatives as soon as practicable, but not later than 7 days after the determination is made.</text></subparagraph> 
<subparagraph id="HF4A2C00BC2754B78A2709D3FA9A43734"><enum>(B)</enum><header>Implementation or continuation</header> 
<clause id="H1D574D91222A4ABA86F0FB6CBA84B146"><enum>(i)</enum><header>In general</header><text>If the Foreign Intelligence Surveillance Court approves a certification that authorizes the intentional acquisition of abouts communications before the end of the 30-day period described in paragraph (2)(B), the Attorney General and the Director of National Intelligence may authorize the immediate implementation or continuation of that certification if the Attorney General and the Director of National Intelligence jointly determine that exigent circumstances exist such that without such immediate implementation or continuation intelligence important to the national security of the United States may be lost or not timely acquired.</text></clause>

<subparagraph id="H5080626757924282B634AA135034A884"><enum>(B)</enum><header>Definitions</header><text>In this paragraph:</text> 
<clause id="HF985306D6D02412B9E111DCE7941E45C"><enum>(i)</enum><text display-inline="yes-display-inline">The term <term>abouts communication</term> means a communication that contains a reference to, but is not to or from, a target of an acquisition authorized under subsection (a).</text></clause> 
<clause id="H44E6ECF3AB39459C8969FDA61607BE3B"><enum>(ii)</enum><text display-inline="yes-display-inline">The term <term>material breach</term> means significant noncompliance with applicable law or an order of the Foreign Intelligence Surveillance Court concerning any acquisition of abouts communications.</text></clause></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subparagraph></paragraph> 
<paragraph id="H85310B4F22404A8B84A7E4A7B8FBE464"><enum>(6)</enum><header>Appointment of amici curiae by Foreign Intelligence Surveillance Court</header><text display-inline="yes-display-inline">For purposes of section 103(i)(2)(A) of the Foreign Intelligence Surveillance Act of 1978 (50 U.S.C. 1803(i)(2)(A)), the Foreign Intelligence Surveillance Court shall treat the first certification under section 702(h) of such Act (50 U.S.C. 1881a(h)) or amendment thereto that authorizes the acquisition of abouts communications as presenting a novel or significant interpretation of the law, unless the court determines otherwise.</text></paragraph></subsection></section> 
<section display-inline="no-display-inline" id="H5062CADD19174D04BE8251A95D232E28" section-type="subsequent-section"><enum>104.</enum><header>Publication of minimization procedures under section 702</header><text display-inline="no-display-inline">Section 702(e) (50 U.S.C. 1881a(e)) is amended by adding at the end the following new paragraph:</text>

<subparagraph id="H7508917655214017B0C1F289D832B3C1"><enum>(A)</enum><text>conduct a declassification review of any minimization procedures adopted or amended in accordance with paragraph (1); and</text></subparagraph> 
<subparagraph id="H6E9BCCB68F814E66BF96FAD0B900A0B7"><enum>(B)</enum><text display-inline="yes-display-inline">consistent with such review, and not later than 180 days after conducting such review, make such minimization procedures publicly available to the greatest extent practicable, which may be in redacted form.</text></subparagraph></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></section>

<paragraph id="H04546C430E124D0E9E692195F0159082" commented="no"><enum>(1)</enum><header>Concurrent authorization</header><text display-inline="yes-display-inline">If the Attorney General authorized the emergency employment of electronic surveillance or a physical search pursuant to section 105 or 304, the Attorney General may authorize, for the effective period of the emergency authorization and subsequent order pursuant to section 105 or 304, without a separate order under section 703 or 704, the targeting of a United States person subject to such emergency employment for the purpose of acquiring foreign intelligence information while such United States person is reasonably believed to be located outside the United States.</text></paragraph> 
<paragraph id="H36B676EE087A49A8AF79A846BC23CD79" commented="no"><enum>(2)</enum><header>Use of information</header><text>If an application submitted to the Court pursuant to section 104 or 303 is denied, or in any other case in which the acquisition pursuant to paragraph (1) is terminated and no order with respect to the target of the acquisition is issued under section 105 or 304, all information obtained or evidence derived from such acquisition shall be handled in accordance with section 704(d)(4).</text></paragraph></subsection><after-quoted-block>.</after-quoted-block></quoted-block></section>

<paragraph id="H6554E1EB6AE343D582596315E7A8D538"><enum>(3)</enum><text display-inline="yes-display-inline">the total number of subjects targeted by electronic surveillance conducted under an order or emergency authorization under this title, rounded to the nearest 500, including the number of such individuals who are United States persons, reported to the nearest band of 500, starting with 0–499.</text></paragraph></subsection>

<subparagraph display-inline="no-display-inline" id="H211B43007D694749B24F46C73FC0F25A" indent="up1"><enum>(A)</enum><text>a violation of any Federal law, rule, or regulation (including with respect to evidence of another employee or contractor employee accessing or sharing classified information without authorization); or</text></subparagraph> 
<subparagraph id="HBC0DE6519B6B48508A2A6F2A7680490E" indent="up1"><enum>(B)</enum><text>gross mismanagement, a gross waste of funds, an abuse of authority, or a substantial and specific danger to public health or safety.</text></subparagraph></paragraph> 
<paragraph commented="no" id="HEE635560203444E187EC69493D7AA33D" indent="up1"><enum>(2)</enum><text display-inline="yes-display-inline">A personnel action under paragraph (1) is prohibited even if the action is undertaken at the request of an agency official, unless the request takes the form of a nondiscretionary directive and is within the authority of the agency official making the request.</text></paragraph></subsection><after-quoted-block>;</after-quoted-block></quoted-block></paragraph>

<clause id="H26336430A98B44CAAFB128070AE602F8"><enum>(iii)</enum><text>to the Office of Professional Responsibility of the Department of Justice;</text></clause> 
<clause id="HE87027CB5B70460A803A34E6171A3098"><enum>(iv)</enum><text>to the Office of Professional Responsibility of the Federal Bureau of Investigation;</text></clause> 
<clause id="HC72C98EBEE894F85B13A1430AD4C1101"><enum>(v)</enum><text>to the Inspection Division of the Federal Bureau of Investigation;</text></clause> 
<clause id="H3A2F7B9512184E1A96D3875ABCE07B71"><enum>(vi)</enum><text>to the Office of Special Counsel; or</text></clause> 
<clause id="H3609934E904E43C4BD8384AA0CF817D6"><enum>(vii)</enum><text>to an employee designated by any officer, employee, office, or division described in clauses (i) through (vii) for the purpose of receiving such disclosures; and</text></clause></subparagraph> 
<subparagraph display-inline="no-display-inline" id="H87ADD50D05984CFF88818236486D79B6"><enum>(B)</enum><text display-inline="yes-display-inline">which the contractor employee reasonably believes evidences—</text> 
<clause id="H62F6EA61950C44B5A626721EA0D41297"><enum>(i)</enum><text display-inline="yes-display-inline">any violation of any law, rule, or regulation (including with respect to evidence of another employee or contractor employee accessing or sharing classified information without authorization); or</text></clause> 
<clause id="HD681210AF2DF418CA868D0281A208E59"><enum>(ii)</enum><text>gross mismanagement, a gross waste of funds, an abuse of authority, or a substantial and specific danger to public health or safety.</text></clause></subparagraph></paragraph> 
<paragraph commented="no" display-inline="no-display-inline" id="HF3AFF9FC612B4546A2AD66E5BC60509F"><enum>(2)</enum><header>Actions by request</header><text display-inline="yes-display-inline">A personnel action under paragraph (1) is prohibited even if the action is undertaken at the request of an official of the Federal Bureau of Investigation, unless the request takes the form of a nondiscretionary directive and is within the authority of the official making the request.</text></paragraph> 
<paragraph id="H8735A99ED0CF4655835F61E7B38D9B69"><enum>(3)</enum><header>Regulations</header><text display-inline="yes-display-inline">The Attorney General shall prescribe regulations to ensure that a personnel action described in paragraph (1) shall not be taken against a contractor employee of the Federal Bureau of Investigation as a reprisal for any disclosure of information described in subparagraph (A) of such paragraph.</text></paragraph> 
<paragraph id="HD12606CEA5194785AE0852A5A41BDBA6"><enum>(4)</enum><header>Enforcement</header><text display-inline="yes-display-inline">The President shall provide for the enforcement of this subsection.</text></paragraph> 
<paragraph display-inline="no-display-inline" id="HF36C1B8220CA4B858F7D7A51D41E1B16"><enum>(5)</enum><header>Definitions</header><text>In this subsection:</text> 
<subparagraph commented="no" id="HFED50CF99B5A42759A48DA631F1F4560"><enum>(A)</enum><text display-inline="yes-display-inline">The term <term>contractor employee</term> means an employee of a contractor, subcontractor, grantee, subgrantee, or personal services contractor, of the Federal Bureau of Investigation.</text></subparagraph> 
<subparagraph commented="no" id="H0C3B3D3FF1C94D82890D3F8A6EF87EC7"><enum>(B)</enum><text>The term <term>personnel action</term> means any action described in clauses (i) through (x) of section 2302(a)(2)(A) of title 5, United States Code, with respect to a contractor employee.</text></subparagraph></paragraph></subsection> 
<subsection id="H9869620E13E445DBACDA85C1B1CF2CF8"><enum>(c)</enum><header>Retaliatory revocation of security clearances and access determinations</header><text display-inline="yes-display-inline">Section 3001(j) of the Intelligence Reform and Terrorism Prevention Act of 2004 (50 U.S.C. 3341(j)) is amended by adding at the end the following new paragraph:</text>

<paragraph id="H7A16410B52A34FA8893FC5B213E5648F"><enum>(8)</enum><header>Inclusion of contractor employees</header><text display-inline="yes-display-inline">In this subsection, the term <term>employee</term> includes an employee of a contractor, subcontractor, grantee, subgrantee, or personal services contractor, of an agency. With respect to such employees, the term <term>employing agency</term> shall be deemed to be the contracting agency.</text></paragraph><after-quoted-block>.</after-quoted-block></quoted-block></subsection></section> 
<section id="H32F0D411D3684DB88FD5BC27E2330337" section-type="subsequent-section"><enum>111.</enum><header>Briefing on notification requirements</header><text display-inline="no-display-inline">Not later than 180 days after the date of the enactment of this Act, the Attorney General, in consultation with the Director of National Intelligence, shall provide to the Committee on the Judiciary and the Permanent Select Committee on Intelligence of the House of Representatives and the Committee on the Judiciary and the Select Committee on Intelligence of the Senate a briefing with respect to how the Department of Justice interprets the requirements under sections 106(c), 305(d), and 405(c) of the Foreign Intelligence Surveillance Act of 1978 (50 U.S.C. 1806(c), 1825(d), and 1845(c)) to notify an aggrieved person under such sections of the use of information obtained or derived from electronic surveillance, physical search, or the use of a pen register or trap and trace device. The briefing shall focus on how the Department interprets the phrase <quote>obtained or derived from</quote> in such sections.</text></section> 
<section id="H26413FE81095467D8043085AE6D185A1" section-type="subsequent-section"><enum>112.</enum><header>Inspector General report on queries conducted by Federal Bureau of Investigation</header> 
<subsection id="H5F5CBC65A8AE4AD49B5D116FEAD15EA2"><enum>(a)</enum><header>Report</header><text display-inline="yes-display-inline">Not later than 1 year after the date on which the Foreign Intelligence Surveillance Court first approves the querying procedures adopted pursuant to section 702(f) of the Foreign Intelligence Surveillance Act of 1978 (50 U.S.C. 1881a(f)), as added by section 101, the Inspector General of the Department of Justice shall submit to the Committee on the Judiciary and the Select Committee on Intelligence of the Senate and the Committee on the Judiciary and the Permanent Select Committee on Intelligence of the House of Representatives a report containing a review by the Inspector General of the interpretation of, and compliance with, such procedures by the Federal Bureau of Investigation.</text></subsection> 
<subsection id="HD0708C1442BA483484108E3E936CBA60"><enum>(b)</enum><header>Matters included</header><text>The report under subsection (a) shall include, at a minimum, an assessment of the following:</text> 
<paragraph id="H7EA5FD6F6681415DA3848D404805973F"><enum>(1)</enum><text display-inline="yes-display-inline">The interpretations by the Federal Bureau of Investigation and the National Security Division of the Department of Justice, respectively, relating to the querying procedures adopted under subsection (f) of section 702 of the Foreign Intelligence Surveillance Act of 1978 (50 U.S.C. 1881a(f)), as added by section 101.</text></paragraph> 
<paragraph id="HED37CD0449A9417E87F4B827670FA86C"><enum>(2)</enum><text display-inline="yes-display-inline">The handling by the Federal Bureau of Investigation of individuals whose citizenship status is unknown at the time of a query conducted under such section 702.</text></paragraph> 
<paragraph id="H2966A73CC1114D27B17D671282CED79B"><enum>(3)</enum><text display-inline="yes-display-inline">The practice of the Federal Bureau of Investigation with respect to retaining records of queries conducted under such section 702 for auditing purposes.</text></paragraph> 
<paragraph id="HC5BC152B6E15434AAB9ABC5060DB1207"><enum>(4)</enum><text display-inline="yes-display-inline">The training or other processes of the Federal Bureau of Investigation to ensure compliance with such querying procedures.</text></paragraph> 
<paragraph id="H0BFFC79479944550A80DCF87437D5A73"><enum>(5)</enum><text display-inline="yes-display-inline">The implementation of such querying procedures with respect to queries conducted when evaluating whether to open an assessment or predicated investigation relating to the national security of the United States.</text></paragraph> 
<paragraph id="HE0B8293C9FD743378CB839F7D45ECE38"><enum>(6)</enum><text display-inline="yes-display-inline">The scope of access by the criminal division of the Federal Bureau of Investigation to information obtained pursuant to the Foreign Intelligence Surveillance Act of 1978 (50 U.S.C. 1801 et seq.), including with respect to information acquired under subsection (a) of such section 702 based on queries conducted by the criminal division.</text></paragraph> 
<paragraph id="H6CB7605E3BCD431599C27B0C9687DD11"><enum>(7)</enum><text display-inline="yes-display-inline">The frequency and nature of the reviews conducted by the National Security Division of the Department of Justice and the Office of the Director of National Intelligence relating to the compliance by the Federal Bureau of Investigation with such querying procedures.</text></paragraph> 
<paragraph id="H083C0C2933D344D1BEA7BF871934C5B3"><enum>(8)</enum><text display-inline="yes-display-inline">Any impediments, including operational, technical, or policy impediments, for the Federal Bureau of Investigation to count—</text> 
<subparagraph id="H2DD9D23462BA461C88AAF54EB962301D"><enum>(A)</enum><text display-inline="yes-display-inline">the total number of queries where the Federal Bureau of Investigation subsequently accessed information acquired under subsection (a) of such section 702;</text></subparagraph>

<subsection id="HA1E7ED591DDC4E9B97E3216485F406E8" commented="no"><enum>(a)</enum><header>Report</header><text display-inline="yes-display-inline">Not later than 270 days after the date of the enactment of this Act, the Attorney General, in coordination with the Director of National Intelligence, shall submit to the Committee on the Judiciary and the Permanent Select Committee on Intelligence of the House of Representatives and the Committee on the Judiciary and the Select Committee on Intelligence of the Senate a report on current and future challenges to the effectiveness of the foreign intelligence surveillance activities of the United States authorized under the Foreign Intelligence Surveillance Act of 1978 (50 U.S.C. 1801 et seq.).</text></subsection> 
<subsection id="HD23CE91EADDE43FFBFF763894555244D" commented="no"><enum>(b)</enum><header>Matters included</header><text display-inline="yes-display-inline">The report under subsection (a) shall include, at a minimum, the following:</text> 
<paragraph id="H66F04496E683421E873FAD45B01B913E" commented="no"><enum>(1)</enum><text display-inline="yes-display-inline">A discussion of any trends that currently challenge the effectiveness of the foreign intelligence surveillance activities of the United States, or could foreseeably challenge such activities during the decade following the date of the report, including with respect to—</text>

<subparagraph id="HB5B7FD45143446BBA6CD1F96FB15E2ED" commented="no"><enum>(D)</enum><text>technical obstacles in determining the location of data or persons;</text></subparagraph> 
<subparagraph id="H1B37A6BFEC8548EB81A8B1E7B91E4253" commented="no"><enum>(E)</enum><text>the increasing complexity of the legal regime, including regarding requests for data in the custody of foreign governments;</text></subparagraph> 
<subparagraph id="H6EE00F222F7742169DF71B375FA6BDEF" commented="no"><enum>(F)</enum><text>the current and future ability of the United States to obtain, on a compulsory or voluntary basis, assistance from telecommunications providers or other entities; and</text></subparagraph> 
<subparagraph id="H70366AAD2EE6459A912EC5FCA4CE2C98" commented="no"><enum>(G)</enum><text>any other matters the Attorney General and the Director of National Intelligence determine appropriate.</text></subparagraph></paragraph> 
<paragraph id="H4C534AB2E5B84BA69D73114E1D516499" commented="no"><enum>(2)</enum><text display-inline="yes-display-inline">Recommendations for changes, including, as appropriate, fundamental changes, to the foreign intelligence surveillance activities of the United States to address the challenges identified under paragraph (1) and to ensure the long-term effectiveness of such activities.</text></paragraph>

<subsection id="HE2F1DFCA9AD14303916964761166F068"><enum>(a)</enum><header>Study</header><text display-inline="yes-display-inline">The Comptroller General of the United States shall conduct a study of the classification system of the United States and the methods by which the intelligence community (as defined in section 3(4) of the National Security Act of 1947 (50 U.S.C. 3003(4))) protects classified information.</text></subsection> 
<subsection id="HFA9596DDDBD64ED88E4AC7697F3388CA"><enum>(b)</enum><header>Matters included</header><text display-inline="yes-display-inline">The study under subsection (a) shall address the following:</text> 
<paragraph id="H0163779249114AC0AEA70111BC03D327"><enum>(1)</enum><text display-inline="yes-display-inline">Whether sensitive information is properly classified.</text></paragraph> 
<paragraph id="H12DE6178D5814D0AA88BE5C7E40E65D8"><enum>(2)</enum><text>The effect of modern technology on the storage and protection of classified information, including with respect to—</text> 
<subparagraph id="H9DEF8B9E20354FA3B1AC1CB38A12D66E"><enum>(A)</enum><text>using cloud storage for classified information; and</text></subparagraph> 
<subparagraph id="H9A45DD43752443138FC02C9C2E1AD699"><enum>(B)</enum><text>any technological means to prevent or detect unauthorized access to such information.</text></subparagraph></paragraph> 
<paragraph id="HCE409E9EFF5D4381AA713112E17D4660"><enum>(3)</enum><text>Any ways to improve the classification system of the United States, including with respect to changing the levels of classification used in such system and to reduce overclassification.</text></paragraph> 
<paragraph id="HB4D5A0F28244424C97720D008B2468F9"><enum>(4)</enum><text display-inline="yes-display-inline">How to improve the authorized sharing of classified information, including with respect to sensitive compartmented information.</text></paragraph> 
<paragraph id="H3BA8C688AA2A4C8ABDB352C51BBB0BFD"><enum>(5)</enum><text>The value of polygraph tests in determining who is authorized to access classified information and in investigating unauthorized disclosures of classified information.</text></paragraph>
