          <enum>1.</enum>
          <header>Short title</header>
          <text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Competitive Health Insurance Reform Act of 2017</short-title></quote>.</text>
        </section>

          <enum>2.</enum>
          <header>Restoring the application of antitrust laws to the business of health insurance</header>
          <subsection id="HB083F256A15B441BB35EDFE7BAD6DCE0">
            <enum>(a)</enum>
            <header>Amendment to Mccarran-Ferguson Act</header>
            <text>Section 3 of the Act of March 9, 1945 (15 U.S.C. 1013), commonly known as the McCarran-Ferguson Act, is amended by adding at the end the following:</text>

              <subsection id="HA510F1B7DF2D41B9B632A4DA202FFA91">
                <enum>(c)</enum>
                <paragraph id="HF97549DDA60E406AB99EEA7BBE22DC7D" display-inline="yes-display-inline">
                  <enum>(1)</enum>
                  <text display-inline="yes-display-inline">Nothing contained in this Act shall modify, impair, or supersede the operation of any of the antitrust laws with respect to the business of health insurance (including the business of dental insurance and limited-scope dental benefits).</text>
                </paragraph>
                <paragraph id="H41A9E3E7419447A8B3A07354A4552487" indent="up1">
                  <enum>(2)</enum>
                  <text>Paragraph (1) shall not apply with respect to making a contract, or engaging in a combination or conspiracy—</text>
                  <subparagraph id="HA0002AAB42A040C593F5A8232C49EADB">
                    <enum>(A)</enum>
                    <text>to collect, compile, or disseminate historical loss data;</text>
                  </subparagraph>
                  <subparagraph id="HA75E01E2B81042ECB38A3A1942B919BA">
                    <enum>(B)</enum>
                    <text>to determine a loss development factor applicable to historical loss data;</text>
                  </subparagraph>
                  <subparagraph id="HF929EA81A83C49B99A25318581225DCC">
                    <enum>(C)</enum>
                    <text>to perform actuarial services if such contract, combination, or conspiracy does not involve a restraint of trade; or</text>
                  </subparagraph>
                  <subparagraph id="H6B83A158088E4CCC9BE71013E665F6DD">
                    <enum>(D)</enum>
                    <text display-inline="yes-display-inline">to develop or disseminate a standard insurance policy form (including a standard addendum to an insurance policy form and standard terminology in an insurance policy form) if such contract, combination, or conspiracy is not to adhere to such standard form or require adherence to such standard form.</text>
                  </subparagraph>
                </paragraph>
                <paragraph id="H2E0DC1B481CF47E99AF082D4A048574C" indent="up1">
                  <enum>(3)</enum>
                  <text>For purposes of this subsection—</text>
                  <subparagraph id="HB65526DD8CB4431AACF2436BBA204E2B">
                    <enum>(A)</enum>
                    <text>the term <quote>antitrust laws</quote> has the meaning given it in subsection (a) of the first section of the Clayton Act (15 U.S.C. 12), except that such term includes section 5 of the Federal Trade Commission Act (15 U.S.C. 45) to the extent that such section 5 applies to unfair methods of competition;</text>
                  </subparagraph>
                  <subparagraph id="H6A035C3B1D9F408E802745598805223C">
                    <enum>(B)</enum>
                    <text>the term <quote>business of health insurance (including the business of dental insurance and limited-scope dental benefits)</quote> does not include—</text>
                    <clause id="H823C4B610C664AE88D33136262D6B24A">
                      <enum>(i)</enum>
                      <text>the business of life insurance (including annuities); or</text>
                    </clause>
                    <clause id="HEDC2040F1743408BB659A482BD27D80E">
                      <enum>(ii)</enum>
                      <text>the business of property or casualty insurance, including but not limited to—</text>
                      <subclause id="H87414BFA56C648CA8986184A7DC34155">
                        <enum>(I)</enum>
                        <text> any insurance or benefits defined as <quote>excepted benefits</quote> under paragraph (1), subparagraph (B) or (C) of paragraph (2), or paragraph (3) of section 9832(c) of the Internal Revenue Code of 1986 (26 U.S.C. 9832(c)) whether offered separately or in combination with insurance or benefits described in paragraph (2)(A) of such section; and</text>
                      </subclause>
                      <subclause id="H384169C335984D0084629A71C8038635">
                        <enum>(II)</enum>
                        <text>any other line of insurance that is classified as property or casualty insurance under State law;</text>
                      </subclause>
                    </clause>
                  </subparagraph>
                  <subparagraph id="H0639B73A3A9D4F44BCD82B48E63B1833">
                    <enum>(C)</enum>
                    <text>the term <quote>historical loss data</quote> means information respecting claims paid, or reserves held for claims reported, by any person engaged in the business of insurance; and</text>
                  </subparagraph>
                  <subparagraph id="H4E1A52CF82CA4C07A31A22613786613B">
                    <enum>(D)</enum>
                    <text>the term <quote>loss development factor</quote> means an adjustment to be made to reserves held for losses incurred for claims reported by any person engaged in the business of insurance, for the purpose of bringing such reserves to an ultimate paid basis.</text>
                  </subparagraph>
                </paragraph>
              </subsection>

          <subsection id="H1FDCE1FCBA284FBE9B4D3449116C5230">
            <enum>(b)</enum>
            <header>Related provision</header>
            <text>For purposes of section 5 of the Federal Trade Commission Act (15 U.S.C. 45) to the extent such section applies to unfair methods of competition, section 3(c) of the McCarran-Ferguson Act shall apply with respect to the business of health insurance without regard to whether such business is carried on for profit, notwithstanding the definition of <quote>Corporation</quote> contained in section 4 of the Federal Trade Commission Act.</text>
          </subsection>
