            <header>Short title</header>
            <text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Regulatory Integrity Act of 2016</short-title></quote>.</text>
          </section>

            <enum>2.</enum>
            <header>Publication of information relating to pending regulatory actions</header>
            <subsection id="H1550F30636574608925F63DE9B2979F4">
              <enum>(a)</enum>
              <header>Amendment</header>
              <text display-inline="yes-display-inline">Chapter 3 of title 5, United States Code, is amended by inserting after section 306 the following new section:</text>

                  <enum>307.</enum>
                  <header>Information regarding pending agency regulatory action</header>
                  <subsection id="H5077247D6E8646FEBA7E95DA0D11C0BB">
                    <enum>(a)</enum>
                    <header>Definitions</header>
                    <text display-inline="yes-display-inline">In this section:</text>
                    <paragraph id="HC8E6C0F82DA24CF9A28105C6455AF1F1">
                      <enum>(1)</enum>
                      <header>Agency regulatory action</header>
                      <text>The term <term>agency regulatory action</term> means guidance, policy statement, directive, rule making, or adjudication issued by an Executive agency.</text>
                    </paragraph>
                    <paragraph id="HFD32B1F80AD34C85B602E0CCD822ACAC">
                      <enum>(2)</enum>
                      <header>Aggrandizement</header>
                      <text>The term <term>aggrandizement</term> means—</text>
                      <subparagraph id="HDBBB39B9BFD74A2BAD0C6C058146AB13">
                        <enum>(A)</enum>
                        <text>any communication emphasizing the importance of the Executive agency or agency regulatory action that does not have the clear purpose of informing the public of the substance or status of the Executive agency or agency regulatory action; or</text>
                      </subparagraph>
                      <subparagraph id="H4D2BEBD7A7EF4E2086B13BA3591017E7">
                        <enum>(B)</enum>
                        <text>any communication that is puffery.</text>
                      </subparagraph>
                    </paragraph>
                    <paragraph id="H25A99078D39B4388B4E26688E1B9698D">
                      <enum>(3)</enum>
                      <header>Public communication</header>
                      <text display-inline="yes-display-inline">The term <term>public communication</term>—</text>
                      <subparagraph id="H436187C21821436ABB3610269C154892">
                        <enum>(A)</enum>
                        <text>means any method (including written, oral, or electronic) of disseminating information to the public, including an agency statement (written or verbal), blog, video, audio recording, or other social media message; and</text>
                      </subparagraph>
                      <subparagraph id="HF9BD0947FE274419894B5B226CDC73BE">
                        <enum>(B)</enum>
                        <text>does not include a notice published in the Federal Register pursuant to section 553 or any requirement to publish pursuant to this section.</text>
                      </subparagraph>
                    </paragraph>
                    <paragraph id="H779A768CDF0B4EABB50C14C26E2A90D5">
                      <enum>(4)</enum>
                      <header>Rule making</header>
                      <text>The term <term>rule making</term> has the meaning given that term under section 551.</text>
                    </paragraph>
                  </subsection>
                  <subsection id="H86308AAB408248E4A483FF4059553FF4">
                    <enum>(b)</enum>
                    <header>Information To be posted online</header>
                    <paragraph id="HE4422BAACF1640019C7B23D559176905">
                      <enum>(1)</enum>
                      <header>Requirement</header>
                      <text display-inline="yes-display-inline">The head of each Executive agency shall make publicly available in a searchable format in a prominent location either on the website of the Executive agency or in the rule making docket on Regulations.gov the following information:</text>
                      <subparagraph id="HD4513BE3C482426DB0F55870D2BD780A">
                        <enum>(A)</enum>
                        <header>Pending agency regulatory action</header>
                        <text>A list of each pending agency regulatory action and with regard to each such action—</text>
                        <clause id="H2A34F68485694860B1FACACA301BF793">
                          <enum>(i)</enum>
                          <text>the date on which the Executive agency first began to develop or consider the agency regulatory action;</text>
                        </clause>
                        <clause id="HAFA904EDE52E4AA0A05E737A96494066">
                          <enum>(ii)</enum>
                          <text>the status of the agency regulatory action;</text>
                        </clause>
                        <clause id="HD639644F358A412283C4B8F4106715A0">
                          <enum>(iii)</enum>
                          <text>an estimate of the date of upon which the agency regulatory action will be final and in effect; and</text>
                        </clause>
                        <clause id="H9257A67C93274696BE13A6D25540BE3E">
                          <enum>(iv)</enum>
                          <text>a brief description of the agency regulatory action.</text>
                        </clause>
                      </subparagraph>
                      <subparagraph id="H52FF6C1CCD704E0B82CBF3B7BBB71955">
                        <enum>(B)</enum>
                        <header>Public communication</header>
                        <text>For each pending agency regulatory action, a list of each public communication about the pending agency regulatory action issued by the Executive agency and with regard to each such communication—</text>
                        <clause id="H469FA919716A4B3C8238F308CF3E90EA">
                          <enum>(i)</enum>
                          <text>the date of the communication;</text>
                        </clause>
                        <clause id="H1A3E6ED8D4C545FEAC756517B77DE5F0">
                          <enum>(ii)</enum>
                          <text>the intended audience of the communication;</text>
                        </clause>
                        <clause id="H26904071F1304BB186E0951966998836">
                          <enum>(iii)</enum>
                          <text>the method of communication; and</text>
                        </clause>
                        <clause id="H78ED9BF1C5804CB88DFD897FDBA7FD38">
                          <enum>(iv)</enum>
                          <text>a copy of the original communication.</text>
                        </clause>
                      </subparagraph>
                    </paragraph>
                    <paragraph commented="no" id="H413608C15E514199A8C78014409995F6">
                      <enum>(2)</enum>
                      <header>Period</header>
                      <text display-inline="yes-display-inline">The head of each Executive agency shall publish the information required under paragraph (1)(A) not later than 24 hours after a public communication relating to a pending agency regulatory action is issued and shall maintain the public availability of such information not less than 5 years after the date on which the pending agency regulatory action is finalized.</text>
                    </paragraph>
                  </subsection>
                  <subsection id="HB77797ED605B4187A04180478E3BE4F7">
                    <enum>(c)</enum>
                    <header>Requirements for public communications</header>
                    <text>Any public communication issued by an Executive agency that refers to a pending agency regulatory action—</text>
                    <paragraph id="HEEF32EC4B8504BB59736A9910EAF39C7">
                      <enum>(1)</enum>
                      <text display-inline="yes-display-inline">shall specify whether the Executive agency is considering alternatives, including alternatives that may conflict with the intent, objective, or methodology of such agency regulatory action;</text>
                    </paragraph>
                    <paragraph id="H5AA220CF07BC4FECB2AB9EAD28C5EE77">
                      <enum>(2)</enum>
                      <text display-inline="yes-display-inline">shall specify whether the Executive agency is accepting or will be accepting comments;</text>
                    </paragraph>
                    <paragraph commented="no" id="H1DE11FA3CF054A5C8970F104F3C1DF24">
                      <enum>(3)</enum>
                      <text display-inline="yes-display-inline">shall expressly disclose that the Executive agency is the source of the information to the intended recipients; and</text>
                    </paragraph>
                    <paragraph id="HC9C5E877A0A147BE9EF1D131B221190F">
                      <enum>(4)</enum>
                      <text>may not—</text>
                      <subparagraph id="H77C655EBFD0A480BA82634B7225D888E">
                        <enum>(A)</enum>
                        <text>solicit support for or promote the pending agency regulatory action; or</text>
                      </subparagraph>
                      <subparagraph id="H23D83A374E134A7395AD7FB1686A1FF2">
                        <enum>(B)</enum>
                        <text>include statements of aggrandizement for the Executive agency, any Federal employee, or the pending agency regulatory action.</text>
                      </subparagraph>
                    </paragraph>
                  </subsection>
                  <subsection id="H501BCE45BA4A484987BBE1C8BD8A1E2B">
                    <enum>(d)</enum>
                    <header>Reporting</header>
                    <paragraph id="H95608E2FB02D47438E570A334653A733">
                      <enum>(1)</enum>
                      <header>In general</header>
                      <text>Not later than January 15 of each year, the head of an Executive agency that communicated about a pending agency regulatory action during the previous fiscal year shall submit to each committee of Congress with jurisdiction over the activities of the Executive agency a report indicating—</text>
                      <subparagraph id="HEE281AD26CEC4A7DBB90AAEC306D904A">
                        <enum>(A)</enum>
                        <text>the number pending agency regulatory actions the Executive agency issued public communications about during that fiscal year;</text>
                      </subparagraph>
                      <subparagraph id="HA17EE3966872466A8C8A88CFF6F30869">
                        <enum>(B)</enum>
                        <text>the average number of public communications issued by the Executive agency for each pending agency regulatory action during that fiscal year;</text>
                      </subparagraph>
                      <subparagraph id="H6231C0B5B89C4EF195691AA4E34128E6">
                        <enum>(C)</enum>
                        <text>the 5 pending agency regulatory actions with the highest number of public communications issued by the Executive agency in that fiscal year; and</text>
                      </subparagraph>
                      <subparagraph id="H53F0554A74254C2F8E90721F4F8CCCA3">
                        <enum>(D)</enum>
                        <text>a copy of each public communication for the pending agency regulatory actions identified in subparagraph (C).</text>
                      </subparagraph>
                    </paragraph>
                    <paragraph id="H8103773067EC4381906A2793E96A33CA">
                      <enum>(2)</enum>
                      <header>Availability of reports</header>
                      <text>The head of an Executive agency that is required to submit a report under paragraph (1) shall make the report publicly available in a searchable format in a prominent location on the website of the Executive agency.</text>
                    </paragraph>
                  </subsection>

              <enum>(b)</enum>
              <header>Technical and conforming amendment</header>
              <text display-inline="yes-display-inline">The table of sections for chapter 3 of title 5, United States Code, is amended by adding after the item relating to section 306 the following new item:</text>
