              <header>Classified Schedule of Authorizations</header>

                <enum>(a)</enum>
                <header>Specifications of amounts</header>
                <text>The amounts authorized to be appropriated under section 101 and, subject to section 103, the authorized personnel ceilings as of September 30, 2017, for the conduct of the intelligence activities of the elements listed in paragraphs (1) through (16) of section 101, are those specified in the classified Schedule of Authorizations prepared to accompany this division of this Act.</text>
              </subsection>
              <subsection id="H331CCE512A4E47618135093E9B2543D6">
                <enum>(b)</enum>
                <header>Availability of classified schedule of authorizations</header>
                <paragraph id="H3F885F6C3D884323B2FE6F7E5619C830">
                  <enum>(1)</enum>
                  <header>Availability</header>
                  <text>The classified Schedule of Authorizations referred to in subsection (a) shall be made available to the Committee on Appropriations of the Senate, the Committee on Appropriations of the House of Representatives, and to the President.</text>
                </paragraph>
                <paragraph id="H813731C04FED452492D2F9DFE72024C2">
                  <enum>(2)</enum>
                  <header>Distribution by the President</header>
                  <text>Subject to paragraph (3), the President shall provide for suitable distribution of the classified Schedule of Authorizations referred to in subsection (a), or of appropriate portions of such Schedule, within the executive branch.</text>
                </paragraph>

                  <enum>(3)</enum>
                  <header>Limits on disclosure</header>
                  <text>The President shall not publicly disclose the classified Schedule of Authorizations or any portion of such Schedule except—</text>
                  <subparagraph id="HEE3EEDBC7227441295F9039D7E2A9F6B">
                    <enum>(A)</enum>
                    <text>as provided in section 601(a) of the Implementing Recommendations of the 9/11 Commission Act of 2007 (50 U.S.C. 3306(a));</text>
                  </subparagraph>
                  <subparagraph id="H440A7CCCEC854C8E83CC97B4EB732743">
                    <enum>(B)</enum>
                    <text>to the extent necessary to implement the budget; or</text>
                  </subparagraph>
                  <subparagraph commented="no" display-inline="no-display-inline" id="H3019B1F42682458090FF85E90A09BDAD">
                    <enum>(C)</enum>
                    <text>as otherwise required by law.</text>
                  </subparagraph>
                </paragraph>
              </subsection>
            </section>
            <section commented="no" display-inline="no-display-inline" id="HE6BD745882084F079A0B96E2F1B4F33C" section-type="subsequent-section">
              <enum>103.</enum>
              <header>Personnel ceiling adjustments</header>
              <subsection commented="no" id="H81742B2A85664EDC94C715C65B88066D">
                <enum>(a)</enum>
                <header>Authority for increases</header>
                <text>The Director of National Intelligence may authorize employment of civilian personnel in excess of the number authorized for fiscal year 2017 by the classified Schedule of Authorizations referred to in section 102(a) if the Director of National Intelligence determines that such action is necessary to the performance of important intelligence functions, except that the number of personnel employed in excess of the number authorized under such section may not, for any element of the intelligence community, exceed—</text>
                <paragraph commented="no" id="H8C22C732F12F46A3BE4F2DEF2BC0D7AD">
                  <enum>(1)</enum>
                  <text>3 percent of the number of civilian personnel authorized under such schedule for such element; or</text>
                </paragraph>
                <paragraph commented="no" id="HC809862E13D048CC91DB123F33A4C424">
                  <enum>(2)</enum>
                  <text>10 percent of the number of civilian personnel authorized under such schedule for such element for the purposes of converting the performance of any function by contractors to performance by civilian personnel.</text>
                </paragraph>
              </subsection>
              <subsection commented="no" id="HB23599603CD6470CB6CC001B65293BA8">
                <enum>(b)</enum>
                <header>Treatment of certain personnel</header>
                <text>The Director of National Intelligence shall establish guidelines that govern, for each element of the intelligence community, the treatment under the personnel levels authorized under section 102(a), including any exemption from such personnel levels, of employment or assignment in—</text>
                <paragraph commented="no" id="H4780664858EB49C095DE4B8CAAE8E1A8">
                  <enum>(1)</enum>
                  <text>a student program, trainee program, or similar program;</text>
                </paragraph>

                <text>Not later than 15 days prior to the exercise of an authority described in subsection (a), the Director of National Intelligence shall submit to the congressional intelligence committees—</text>

                  <text>a written notice of the exercise of such authority; and</text>
                </paragraph>

                  <text>in the case of an exercise of such authority subject to the limitation in subsection (a)(2), a written justification for the contractor conversion that includes a comparison of whole of government costs.</text>

                <header display-inline="yes-display-inline">Authorization of appropriations</header>
                <text display-inline="yes-display-inline">There is authorized to be appropriated for the Intelligence Community Management Account of the Director of National Intelligence for fiscal year 2017 the sum of $563,588,000. Within such amount, funds identified in the classified Schedule of Authorizations referred to in section 102(a) for advanced research and development shall remain available until September 30, 2018.</text>
              </subsection>

              <header>Increase in employee compensation and benefits authorized by law</header>
              <text display-inline="no-display-inline">Appropriations authorized by this division for salary, pay, retirement, and other benefits for Federal employees may be increased by such additional or supplemental amounts as may be necessary for increases in such compensation or benefits authorized by law.</text>
            </section>

              <header>Support to nonprofit organizations assisting intelligence community employees</header>

                <enum>(a)</enum>
                <header>Director of National Intelligence</header>
                <text display-inline="yes-display-inline">Section 102A of the National Security Act of 1947 (50 U.S.C. 3024) is amended by adding at the end the following:</text>

                      <text>The Director of National Intelligence may engage in fundraising in an official capacity for the benefit of nonprofit organizations that—</text>
                      <subparagraph id="H308A7A3EA3664E018BDBBCE4464E6A9D" indent="up1">
                        <enum>(A)</enum>
                        <text>provide support to surviving family members of a deceased employee of an element of the intelligence community; or</text>
                      </subparagraph>
                      <subparagraph id="HC20737B4DEEE4BCD895352B13CD57279" indent="up1">
                        <enum>(B)</enum>
                        <text>otherwise provide support for the welfare, education, or recreation of employees of an element of the intelligence community, former employees of an element of the intelligence community, or family members of such employees.</text>
                      </subparagraph>
                    </paragraph>
                    <paragraph id="HE29918E98C8D4282A94F67EF8433A747" indent="up1">
                      <enum>(2)</enum>
                      <text>In this subsection, the term <term>fundraising</term> means the raising of funds through the active participation in the promotion, production, or presentation of an event designed to raise funds and does not include the direct solicitation of money by any other means.</text>
                    </paragraph>
                    <paragraph id="HD96A6B523E0F42CFA7356F6D3DC23962" indent="up1">
                      <enum>(3)</enum>
                      <text>Not later than 7 days after the date the Director engages in fundraising authorized by this subsection or at the time the decision is made to participate in such fundraising, the Director shall notify the congressional intelligence committees of such fundraising.</text>
                    </paragraph>

                      <enum>(4)</enum>
                      <text>The Director, in consultation with the Director of the Office of Government Ethics, shall issue regulations to carry out the authority provided in this subsection. Such regulations shall ensure that such authority is exercised in a manner that is consistent with all relevant ethical constraints and principles, including the avoidance of any prohibited conflict of interest or appearance of impropriety.</text>
                    </paragraph>
                  </subsection>

              <header>Promotion of science, technology, engineering, and mathematics education in the intelligence community</header>

                <enum>(a)</enum>
                <header>Requirement for investment strategy for STEM recruiting and outreach activities</header>
                <text>Along with the budget for fiscal year 2018 submitted by the President pursuant to section 1105(a) of title 31, United States Code, the Director of National Intelligence shall submit a five-year investment strategy for outreach and recruiting efforts in the fields of science, technology, engineering, and mathematics (STEM), to include cybersecurity and computer literacy.</text>
              </subsection>
              <subsection commented="no" display-inline="no-display-inline" id="H62B036BB14BB406CBADECA416D5C314B">
                <enum>(b)</enum>
                <header>Requirement for intelligence community plans for STEM recruiting and outreach activities</header>
                <text>For each of the fiscal years 2018 through 2022, the head of each element of the intelligence community shall submit an investment plan along with the materials submitted as justification of the budget request of such element that supports the strategy required by subsection (a).</text>
              </subsection>
            </section>

              <enum>305.</enum>
              <header>Retention of employees of the intelligence community who have science, technology, engineering, or mathematics expertise</header>
              <subsection id="H04022ED15A334070892546EC335D1673">
                <enum>(a)</enum>
                <header>Special rates of pay for certain occupations in the intelligence community</header>
                <text>The National Security Act of 1947 (50 U.S.C. 3001 et seq.) is amended by inserting after section 113A the following:</text>

                      <enum>(a)</enum>
                      <header>Authority To set special rates of pay</header>
                      <text>Notwithstanding part III of title 5, United States Code, the head of each element of the intelligence community may establish higher minimum rates of pay for 1 or more categories of positions in such element that require expertise in science, technology, engineering, or mathematics (STEM).</text>
                    </subsection>
                    <subsection id="HFB781DCD27934C62B345B9D3466B71D9">
                      <enum>(b)</enum>
                      <header>Maximum special rate of pay</header>
                      <text>A minimum rate of pay established for a category of positions under subsection (a) may not exceed the maximum rate of basic pay (excluding any locality-based comparability payment under section 5304 of title 5, United States Code, or similar provision of law) for the position in that category of positions without the authority of subsection (a) by more than 30 percent, and no rate may be established under this section in excess of the rate of basic pay payable for level IV of the Executive Schedule under section 5315 of title 5, United States Code.</text>
                    </subsection>
                    <subsection id="H931D8ABBF1A34B988E953757F0A9F332">
                      <enum>(c)</enum>
                      <header>Notification of removal from special rate of pay</header>
                      <text>If the head of an element of the intelligence community removes a category of positions from coverage under a rate of pay authorized by subsection (a) after that rate of pay takes effect—</text>
                      <paragraph id="H39F02B7DFB3C48829B965910953F6FCB">
                        <enum>(1)</enum>
                        <text>the head of such element shall provide notice of the loss of coverage of the special rate of pay to each individual in such category; and</text>
                      </paragraph>
                      <paragraph id="H56C7F293903C4707B365A827D467F721">
                        <enum>(2)</enum>
                        <text>the loss of coverage will take effect on the first day of the first pay period after the date of the notice.</text>
                      </paragraph>
                    </subsection>
                    <subsection id="H670301E58D244EEB959E195B9A8184E0">
                      <enum>(d)</enum>
                      <header>Revision of special rates of pay</header>
                      <text>Subject to the limitations in this section, rates of pay established under this section by the head of the element of the intelligence community may be revised from time to time by the head of such element and the revisions have the force and effect of statute.</text>
                    </subsection>
                    <subsection id="HD99604E1F74A4668AC1F02E3BFE0512A">
                      <enum>(e)</enum>
                      <header>Regulations</header>
                      <text>The head of each element of the intelligence community shall promulgate regulations to carry out this section with respect to such element, which shall, to the extent practicable, be comparable to the regulations promulgated to carry out section 5305 of title 5, United States Code.</text>
                    </subsection>

                      <enum>(f)</enum>
                      <header>Reports</header>
                      <paragraph id="HB00BAAAB1E024D629DF27C2901F16DD2">
                        <enum>(1)</enum>
                        <header>Requirement for reports</header>
                        <text>Not later than 90 days after the date of the enactment of the Intelligence Authorization Act for Fiscal Year 2017, the head of each element of the intelligence community shall submit to the congressional intelligence committees a report on any rates of pay established for such element under this section.</text>
                      </paragraph>

                        <enum>(2)</enum>
                        <header>Contents</header>
                        <text>Each report required by paragraph (1) shall contain for each element of the intelligence community—</text>

                  <text>Beginning on October 1, 2018, the Director of National Intelligence shall improve management of the workforce of the intelligence community by enabling elements of the intelligence community to build and maintain an appropriate mix between employees of the United States Government and core contractors.</text>
                </paragraph>

                  <enum>(2)</enum>
                  <header>Briefing to Congress</header>
                  <text>Not later than July 1, 2017, and each 120 days thereafter until July 1, 2018, the Director of National Intelligence shall brief the congressional intelligence committees on the initiative required by paragraph (1).</text>
                </paragraph>
              </subsection>

                <enum>(b)</enum>
                <header>Management based on workload requirements and authorized funding</header>
                <paragraph id="H7939DC5F3F5144C99D59BA5CA7FE182C">
                  <enum>(1)</enum>
                  <header>In general</header>
                  <text>Beginning on October 1, 2018, the personnel levels of the intelligence community shall be managed each fiscal year on the basis of—</text>
                  <subparagraph id="HC2F8F01BD2774CDBAA3ACBFBA3AC40F0">
                    <enum>(A)</enum>
                    <text>the workload required to carry out the functions and activities of the intelligence community; and</text>
                  </subparagraph>
                  <subparagraph id="HA0010E08528446BA9ACF345FEC4B2AE5">
                    <enum>(B)</enum>
                    <text>the funds made available to the intelligence community in accordance with section 504 of the National Security Act of 1947 (50 U.S.C. 3094).</text>
                  </subparagraph>
                </paragraph>
                <paragraph id="HA70C60618454406AA1CF5212F148ED45">
                  <enum>(2)</enum>
                  <header>Prohibition on constraints or limitations</header>
                  <text>Beginning on October 1, 2018, the management of such personnel in the intelligence community in any fiscal year shall not be subject to an externally imposed constraint or limitation expressed in terms of man years, end strength, full-time equivalent positions, or maximum number of employees.</text>
                </paragraph>
              </subsection>
              <subsection id="H24133BD471AC472BB75C2695AF39C67A">
                <enum>(c)</enum>
                <header>Briefing and report to Congress</header>
                <text>Not later than 180 days after the date of the enactment of this Act, the Director of National Intelligence shall issue a written report and provide a briefing to the congressional intelligence committees on—</text>
                <paragraph id="HA84ADB99AE054B6DB3958E9FAE43B6D3">
                  <enum>(1)</enum>
                  <text>the methodology used to calculate the number of civilian and contractor full-time equivalent positions in the intelligence community;</text>
                </paragraph>
                <paragraph id="HEA91D99FB2C54FB38B58366E7408D1A4">
                  <enum>(2)</enum>
                  <text>the cost analysis tool used to calculate personnel costs in the intelligence community; and</text>
                </paragraph>
                <paragraph id="HA214EE49A3044FDABD844802E0B2A926">
                  <enum>(3)</enum>
                  <text>the plans of the Director of National Intelligence and the head of each element of the intelligence community to implement a multi-sector workforce as required by subsections (a) and (b).</text>
                </paragraph>
              </subsection>
              <subsection id="HA86BDB9DFCD548A3822FBA01C6D6079F">
                <enum>(d)</enum>
                <header>Report</header>
                <text>Not later than 240 days after date of the enactment of this Act, the Inspector General of the Intelligence Community shall submit to the congressional intelligence committees a written report on the accuracy of intelligence community data for the numbers and costs associated with the civilian and contractor workforce in each element of the intelligence community.</text>
              </subsection>
            </section>

              <header>Notification of repair or modification of facilities to be used primarily by the intelligence community</header>

                    <text>means any significant interaction between an element of the intelligence community and an entertainment industry entity for the purposes of contributing to an entertainment product intended to be heard, read, viewed, or otherwise experienced by the public; and</text>
                  </subparagraph>

                    <enum>(B)</enum>
                    <text>does not include routine inquiries made by the press or news media to the public affairs office of an intelligence community.</text>
                  </subparagraph>
                </paragraph>
                <paragraph commented="no" id="H1C1F0567FF4D431DB3E6FFB9B91E8023">
                  <enum>(2)</enum>
                  <header>Entertainment industry entity</header>
                  <text>The term <term>entertainment industry entity</term> means an entity that creates, produces, promotes, or distributes a work of entertainment intended to be heard, read, viewed, or otherwise experienced by an audience, including—</text>
                  <subparagraph commented="no" id="H6E418828CFE74510B67EA32A13EDB728">
                    <enum>(A)</enum>
                    <text>theater productions, motion pictures, radio broadcasts, television broadcasts, podcasts, webcasts, other sound or visual recording, music, or dance;</text>
                  </subparagraph>
                  <subparagraph commented="no" id="H603277E91E5143F6B09A79FAF637E49B">
                    <enum>(B)</enum>
                    <text>books and other published material; and</text>
                  </subparagraph>
                  <subparagraph commented="no" id="H20100D92C38F44C3A7E1FD1CCE6043FB">
                    <enum>(C)</enum>
                    <text>such other entertainment activity, as determined by the Director of National Intelligence.</text>
                  </subparagraph>
                </paragraph>
              </subsection>

                <enum>(b)</enum>
                <header>Director of National Intelligence guidance</header>
                <paragraph commented="no" display-inline="no-display-inline" id="H0937EAEACD6D4888886284E9298D90B5">

                  <header>In general</header>
                  <text>Not later than 180 days after the date of the enactment of this Act, the Director of National Intelligence shall issue, and release to the public, guidance regarding engagements by elements of the intelligence community with entertainment industry entities.</text>
                </paragraph>

                  <enum>(2)</enum>
                  <header>Criteria</header>
                  <text>The guidance required by paragraph (1) shall—</text>

                    <enum>(A)</enum>
                    <text>permit an element of the intelligence community to conduct engagements, if the head of the element, or a designee of such head, provides prior approval; and</text>
                  </subparagraph>

                    <enum>(B)</enum>
                    <text>require an unclassified annual report to the congressional intelligence committees regarding engagements.</text>
                  </subparagraph>

              </subsection>

                <enum>(c)</enum>
                <header>Annual report</header>
                <text>Each report required by subsection (b)(2)(B) shall include the following:</text>

              <header>Protections for independent inspectors general of certain elements of the intelligence community</header>
              <subsection id="HC5B9A1CDC415400EA62F0CF16FDBA0D8">
                <enum>(a)</enum>
                <header>Limitation on activities of employees of an office of inspector general</header>
                <paragraph id="H975FB068AB874240A45D82465D91571B">
                  <enum>(1)</enum>
                  <header>Limitations</header>
                  <text>Not later than 180 days after the date of the enactment of this Act, the Director of National Intelligence shall develop and implement a uniform policy for each covered office of an inspector general to better ensure the independence of each such office. Such policy shall include—</text>
                  <subparagraph id="H41370391B36F4FBFAB3761946FA91E0A">
                    <enum>(A)</enum>
                    <text>provisions to prevent any conflict of interest related to a matter any employee of a covered office of an inspector general personally and substantially participated in during previous employment;</text>
                  </subparagraph>
                  <subparagraph id="HC9CDC6900A9149AF85E172180856F55C">
                    <enum>(B)</enum>
                    <text>standards to ensure personnel of a covered office of an inspector general are free both in fact and in appearance from personal, external, and organizational impairments to independence;</text>
                  </subparagraph>
                  <subparagraph id="H70B3406FE6AC411B974942AC6C853165">
                    <enum>(C)</enum>
                    <text>provisions to permit the head of each covered office of an inspector general to waive the application of the policy with respect to an individual if such head—</text>
                    <clause id="HB9A3F177944D495EBB963A5A904204F5">
                      <enum>(i)</enum>
                      <text>prepares a written and signed justification for such waiver that sets out, in detail, the need for such waiver, provided that waivers shall not be issued for in fact impairments to independence; and</text>
                    </clause>

                      <enum>(ii)</enum>
                      <text>submits to the congressional intelligence committees each such justification; and</text>

                    <text display-inline="yes-display-inline">any other protections the Director determines appropriate.</text>

                  <text>Prior to the date that the policy required by paragraph (1) takes effect, the Director of National Intelligence shall provide the congressional intelligence committees a briefing on such policy.</text>
                </paragraph>
              </subsection>
              <subsection id="H3ADCAFA8585F4DF4B961A8716CBC1382">
                <enum>(b)</enum>
                <header>Limitation on rotation of employees of an office of inspector general</header>
                <text>Section 102A(l)(3) of the National Security Act of 1947 (50 U.S.C. 3024(l)(3)) is amended by adding at the end the following:</text>

                      <text>may not require an employee of an office of inspector general for an element of the intelligence community, including the Office of the Inspector General of the Intelligence Community, to rotate to a position in an office or organization of such an element over which such office of inspector general exercises jurisdiction; and</text>

                      <enum>(ii)</enum>
                      <text>shall be implemented in a manner that exempts employees of an office of inspector general from a rotation that may impact the independence of such office.</text>

              <enum>310.</enum>
              <header>Congressional oversight of policy directives and guidance</header>
              <subsection commented="no" id="HEA48449071404382A25D59FEEC0F9588">
                <enum>(a)</enum>
                <header>Covered policy document defined</header>
                <text>In this section, the term <term>covered policy document</term> means any classified or unclassified Presidential Policy Directive, Presidential Policy Guidance, or other similar policy document issued by the President, including any classified or unclassified annex to such a Directive, Guidance, or other document, that assigns tasks, roles, or responsibilities to the intelligence community or an element of the intelligence community.</text>
              </subsection>
              <subsection commented="no" id="HC6FC1EC06FB14BA7A0FEC53FCA171FCE">
                <enum>(b)</enum>
                <header>Submissions to Congress</header>
                <text>The Director of National Intelligence shall submit to the congressional intelligence committees the following:</text>
                <paragraph commented="no" id="HDFE000E30F7945FE8E9D87EEC9232DC3">
                  <enum>(1)</enum>
                  <text>Not later than 15 days after the date that a covered policy document is issued, a written notice of the issuance and a summary of the subject matter addressed by such covered policy document.</text>
                </paragraph>
                <paragraph commented="no" id="H6DA0BC22129145E0858CEA0C760EBDCD">
                  <enum>(2)</enum>
                  <text>Not later than 15 days after the date that the Director issues any guidance or direction on implementation of a covered policy document or implements a covered policy document, a copy of such guidance or direction or a description of such implementation.</text>
                </paragraph>

                  <enum>(3)</enum>
                  <text>Not later than 15 days after the date of the enactment of this Act, for any covered policy document issued prior to such date that is being implemented by any element of the intelligence community or that is in effect on such date—</text>

                    <enum>(A)</enum>
                    <text>a written notice that includes the date such covered policy document was issued and a summary of the subject matter addressed by such covered policy document; and</text>
                  </subparagraph>
                  <subparagraph commented="no" id="H91EE5A49203F459595B42E5A7DEB0377">
                    <enum>(B)</enum>
                    <text>if the Director has issued any guidance or direction on implementation of such covered policy document or is implementing such covered policy document, a copy of the guidance or direction or a written description of such implementation.</text>
                  </subparagraph>
                </paragraph>
              </subsection>
            </section>

              <enum>311.</enum>
              <header>Notification of memoranda of understanding</header>
              <subsection id="HBFD27443ECB34B14B0CBD42A66E5F7D6">
                <enum>(a)</enum>
                <header>In general</header>
                <text display-inline="yes-display-inline">The head of each element of the intelligence community shall submit to the congressional intelligence committees a copy of each memorandum of understanding or other agreement regarding significant operational activities or policy between or among such element and any other entity or entities of the United States Government—</text>
                <paragraph id="HDF0F94F121E64AC784422EB4DA657BD3">
                  <enum>(1)</enum>
                  <text>for such a memorandum or agreement that is in effect on the date of the enactment of this Act, not later than 60 days after such date; and</text>
                </paragraph>
                <paragraph commented="no" display-inline="no-display-inline" id="H66EDA4C9B1BC44DA89B8A17BA7CCBC28">
                  <enum>(2)</enum>
                  <text>for such a memorandum or agreement entered into after such date, in a timely manner and not more than 60 days after the date such memorandum or other agreement is entered into.</text>
                </paragraph>
              </subsection>
              <subsection commented="no" display-inline="no-display-inline" id="H2D6E1637262C43FBB5846A1AEBD0AAD1">
                <enum>(b)</enum>
                <header>Administrative memorandum or agreement</header>
                <text>Nothing in this section may be construed to require an element of the intelligence community to submit to the congressional intelligence committees any memorandum or agreement that is solely administrative in nature, including a memorandum or agreement regarding joint duty or other routine personnel assignments.</text>
              </subsection>
            </section>

              <enum>312.</enum>
              <header>Technical correction to Executive Schedule</header>
              <text display-inline="no-display-inline">Section 5313 of title 5, United States Code, is amended by striking the item relating to <quote>Director of the National Counter Proliferation Center.</quote>.</text>

                    <enum>(2)</enum>
                    <text>An assessment of whether officers of the Federal Bureau of Investigation who possess such skills are fully integrated into the Bureau's work, including Agent-led investigations.</text>

                    <enum>(3)</enum>

                    <text display-inline="yes-display-inline">Except as provided in subsection (c), the Director of the National Reconnaissance Office shall develop a plan for the National Reconnaissance Office to address how to carry out covered space-based environmental monitoring missions. Such plan shall include—</text>

                      <enum>(A)</enum>
                      <text display-inline="yes-display-inline">a description of the related national security requirements for such missions;</text>
                    </subparagraph>

                      <enum>(B)</enum>
                      <text>a description of the appropriate manner to meet such requirements; and</text>
                    </subparagraph>

                      <text display-inline="yes-display-inline">the amount of funds that would be necessary to be transferred from the Air Force to the National Reconnaissance Office during fiscal years 2018 through 2022 to carry out such plan.</text>

                    <enum>(2)</enum>
                    <header>Activities</header>
                    <text display-inline="yes-display-inline">In developing the plan under paragraph (1), the Director may conduct pre-acquisition activities, including with respect to requests for information, analyses of alternatives, study contracts, modeling and simulation, and other activities the Director determines necessary to develop such plan.</text>
                  </paragraph>

                  <enum>(c)</enum>
                  <header>Waiver based on report and certification of Air Force acquisition program</header>
                  <text>The Director of the National Reconnaissance Office may waive the requirement to develop a plan under subsection (a), if the Under Secretary of Defense for Acquisition Technology, and Logistics and the Chairman of the Joint Chiefs of Staff jointly submit to the appropriate congressional committees a report by not later than July 1, 2017) that contains—</text>

                <text>The duties of the committee established by subsection (b) shall be as follows:</text>

                  <text>To counter active measures by Russia to exert covert influence, including by exposing falsehoods, agents of influence, corruption, human rights abuses, terrorism, and assassinations carried out by the security services or political elites of the Russian Federation or their proxies.</text>
                </paragraph>
                <paragraph commented="no" id="H8A16A81D8BA0453AB1A30C1139ABD514">
                  <enum>(2)</enum>
                  <text>Such other duties as the President may designate for purposes of this section.</text>
                </paragraph>
              </subsection>

                <enum>(f)</enum>
                <header>Staff</header>
                <text>The committee established by subsection (b) may employ such staff as the members of such committee consider appropriate.</text>
              </subsection>

                <enum>(g)</enum>
                <header>Budget request</header>
                <text>A request for funds required for the functioning of the committee established by subsection (b) may be included in each budget for a fiscal year submitted by the President pursuant to section 1105(a) of title 31, United States Code.</text>

                  <text>Not later than 180 days after the date of the enactment of this Act, and annually thereafter, and consistent with the protection of intelligence sources and methods, the committee established by subsection (b) shall submit to the appropriate committees of Congress a report describing steps being taken by the committee to counter active measures by Russia to exert covert influence.</text>
                </paragraph>

                  <header>Content</header>
                  <text>Each report required by paragraph (1) shall include the following:</text>

                    <text>A summary of the active measures by the Russian Federation to exert covert influence during the previous year, including significant incidents and notable trends.</text>

                    <enum>(B)</enum>
                    <text>A description of the key initiatives of the committee.</text>
                  </subparagraph>

                    <text>A description of the implementation of the committee’s initiatives by the head of an agency or department of the Government set out under subsection (c)(1)(B).</text>
                  </subparagraph>

                    <text>An analysis of the impact of the committee’s initiatives.</text>

              <header>Strict enforcement of travel protocols and procedures of accredited diplomatic and consular personnel of the Russian Federation in the United States</header>

                <text>In this section, the term <term>appropriate committees of Congress</term> means—</text>

                  <text>the congressional intelligence committees;</text>
                </paragraph>

                  <text>the Committee on Foreign Relations and the Committee on the Judiciary of the Senate; and</text>
                </paragraph>

                  <text>the Committee on Foreign Affairs and the Committee on the Judiciary of the House of Representatives.</text>
                </paragraph>
              </subsection>
              <subsection id="H108D1B0325344239B6C15C052A64BDF7">
                <enum>(b)</enum>
                <header>Advance notification requirement</header>
                <text>The Secretary of State shall, in coordination with the Director of the Federal Bureau of Investigation and the Director of National Intelligence, establish a mandatory advance notification regime governing all travel by accredited diplomatic and consular personnel of the Russian Federation in the United States and take necessary action to secure full compliance by Russian personnel and address any noncompliance.</text>
              </subsection>
              <subsection id="H99B1634CEE0D4516A85374B61CFCD0C8">
                <enum>(c)</enum>
                <header>Interagency cooperation</header>
                <text>The Secretary of State, the Director of the Federal Bureau of Investigation, and the Director of National Intelligence shall develop written mechanisms to share information—</text>
                <paragraph id="H61D1370306CE4421BA61305DE78C7F36">
                  <enum>(1)</enum>
                  <text>on travel by accredited diplomatic and consular personnel of the Russian Federation who are in the United States; and</text>
                </paragraph>
                <paragraph id="H6597CE5F31FC494298C11609D867F119">
                  <enum>(2)</enum>
                  <text>on any known or suspected noncompliance by such personnel with the regime required by subsection (b).</text>
                </paragraph>
              </subsection>
              <subsection id="H07D6AC164DA4481F894FB179860304F3">
                <enum>(d)</enum>
                <header>Quarterly reports</header>
                <text>Not later than 90 days after the date of the enactment of this Act, and quarterly thereafter, and consistent with the protection of intelligence sources and methods—</text>

                  <enum>(1)</enum>
                  <text>the Secretary of State shall submit to the appropriate committees of Congress a written report detailing the number of notifications submitted under the regime required by subsection (b); and</text>
                </paragraph>

                  <enum>(2)</enum>
                  <text>the Secretary of State and the Director of the Federal Bureau of Investigation shall jointly submit to the appropriate committees of Congress a written report detailing the number of known or suspected violations of such requirements by any accredited diplomatic and consular personnel of the Russian Federation.</text>
                </paragraph>
              </subsection>

              <enum>503.</enum>
              <header>Study and report on enhanced intelligence and information sharing with Open Skies Treaty member states</header>

                <header>Definitions</header>
                <text>In this section:</text>

                  <text>The term <term>appropriate committees of Congress</term> means—</text>

                    <text>congressional intelligence committees;</text>
                  </subparagraph>

                    <text>was a state party to the Open Skies Treaty on February 22, 2016; and</text>
                  </subparagraph>

                    <enum>(B)</enum>
                    <text>is not the Russian Federation or the Republic of Belarus.</text>
                  </subparagraph>
                </paragraph>
                <paragraph commented="no" id="HE2E918F4BA0840749520E76F3AA9F88B">
                  <enum>(3)</enum>
                  <header>Open Skies Treaty</header>
                  <text>The term <term>Open Skies Treaty</term> means the Treaty on Open Skies, done at Helsinki March 24, 1992, and entered into force January 1, 2002.</text>
                </paragraph>
              </subsection>
              <subsection commented="no" id="H069E0A04D9BD48D5B8E9B385172B63EB">
                <enum>(b)</enum>
                <header>Feasibility study</header>
                <paragraph commented="no" id="H0164B38DEF7C4FED962E9754452D3446">
                  <enum>(1)</enum>
                  <header>Requirement for study</header>
                  <text>Not later than 180 days after the date of the enactment of this Act, the Director of National Intelligence shall conduct and submit to the appropriate committees of Congress a study to determine the feasibility of creating an intelligence sharing arrangement and database to provide covered state parties with imagery that is comparable, delivered more frequently, and in equal or higher resolution than imagery available through the database established under the Open Skies Treaty.</text>
                </paragraph>
                <paragraph commented="no" id="H9559C79900C34EA08C20BF7F7FD344CF">
                  <enum>(2)</enum>
                  <header>Elements</header>
                  <text>The study required by paragraph (1) shall include an evaluation of the following:</text>
                  <subparagraph commented="no" id="H8092A50CD8C642F6AB41F7418F29208B">
                    <enum>(A)</enum>
                    <text>The methods by which the United States could collect and provide imagery, including commercial satellite imagery, national technical means, and through other intelligence, surveillance, and reconnaissance platforms, under an information sharing arrangement and database referred to in paragraph (1).</text>
                  </subparagraph>
                  <subparagraph commented="no" id="HACDA50111092416EA34556D3C4126346">
                    <enum>(B)</enum>
                    <text>The ability of other covered state parties to contribute imagery to the arrangement and database.</text>
                  </subparagraph>
                  <subparagraph commented="no" id="H0EE6C0D14C22436DB01B765A0B43C309">
                    <enum>(C)</enum>
                    <text>Any impediments to the United States and other covered states parties providing such imagery, including any statutory barriers, insufficiencies in the ability to collect the imagery or funding, under such an arrangement.</text>
                  </subparagraph>
                  <subparagraph commented="no" id="HBD22BD815B954FA5BD49370E22CB31D3">
                    <enum>(D)</enum>
                    <text>Whether imagery of Moscow, Chechnya, the international border between Russia and Georgia, Kaliningrad, or the Republic of Belarus could be provided under such an arrangement.</text>
                  </subparagraph>
                  <subparagraph commented="no" id="HA9B7EC321C094C379AB50464B3E075B0">
                    <enum>(E)</enum>
                    <text>The annual and projected costs associated with the establishment of such an arrangement and database, as compared with costs to the United States and other covered state parties of being parties to the Open Skies Treaty, including Open Skies Treaty plane maintenance, aircraft fuel, crew expenses, mitigation measures necessary associated with Russian Federation overflights of the United States or covered state parties, and new sensor development and acquisition.</text>
                  </subparagraph>
                </paragraph>
                <paragraph commented="no" id="H1022C9B4FBBD41619DECAD6971B6F30B">
                  <enum>(3)</enum>
                  <header>Support from other Federal agencies</header>
                  <text>Each head of a Federal agency shall provide such support to the Director as may be necessary for the Director to conduct the study required by paragraph (1).</text>
                </paragraph>
              </subsection>

                <header>Report</header>

                    <text>An intelligence assessment of Russian Federation warfighting doctrine and the extent to which Russian Federation flights under the Open Skies Treaty contribute to such doctrine.</text>

                    <enum>(B)</enum>
                    <text>A counterintelligence analysis as to whether the Russian Federation has, could have, or intends to have the capability to exceed the imagery limits set forth in the Open Skies Treaty.</text>
                  </subparagraph>
                  <subparagraph commented="no" id="HAB7BF68511B240FFA094241A4F4858E1">
                    <enum>(C)</enum>
                    <text>A list of intelligence exchanges with covered state parties that have been updated on the information described in subparagraphs (A) and (B) and the date and form such information was provided.</text>
                  </subparagraph>
                </paragraph>
              </subsection>

                <enum>(d)</enum>
                <header>Form of submission</header>
                <text display-inline="yes-display-inline">The study required by subsection (b) and the report required by subsection (c) shall be submitted in an unclassified form but may include a classified annex.</text>

              <header>Declassification review with respect to detainees transferred from United States Naval Station, Guantanamo Bay, Cuba</header>

                <header>In general</header>
                <text>For each individual detained at United States Naval Station, Guantanamo Bay, Cuba, who was transferred or released from United States Naval Station, Guantanamo Bay, Cuba, the Director of National Intelligence shall—</text>

                  <enum>(1)</enum>
                  <subparagraph commented="no" display-inline="yes-display-inline" id="HEF0F51E9B13A42619DE21BED46AC966A">

                    <text>complete a declassification review of intelligence reports regarding past terrorist activities of that individual prepared by the National Counterterrorism Center for the individual's Periodic Review Board sessions, transfer, or release; or</text>
                  </subparagraph>
                  <subparagraph commented="no" id="H006D257F157F4B889DDC971BF5F752F5" indent="up1">
                    <enum>(B)</enum>
                    <text>if the individual’s transfer or release occurred prior to the date on which the National Counterterrorism Center first began to prepare such reports regarding detainees, such other intelligence report or reports that contain the same or similar information regarding the individual’s past terrorist activities;</text>
                  </subparagraph>
                </paragraph>
                <paragraph commented="no" id="H145DC5EE50DA4FD1B9AF4E74601D463F">
                  <enum>(2)</enum>
                  <text>make available to the public—</text>
                  <subparagraph commented="no" id="HE10359A7CA31465A92490CA562CB0DB8">
                    <enum>(A)</enum>
                    <text>any intelligence reports declassified as a result of the declassification review; and</text>
                  </subparagraph>
                  <subparagraph commented="no" id="HA9D69611D81B460CB75A41324BC1B6CA">
                    <enum>(B)</enum>
                    <text>with respect to each individual transferred or released, for whom intelligence reports are declassified as a result of the declassification review, an unclassified summary which shall be prepared by the President of measures being taken by the country to which the individual was transferred or released to monitor the individual and to prevent the individual from carrying out future terrorist activities; and</text>
                  </subparagraph>
                </paragraph>
                <paragraph commented="no" id="H2EA223085A904758BFFB3DF60985B08D">
                  <enum>(3)</enum>
                  <text>submit to the congressional intelligence committees a report setting out the results of the declassification review, including a description of intelligence reports covered by the review that were not declassified.</text>
                </paragraph>
              </subsection>

                <enum>(b)</enum>
                <header>Schedule</header>
                <paragraph commented="no" id="H76EE5A34165446AF85AA18C909E3E250">
                  <enum>(1)</enum>
                  <header>Transfer or release prior to enactment</header>
                  <text>Not later than 210 days after the date of the enactment of this Act, the Director of National Intelligence shall submit the report required by subsection (a)(3), which shall include the results of the declassification review completed for each individual detained at United States Naval Station, Guantanamo Bay, Cuba, who was transferred or released from United States Naval Station, Guantanamo Bay, prior to the date of the enactment of this Act.</text>
                </paragraph>
                <paragraph commented="no" id="HDEA4E2B84BB844D7BDB162EDD9EA44E8">
                  <enum>(2)</enum>
                  <header>Transfer or release after enactment</header>
                  <text>Not later than 120 days after the date an individual detained at United States Naval Station, Guantanamo Bay, on or after the date of the enactment of this Act is transferred or released from United States Naval Station, Guantanamo Bay, the Director shall submit the report required by subsection (a)(3) for such individual.</text>
                </paragraph>
              </subsection>
              <subsection commented="no" id="HD742C4AE6A1B4ADAA81E8CBB82D1600E">
                <enum>(c)</enum>
                <header>Past terrorist activities</header>
                <text>For purposes of this section, the past terrorist activities of an individual shall include all terrorist activities conducted by the individual before the individual's transfer to the detention facility at United States Naval Station, Guantanamo Bay, including, at a minimum, the following:</text>

                  <enum>(1)</enum>
                  <text>The terrorist organization, if any, with which affiliated.</text>
                </paragraph>
                <paragraph commented="no" id="HDEAF514FE57B47EF9F1515C3EE821EEA">
                  <enum>(2)</enum>
                  <text>The terrorist training, if any, received.</text>
                </paragraph>
                <paragraph commented="no" id="H4192892B2F394C77A595FF7939BE0F62">
                  <enum>(3)</enum>
                  <text>The role in past terrorist attacks against United States interests or allies.</text>
                </paragraph>
                <paragraph commented="no" id="HAE9453655BB24FCC998BC6B16FE64737">

                  <text>The direct responsibility, if any, for the death of United States citizens or members of the Armed Forces.</text>
                </paragraph>

                      <enum>(a)</enum>
                      <header>Establishment</header>
                      <paragraph commented="no" display-inline="yes-display-inline" id="H963BA92B8BAE484E89A681B69FF1CEC9">
                        <enum>(1)</enum>
                        <text>The Secretary of Defense may establish at a publicly accessible location at Fort George G. Meade the <quote>Cyber Center for Education and Innovation-Home of the National Cryptologic Museum</quote> (in this section referred to as the <quote>Center</quote>).</text>
                      </paragraph>
                      <paragraph id="HD3B6BC7E39B2488AA5A18BD0AFA691F6" indent="up1">
                        <enum>(2)</enum>
                        <text>The Center may be used for the identification, curation, storage, and public viewing of materials relating to the activities of the National Security Agency, its predecessor or successor organizations, and the history of cryptology.</text>
                      </paragraph>
                      <paragraph id="H617026DB8CE24D4C91DC2ED6FF956715" indent="up1">
                        <enum>(3)</enum>
                        <text>The Center may contain meeting, conference, and classroom facilities that will be used to support such education, training, public outreach, and other purposes as the Secretary considers appropriate.</text>
                      </paragraph>
                    </subsection>
                    <subsection id="H01D9AC24D73B4CCA8F5B2EF9A581AB0D">
                      <enum>(b)</enum>
                      <header>Design, construction, and operation</header>
                      <text>The Secretary may enter into an agreement with the National Cryptologic Museum Foundation (in this section referred to as the <quote>Foundation</quote>), a nonprofit organization, for the design, construction, and operation of the Center.</text>
                    </subsection>
                    <subsection id="HEC19324743A149E6AC3B66E42F3AC43E">
                      <enum>(c)</enum>
                      <header>Acceptance authority</header>
                      <paragraph commented="no" display-inline="yes-display-inline" id="H177E86232A1D48EAB096CAAC56474F43">
                        <enum>(1)</enum>
                        <text>If the Foundation constructs the Center pursuant to an agreement with the Foundation under subsection (b), upon satisfactory completion of the Center’s construction or any phase thereof, as determined by the Secretary, and upon full satisfaction by the Foundation of any other obligations pursuant to such agreement, the Secretary may accept the Center (or any phase thereof) from the Foundation, and all right, title, and interest in the Center or such phase shall vest in the United States.</text>
                      </paragraph>
                      <paragraph id="H9CFA4F3C32CF419BB424A7A697382905" indent="up1">
                        <enum>(2)</enum>
                        <text>Notwithstanding section 1342 of title 31, the Secretary may accept services from the Foundation in connection with the design construction, and operation of the Center. For purposes of this section and any other provision of law, employees or personnel of the Foundation shall not be considered to be employees of the United States.</text>
                      </paragraph>
                    </subsection>
                    <subsection id="H582EDDC4ECC2452F8924197F39F91B90">
                      <enum>(d)</enum>
                      <header>Fees and user charges</header>
                      <paragraph commented="no" display-inline="yes-display-inline" id="HD99E879DFDAA48E19258BFA41C0278DE">
                        <enum>(1)</enum>
                        <text>The Secretary may assess fees and user charges to cover the cost of the use of Center facilities and property, including rental, user, conference, and concession fees.</text>
                      </paragraph>
                      <paragraph id="H847EF626388E4DACB77A4AFA297BE268" indent="up1">
                        <enum>(2)</enum>
                        <text>Amounts received under paragraph (1) shall be deposited into the fund established under subsection (e).</text>
                      </paragraph>
                    </subsection>

                      <enum>(e)</enum>
                      <header>Fund</header>
                      <paragraph commented="no" display-inline="yes-display-inline" id="H01C654560F584329999416FC36639A93">
                        <enum>(1)</enum>
                        <text>Upon the Secretary's acceptance of the Center under subsection (c)(1)) there is established in the Treasury a fund to be known as the <quote>Cyber Center for Education and Innovation-Home of the National Cryptologic Museum Fund</quote> (in this subsection referred to as the <quote>Fund</quote>).</text>
                      </paragraph>
                      <paragraph commented="no" id="H672061A1B7914A09976FA61152DBB815" indent="up1">
                        <enum>(2)</enum>
                        <text>The Fund shall consist of the following amounts:</text>
                        <subparagraph commented="no" id="H0CB83AD3B2054D79A572956BBDE451DD">
                          <enum>(A)</enum>
                          <text>Fees and user charges deposited by the Secretary under subsection (d).</text>
                        </subparagraph>
                        <subparagraph commented="no" id="HF80B095BCE87490E94C50765B16DBF45">
                          <enum>(B)</enum>
                          <text>Any other amounts received by the Secretary which are attributable to the operation of the Center.</text>
                        </subparagraph>
                      </paragraph>

                        <enum>(3)</enum>
                        <text>Amounts in the Fund shall be available to the Secretary for the benefit and operation of the Center, including the costs of operation and the acquisition of books, manuscripts, works of art, historical artifacts, drawings, plans, models, and condemned or obsolete combat materiel.</text>
                      </paragraph>

              </subsection>

                <enum>(c)</enum>
                <header>Content</header>
                <text>Each report submitted under subsection (b) shall include information related to—</text>

                  <text>national security systems or components thereof that have been decertified and are still in operational use;</text>
                </paragraph>

                  <enum>(2)</enum>
                  <text>extension requests and the current status of any national security systems still in use or components thereof that have been decertified and are still in use;</text>
                </paragraph>
                <paragraph commented="no" id="H5D7E61CFC8474A5AB8B1BC8D0E138362">
                  <enum>(3)</enum>
                  <text>national security systems known to not be in compliance with the policies, principles, standards, and guidelines issued by the Committee on National Security Systems established pursuant to National Security Directive 42, signed by the President on July 5, 1990; and</text>
                </paragraph>

                  <enum>(4)</enum>
                  <text>organizations which have not provided access or information to the Director of the National Security Agency that is adequate to enable the Director to make a determination as to whether such organizations are in compliance with the policies, principles, standards, and guidelines issued by such Committee on National Security Systems.</text>

              <header>Joint facilities certification</header>

                <enum>(a)</enum>
                <header>Findings</header>
                <text>Congress finds the following:</text>
                <paragraph id="HF1BF88C25814422FBCDD432DBE784AFE">
                  <enum>(1)</enum>
                  <text>The Director of National Intelligence set a strategic goal to use joint facilities as a means to save costs by consolidating administrative and support functions across multiple elements of the intelligence community.</text>
                </paragraph>
                <paragraph id="H981822C19A7F46F696A53006E320322E">
                  <enum>(2)</enum>
                  <text>The use of joint facilities provides more opportunities for operational collaboration and information sharing among elements of the intelligence community.</text>
                </paragraph>
              </subsection>
              <subsection id="H9C3EC8122C3F424EAC6B66A19204EC2C">
                <enum>(b)</enum>
                <header>Certification</header>
                <text>Before an element of the intelligence community purchases, leases, or constructs a new facility that is 20,000 square feet or larger, the head of that element of the intelligence community shall submit to the Director of National Intelligence—</text>

                  <enum>(1)</enum>
                  <text>a written certification that, to the best of the knowledge of the head of such element, all prospective joint facilities in the vicinity have been considered and the element is unable to identify a joint facility that meets the operational requirements of such element; and</text>

                  <enum>(2)</enum>
                  <text>a written statement listing the reasons for not participating in the prospective joint facilities considered by the element.</text>

              <header>Leadership and management of space activities</header>

                <text>In this section, the term <quote>appropriate committees of Congress</quote> means the congressional intelligence committees, the Committee on Armed Services of the Senate, and the Committee on Armed Services of the House of Representatives.</text>

                <header>Update to strategy for comprehensive interagency review of the United States national security overhead satellite architecture</header>
                <text>Not later than 180 days after the date of the enactment of this Act, the Director of National Intelligence, in consultation with the Secretary of Defense and the Chairman of the Joint Chiefs of Staff, shall issue a written update to the strategy required by section 312 of the Intelligence Authorization Act for Fiscal Year 2016 (division M of Public Law 114–113; 129 Stat. 2919).</text>
              </subsection>

                <enum>(c)</enum>
                <header>Unity of effort in space operations between the intelligence community and Department of Defense</header>
                <paragraph id="H533E335D904747C8B13E8D7966F90E04">
                  <enum>(1)</enum>
                  <header>Requirement for plan</header>
                  <text>Not later than 180 days after the date of the enactment of this Act, the Director of National Intelligence, in consultation with the Secretary of Defense, shall submit to the appropriate committees of Congress a plan to functionally integrate the governance, operations, analysis, collection, policy, and acquisition activities related to space and counterspace carried out by the intelligence community. The plan shall include analysis of no fewer than 2 alternative constructs to implement this plan, and an assessment of statutory, policy, organizational, programmatic, and resources changes that may be required to implement each alternative construct.</text>
                </paragraph>
                <paragraph id="H0EC038A621C74FD2B80147AD1A4CD6F9">
                  <enum>(2)</enum>
                  <header>Appointment by the director of national intelligence</header>
                  <text>Not later than 30 days after the date of the enactment of this Act, the Director of National Intelligence, in consultation with the Secretary of Defense, shall appoint a single official to oversee development of the plan required by paragraph (1).</text>
                </paragraph>

              </subsection>

                <enum>(e)</enum>
                <header>Joint Interagency Combined Space Operations Center</header>

                  <text>The Director of the National Reconnaissance Office and the Commander of the United States Strategic Command, in consultation with the Director of National Intelligence, the Under Secretary of Defense for Intelligence, and the Chairman of the Joint Chiefs of Staff, shall submit to the appropriate committees of Congress concept of operations and requirements documents for the Joint Interagency Combined Space Operations Center by the date that is the earlier of—</text>

                  <text>The Director of the National Reconnaissance Office and the Commander of the United States Strategic Command, in coordination with the Director of National Intelligence and Under Secretary of Defense for Intelligence, shall provide to the appropriate committees of Congress briefings providing updates on activities and progress of the Joint Interagency Combined Space Operations Center to begin 30 days after the date of the enactment of this Act. Such briefings shall be quarterly for the first year following enactment, and annually thereafter.</text>
                </paragraph>
              </subsection>
            </section>

              <enum>606.</enum>
              <header> Advances in life sciences and biotechnology</header>
              <subsection id="H505DAD8C996F48B1859F2F81EDB0D679">
                <enum>(a)</enum>
                <header>Requirement for plan</header>
                <text display-inline="yes-display-inline">Not later than 180 days after the date of the enactment of this Act, the Director of National Intelligence shall brief the congressional intelligence committees on a proposed plan to monitor advances in life sciences and biotechnology to be carried out by the Director.</text>
              </subsection>
              <subsection id="H88CF3DFA7B79486CB5D45C6C830B7938">
                <enum>(b)</enum>
                <header>Contents of plan</header>
                <text>The plan required by subsection (a) shall include—</text>
                <paragraph id="H242F66FF3F7248B1B2EC8A79A99A14FE">
                  <enum>(1)</enum>
                  <text>a description of the approach the elements of the intelligence community will take to make use of organic life science and biotechnology expertise, within and outside the intelligence community on a routine and contingency basis;</text>
                </paragraph>
                <paragraph id="H6A0E1C211A234049B9B100871FDF9669">
                  <enum>(2)</enum>
                  <text>an assessment of the current collection and analytical posture of the life sciences and biotechnology portfolio as it relates to United States competitiveness and the global bio-economy, the risks and threats evolving with advances in genetic editing technologies, and the implications of such advances on future biodefense requirements; and</text>
                </paragraph>
                <paragraph id="H135A1225A75E42DEA4F5C3430CA88E65">
                  <enum>(3)</enum>
                  <text>an analysis of organizational requirements and responsibilities, including potentially creating new positions.</text>
                </paragraph>
              </subsection>
              <subsection id="H405BC29D5E904921A74A32266BC833AC">
                <enum>(c)</enum>
                <header>Report to Congress</header>
                <text>Not later than 180 days after the date of the enactment of this Act, the Director of National Intelligence shall submit to the congressional intelligence committees, the Committee on Armed Services of the Senate, and the Committee on Armed Services of the House of Representatives a report and provide a briefing on the role of the intelligence community in the event of a biological attack on the United States, including an assessment of the capabilities and gaps in technical capabilities that exist to address the potential circumstance of a novel unknown pathogen.</text>
              </subsection>
            </section>
            <section id="H1D893A573436458BBB10C3FC3C0D4FEA">
              <enum>607.</enum>
              <header>Reports on declassification proposals</header>
              <subsection id="H5DB021715F8741C8A5FAA57E999C45A6">
                <enum>(a)</enum>
                <header>Covered studies defined</header>
                <text>In this section, the term <term>covered studies</term> means the studies that the Director of National Intelligence requested that the elements of the intelligence community produce in the course of producing the fundamental classification guidance review for fiscal year 2017 required by Executive Order No. 13526 (50 U.S.C. 3161 note), as follows:</text>
                <paragraph id="HD65F0434E8714A7C9CDD444B628021B3">
                  <enum>(1)</enum>
                  <text>A study of the feasibility of reducing the number of original classification authorities in each element of the intelligence community to the minimum number required and any negative impacts that reduction could have on mission capabilities.</text>
                </paragraph>
                <paragraph id="H6E05F83ED16B4C1C92ED80B1BE9812B1">
                  <enum>(2)</enum>
                  <text>A study of the actions required to implement a proactive discretionary declassification program distinct from the systematic, automatic, and mandatory declassification review programs outlined in part 2001 of title 32, Code of Federal Regulations, including section 2001.35 of such part.</text>
                </paragraph>
                <paragraph id="H240981A6AD664546B5DD0B18679E7153">
                  <enum>(3)</enum>
                  <text>A study of the benefits and drawbacks of implementing a single classification guide that could be used by all elements of the intelligence community in the nonoperational and more common areas of such elements.</text>
                </paragraph>

                  <enum>(4)</enum>
                  <text>A study of whether the classification level of <quote>confidential</quote> could be eliminated within agency-generated classification guides from use by elements of the intelligence community and any negative impacts that elimination could have on mission success.</text>
                </paragraph>
              </subsection>

                <enum>(b)</enum>
                <header>Reports and briefings to Congress</header>
                <paragraph id="H5934983B12844D6AB778149EF6BF22CD">
                  <enum>(1)</enum>
                  <header>Progress report</header>
                  <text>Not later than 30 days after the date of the enactment of this Act, the Director of National Intelligence shall submit a report to the congressional intelligence committees and provide the congressional intelligence committees a briefing on the progress of the elements of the intelligence community in producing the covered studies.</text>
                </paragraph>
                <paragraph id="H99B6D4DB9F9148138A1A4E739B4A0B47">
                  <enum>(2)</enum>
                  <header>Final report</header>
                  <text>Not later than the earlier of 120 days after the date of the enactment of this Act or June 30, 2017, the Director of National Intelligence shall submit a report and provide a briefing to the congressional intelligence committees on—</text>

                    <text>the final versions of the covered studies that have been provided to the Director by the elements of the intelligence community; and</text>
                  </subparagraph>

                    <text>a plan for implementation of each initiative included in each such covered study.</text>
                  </subparagraph>
                </paragraph>
              </subsection>

                  <text>Not less frequently than once each year, the Director of National Intelligence shall certify in writing to the congressional intelligence committees whether the creation, validation, or substantial modification, including termination, for all existing and proposed controlled access programs, and the compartments and subcompartments within each, are substantiated and justified based on the information required by paragraph (2).</text>

            </section>

              <enum>609.</enum>
              <header>Report on implementation of research and development recommendations</header>
              <text display-inline="no-display-inline">Not later than 120 days after the date of the enactment of this Act, the Director of National Intelligence shall submit to the congressional intelligence committees a report that includes the following:</text>
              <paragraph id="H27C8B9C67F394774B2E980694B0EBC4D">
                <enum>(1)</enum>
                <text>An assessment of the actions each element of the intelligence community has completed to implement the recommendations made by the National Commission for the Review of the Research and Development Programs of the United States Intelligence Community established under section 1002 of the Intelligence Authorization Act for Fiscal Year 2003 (Public Law 107–306; 50 U.S.C. 3001 note).</text>
              </paragraph>
              <paragraph id="H1B54DEECEA6D4A78A2C9A3029DBD6DC7">
                <enum>(2)</enum>
                <text>An analysis of the balance between short-, medium-, and long-term research efforts carried out by each element of the intelligence community.</text>
              </paragraph>
            </section>
            <section id="HD56CBD2B76884B6084EE51429CF4A3F9">
              <enum>610.</enum>
              <header>Report on Intelligence Community Research and Development Corps</header>
              <text display-inline="no-display-inline">Not later than 120 days after the date of the enactment of this Act, the Director of National Intelligence shall submit to the congressional intelligence committees a report and provide briefing on a plan, with milestones and benchmarks, to implement an Intelligence Community Research and Development Corps, as recommended in the Report of the National Commission for the Review of the Research and Development Programs of the United States Intelligence Community, including an assessment—</text>
              <paragraph id="HB3B9CB91207F428FB87981AE571A0641">
                <enum>(1)</enum>
                <text>of the funding and modification to existing authorities needed to allow for the implementation of such Corps; and</text>
              </paragraph>
              <paragraph id="HE73264B6DF7140DF9CE404B11179B565">
                <enum>(2)</enum>
                <text>of additional legislative authorities, if any, necessary to undertake such implementation.</text>
              </paragraph>
            </section>
            <section id="HB413932FA8344A55B338A004342B6CA3">
              <enum>611.</enum>
              <header>Report on information relating to academic programs, scholarships, fellowships, and internships sponsored, administered, or used by the intelligence community</header>
              <subsection id="HDEA118DB95AC4C809D9CE9B463F298E6">
                <enum>(a)</enum>
                <header>Report</header>
                <text display-inline="yes-display-inline">Not later than 120 days after the date of the enactment of this Act, the Director of National Intelligence shall submit to the congressional intelligence committees a report by the intelligence community regarding covered academic programs. Such report shall include—</text>
                <paragraph id="HA6770550E21E4C5D982D6E0433AD6379">
                  <enum>(1)</enum>
                  <text>a description of the extent to which the Director and the heads of the elements of the intelligence community independently collect information on covered academic programs, including with respect to—</text>
                  <subparagraph id="HDA10B146D47148649CDA3B39410996BB">
                    <enum>(A)</enum>
                    <text>the number of applicants for such programs;</text>
                  </subparagraph>
                  <subparagraph id="HEC84E8EF979C44C18B07F9DBFE5DCDE5">
                    <enum>(B)</enum>
                    <text>the number of individuals who have participated in such programs; and</text>
                  </subparagraph>
                  <subparagraph id="H71CEF51E2E19445A9C2CAD794A115FFD">
                    <enum>(C)</enum>
                    <text display-inline="yes-display-inline">the number of individuals who have participated in such programs and were hired by an element of the intelligence community after completing such program;</text>
                  </subparagraph>
                </paragraph>
                <paragraph id="HF73BEB50D1A54671B93C5A27DB6FC5B5">
                  <enum>(2)</enum>
                  <text display-inline="yes-display-inline">to the extent that the Director and the heads independently collect the information described in paragraph (1), a chart, table, or other compilation illustrating such information for each covered academic program and element of the intelligence community, as appropriate, during the three-year period preceding the date of the report; and</text>
                </paragraph>

                  <enum>(3)</enum>
                  <text display-inline="yes-display-inline">to the extent that the Director and the heads do not independently collect the information described in paragraph (1) as of the date of the report—</text>

                    <enum>(A)</enum>
                    <text display-inline="yes-display-inline">whether the Director and the heads can begin collecting such information during fiscal year 2017; and</text>
                  </subparagraph>

                    <enum>(B)</enum>
                    <text display-inline="yes-display-inline">the personnel, tools, and other resources required by the Director and the heads to independently collect such information.</text>
                  </subparagraph>
                </paragraph>
              </subsection>

                <enum>(b)</enum>
                <header>Covered academic programs defined</header>
                <text display-inline="yes-display-inline">In this section, the term <term>covered academic programs</term> means—</text>

                  <enum>(1)</enum>
                  <text display-inline="yes-display-inline">the Federal Cyber Scholarship-for-Service Program under section 302 of the Cybersecurity Enhancement Act of 2014 (15 U.S.C. 7442);</text>
                </paragraph>
                <paragraph id="H32FD52E66A2946AB9AE1CC127B523272">
                  <enum>(2)</enum>
                  <text display-inline="yes-display-inline">the National Security Education Program under the David L. Boren National Security Education Act of 1991 (50 U.S.C. 1901 et seq.);</text>
                </paragraph>
                <paragraph id="H689AB128B78A409AB445A064AC026C22">
                  <enum>(3)</enum>
                  <text display-inline="yes-display-inline">the Science, Mathematics, and Research for Transformation Defense Education Program under section 2192a of title 10, United States Code;</text>

                  <enum>(4)</enum>
                  <text display-inline="yes-display-inline">the National Centers of Academic Excellence in Information Assurance and Cyber Defense of the National Security Agency and the Department of Homeland Security; and</text>

                  <enum>(5)</enum>
                  <text>any other academic program, scholarship program, fellowship program, or internship program sponsored, administered, or used by an element of the intelligence community.</text>
                </paragraph>
              </subsection>
            </section>
            <section id="H89B60F6B4515403595D0928CDACDB501">
              <enum>612.</enum>
              <header>Report on intelligence community employees detailed to National Security Council</header>
              <text display-inline="no-display-inline">Not later than 60 days after the date of the enactment of this Act, the Director of National Intelligence shall submit to the congressional intelligence committees a classified written report listing, by year, the number of employees of an element of the intelligence community who have been detailed to the National Security Council during the 10-year period preceding the date of the report.</text>
            </section>
            <section id="HBA1F930E1F7841A0871FA47550DB8ADC">
              <enum>613.</enum>
              <header>Intelligence community reporting to Congress on foreign fighter flows</header>
              <subsection id="HC3D9F8D7E2DF4EA09A65E583B8DB4D2D">
                <enum>(a)</enum>
                <header>Reports required</header>
                <text display-inline="yes-display-inline">Not later than 60 days after the date of the enactment of this Act, and every 180 days thereafter, the Director of National Intelligence, consistent with the protection of intelligence sources and methods, shall submit to the appropriate congressional committees a report on foreign fighter flows to and from terrorist safe havens abroad.</text>
              </subsection>
              <subsection id="H1E9D8DDE19E346328B20D8ADEAE12133">
                <enum>(b)</enum>
                <header>Contents</header>
                <text display-inline="yes-display-inline">Each report submitted under subsection (a) shall include, with respect to each terrorist safe haven, the following:</text>
                <paragraph id="H8059013F3A094F60AF6F5C7E4BA39914">
                  <enum>(1)</enum>
                  <text>The total number of foreign fighters who have traveled or are suspected of having traveled to the terrorist safe haven since 2011, including the countries of origin of such foreign fighters.</text>
                </paragraph>
                <paragraph id="H6E0262B5C539467890CA0EDD05034ED8">
                  <enum>(2)</enum>
                  <text>The total number of United States citizens present in the terrorist safe haven.</text>
                </paragraph>
                <paragraph id="HD231272F82DC43BDA53B7B7258E00892">
                  <enum>(3)</enum>
                  <text>The total number of foreign fighters who have left the terrorist safe haven or whose whereabouts are unknown.</text>
                </paragraph>
              </subsection>
              <subsection id="H867B4F922C6F467EAC96897138179322">
                <enum>(c)</enum>
                <header>Form</header>
                <text display-inline="yes-display-inline">The reports submitted under subsection (a) may be submitted in classified form. If such a report is submitted in classified form, such report shall also include an unclassified summary.</text>
              </subsection>

                <enum>(d)</enum>
                <header>Sunset</header>
                <text>The requirement to submit reports under subsection (a) shall terminate on the date that is two years after the date of the enactment of this Act.</text>
              </subsection>

                <text display-inline="yes-display-inline">Not later than 180 days after the date of the enactment of this Act, the Under Secretary of Homeland Security for Intelligence and Analysis, in consultation with the Director of National Intelligence, and consistent with the protection of sources and methods, shall submit to the appropriate congressional committees a report on the cybersecurity threats to, and the cyber vulnerabilities within, the software, communications networks, computer networks, or other systems employed by—</text>

                  <enum>(1)</enum>
                  <text>entities conducting significant operations at seaports in the United States;</text>
                </paragraph>
                <paragraph id="HDCCE057CEC2743279B7CE958180ABCD8">

                  <text>the maritime shipping concerns of the United States; and</text>
                </paragraph>
                <paragraph id="H1426475D780F4623A0FDEC556DBC1EFB">
                  <enum>(3)</enum>
                  <text display-inline="yes-display-inline">entities conducting significant operations at transshipment points in the United States.</text>
                </paragraph>
              </subsection>
              <subsection id="H15FCB1C8CD8A4CC5886384FE95320695">
                <enum>(b)</enum>
                <header>Matters included</header>
                <text>The report under subsection (a) shall include the following:</text>
                <paragraph id="HFF29ECCE09CB4910953828731047DA3D">
                  <enum>(1)</enum>
                  <text display-inline="yes-display-inline">A description of any recent and significant cyberattacks or cybersecurity threats directed against software, communications networks, computer networks, or other systems employed by the entities and concerns described in paragraphs (1) through (3) of subsection (a).</text>
                </paragraph>

                  <enum>(2)</enum>
                  <text>An assessment of—</text>

                  </subparagraph>

                    <text display-inline="yes-display-inline">any significant vulnerabilities to such software, networks, and systems; and</text>
                  </subparagraph>

                    <enum>(C)</enum>
                    <text>how such entities and concerns are mitigating such vulnerabilities.</text>
                  </subparagraph>
                </paragraph>

                  <enum>(3)</enum>
                  <text display-inline="yes-display-inline">An update on the status of the efforts of the Coast Guard to include cybersecurity concerns in the National Response Framework, Emergency Support Functions, or both, relating to the shipping or ports of the United States.</text>
                </paragraph>
              </subsection>

                <text display-inline="yes-display-inline">Not later than 180 days after the date of the enactment of this Act, the Inspector General of the Intelligence Community, consistent with the protection of sources and methods, shall submit to the congressional intelligence committees a report on reprisals made against covered contractor employees.</text>
              </subsection>

                <enum>(b)</enum>
                <header>Elements</header>
                <text>The report under subsection (a) shall include the following:</text>
                <paragraph commented="no" id="H8346F41A4BCB480EA25F2364054E03E6">
                  <enum>(1)</enum>
                  <text display-inline="yes-display-inline">Identification of the number of known or claimed reprisals made against covered contractor employees during the 3-year period preceding the date of the report and any evaluation of such reprisals.</text>
                </paragraph>
                <paragraph commented="no" id="HE62E8B64B7624A6A91A4E55B8417FB8E">
                  <enum>(2)</enum>
                  <text>An evaluation of the usefulness of establishing a prohibition on reprisals against covered contractor employees as a means of encouraging such contractors to make protected disclosures.</text>
                </paragraph>
                <paragraph commented="no" id="HDC4F5149C3834677A079C5A61F76DA31">
                  <enum>(3)</enum>
                  <text>A description of any challenges associated with establishing such a prohibition, including with respect to the nature of the relationship between the Federal Government, the contractor, and the covered contractor employee.</text>

                  <enum>(4)</enum>

                  <header>Reprisal</header>
                  <text>The term <term>reprisal</term> means the discharge or other adverse personnel action made against a covered contractor employee for making a disclosure of information that would be a disclosure protected by law if the contractor were an employee of the Federal Government.</text>
