              <header>Catastrophic event</header>
              <text>The term <term>catastrophic event</term> means any natural disaster (such as hurricane, tornado, windstorm, snow or ice storm, rain storm, high water, wind-driven water, tidal wave, earthquake, volcanic eruption, landslide, mudslide, drought, or insect or disease outbreak) or any fire, flood, or explosion, regardless of cause.</text>
            </paragraph>

              <enum>(2)</enum>
              <header>Collaborative process</header>
              <text>The term <term>collaborative process</term> refers to a process relating to the management of National Forest System lands or public lands by which a project or forest management activity is developed and implemented by the Secretary concerned through collaboration with interested persons, as described in section 603(b)(1)(C) of the Healthy Forests Restoration Act of 2003 (16 U.S.C. 6591b(b)(1)(C)).</text>

              <enum>(3)</enum>
              <header>Community wildfire protection plan</header>
              <text>The term <term>community wildfire protection plan</term> has the meaning given that term in section 101 of the Healthy Forests Restoration Act of 2003 (16 U.S.C. 6511).</text>

              <enum>(4)</enum>
              <header>Coos bay wagon road grant lands</header>
              <text>The term <term>Coos Bay Wagon Road Grant lands</term> means the lands reconveyed to the United States pursuant to the first section of the Act of February 26, 1919 (40 Stat. 1179).</text>
            </paragraph>

              <enum>(5)</enum>
              <header>Forest management activity</header>
              <text>The term <term>forest management activity</term> means a project or activity carried out by the Secretary concerned on National Forest System lands or public lands consistent with the forest plan covering the lands.</text>
            </paragraph>

              <enum>(6)</enum>
              <header>Forest plan</header>
              <text>The term <term>forest plan</term> means—</text>
              <subparagraph id="H35955FBEA4FD490696F4E0AA47288EE5">
                <enum>(A)</enum>
                <text>a land use plan prepared by the Bureau of Land Management for public lands pursuant to section 202 of the Federal Land Policy and Management Act of 1976 (43 U.S.C. 1712); or</text>
              </subparagraph>
              <subparagraph id="H02DB96538461409592A5A415F12406CE">
                <enum>(B)</enum>
                <text>a land and resource management plan prepared by the Forest Service for a unit of the National Forest System pursuant to section 6 of the Forest and Rangeland Renewable Resources Planning Act of 1974 (16 U.S.C. 1604).</text>
              </subparagraph>
            </paragraph>
            <paragraph id="H8CC4557E85BD46199787C457F4712D83">
              <enum>(7)</enum>
              <header>Large-scale catastrophic event</header>
              <text>The term <term>large-scale catastrophic event</term> means a catastrophic event that adversely impacts at least 5,000 acres of reasonably contiguous National Forest System lands or public lands, as determined by the Secretary concerned.</text>
            </paragraph>

              <enum>(8)</enum>
              <header>National Forest System</header>
              <text>The term <term>National Forest System</term> has the meaning given that term in section 11(a) of the Forest and Rangeland Renewable Resources Planning Act of 1974 (16 U.S.C. 1609(a)).</text>
            </paragraph>

              <enum>(9)</enum>
              <header>Oregon and California railroad grant lands</header>
              <text>The term <term>Oregon and California Railroad Grant lands</term> means the following lands:</text>
              <subparagraph id="H3702C8C9901946948B2386523C5C7BF0">
                <enum>(A)</enum>
                <text>All lands in the State of Oregon revested in the United States under the Act of June 9, 1916 (39 Stat. 218), that are administered by the Secretary of the Interior, acting through the Bureau of Land Management, pursuant to the first section of the Act of August 28, 1937 (43 U.S.C. 1181a).</text>
              </subparagraph>
              <subparagraph id="H4E19AAD0A6784985A4A76038D7D3EEF0">
                <enum>(B)</enum>
                <text>All lands in that State obtained by the Secretary of the Interior pursuant to the land exchanges authorized and directed by section 2 of the Act of June 24, 1954 (43 U.S.C. 1181h).</text>
              </subparagraph>
              <subparagraph id="H5CCEEFA6DCF24EB5892FA3F30F8DD940">
                <enum>(C)</enum>
                <text>All lands in that State acquired by the United States at any time and made subject to the provisions of title II of the Act of August 28, 1937 (43 U.S.C. 1181f).</text>
              </subparagraph>
            </paragraph>

              <enum>(10)</enum>
              <header>Public lands</header>
              <text>The term <term>public lands</term> has the meaning given that term in section 103 of the Federal Land Policy and Management Act of 1976 (43 U.S.C. 1702), except that the term includes Coos Bay Wagon Road Grant lands and Oregon and California Railroad Grant lands.</text>
            </paragraph>

              <enum>(11)</enum>
              <header>Reforestation activity</header>
              <text>The term <term>reforestation activity</term> means a project or forest management activity carried out by the Secretary concerned whose primary purpose is the reforestation of impacted lands following a large-scale catastrophic event. The term includes planting, evaluating and enhancing natural regeneration, clearing competing vegetation, and other activities related to reestablishment of forest species on the impacted lands.</text>
            </paragraph>

              <enum>(12)</enum>
              <header>Resource advisory committee</header>
              <text>The term <term>resource advisory committee</term> has the meaning given that term in section 201 of the Secure Rural Schools and Community Self-Determination Act of 2000 (16 U.S.C. 7121).</text>
            </paragraph>

              <enum>(13)</enum>
              <header>Salvage operation</header>
              <text>The term <term>salvage operation</term> means a forest management activity and restoration activities carried out in response to a catastrophic event where the primary purpose is—</text>
              <subparagraph id="H5FD1003C5A9C4CABB6E595B4C3AC430B">
                <enum>(A)</enum>
                <text>to prevent wildfire as a result of the catastrophic event, or, if the catastrophic event was wildfire, to prevent a re-burn of the fire-impacted area;</text>
              </subparagraph>
              <subparagraph id="HC414EE107BF849B1951F78BE06361AC3">
                <enum>(B)</enum>
                <text>to provide an opportunity for utilization of forest materials damaged as a result of the catastrophic event; or</text>
              </subparagraph>
              <subparagraph id="H0A326B38173A4CEAB17FABC8C377FD71">
                <enum>(C)</enum>

            <text display-inline="no-display-inline">Unless specifically provided by a provision of titles I through IX, the authorities provided by such titles do not apply with respect to any National Forest System lands or public lands—</text>

                <text display-inline="yes-display-inline">the forest management activity to be carried out under such authority is consistent with the forest plan applicable to the area; or</text>

                <text>the Secretary concerned determines the activity is allowed under the applicable roadless rule governing such lands; or</text>
              </subparagraph>

                <header>Analysis of only two alternatives (action versus no action) in proposed collaborative forest management activities</header>

                  <enum>(a)</enum>
                  <header>Application to certain Environmental Assessments and Environmental Impact Statements</header>
                  <text>This section shall apply whenever the Secretary concerned prepares an environmental assessment or an environmental impact statement pursuant to section 102 of the National Environmental Policy Act of 1969 (42 U.S.C. 4332) for a forest management activity that—</text>

                    <enum>(1)</enum>
                    <text display-inline="yes-display-inline">is developed through a collaborative process;</text>
                  </paragraph>

                    <text>is proposed by a resource advisory committee;</text>
                  </paragraph>
                  <paragraph id="HAD95E4D462664189A3AB841D69C82A30">
                    <enum>(3)</enum>
                    <text>will occur on lands identified by the Secretary concerned as suitable for timber production;</text>
                  </paragraph>
                  <paragraph commented="no" id="H43FF80CD69394C0E818FFFCFF8DEFC6F">
                    <enum>(4)</enum>
                    <text display-inline="yes-display-inline">will occur on lands designated by the Secretary (or designee thereof) pursuant to section 602(b) of the Healthy Forests Restoration Act of 2003 (16 U.S.C. 6591a(b)), notwithstanding whether such forest management activity is initiated prior to September 30, 2018; or</text>
                  </paragraph>

                    <text display-inline="yes-display-inline">is covered by a community wildfire protection plan.</text>
                  </paragraph>
                </subsection>

                  <header>Consideration of Alternatives</header>
                  <text>In an environmental assessment or environmental impact statement described in subsection (a), the Secretary concerned shall study, develop, and describe only the following two alternatives:</text>

                  </paragraph>

                  </paragraph>
                </subsection>

                    <text display-inline="yes-display-inline">A salvage operation covered by the categorical exclusion established under subsection (a) shall comply with the standards and guidelines for stream buffers contained in the applicable forest plan unless waived by the Regional Forester, in the case of National Forest System lands, or the State Director of the Bureau of Land Management, in the case of public lands.</text>
                  </paragraph>

                  <header>Forest management activities designated for categorical exclusion</header>
                  <text>The forest management activities designated under this section for a categorical exclusion are forest management activities carried out by the Secretary concerned on National Forest System lands or public lands where the primary purpose of such activity is to modify, improve, enhance, or create early successional forests for wildlife habitat improvement and other purposes, consistent with the applicable forest plan.</text>
                </subsection>

                  <enum>(c)</enum>
                  <header>Availability of categorical exclusion</header>
                  <text>On and after the date of the enactment of this Act, the Secretary concerned may use the categorical exclusion established under subsection (a) in accordance with this section.</text>

                  <enum>(d)</enum>
                  <header>Project goals</header>
                  <text display-inline="yes-display-inline">To the maximum extent practicable, the Secretary concerned shall design a forest management activity under this section to meet early successional forest goals in such a manner so as to maximize production and regeneration of priority species, as identified in the forest plan and consistent with the capability of the activity site.</text>
                </subsection>

                      <text display-inline="yes-display-inline">Removal of juniper trees, medusahead rye, conifer trees, piñon pine trees, cheatgrass, and other noxious or invasive weeds specified on Federal or State noxious weeds lists through late-season livestock grazing, targeted livestock grazing, prescribed burns, and mechanical treatments.</text>
                    </subparagraph>

                      <enum>(B)</enum>
                      <text>Performance of hazardous fuels management.</text>
                    </subparagraph>

                      <text display-inline="yes-display-inline">Performance of soil treatments, native and non-native seeding, and planting of and transplanting sagebrush, grass, forb, shrub, and other species.</text>

                      <text display-inline="yes-display-inline">Use of herbicides, so long as the Secretary concerned determines that the activity is otherwise conducted consistently with agency procedures, including any forest plan applicable to the area covered by the activity.</text>

                  </paragraph>
                </subsection>

                  <enum>(c)</enum>
                  <header>Availability of categorical exclusion</header>
                  <text>On and after the date of the enactment of this Act, the Secretary concerned may use the categorical exclusion established under subsection (a) in accordance with this section.</text>

                    <enum>(2)</enum>
                    <header>Late-season grazing</header>
                    <text display-inline="yes-display-inline">The term <term>late-season grazing</term> means grazing activities that occur after both the invasive species and native perennial species have completed their current-year annual growth cycle until new plant growth begins to appear in the following year.</text>
                  </paragraph>

                    <header>Targeted livestock grazing</header>
                    <text>The term <term>targeted livestock grazing</term> means grazing used for purposes of hazardous fuel reduction.</text>

                <header>Consultation under the National Historic Preservation Act</header>

                  <enum>(a)</enum>
                  <header>In general</header>
                  <text display-inline="yes-display-inline">Not later than 12 months after the date of enactment of this Act, the Secretary concerned shall each develop, in consultation with relevant consulting parties, a programmatic agreement or other appropriate program alternative pursuant to section 800.14 of title 36, Code of Federal Regulations, or successor regulation, for expediting reviews under section 306108 of title 54, United States Code, for forest management activities carried out pursuant to this Act.</text>
                </subsection>
                <subsection id="H1A1B6729C3324CFBB7744838E1EF6CCC">
                  <enum>(b)</enum>
                  <header>Requirement</header>
                  <text>A programmatic agreement or other program alternative developed under subsection (a) shall incorporate the concepts of phased identification and evaluation set forth in section 800.4(b)(2) of title 36, Code of Federal Regulations, or successor regulation. </text>
                </subsection>
              </section>

                <enum>123.</enum>
                <header>Consultation under the Endangered Species Act</header>
                <subsection commented="no" id="H612EB5F028D14FE38FBDC8980B0DAD31">
                  <enum>(a)</enum>
                  <header>No consultation if action not likely To adversely affect a listed species or designated critical habitat</header>
                  <text display-inline="yes-display-inline">With respect to a forest management activity carried out pursuant to this Act, consultation under section 7 of the Endangered Species Act of 1973 (16 U.S.C. 1536) shall not be required if the Secretary concerned determines that the such forest management activity is not likely to adversely affect a listed species or designated critical habitat.</text>
                </subsection>
                <subsection commented="no" id="HF91DAD2616254F98BB42D118E43589C5">
                  <enum>(b)</enum>
                  <header>Expedited consultation</header>
                  <paragraph commented="no" id="H792E2BAB53674296801055035A8A7509">
                    <enum>(1)</enum>
                    <header>In general</header>
                    <text>With respect to a forest management activity carried out pursuant to this Act, consultation required under section 7 of the Endangered Species Act of 1973 (16 U.S.C. 1536) shall be concluded within the 90-day period beginning on the date on which such consultation was requested by the Secretary concerned.</text>
                  </paragraph>
                  <paragraph commented="no" id="H74F40FB401FD4386B01133DF9664EC69">
                    <enum>(2)</enum>
                    <header>No conclusion</header>
                    <text>In the case of a consultation described in paragraph (1) that is not concluded within the 90-day period, the forest management activity for which such consultation was initiated—</text>

                      <enum>(A)</enum>
                      <text display-inline="yes-display-inline">shall be considered to have not violated section 7 of the Endangered Species Act of 1973 (16 U.S.C. 1536(a)(2)); and</text>

                      <enum>(B)</enum>
                      <text>may be carried out.</text>
                    </subparagraph>
                  </paragraph>
                </subsection>
              </section>

                <enum>124.</enum>
                <header>Forest management activities considered non-discretionary actions</header>
                <text display-inline="no-display-inline">For purposes of the Endangered Species Act of 1973 (16 U.S.C. 1531 et seq.), a forest management activity carried out by the Secretary concerned pursuant to this Act shall be considered a non-discretionary action.</text>
              </section>
            </subtitle>
          </title>

            <enum>II</enum>
            <header>Salvage and Reforestation in Response to Catastrophic Events</header>
            <section id="H2D87D0A215AE4C5C915D55FA0DE45A56">
              <enum>201.</enum>
              <header>Expedited salvage operations and reforestation activities following large-scale catastrophic events</header>
              <subsection commented="no" id="H3B9369DFBDC2444AB876A28024B8605E">
                <enum>(a)</enum>
                <header>Expedited environmental assessment</header>
                <text display-inline="yes-display-inline">Notwithstanding any other provision of law, an environmental assessment prepared by the Secretary concerned pursuant to section 102 of the National Environmental Policy Act of 1969 (42 U.S.C. 4332) for a salvage operation or reforestation activity proposed to be conducted on National Forest System lands or public lands adversely impacted by a large-scale catastrophic event shall be completed within 60 days after the conclusion of the catastrophic event.</text>
              </subsection>
              <subsection id="H0BA3DC6A2940486390E34FBBB3793204">
                <enum>(b)</enum>
                <header>Expedited implementation and completion</header>
                <text display-inline="yes-display-inline">In the case of reforestation activities conducted on National Forest System lands or public lands adversely impacted by a large-scale catastrophic event, the Secretary concerned shall, to the maximum extent practicable, achieve reforestation of at least 75 percent of the impacted lands during the 5-year period following the conclusion of the catastrophic event.</text>
              </subsection>
              <subsection id="HF68748890F2443DE944EB7F7C5AFB841">
                <enum>(c)</enum>
                <header>Availability of Knutson-Vandenberg funds</header>
                <text display-inline="yes-display-inline">Amounts in the special fund established pursuant to section 3 of the Act of June 9, 1930 (commonly known as the Knutson-Vandenberg Act; 16 U.S.C. 576b) shall be available to the Secretary of Agriculture for reforestation activities authorized by this title.</text>
              </subsection>
              <subsection id="HD056F6EBDCDF401DA2E93879F66132C9">
                <enum>(d)</enum>
                <header>Timeline for Public Input Process</header>
                <text display-inline="yes-display-inline">Notwithstanding any other provision of law, in the case of a salvage operation or reforestation activity proposed to be conducted on National Forest System lands or public lands adversely impacted by a large-scale catastrophic event, the Secretary concerned shall allow 30 days for public scoping and comment, 15 days for filing an objection, and 15 days for the agency response to the filing of an objection. Upon completion of this process and expiration of the period specified in subsection (a), the Secretary concerned shall implement the project immediately.</text>
              </subsection>
            </section>
            <section id="HD1A66D1114CB42B1BC26AA083FE29196">
              <enum>202.</enum>
              <header>Compliance with forest plan</header>
              <text display-inline="no-display-inline">A salvage operation or reforestation activity authorized by this title shall be conducted in a manner consistent with the forest plan applicable to the National Forest System lands or public lands covered by the salvage operation or reforestation activity.</text>
            </section>

              <enum>203.</enum>
              <header>Prohibition on restraining orders, preliminary injunctions, and injunctions pending appeal</header>
              <text display-inline="no-display-inline">No restraining order, preliminary injunction, or injunction pending appeal shall be issued by any court of the United States with respect to any decision to prepare or conduct a salvage operation or reforestation activity in response to a large-scale catastrophic event. Section 705 of title 5, United States Code, shall not apply to any challenge to the salvage operation or reforestation activity.</text>
            </section>

            <header>Forest Management Litigation</header>

                <text display-inline="no-display-inline">Notwithstanding section 1304 of title 31, United States Code, no award may be made under section 2412 of title 28, United States Code, and no amounts may be obligated or expended from the Claims and Judgment Fund of the United States Treasury to pay any fees or other expenses under such sections to any plaintiff related to an action challenging a forest management activity carried out pursuant to this Act.</text>

                <header>Injunctive relief</header>
                <subsection id="H588BC678BA9141F2961617175AF5D161">
                  <enum>(a)</enum>
                  <header>Balancing short- and long-Term effects of forest management activities in considering injunctive relief</header>
                  <text display-inline="yes-display-inline">As part of its weighing the equities while considering any request for an injunction that applies to any agency action as part of a forest management activity under titles I through IX, the court reviewing the agency action shall balance the impact to the ecosystem likely affected by the forest management activity of—</text>

                    <enum>(1)</enum>
                    <text>the short- and long-term effects of undertaking the agency action; against</text>
                  </paragraph>
                  <paragraph id="HE773283DA0B0429BA06116013898E967">
                    <enum>(2)</enum>
                    <text>the short- and long-term effects of not undertaking the action.</text>
                  </paragraph>
                </subsection>

                  <enum>(b)</enum>
                  <header>Time limitations for injunctive relief</header>
                  <paragraph id="HE71521E0E8854758A1489EBB1C6048A0">
                    <enum>(1)</enum>
                    <header>In general</header>
                    <text display-inline="yes-display-inline">Subject to paragraph (2) the length of any preliminary injunctive relief and stays pending appeal that applies to any agency action as part of a forest management activity under titles I through IX, shall not exceed 60 days.</text>

              <enum>B</enum>
              <header>Forest Management Activity Arbitration Pilot Program</header>
              <section display-inline="no-display-inline" id="HA4A1E0C8F57B410FA6F8E688BA09E071">
                <enum>311.</enum>
                <header>Use of arbitration instead of litigation to address challenges to forest management activities</header>
                <subsection id="HC86284543A2D4541A472674B9F2C8C41">
                  <enum>(a)</enum>
                  <header>Discretionary arbitration process pilot program</header>
                  <paragraph id="H3001EFA47B81499181652C2BF0F109F6">
                    <enum>(1)</enum>
                    <header>In general</header>
                    <text display-inline="yes-display-inline">The Secretary of Agriculture, with respect to National Forest System lands, and the Secretary of the Interior, with respect to public lands, shall each establish a discretionary arbitration pilot program as an alternative dispute resolution process in lieu of judicial review for the activities described in paragraph (2).</text>
                  </paragraph>
                  <paragraph id="H536E50D8852E413C98F6E8A0ECDE2A24">
                    <enum>(2)</enum>
                    <header>Activities described</header>
                    <text display-inline="yes-display-inline">The Secretary concerned, at the sole discretion of the Secretary, may designate objections or protests to forest management activities for arbitration under the arbitration pilot program established under paragraph (1).</text>
                  </paragraph>
                  <paragraph id="H475AEE51F31A416299143FB16481A950">
                    <enum>(3)</enum>
                    <header>Maximum amount of arbitrations</header>
                    <text>Under the arbitration pilot program, the Secretary concerned may not arbitrate more than 10 objections or protests to forest management activities in a fiscal year in—</text>
                    <subparagraph id="H7C8173073C384ECB8152C049D3B5C2E4">
                      <enum>(A)</enum>
                      <text>each Forest Service Region; and</text>
                    </subparagraph>
                    <subparagraph id="H62CA3C046F914C21B8F471BA4F85A348">
                      <enum>(B)</enum>
                      <text>each State Region of the Bureau of Land Management.</text>
                    </subparagraph>
                  </paragraph>
                  <paragraph id="H23C79A078A5C4E63B65CE290E4A93567">
                    <enum>(4)</enum>
                    <header>Determining amount of arbitrations</header>
                    <text>An objection or protest to a forest management activity shall not be counted towards the limitation on number of arbitrations under paragraph (3) unless—</text>
                    <subparagraph id="H574681F77D1E4D44830740C32FD0505D">
                      <enum>(A)</enum>
                      <text>on the date such objection or protest is designated for arbitration, the forest management activity for which such objection or protest is filed has not been the subject of arbitration proceedings under the pilot program; and</text>
                    </subparagraph>
                    <subparagraph id="HE2A5C66C84C54EABB57EF3A54087BC7B">
                      <enum>(B)</enum>
                      <text>the arbitration proceeding has commenced with respect to such objection or protest.</text>
                    </subparagraph>
                  </paragraph>

                    <enum>(5)</enum>
                    <header>Termination</header>
                    <text>The pilot programs established pursuant to paragraph (1) shall terminate on the date that is 7 years after the date of the enactment of this Act.</text>
                  </paragraph>
                </subsection>

                  <enum>(b)</enum>
                  <header>Intervening parties</header>
                  <paragraph id="H59AF823646554841923FF7E7AAACCE7F">
                    <enum>(1)</enum>
                    <header>Requirements</header>
                    <text display-inline="yes-display-inline">Any person that submitted a public comment on the forest management activity that is subject to arbitration may intervene in the arbitration—</text>
                    <subparagraph id="HF71B47ACD5594BBF8BE44218421AF77A">
                      <enum>(A)</enum>
                      <text display-inline="yes-display-inline">by endorsing—</text>
                      <clause id="HDC66E384DBD84FAEAFDF1407B6C812CA">
                        <enum>(i)</enum>
                        <text>the forest management activity; or</text>
                      </clause>
                      <clause id="HE775B32D4F214F99A877A69E82B3DD1B">
                        <enum>(ii)</enum>
                        <text>the modification proposal submitted under subparagraph (B); or</text>
                      </clause>
                    </subparagraph>
                    <subparagraph id="H374E1134E8AD41C8A62FADF2877436D8">
                      <enum>(B)</enum>
                      <text>by submitting a proposal to further modify the forest management activity.</text>
                    </subparagraph>
                  </paragraph>
                  <paragraph id="H8864D71A46FB43D2A9CA0512321D7B86">
                    <enum>(2)</enum>
                    <header>Deadline for submission</header>
                    <text>With respect to an objection or protest that is designated for arbitration under this subsection (a), a request to intervene in an arbitration must be submitted not later than the date that is 30 days after the date on which such objection or protest was designated for arbitration.</text>
                  </paragraph>
                  <paragraph id="H4B3BFD29C92F4C9086CEF01652E3789E">
                    <enum>(3)</enum>
                    <header>Multiple parties</header>
                    <text display-inline="yes-display-inline">Multiple intervening parties may submit a joint proposal so long as each intervening party meets the eligibility requirements of paragraph (1).</text>
                  </paragraph>
                </subsection>

                  <enum>(c)</enum>
                  <header>Appointment of arbitrator</header>
                  <paragraph id="HBCAC08745B224B808FDB194D7571DCCD">
                    <enum>(1)</enum>
                    <header>Appointment</header>
                    <text>The Secretary of Agriculture and the Secretary of the Interior shall jointly develop and publish a list of not fewer than 20 individuals eligible to serve as arbitrators for the pilot programs under this section.</text>
                  </paragraph>

                    <enum>(2)</enum>
                    <header>Qualifications</header>
                    <text display-inline="yes-display-inline">In order to be eligible to serve as an arbitrator under this subsection, an individual shall be, on the date of the appointment of such arbitrator—</text>

                      <enum>(A)</enum>
                      <text>certified by the American Arbitration Association; and</text>
                    </subparagraph>
                    <subparagraph id="H6E86F7AB97F9456DA609D8D302B5C0DC">
                      <enum>(B)</enum>
                      <text>not a registered lobbyist.</text>
                    </subparagraph>
                  </paragraph>
                  <paragraph id="H0A13D2BBAA6F42C7B4508872E333B9B9">
                    <enum>(3)</enum>
                    <header>Selection of arbitrator</header>

                      <text>For each arbitration commenced under this section, the Secretary concerned and each applicable objector or protestor shall agree, not later than 14 days after the agreement process is initiated, on a mutually acceptable arbitrator from the list published under subsection.</text>
                    </subparagraph>
                    <subparagraph id="H03C60DFA672741F0A97F35B8DEA4A381">
                      <enum>(B)</enum>
                      <header>Appointment after 14-days</header>
                      <text display-inline="yes-display-inline">In the case of an agreement with respect to a mutually acceptable arbitrator not being reached within the 14-day limit described in subparagraph (A), the Secretary concerned shall appoint an arbitrator from the list published under this subsection.</text>
                    </subparagraph>
                  </paragraph>
                </subsection>

                  <enum>(d)</enum>
                  <header>Selection of proposals</header>
                  <paragraph id="HA2C053EB23A74D6C805C02C6B22E1E73">
                    <enum>(1)</enum>
                    <header>In general</header>
                    <text>The arbitrator appointed under subsection (c)—</text>
                    <subparagraph id="H7BF0CDCD11054617AE1101E2A048C14B">
                      <enum>(A)</enum>
                      <text>may not modify any of the proposals submitted with the objection, protest, or request to intervene; and</text>
                    </subparagraph>
                    <subparagraph id="H456FA31B190841E0A0DFAF6088349704">
                      <enum>(B)</enum>
                      <text>shall select to be conducted—</text>
                      <clause id="H8C8CA7A6DDC7469DACC9F4B7987722A5">
                        <enum>(i)</enum>
                        <text display-inline="yes-display-inline">the forest management activity, as approved by the Secretary; or</text>
                      </clause>
                      <clause id="H9EA14FA477E9466B8CA87E4FBD0F04C4">
                        <enum>(ii)</enum>
                        <text>a proposal submitted by an objector or an intervening party.</text>
                      </clause>
                    </subparagraph>
                  </paragraph>
                  <paragraph commented="no" id="HEA02A379C0A84835BFC72481FA83CEBD">
                    <enum>(2)</enum>
                    <header>Selection criteria</header>
                    <text display-inline="yes-display-inline">An arbitrator shall, when selecting a proposal, consider—</text>
                    <subparagraph id="H8FAD6ACEA10046218545D38778328FCE">
                      <enum>(A)</enum>
                      <text>whether the proposal is consistent with the applicable forest plan, laws, and regulations;</text>
                    </subparagraph>

                      <enum>(B)</enum>
                      <text>whether the proposal can be carried out by the Secretary concerned; and</text>
                    </subparagraph>

                      <enum>(C)</enum>
                      <text>the effect of each proposal on—</text>

                        <text>insect and disease potential;</text>
                      </clause>

                        <enum>(v)</enum>
                        <text>timber production; and</text>
                      </clause>

                        <enum>(vi)</enum>
                        <text>the implications of a resulting decline in forest health, loss of habitat diversity, wildfire, or insect or disease infestation, given fire and insect and disease historic cycles, on—</text>

                          <enum>(I)</enum>
                          <text>domestic water costs;</text>
                        </subclause>
                        <subclause id="H3D10171C3E514DC888B5E4754D80758B">
                          <enum>(II)</enum>
                          <text>wildlife habitat loss; and</text>
                        </subclause>
                        <subclause id="H5A83714EA37542C1A5E8B92F9897D033">
                          <enum>(III)</enum>
                          <text>other economic and social factors.</text>
                        </subclause>
                      </clause>
                    </subparagraph>
                  </paragraph>
                </subsection>
                <subsection id="H7C2F09FF75DA4D8CB86522303D396B24">
                  <enum>(e)</enum>
                  <header>Effect of decision</header>
                  <text display-inline="yes-display-inline">The decision of an arbitrator with respect to the forest management activity—</text>
                  <paragraph id="HDADFBFAE72584CE3B5507077DA60A37D">
                    <enum>(1)</enum>
                    <text>shall not be considered a major Federal action;</text>
                  </paragraph>
                  <paragraph id="H75692B4B87454B929E5E1473F8876F05">
                    <enum>(2)</enum>
                    <text>shall be binding; and</text>
                  </paragraph>
                  <paragraph id="H1A748FD427D04ED0B3AE8DE26C93E35A">
                    <enum>(3)</enum>
                    <text display-inline="yes-display-inline">shall not be subject to judicial review, except as provided in section 10(a) of title 9, United States Code.</text>
                  </paragraph>

                <text>The term <term>eligible entity</term> means—</text>

                  <text display-inline="yes-display-inline">a State or political subdivision of a State containing National Forest System lands or public lands;</text>
                </subparagraph>

                  <text display-inline="yes-display-inline">a publicly chartered utility serving one or more States or a political subdivision thereof;</text>
                </subparagraph>

              <header>State-supported planning of forest management activities</header>
              <subsection id="H20CEA2203F6F4E618C68CB61867669BC">
                <enum>(a)</enum>
                <header>State-Supported forest management fund</header>
                <text display-inline="yes-display-inline">There is established in the Treasury of the United States a fund, to be known as the <quote>State-Supported Forest Management Fund</quote>, to cover the cost of planning (especially related to compliance with section 102 of the National Environmental Policy Act of 1969 (42 U.S.C. 4332)), carrying out, and monitoring certain forest management activities on National Forest System lands or public lands.</text>
              </subsection>
              <subsection id="H64B59292489C44849F9110C4CE67E76F">
                <enum>(b)</enum>
                <header>Contents</header>
                <text display-inline="yes-display-inline">The State-Supported Forest Management Fund shall consist of such amounts as may be—</text>
                <paragraph id="HA24EDEA8F21747FAB6070F7445515AB0">
                  <enum>(1)</enum>
                  <text display-inline="yes-display-inline">contributed by an eligible entity for deposit in the Fund;</text>
                </paragraph>
                <paragraph id="H084BBD25BB014E0ABE3D45BE18B540F8">
                  <enum>(2)</enum>
                  <text>appropriated to the Fund; or</text>
                </paragraph>
                <paragraph id="HDF17F572C7824E64A601749BA86FF1B4">
                  <enum>(3)</enum>
                  <text display-inline="yes-display-inline">generated by forest management activities carried out using amounts in the Fund.</text>
                </paragraph>
              </subsection>
              <subsection id="H827E6A1B18014CB089C4ABDCBD39B83F">
                <enum>(c)</enum>
                <header>Geographical and use limitations</header>
                <text display-inline="yes-display-inline">In making a contribution under subsection (b)(1), an eligible entity may—</text>
                <paragraph id="H7EED2F5E45EF48B9BB250EEE1CA4FF1B">
                  <enum>(1)</enum>
                  <text display-inline="yes-display-inline">specify the National Forest System lands or public lands for which the contribution may be expended; and</text>
                </paragraph>
                <paragraph id="HF14F9D3D18D2429AB9629624C7714B83">
                  <enum>(2)</enum>
                  <text>limit the types of forest management activities for which the contribution may be expended.</text>
                </paragraph>
              </subsection>
              <subsection id="H8391602D512F46D79C005C819CC9D0C6">
                <enum>(d)</enum>
                <header>Authorized forest management activities</header>
                <text display-inline="yes-display-inline">In such amounts as may be provided in advance in appropriation Acts, the Secretary concerned may use the Fund to plan, carry out, and monitor a forest management activity that—</text>

                  <enum>(1)</enum>
                  <text display-inline="yes-display-inline">is developed through a collaborative process;</text>
                </paragraph>
                <paragraph id="HED12D9EF52B3493DAA4D67E1C7E7D808">
                  <enum>(2)</enum>
                  <text>is proposed by a resource advisory committee;</text>
                </paragraph>
                <paragraph id="HCEFA4D5DC5414747872DBE16C95EB3B7">
                  <enum>(3)</enum>
                  <text display-inline="yes-display-inline">is covered by a community wildfire protection plan.</text>
                </paragraph>
              </subsection>
              <subsection id="HE171B40362CB4980955BD163F0DDFF8B">
                <enum>(e)</enum>
                <header>Implementation methods</header>
                <text display-inline="yes-display-inline">A forest management activity carried out using amounts in the Fund may be carried out using a contract or agreement under section 604 of the Healthy Forests Restoration Act of 2003 (16 U.S.C. 6591c), the good neighbor authority provided by section 8206 of the Agricultural Act of 2014 (16 U.S.C. 2113a), a contract under section 14 of the National Forest Management Act of 1976 (16 U.S.C. 472a), or other authority available to the Secretary concerned, but revenues generated by the forest management activity shall be used to reimburse the Fund for planning costs covered using amounts in the Fund.</text>
              </subsection>

                <enum>(f)</enum>
                <header>Relation to other laws</header>
                <paragraph id="H3C26699533AE4E1192CE868B8CDB10C2">
                  <enum>(1)</enum>
                  <header>Revenue sharing</header>
                  <text display-inline="yes-display-inline">Subject to subsection (e), revenues generated by a forest management activity carried out using amounts from the Fund shall be considered monies received from the National Forest System.</text>
                </paragraph>
                <paragraph id="HB68ED46D1B55415C82527B226A390985">
                  <enum>(2)</enum>
                  <header>Knutson-vanderberg Act</header>
                  <text display-inline="yes-display-inline">The Act of June 9, 1930 (commonly known as the Knutson-Vanderberg Act; 16 U.S.C. 576 et seq.), shall apply to any forest management activity carried out using amounts in the Fund.</text>
                </paragraph>
              </subsection>
              <subsection id="H6EFE95AAC5B045F3A64D517E1C1C27FC">
                <enum>(g)</enum>
                <header>Termination of fund</header>
                <paragraph id="H6B7D0D7BA9054E74A9A5B2E94DFD4513">
                  <enum>(1)</enum>
                  <header>Termination</header>
                  <text display-inline="yes-display-inline">The Fund shall terminate 10 years after the date of the enactment of this Act.</text>
                </paragraph>
                <paragraph id="H5039BBC55F8345F2B1FEEF4A9D0915C5">
                  <enum>(2)</enum>
                  <header>Effect of termination</header>
                  <text display-inline="yes-display-inline">Upon the termination of the Fund pursuant to paragraph (1) or pursuant to any other provision of law, unobligated contributions remaining in the Fund shall be returned to the eligible entity that made the contribution.</text>
                </paragraph>
              </subsection>

            <header>Tribal Forestry Participation and Protection</header>

              <enum>701.</enum>
              <header>Protection of Tribal forest assets through use of stewardship end result contracting and other authorities</header>
              <subsection id="H6D31A44EDFD942A38A7F138B92433FD3">
                <enum>(a)</enum>
                <header>Prompt consideration of tribal requests</header>
                <text>Section 2(b) of the Tribal Forest Protection Act of 2004 (25 U.S.C. 3115a(b)) is amended—</text>

                  <enum>(1)</enum>
                  <text>in paragraph (1), by striking <quote>Not later than 120 days after the date on which an Indian tribe submits to the Secretary</quote> and inserting <quote>In response to the submission by an Indian Tribe of </quote>; and</text>

                        <text>Not later than 120 days after the date on which the Secretary receives a Tribal request under paragraph (1), the Secretary shall provide an initial response to the Indian Tribe regarding—</text>

                          <enum>(i)</enum>
                          <text>whether the request may meet the selection criteria described in subsection (c); and</text>
                        </clause>
                        <clause id="H545B8B2FC708470098C771F4B7D5EB2D">

                          <text>the likelihood of the Secretary entering into an agreement or contract with the Indian Tribe under paragraph (2) for activities described in paragraph (3).</text>
                        </clause>
                      </subparagraph>
                      <subparagraph id="HF1E5FA1E4D754723961880FFC6D0891D">
                        <enum>(B)</enum>
                        <header>Notice of denial</header>
                        <text>Notice under subsection (d) of the denial of a Tribal request under paragraph (1) shall be provided not later than 1 year after the date on which the Secretary received the request.</text>
                      </subparagraph>
                      <subparagraph id="H3B9606DD84254B3EBBB6A1089FB65C82">
                        <enum>(C)</enum>
                        <header>Completion</header>
                        <text>Not later than 2 years after the date on which the Secretary receives a Tribal request under paragraph (1), other than a Tribal request denied under subsection (d), the Secretary shall—</text>
                        <clause id="HDD2CEB4B49734C259D530BEA6C82E52F">
                          <enum>(i)</enum>
                          <text>complete all environmental reviews necessary in connection with the agreement or contract and proposed activities under the agreement or contract; and</text>
                        </clause>

                          <enum>(ii)</enum>
                          <text>enter into the agreement or contract with the Indian tribe under paragraph (2).</text>
                        </clause>
                      </subparagraph>

              <header>Management of Indian forest land authorized to include related National Forest System lands and public lands</header>
              <text display-inline="no-display-inline">Section 305 of the National Indian Forest Resources Management Act (25 U.S.C. 3104) is amended by adding at the end the following new subsection:</text>

                  <enum>(c)</enum>
                  <header>Inclusion of certain national forest system land and public land</header>
                  <paragraph id="HD5878AAFD68A41C59E196C8EFA9989BE">
                    <enum>(1)</enum>
                    <header>Authority</header>
                    <text>At the request of an Indian Tribe, the Secretary concerned may agree to treat Federal forest land as Indian forest land for purposes of planning and conducting forest land management activities under this section if the Federal forest land is located within, or mostly within, a geographic area that presents a feature or involves circumstances principally relevant to that Indian Tribe, such as Federal forest land ceded to the United States by treaty, Federal forest land within the boundaries of a current or former reservation, or Federal forest land adjudicated to be Tribal homelands.</text>
                  </paragraph>
                  <paragraph id="H77250BBC58E64FF881D02B104068873E">
                    <enum>(2)</enum>
                    <header>Requirements</header>
                    <text>As part of the agreement to treat Federal forest land as Indian forest land under paragraph (1), the Secretary concerned and the Indian Tribe making the request shall—</text>
                    <subparagraph id="HD3EBB9788506413A80D31EFAE12C61BD">
                      <enum>(A)</enum>
                      <text>provide for continued public access applicable to the Federal forest land prior to the agreement, except that the Secretary concerned may limit or prohibit such access as needed;</text>
                    </subparagraph>
                    <subparagraph id="H4E77B39062104352BC87CDC8B3D7EC32">
                      <enum>(B)</enum>
                      <text>continue sharing revenue generated by the Federal forest land with State and local governments either—</text>
                      <clause id="HC4F38E5730DB4547BC556AC50763307F">
                        <enum>(i)</enum>
                        <text>on the terms applicable to the Federal forest land prior to the agreement, including, where applicable, 25-percent payments or 50-percent payments; or</text>
                      </clause>
                      <clause id="HA94E780DE8FF44C291439B0F2ECDA3D9">
                        <enum>(ii)</enum>
                        <text>at the option of the Indian Tribe, on terms agreed upon by the Indian Tribe, the Secretary concerned, and State and county governments participating in a revenue sharing agreement for the Federal forest land;</text>
                      </clause>
                    </subparagraph>
                    <subparagraph id="HA66E91483C3540E39AAD50D136597B41">
                      <enum>(C)</enum>
                      <text>comply with applicable prohibitions on the export of unprocessed logs harvested from the Federal forest land;</text>
                    </subparagraph>
                    <subparagraph id="H250490F0E41F405C9863EEC7D0E82E33">
                      <enum>(D)</enum>
                      <text>recognize all right-of-way agreements in place on Federal forest land prior to commencement of Tribal management activities;</text>
                    </subparagraph>
                    <subparagraph id="HBDD25877A0B4483588EB127394FD4A18">
                      <enum>(E)</enum>
                      <text>ensure that all commercial timber removed from the Federal forest land is sold on a competitive bid basis; and</text>
                    </subparagraph>
                    <subparagraph id="H2BA86B1862A44018B585393757EFB629">
                      <enum>(F)</enum>
                      <text>cooperate with the appropriate State fish and wildlife agency to achieve mutual agreement on the management of fish and wildlife.</text>
                    </subparagraph>
                  </paragraph>
                  <paragraph id="H543209F8D7AB4D06B42C548E5C5C4707">
                    <enum>(3)</enum>
                    <header>Limitation</header>
                    <text>Treating Federal forest land as Indian forest land for purposes of planning and conducting management activities pursuant to paragraph (1) shall not be construed to designate the Federal forest land as Indian forest lands for any other purpose.</text>
                  </paragraph>

                    <enum>(4)</enum>
                    <header>Definitions</header>
                    <text>In this subsection:</text>

                      <text>The term <term>Federal forest land</term> means—</text>

                        <text>National Forest System lands; and</text>
                      </clause>
                      <clause id="H16A2FC7B01C1492E95A9B167057C6C64">
                        <enum>(ii)</enum>
                        <text>public lands (as defined in section 103(e) of the Federal Land Policy and Management Act of 1976 (43 U.S.C. 1702(e))), including Coos Bay Wagon Road Grant lands reconveyed to the United States pursuant to the first section of the Act of February 26, 1919 (40 Stat. 1179), and Oregon and California Railroad Grant lands.</text>
                      </clause>
                    </subparagraph>

                      <enum>(B)</enum>
                      <header>Secretary concerned</header>
                      <text>The term <term>Secretary concerned</term> means—</text>

              <header>Tribal forest management demonstration project</header>
              <text display-inline="no-display-inline">The Secretary of the Interior and the Secretary of Agriculture may carry out demonstration projects by which federally recognized Indian Tribes or Tribal organizations may contract to perform administrative, management, and other functions of programs of the Tribal Forest Protection Act of 2004 (25 U.S.C. 3115a et seq.) through contracts entered into under the Indian Self-Determination and Education Assistance Act (25 U.S.C. 5304 et seq.).</text>
            </section>
            <section id="HB64ADBAB25624A52BC587BD652D86F25">
              <enum>704.</enum>
              <header>Rule of application</header>
              <text display-inline="no-display-inline">Nothing in this title, or the amendments made by this title, shall be construed as interfering with, diminishing, or conflicting with the authority, jurisdiction, or responsibility of any State to exercise primary management, control, or regulation of fish and wildlife on land or water within the State (including on public land) under State law.</text>

                  <enum>(2)</enum>
                  <text>if an agency determines such action will not likely adversely affect listed species or critical habitat pursuant to paragraph (1), not require such agency to complete a formal consultation, informal consultation, or written concurrence of the U.S. Fish and Wildlife Service or the National Marine Fisheries Service with respect to such action.</text>
                </paragraph>
              </section>

                <header>Revision of extraordinary circumstances regulations</header>
                <subsection id="H6A861DD2CA2D4869823974648DCCD020">
                  <enum>(a)</enum>
                  <header>Determinations of extraordinary circumstances</header>
                  <text>In determining whether extraordinary circumstances related to a proposed action preclude use of a categorical exclusion, the Forest Service shall not be required to—</text>
                  <paragraph id="H3EE36FD3B11A493386BE442140C2C45E">
                    <enum>(1)</enum>
                    <text>consider whether a proposed action is within a potential wilderness area;</text>
                  </paragraph>
                  <paragraph id="H62A7BFDAA78D4749BEDED5F940E046A0">
                    <enum>(2)</enum>
                    <text>consider whether a proposed action affects a Forest Service sensitive species;</text>
                  </paragraph>
                  <paragraph commented="no" id="HAA5AD3E589AC4ED68945697C81E81A75">
                    <enum>(3)</enum>
                    <text>conduct an analysis under section 220.4(f) of title 36, Code of Federal Regulations, of the proposed action’s cumulative impact (as the term is defined in section 1508.7 of title 40, Code of Federal Regulations);</text>
                  </paragraph>
                  <paragraph id="HEC3A5E6D703C49898FFF089CAE504EFD">
                    <enum>(4)</enum>
                    <text>consider a determination under section 7 of the Endangered Species Act of 1973 (16 U.S.C. 1536) that a proposed action may affect, but is not likely to adversely affect, threatened, endangered, or candidate species, or designated critical habitats; or</text>
                  </paragraph>
                  <paragraph id="H7C4966F1492749F28913F16B6F59CCB4">
                    <enum>(5)</enum>
                    <text>consider a determination under section 7 of the Endangered Species Act of 1973 (16 U.S.C. 1536) that a proposed action may affect, and is likely to adversely affect threatened, endangered, candidate species, or designated critical habitat if the agency is in compliance with the applicable provisions of the biological opinion.</text>
                  </paragraph>
                </subsection>
                <subsection id="HFFD75D94EE504DD6B9F5B6D517A46B74">
                  <enum>(b)</enum>
                  <header>Proposed rulemaking</header>
                  <text>Not later than 60 days after the date of enactment of this Act, the Secretary of Agriculture shall publish a notice of proposed rulemaking to revise section 220.6(b) of title 36, Code of Federal Regulations to conform such section with subsection (a).</text>
                </subsection>
                <subsection id="H84146C0FC5844885871568D2904F5EAF">
                  <enum>(c)</enum>
                  <header>Additional revision</header>
                  <text>As part of the proposed rulemaking described in subsection (b), the Secretary of Agriculture shall revise section 220.5(a)(2) of title 36, Code of Federal Regulations, to provide that the Forest Service shall not be required to consider proposals that would substantially alter a potential wilderness area as a class of actions normally requiring environmental impact statements.</text>
                </subsection>
                <subsection id="HAFF8D0A8277443E7B1E69DA7FD6388D0">
                  <enum>(d)</enum>
                  <header>Additional actions</header>
                  <text>Not later than 120 days after the date of enactment of this Act, the Secretary of Agriculture shall issue final regulations to carry out the revisions described in subsections (b) and (c).</text>
                </subsection>
              </section>

                <enum>904.</enum>
                <header>Conditions on Forest Service road decommissioning</header>
                <subsection id="HE4A54500E3A5457D97149CE5B516BF00">
                  <enum>(a)</enum>
                  <header>Consultation with affected county</header>
                  <text display-inline="yes-display-inline">Whenever any Forest Service defined maintenance level one- or two-system road within a designated high-fire prone area of a unit of the National Forest System is considered for decommissioning, the Forest Supervisor of that unit of the National Forest System shall—</text>
                  <paragraph id="H4C5A4C60C77E4D709EF8A217836A76F5">
                    <enum>(1)</enum>
                    <text>consult with the government of the county containing the road regarding the merits and possible consequences of decommissioning the road; and</text>
                  </paragraph>
                  <paragraph id="H929B4778D3444F23AFA805776593B276">
                    <enum>(2)</enum>
                    <text>solicit possible alternatives to decommissioning the road.</text>
                  </paragraph>
                </subsection>
                <subsection id="H51529B7661404A23BA48B2803D14407E">
                  <enum>(b)</enum>
                  <header>Period prior to decommission</header>
                  <text>A Forest Service road described in subsection (a) may not be decommissioned without the advance approval of the Regional Forester.</text>
                </subsection>

                <header>Prohibition on application of Eastside Screens requirements on National Forest System lands</header>

                  <header>Repeal of Eastside Screens requirements</header>
                  <text display-inline="yes-display-inline">Notwithstanding any other provision of law, the Secretary of Agriculture shall immediately withdraw the Interim Management Direction Establishing Riparian, Ecosystem, and Wildlife Standards for Timber Sales (commonly known as the Eastside Screens requirements), including all preceding or associated versions of these amendments.</text>
                </subsection>
                <subsection id="HD282882214104FD4ADAC69EDC078B6D2">
                  <enum>(b)</enum>
                  <header>Effect of repeal</header>
                  <text display-inline="yes-display-inline">On and after the date of the enactment of this Act, the Secretary of Agriculture may not apply to National Forest System lands any of the amendments repealed under subsection (a).</text>

                <enum>906.</enum>
                <header>Use of site-specific forest plan amendments for certain projects and activities</header>
                <text display-inline="no-display-inline">If the Secretary concerned determines that, in order to conduct a project or carry out an activity implementing a forest plan, an amendment to the forest plan is required, the Secretary concerned shall execute such amendment as a nonsignificant plan amendment through the record of decision or decision notice for the project or activity.</text>

                <header>Knutson-Vandenberg Act modifications</header>

                  <header>Creation of permanent rights of access required</header>
                  <text display-inline="yes-display-inline">Notwithstanding any other provision of law, on the date of the enactment of this section, reciprocal road right-of-way permits, grants, and agreements issued to a private landowner by the Secretary of the Interior pursuant to subpart 2812 of part 2810 of title 43, Code of Federal Regulations, or its predecessor regulation shall become permanent rights of access that are recordable and that shall run with the land.</text>
                </subsection>

                  <header>Records updated</header>

No other amendments shall be made to such right-of-way permits, grants, and agreements.</text>

                <header>Management of Bureau of Land Management lands in Western Oregon</header>
                <subsection id="H3E78E9F080DB48D480C20B399728B3EB">
                  <enum>(a)</enum>
                  <header>In general</header>
                  <text display-inline="yes-display-inline">All of the public land managed by the Bureau of Land Management in the Northwest District, Roseburg District, Coos Bay District, Medford District, and the Klamath Resource Area of the Lakeview District in the State of Oregon shall hereafter be managed pursuant to title I of the of the Act of August 28, 1937 (43 U.S.C. 1181a through 1181e). Except as provided in subsection (b), all of the revenue produced from such land shall be deposited in the Treasury of the United States in the Oregon and California land-grant fund and be subject to the provisions of title II of the Act of August 28, 1937 (43 U.S.C. 1181f).</text>

                <header>Clarification of research and development program for wood building construction</header>
                <subsection id="H4A3D78C553C04883A7DC4EB67F2DAF55" commented="no">
                  <enum>(a)</enum>
                  <header>In general</header>
                  <text>The Secretary shall conduct performance-driven research and development, education, and technical assistance for the purpose of facilitating the use of innovative wood products in wood building construction in the United States.</text>
                </subsection>
                <subsection id="HBAB2E7B67B97463C8CB78862F8AFECEA" commented="no">
                  <enum>(b)</enum>
                  <header>Activities</header>
                  <text>In carrying out subsection (a), the Secretary shall—</text>
                  <paragraph id="H0D041B4FEDA943B786081C4C97182855" commented="no">
                    <enum>(1)</enum>
                    <text>after receipt of input and guidance from, and collaboration with, the wood products industry, conservation organizations, and institutions of higher education, conduct research and development, education, and technical assistance at the Forest Products Laboratory or through the State and Private Forestry deputy area that meets measurable performance goals for the achievement of the priorities described in subsection (c); and</text>
                  </paragraph>
                  <paragraph id="H30CE60D531F74B8C8FD86E61BA26B253" commented="no">
                    <enum>(2)</enum>
                    <text>after coordination and collaboration with the wood products industry and conservation organizations, make competitive grants to institutions of higher education to conduct research and development, education, and technical assistance that meets measurable performance goals for the achievement of the priorities described in subsection (c).</text>
                  </paragraph>
                </subsection>

                  <enum>(c)</enum>
                  <header>Priorities</header>
                  <text>The research and development, education, and technical assistance conducted under subsection (a) shall give priority to—</text>

                    <enum>(1)</enum>
                    <text>ways to improve the commercialization of innovative wood products;</text>
                  </paragraph>

                    <text>analyzing the safety of tall wood building materials;</text>
                  </paragraph>
                  <paragraph id="H7E722B293B964B9E9AE3111F5C186BBB" commented="no">

                    <text>calculations by the Forest Products Laboratory of the life cycle environmental footprint, from extraction of raw materials through the manufacturing process, of tall wood building construction;</text>
                  </paragraph>

                    <enum>(4)</enum>
                    <text>analyzing methods to reduce the life cycle environmental footprint of tall wood building construction;</text>
                  </paragraph>

                    <enum>(5)</enum>
                    <text>analyzing the potential implications of the use of innovative wood products in building construction on wildlife; and</text>
                  </paragraph>

                    <header>Procedure for declaration of a major disaster for wildfire on Federal lands</header>
                    <subsection id="HBC09FAE42686443383C7B2570D21A43D">
                      <enum>(a)</enum>
                      <header>In general</header>
                      <text>The Secretary of the Interior or the Secretary of Agriculture may submit a request to the President consistent with the requirements of this title for a declaration by the President that a major disaster for wildfire on Federal lands exists.</text>
                    </subsection>
                    <subsection id="H6C2DDDF9367142EB92F303BED586EFC4">
                      <enum>(b)</enum>
                      <header>Requirements</header>
                      <text>A request for a declaration by the President that a major disaster for wildfire on Federal lands exists shall—</text>
                      <paragraph id="HF65B418FADBF4CEAB0FA32FCBD66B547">
                        <enum>(1)</enum>
                        <text>be made in writing by the respective Secretary;</text>
                      </paragraph>
                      <paragraph id="HE1AEE2DC4049420B9D4E9C33EE15DB4B">
                        <enum>(2)</enum>
                        <text>certify that the amount appropriated in the current fiscal year for wildfire suppression operations of the Federal land management agencies under the jurisdiction of the respective Secretary, net of any concurrently enacted rescissions of wildfire suppression funds, increases the total unobligated balance of amounts available for wildfire suppression by an amount equal to or greater than the average total costs incurred by the Federal land management agencies per year for wildfire suppression operations, including the suppression costs in excess of appropriated amounts, over the previous ten fiscal years;</text>
                      </paragraph>
                      <paragraph id="H23BCAE64F2664F929370304BDA51D6EC">
                        <enum>(3)</enum>
                        <text>certify that the amount available for wildfire suppression operations of the Federal land management agencies under the jurisdiction of the respective Secretary will be obligated not later than 30 days after such Secretary notifies the President that wildfire suppression funds will be exhausted to fund ongoing and anticipated wildfire suppression operations related to the wildfire on which the request for the declaration of a major disaster for wildfire on Federal lands pursuant to this title is based; and</text>
                      </paragraph>
                      <paragraph id="HD3B04FE33FE242239F258A2F2D9DA95F">
                        <enum>(4)</enum>
                        <text>specify the amount required in the current fiscal year to fund wildfire suppression operations related to the wildfire on which the request for the declaration of a major disaster for wildfire on Federal lands pursuant to this title is based.</text>
                      </paragraph>
                    </subsection>
                    <subsection commented="no" id="H2EE522F0F6894B05A0B07B4B6A76468D">
                      <enum>(c)</enum>
                      <header>Declaration</header>
                      <text>Based on the request of the respective Secretary under this title, the President may declare that a major disaster for wildfire on Federal lands exists.</text>
                    </subsection>
                  </section>
                  <section id="HD040C2B26C8645D2ABE1253073481FCD">
                    <enum>803.</enum>
                    <header>Wildfire on Federal lands assistance</header>
                    <subsection id="H9C50BFC1919943C9A6F7D707CAE4E29C">
                      <enum>(a)</enum>
                      <header>In general</header>
                      <text>In a major disaster for wildfire on Federal lands, the President may transfer funds, only from the account established pursuant to subsection (b), to the Secretary of the Interior or the Secretary of Agriculture to conduct wildfire suppression operations on Federal lands (and non-Federal lands pursuant to a fire protection agreement or cooperative agreement).</text>
                    </subsection>
                    <subsection id="H82AAF790179F4E2E84116E3AA8FA5744">
                      <enum>(b)</enum>
                      <header>Wildfire suppression operations account</header>
                      <text>The President shall establish a specific account for the assistance available pursuant to a declaration under section 802. Such account may only be used to fund assistance pursuant to this title.</text>
                    </subsection>

                      <enum>(c)</enum>
                      <header>Limitation</header>
                      <paragraph id="H8F6F8CACACD04C9483288684BC4224C4">
                        <enum>(1)</enum>
                        <header>Limitation of transfer</header>
                        <text>The assistance available pursuant to a declaration under section 802 is limited to the transfer of the amount requested pursuant to section 802(b)(4). The assistance available for transfer shall not exceed the amount contained in the wildfire suppression operations account established pursuant to subsection (b).</text>
                      </paragraph>
                      <paragraph id="HB7AD84B8A16B432BA5EB748C21B4FFEB">
                        <enum>(2)</enum>
                        <header>Transfer of funds</header>
                        <text display-inline="yes-display-inline">Funds under this section shall be transferred from the wildfire suppression operations account to the wildfire suppression subactivity of the Wildland Fire Management Account.</text>
                      </paragraph>
                    </subsection>
                    <subsection id="H6F81F80AFFD047F78FFDD1E8F8183847">
                      <enum>(d)</enum>
                      <header>Prohibition of other transfers</header>
                      <text>Except as provided in this section, no funds may be transferred to or from the account established pursuant to subsection (b) to or from any other fund or account.</text>
                    </subsection>
                    <subsection display-inline="no-display-inline" id="HF1A041BE5F064017AA70CC8DFD824788">
                      <enum>(e)</enum>
                      <header>Reimbursement for Wildfire suppression operations on non-Federal land</header>
                      <text display-inline="yes-display-inline">If amounts transferred under subsection (c) are used to conduct wildfire suppression operations on non-Federal land, the respective Secretary shall—</text>
                      <paragraph id="H87B675CB00BA4DFEB54F6B42C155498B">
                        <enum>(1)</enum>
                        <text>secure reimbursement for the cost of such wildfire suppression operations conducted on the non-Federal land; and</text>
                      </paragraph>
                      <paragraph id="H040E0EE1B91444FCB65B0CDA56730215">
                        <enum>(2)</enum>
                        <text display-inline="yes-display-inline">transfer the amounts received as reimbursement to the wildfire suppression operations account established pursuant to subsection (b).</text>
                      </paragraph>
                    </subsection>
                    <subsection id="H3FF7E2AA2FF64831B209BE3C5BA2C3EE">
                      <enum>(f)</enum>
                      <header>Annual Accounting and reporting requirements</header>
                      <text display-inline="yes-display-inline">Not later than 90 days after the end of each fiscal year for which assistance is received pursuant to this section, the respective Secretary shall submit to the Committees on Agriculture, Appropriations, the Budget, Natural Resources, and Transportation and Infrastructure of the House of Representatives and the Committees on Agriculture, Nutrition, and Forestry, Appropriations, the Budget, Energy and Natural Resources, Homeland Security and Governmental Affairs, and Indian Affairs of the Senate, and make available to the public, a report that includes the following:</text>
                      <paragraph id="HDD3B0513A5C842629E2C32FD251E1B95">
                        <enum>(1)</enum>
                        <text display-inline="yes-display-inline">The risk-based factors that influenced management decisions regarding wildfire suppression operations of the Federal land management agencies under the jurisdiction of the Secretary concerned.</text>
                      </paragraph>
                      <paragraph id="H811A9703303C4412A03E30C96CE84876">
                        <enum>(2)</enum>
                        <text display-inline="yes-display-inline">Specific discussion of a statistically significant sample of large fires, in which each fire is analyzed for cost drivers, effectiveness of risk management techniques, resulting positive or negative impacts of fire on the landscape, impact of investments in preparedness, suggested corrective actions, and such other factors as the respective Secretary considers appropriate.</text>
                      </paragraph>
                      <paragraph id="H0419ED7CE9BB46428C0DEE55EDF18123">
                        <enum>(3)</enum>
                        <text display-inline="yes-display-inline">Total expenditures for wildfire suppression operations of the Federal land management agencies under the jurisdiction of the respective Secretary, broken out by fire sizes, cost, regional location, and such other factors as the such Secretary considers appropriate.</text>
                      </paragraph>
                      <paragraph id="H33D2E19FA4454CC887B7DAC2E4FD07B1">
                        <enum>(4)</enum>
                        <text>Lessons learned.</text>
                      </paragraph>
                      <paragraph id="HD8F7488346604F9A86C40033CD7D8957">
                        <enum>(5)</enum>
                        <text display-inline="yes-display-inline">Such other matters as the respective Secretary considers appropriate.</text>
                      </paragraph>
                    </subsection>
                    <subsection id="H06B60BB90AA045DD9E92EAA7287326F0">
                      <enum>(g)</enum>
                      <header>Savings provision</header>
                      <text display-inline="yes-display-inline">Nothing in this title shall limit the Secretary of the Interior, the Secretary of Agriculture, Indian Tribe, or a State from receiving assistance through a declaration made by the President under this Act when the criteria for such declaration have been met.</text>
                    </subsection>

              <header>Prohibition on transfers</header>
              <text display-inline="no-display-inline">No funds may be transferred to or from the Federal land management agencies’ wildfire suppression operations accounts referred to in section 801(3) of the Robert T. Stafford Disaster Relief and Emergency Assistance Act to or from any account or subactivity of the Federal land management agencies, as defined in section 801(2) of such Act, that is not used to cover the cost of wildfire suppression operations.</text>

            <enum>XI</enum>
            <header>Disaster Relief and Wildfire Adjustment</header>
            <section id="HDB651CD7594B4B6081FFC550C1AACBBD">
              <enum>1101.</enum>
              <header>Increase in maximum adjustment to accommodate wildfire funding</header>
              <text display-inline="no-display-inline">Section 251(b)(2)(D) of the Balanced Budget and Emergency Deficit Control of 1985 is amended—</text>
              <paragraph id="H0E8D9671C712449F88C1EE60CD4FCA74">
                <enum>(1)</enum>
                <text>in clause (i), by striking subclause (I) and inserting the following:</text>

                      <text>10 percent of the funding for disaster relief designated as an emergency under subparagraph (A)(i); and</text>
