      <header>Findings</header>
      <text display-inline="no-display-inline">Congress finds the following:</text>
      <paragraph id="H8E32612C04114165B244BB08BF90BF0A">
        <enum>(1)</enum>
        <text display-inline="yes-display-inline">On April 2, 2015, in announcing a framework agreement for the Joint Comprehensive Plan of Action, President Obama stated that <quote>other American sanctions on Iran for its support of terrorism, its human rights abuses, its ballistic missile program, will continue to be fully enforced</quote>.</text>
      </paragraph>
      <paragraph id="HC964B5D63E42497F9F87755C560278C9">
        <enum>(2)</enum>
        <text>On July 14, 2015, President Obama stated that <quote>we will maintain our own sanctions related to Iran’s support for terrorism, its ballistic missile program, and its human rights violations</quote>.</text>
      </paragraph>
      <paragraph id="H128CB4500A9F46E2905D4D6AA53BB0E8">
        <enum>(3)</enum>
        <text>On January 16, 2016, President Obama stated that <quote>We still have sanctions on Iran for its violations of human rights, for its support of terrorism, and for its ballistic missile program. And we will continue to enforce these sanctions, vigorously.</quote>.</text>
      </paragraph>
      <paragraph id="H06FF3543FEB84C028D55B5014EF33C7A">
        <enum>(4)</enum>
        <text>On January 21, 2016, Secretary of State John Kerry admitted that sanctions relief under the Joint Comprehensive Plan of Action would go to terrorist organizations, stating: <quote>I think that some of it will end up in the hands of the IRGC or other entities, some of which are labeled terrorists…You know, to some degree, I'm not going to sit here and tell you that every component of that can be prevented.</quote>.</text>
      </paragraph>
      <paragraph id="H15DCA1CA2B5B4649B1DB0A2B47D34B4C">
        <enum>(5)</enum>
        <text>Secretary of State John Kerry stated on July 23, 2015, <quote>We will not violate the [Joint Comprehensive Plan of Action (JCPOA)] if we use our authorities to impose sanctions on Iran for terrorism, human rights, missiles, or other nonnuclear reasons. And the JCPOA does not provide Iran any relief from United States sanctions under any of those authorities or other authorities.</quote>.</text>
      </paragraph>
      <paragraph id="H3CC53AA440E54E0298049E74CB53D5E8">
        <enum>(6)</enum>
        <text>Director of National Intelligence James Clapper wrote on February 9, 2016, <quote>[T]he Islamic Republic of Iran presents an enduring threat to U.S national interests because of its support to regional terrorist and militant groups and the Assad regime, as well as its development of advanced military capabilities. Tehran views itself as leading the <quote>axis of resistance</quote> which includes the Asad regime and sub-national groups aligned with Iran, especially Lebanese Hezbollah and Iraqi Shia militants . . . Tehran might even use American citizens detained when entering Iranian territories as bargaining pieces to achieve financial or political concessions in line with heir strategic intentions.</quote>.</text>
      </paragraph>

        <enum>(7)</enum>
        <text>Secretary of the Treasury Jacob Lew stated on July 14, 2015, <quote>We harbor no illusions about the Iranian government’s nefarious activities beyond its nuclear program. Make no mistake: we will continue to impose and aggressively enforce sanctions to combat Iran’s support for terrorist groups, its fomenting of violence in the region, and its perpetration of human rights abuses.</quote>.</text>
      </paragraph>
    </section>
    <section id="H1054764613924701BE36E5CBA161A6D2">
      <enum>3.</enum>
      <header>Sense of Congress</header>
      <text display-inline="no-display-inline">It is the sense of Congress that—</text>
      <paragraph id="H1B30F8C6DC8D499EB8A08202A0AA2BF9">
        <enum>(1)</enum>
        <text>Iran’s ballistic missile program and support for terrorism represents a serious threat to allies of the United States in the Middle East and Europe, members of the Armed Forces deployed in the those regions, and ultimately the United States; and</text>
      </paragraph>
      <paragraph id="H2E6AC3499C3C423EBB7A4B4487161B64">
        <enum>(2)</enum>
        <text display-inline="yes-display-inline">the United States should impose tough primary and secondary sanctions against any person that directly or indirectly supports the ballistic missile program of Iran, its state-sponsorship of terrorism and human rights abuses, as well as against any foreign person or financial institution that engages in transactions or trade that support those efforts. </text>
      </paragraph>
    </section>
    <section id="H1A7CA12D778A4814A658E059BEA68D78">
      <enum>4.</enum>
      <header>Statement of policy</header>
      <text display-inline="no-display-inline">It is the policy of the United States—</text>
      <paragraph id="HF6F469AC4A3347E1B19486F4ACCEAEA9">
        <enum>(1)</enum>
        <text>to continue to impose pressure on the Government of Iran for its role as the foremost state sponsor of terrorism, its ongoing human rights abuses against the citizens of Iran and other peoples, and its unjust detention of United States citizens; and</text>
      </paragraph>
      <paragraph id="HBCF4B4C4CBBE4936A2E7574E560F2729">
        <enum>(2)</enum>
        <text>to continue to use sanctions as an element of that pressure and to discourage financial institutions and entities from engaging in business and commerce with Iranian entities tied to Iran’s Revolutionary Guard Corps and to Iranian officials involved in human rights abuses.</text>
      </paragraph>
    </section>

      <enum>5.</enum>
      <header>Definitions</header>
      <text display-inline="no-display-inline">In this Act:</text>
      <paragraph commented="no" display-inline="no-display-inline" id="H9806B623317A47F787658D8791DE8386">
        <enum>(1)</enum>
        <header display-inline="yes-display-inline">Entity</header>
        <text display-inline="yes-display-inline">The term <term>entity</term> means any corporation, business association, partnership, trust, society, or any other entity.</text>
      </paragraph>
      <paragraph commented="no" display-inline="no-display-inline" id="H1D12F5B89C00435290AE0978B51DBC3F">
        <enum>(2)</enum>
        <header display-inline="yes-display-inline">Foreign person</header>
        <text display-inline="yes-display-inline">The term <term>foreign person</term> means an individual or entity that is not a United States person.</text>
      </paragraph>
      <paragraph commented="no" display-inline="no-display-inline" id="HFBCF34567499411691BEDA7A63C6D9B3">
        <enum>(3)</enum>
        <header display-inline="yes-display-inline">IRGC</header>
        <text display-inline="yes-display-inline">The term <term>IRGC</term> means—</text>
        <subparagraph id="HD2B0D0B6910F42BCB9C1072CBA5DCE72" commented="no">
          <enum>(A)</enum>
          <text>Iran’s Revolutionary Guard Corps and any official, agent, or affiliate of Iran’s Revolutionary Guard Corps; or</text>
        </subparagraph>
        <subparagraph id="H021BF33FD3724B62834BD280B1AA5CA4" commented="no">
          <enum>(B)</enum>
          <text>any person owned or controlled by Iran’s Revolutionary Guard Corps.</text>
        </subparagraph>
      </paragraph>

        <enum>(4)</enum>
        <header>Own or control</header>
        <text>The term <term>own or control</term> means, with respect to an entity—</text>
        <subparagraph id="H3128D15893A24AD1AA96DDE8E7081726">
          <enum>(A)</enum>
          <text>to hold more than 25 percent of the equity interest by vote or value in the entity;</text>
        </subparagraph>
        <subparagraph id="H2CCA19CD60C64E1F87D255F6B65FD330">
          <enum>(B)</enum>
          <text>to hold any seats on the board of directors of the entity; or</text>
        </subparagraph>
        <subparagraph id="HA15578FB1F9D48C5B78BF855EF43CFAC">
          <enum>(C)</enum>
          <text>to otherwise control the actions, policies, or personnel decisions of the entity. </text>
        </subparagraph>
      </paragraph>

        <enum>(5)</enum>
        <header>Person</header>
        <text>The term <term>person</term> means an individual or entity.</text>
      </paragraph>

        <text>The term <term>United States person</term> means—</text>

          <text>a United States citizen or an alien lawfully admitted for permanent residence to the United States; or</text>
        </subparagraph>

          <text>an entity organized under the laws of the United States or of any jurisdiction within the United States, including a foreign branch of such an entity.</text>

      <enum>I</enum>
      <header>Sanctions with respect to entities owned by Iran’s Revolutionary Guard Corps</header>

        <enum>101.</enum>
        <header>Imposition of sanctions with respect to the IRGC</header>
        <subsection id="HB7E11E63E6F24994963EB9398626E50B">
          <enum>(a)</enum>
          <header>Amendments</header>
          <text>Subtitle A of title III of the Iran Threat Reduction and Syria Human Rights Act of 2012 (22 U.S.C. 8741 et seq.) is amended—</text>
          <paragraph id="HD5D2054CEC09484290D4862B90A27662">
            <enum>(1)</enum>
            <text>by redesignating section 304 as section 306; and</text>
          </paragraph>
          <paragraph id="H1212B083CBE14494863F533E26384210">
            <enum>(2)</enum>
            <text>by inserting after section 303 the following new sections:</text>

                <enum>304.</enum>
                <header>Imposition of sanctions with respect to Iran’s Revolutionary Guard Corps, any official, agent, or affiliate of Iran’s Revolutionary Guard Corps, and any person owned or controlled by Iran’s Revolutionary Guard Corps</header>
                <subsection id="HF17E8FED995F44A8BE3EF0C2FD00D58A">
                  <enum>(a)</enum>
                  <header>In general</header>
                  <text display-inline="yes-display-inline">Not later than 120 days after the date of the enactment of the <short-title>Iran Accountability Act of 2016</short-title>, and as appropriate thereafter, the President shall impose the sanctions described in subsection (b) with respect to Iran’s Revolutionary Guard Corps, any official, agent, or affiliate of Iran’s Revolutionary Guard Corps, and any person owned or controlled by Iran’s Revolutionary Guard Corps.</text>
                </subsection>
                <subsection id="H39D6AEC34F3A45EE99928122CE33D71D">
                  <enum>(b)</enum>
                  <header>Sanctions described</header>
                  <text>The sanctions described in this subsection are the following:</text>
                  <paragraph id="HB7F3C5BE75DD49CDA4F084F8EE0C2888">
                    <enum>(1)</enum>
                    <text>Sanctions applicable with respect to an organization that is designated by the Secretary of State as a foreign terrorist organization pursuant to section 219 of the Immigration and Nationality Act (8 U.S.C. 1189).</text>
                  </paragraph>
                  <paragraph id="H543E29A52F2D48A882107E5DE4E13A62">
                    <enum>(2)</enum>
                    <text>Sanctions applicable with respect to a foreign person pursuant to Executive Order 13224 (September 23, 2001; relating to blocking property and prohibiting transactions with persons who commit, threaten to commit, or support terrorism).</text>

                <header>Definitions</header>
                <text display-inline="no-display-inline">In this title:</text>

                  <header display-inline="yes-display-inline">Entity</header>
                  <text display-inline="yes-display-inline">The term <term>entity</term> means any corporation, business association, partnership, trust, society, or any other entity.</text>
                </paragraph>

                  <enum>(2)</enum>
                  <header display-inline="yes-display-inline">Foreign person</header>
                  <text display-inline="yes-display-inline">The term <term>foreign person</term> means a person that is not a United States person.</text>

          <enum>(c)</enum>
          <header>Waiver of imposition of sanctions</header>

          <header>In general</header>
          <text>The Secretary of the Treasury shall establish, maintain, and publish in the Federal Register a list (to be known as the <quote>IRGC Watch List</quote>) of—</text>
          <paragraph id="HBAAC40C25E1C462B8DFD2F8976D078C6">
            <enum>(1)</enum>
            <text>each entity in which the IRGC has an ownership interest of less than 25 percent;</text>
          </paragraph>
          <paragraph id="H2F1C26E570AC46FCBDF2A4D4F5FF8453">
            <enum>(2)</enum>
            <text>each entity in which the IRGC does not have an ownership interest if the IRGC maintains a presence on the board of directors of the entity or otherwise influences the actions, policies, or personnel decisions of the entity; and</text>

              <text>Not later than 90 days after the date of the enactment of this Act, and annually thereafter, the Secretary of the Treasury shall submit to Congress a report that includes—</text>

        </subsection>
      </section>

        <enum>104.</enum>
        <header>Imposition of sanctions against Mahan Air</header>
        <subsection id="H50CD31E4013A4F24BB8AECE195455DF2">
          <enum>(a)</enum>
          <header>In general</header>
          <text>The President shall impose the sanctions described in subsection (b) with respect to—</text>
          <paragraph id="H53E236F4034F4FAABC7ECAE0F77D2198">
            <enum>(1)</enum>
            <text>a person that provides, directly or indirectly, goods, services, technology, or financial services, including the sale or provision of aircraft or aircraft parts, fuel, ramp assistance, baggage and cargo handling, catering, refueling, ticketing, check-in services, crew handling, or other services related to flight operations, to or for Mahan Air or its agents or affiliates; or</text>
          </paragraph>
          <paragraph id="H797C9408B8A24C5289359266E328DD71">
            <enum>(2)</enum>
            <text>any person owned or controlled by, or any person that owns or controls, a person described in paragraph (1).</text>
          </paragraph>
        </subsection>
        <subsection id="H9FA43847E3A64CBE86D852A1865C9363">
          <enum>(b)</enum>
          <header>Sanctions described</header>
          <paragraph id="H44BB15917FB74FD6AD0DFC16BA6AE13D">
            <enum>(1)</enum>
            <header>Blocking of property</header>
            <text>The President shall block, in accordance with the International Emergency Economic Powers Act (50 U.S.C. 1701 et seq.), all transactions in all property and interests in property of any person subject to subsection (a) if such property and interests in property are in the United States, come within the United States, or are or come within the possession or control of a United States person.</text>
          </paragraph>
          <paragraph id="H15D0936E700B40229AD1B7714E4731E8">
            <enum>(2)</enum>
            <header>Exclusion from United States</header>
            <text>The Secretary of State shall deny a visa to, and the Secretary of Homeland Security shall exclude from the United States, any person subject to subsection (a) that is an alien.</text>
          </paragraph>
        </subsection>
        <subsection id="H15E34E63A5EF43BFA8E283584CBC392C" commented="no" display-inline="no-display-inline">
          <enum>(c)</enum>
          <header>Compliance with united nations headquarters agreement</header>
          <text>Subsection (b)(2) shall not apply to the head of state of Iran, or necessary staff of that head of state, if admission to the United States is necessary to permit the United States to comply with the Agreement regarding the Headquarters of the United Nations, signed at Lake Success June 26, 1947, and entered into force November 21, 1947, between the United Nations and the United States.</text>
        </subsection>
        <subsection id="HE38487DB041C4D03BF1D9B2763DAD939">
          <enum>(d)</enum>
          <header>Applicability of additional sanctions</header>
          <text>A person with respect to which the President imposes sanctions under subsection (a) shall be considered an agent or affiliate of the IRGC for purposes of sections 104 and 104A of the Comprehensive Iran Sanctions, Accountability, and Divestment Act of 2010 (22 U.S.C. 8513 and 8513b).</text>
        </subsection>

          <enum>(e)</enum>
          <header>Additional measures</header>

            <text display-inline="yes-display-inline">The President shall require each covered person to provide a certification to the President that the person does not conduct transactions with any person that provides, directly or indirectly, goods, services, technology, or financial services, including the sale or provision of aircraft or aircraft parts, fuel, ramp assistance, baggage or cargo handling, catering, refueling, ticketing, check-in services, crew handling, or other services related to flight operations—</text>

            </subparagraph>

            </subparagraph>
          </paragraph>

                  <text display-inline="yes-display-inline">For purposes of this subtitle, in determining if financial transactions or financial services are significant, the President may consider the totality of the facts and circumstances, including factors similar to the factors set forth in section 561.404 of title 31, Code of Federal Regulations (or any corresponding similar regulation or ruling).</text>
                </subsection>
              </section>

                <enum>232.</enum>
                <header>Imposition of sanctions with respect to persons that support the ballistic missile program of Iran</header>

                  <enum>(a)</enum>
                  <header>Identification of persons</header>
                  <paragraph id="HB7D72E7DC3364280B7E6D38BD6992BC7">
                    <enum>(1)</enum>
                    <header>In general</header>
                    <text display-inline="yes-display-inline">Not later than 120 days after the date of the enactment of the <short-title>Iran Accountability Act of 2016</short-title>, and not less frequently than once every 180 days thereafter, the President shall submit to the appropriate congressional committees a report identifying persons that have provided material support to the Government of Iran in the development of the ballistic missile program of Iran.</text>
                  </paragraph>
                  <paragraph id="H4F4F0F6EB4F849849307673CF834281C">
                    <enum>(2)</enum>
                    <header>Elements</header>
                    <text>Each report required by paragraph (1) shall include the following:</text>
                    <subparagraph id="H54E8821D89CE411599A5AD881D1B092C">
                      <enum>(A)</enum>
                      <text>An identification of persons (disaggregated by Iranian and non-Iranian persons) with respect to which there is credible evidence that such persons have provided material support to the Government of Iran in the development of the ballistic missile program of Iran, including persons that have—</text>
                      <clause id="H6BC895116526431494184B499BCEBA77" commented="no">
                        <enum>(i)</enum>
                        <text>engaged in the direct or indirect provision of material support to such program;</text>
                      </clause>
                      <clause id="HC0C21945B7584FC2A2E3D32887C8EF8F">
                        <enum>(ii)</enum>
                        <text>facilitated, supported, or engaged in activities to further the development of such program;</text>
                      </clause>
                      <clause id="H750F25E9B17D44DABF64490CAE801414">
                        <enum>(iii)</enum>
                        <text>transmitted information relating to ballistic missiles to the Government of Iran; or</text>
                      </clause>
                      <clause id="HD3505AA3CB9B48F7B5FE95F719144CA0">
                        <enum>(iv)</enum>
                        <text>otherwise aided such program.</text>
                      </clause>
                    </subparagraph>
                    <subparagraph id="HB8400CDB70EF4F8FB429E38ED812BE74">
                      <enum>(B)</enum>
                      <text>A description of the character and significance of the cooperation of each person identified under subparagraph (A) with the Government of Iran with respect to such program.</text>
                    </subparagraph>
                    <subparagraph commented="no" id="H68CE25D2148E4264BF9E452716EE1517">
                      <enum>(C)</enum>
                      <text>An assessment of the cooperation of the Government of the Democratic People’s Republic of Korea with the Government of Iran with respect to such program.</text>
                    </subparagraph>
                  </paragraph>
                  <paragraph id="H95E0F1E7D3CA4AA8816A87F1FFDBBAA3">
                    <enum>(3)</enum>
                    <header>Classified annex</header>
                    <text>Each report required by paragraph (1) shall be submitted in unclassified form, but may contain a classified annex.</text>
                  </paragraph>
                </subsection>
                <subsection id="HD19E377464C24438B5522DA7D5A36341">
                  <enum>(b)</enum>
                  <header>Blocking of property</header>
                  <text>Not later than 15 days after submitting a report required by subsection (a)(1), the President shall, in accordance with the International Emergency Economic Powers Act (50 U.S.C. 1701 et seq.), block and prohibit all transactions in all property and interests in property of any person specified in such report that engages in activities described in subsection (a) if such property and interests in property are in the United States, come within the United States, or are or come within the possession or control of a United States person.</text>
                </subsection>
                <subsection id="H95924ADF68374ACAA3E0D2AA4651F6A2">
                  <enum>(c)</enum>
                  <header>Exclusion from United States </header>
                  <paragraph id="HC3075D0F84DA48C2B550BA9F10F25DAE">
                    <enum>(1)</enum>
                    <header>In general</header>
                    <text>Except as provided in paragraph (2), the Secretary of State shall deny a visa to, and the Secretary of Homeland Security shall exclude from the United States, any alien subject to blocking of property and interests in property under subsection (b).</text>
                  </paragraph>
                  <paragraph id="HEF63271DBE1749D9B4E06E51AF1E7AAA">
                    <enum>(2)</enum>
                    <header>Compliance with United Nations headquarters agreement</header>
                    <text>Paragraph (1) shall not apply to the head of state of Iran, or necessary staff of that head of state, if admission to the United States is necessary to permit the United States to comply with the Agreement regarding the Headquarters of the United Nations, signed at Lake Success June 26, 1947, and entered into force November 21, 1947, between the United Nations and the United States.</text>
                  </paragraph>
                </subsection>
                <subsection id="HD2A7FEC4BC9C4F89A2AAB81EA6F678BC">
                  <enum>(d)</enum>
                  <header>Facilitation of certain transactions</header>
                  <text>The President shall prohibit the opening, and prohibit or impose strict conditions on the maintaining, in the United States of a correspondent account or a payable-through account by a foreign financial institution that the President determines knowingly, on or after the date that is 180 days after the date of the enactment of the <short-title>Iran Accountability Act of 2016</short-title>, conducts or facilitates a significant financial transaction for a person subject to blocking of property and interests in property under subsection (b).</text>
                </subsection>
              </section>

                <enum>233.</enum>
                <header>Blocking of property of persons affiliated with certain Iranian entities</header>

                  <enum>(a)</enum>
                  <header>Blocking of property</header>

                    <enum>(1)</enum>
                    <header>In general</header>
                    <text>The President shall, in accordance with the International Emergency Economic Powers Act (50 U.S.C. 1701 et seq.), block and prohibit all transactions in all property and interests in property of any person described in paragraph (2) if such property and interests in property are in the United States, come within the United States, or are or come within the possession or control of a United States person.</text>
                  </paragraph>
                  <paragraph commented="no" display-inline="no-display-inline" id="H9DF90146A0324D69A944650EAAEBCCC3">
                    <enum>(2)</enum>
                    <header display-inline="yes-display-inline">Persons described</header>
                    <text display-inline="yes-display-inline">A person described in this paragraph is—</text>
                    <subparagraph commented="no" display-inline="no-display-inline" id="H7431910F38EA4DACB83B200B800995DC">
                      <enum>(A)</enum>
                      <text display-inline="yes-display-inline">an entity that is owned or controlled—</text>
                      <clause commented="no" display-inline="no-display-inline" id="HB4E9695ED4684A4CA8EA22BD5D409892">
                        <enum>(i)</enum>
                        <text display-inline="yes-display-inline">by the Aerospace Industries Organization, the Shahid Hemmat Industrial Group, the Shahid Bakeri Industrial Group, or any agent or affiliate of such organization or group; or</text>
                      </clause>
                      <clause commented="no" display-inline="no-display-inline" id="H8E937DF9C53344A7BEE12E08157D8A14">
                        <enum>(ii)</enum>
                        <text>collectively by a group of individuals that hold an interest in the Aerospace Industries Organization, the Shahid Hemmat Industrial Group, the Shahid Bakeri Industrial Group, or any agent or affiliate of such organization or group, even if none of those individuals hold a 25 percent or greater interest in the entity; or</text>
                      </clause>
                    </subparagraph>
                    <subparagraph id="H110ACF4C94734138B24A44FD56AB6D5B" commented="no">
                      <enum>(B)</enum>
                      <text>a person that owns or controls an entity described in subparagraph (A).</text>
                    </subparagraph>
                  </paragraph>
                </subsection>
                <subsection commented="no" display-inline="no-display-inline" id="H2C00ECDA311040AE9CADE38CC161C7B5">
                  <enum>(b)</enum>
                  <header display-inline="yes-display-inline">Facilitation of certain transactions</header>
                  <text display-inline="yes-display-inline">The President shall prohibit the opening, and prohibit or impose strict conditions on the maintaining, in the United States of a correspondent account or a payable-through account by a foreign financial institution that the President determines knowingly, on or after the date that is 180 days after the date of the enactment of the <short-title>Iran Accountability Act of 2016</short-title>, conducts or facilitates a significant financial transaction for a person subject to blocking of property and interests in property under subsection (a).</text>
                </subsection>

                  <enum>(c)</enum>
                  <header>Iran Missile Proliferation Watch List</header>
                  <paragraph id="H70B518766149422993B40002DF2A614E">
                    <enum>(1)</enum>
                    <header>In general</header>
                    <text>Not later than 90 days after the date of the enactment of the <short-title>Iran Accountability Act of 2016</short-title>, and not less frequently than annually thereafter, the Secretary of the Treasury shall submit to the appropriate congressional committees and publish in the Federal Register a list of—</text>
                    <subparagraph id="H1C79F5B5E4074F608374D9FD3AB07840">
                      <enum>(A)</enum>
                      <text>each entity in which the Aerospace Industries Organization, the Shahid Hemmat Industrial Group, the Shahid Bakeri Industrial Group, or any agent or affiliate of such organization or group has an ownership interest of more than 0 percent and less than 25 percent;</text>
                    </subparagraph>
                    <subparagraph id="HDE4FD9F3CBDB41A0A0BB04236AEA163C">
                      <enum>(B)</enum>
                      <text>each entity in which the Aerospace Industries Organization, the Shahid Hemmat Industrial Group, the Shahid Bakeri Industrial Group, or any agent or affiliate of such organization or group does not have an ownership interest but maintains a presence on the board of directors of the entity or otherwise influences the actions, policies, or personnel decisions of the entity; and</text>
                    </subparagraph>
                    <subparagraph id="HCE77F9A1AD7149018F0A82D077CB8A1A">
                      <enum>(C)</enum>
                      <text>each person that owns or controls an entity described in subparagraph (A) or (B).</text>
                    </subparagraph>
                  </paragraph>
                  <paragraph commented="no" id="H6FA160DDC1444A36A7119E16A00CD7FD">
                    <enum>(2)</enum>
                    <header>Reference</header>
                    <text>The list required by paragraph (1) may be referred to as the <quote>Iran Missile Proliferation Watch List</quote>.</text>
                  </paragraph>
                </subsection>

                  <enum>(d)</enum>
                  <header>Comptroller General report</header>
                  <paragraph id="H7EA0373C6CB545B7ADE00A263B204B90">
                    <enum>(1)</enum>
                    <header>In general</header>
                    <text>The Comptroller General of the United States shall—</text>
                    <subparagraph id="HD7572A4C5DAB4C65BEEAF7EFD534B2FA">
                      <enum>(A)</enum>
                      <text>conduct a review of each list required by subsection (c)(1); and</text>
                    </subparagraph>
                    <subparagraph id="HA0357A9877BA49109C4E9EC1F541C600">
                      <enum>(B)</enum>
                      <text>not later than 180 days after each such list is submitted to the appropriate congressional committees under that subsection, submit to the appropriate congressional committees a report on the review conducted under subparagraph (A) that includes a list of persons not included in that list that qualify for inclusion in that list, as determined by the Comptroller General.</text>
                    </subparagraph>
                  </paragraph>
                  <paragraph id="HEA5AB930A760487EA3C54641607EC782">
                    <enum>(2)</enum>
                    <header>Consultations</header>
                    <text>In preparing the report required by paragraph (1)(B), the Comptroller General shall consult with nongovernmental organizations. </text>
                  </paragraph>
                </subsection>
              </section>

                <enum>234.</enum>
                <header>Imposition of sanctions with respect to certain persons involved in ballistic missile activities</header>
                <subsection id="H7289754169B54D0FA3847EE122965801">
                  <enum>(a)</enum>
                  <header>Certification</header>
                  <text>Not later than 120 days after the date of the enactment of the <short-title>Iran Accountability Act of 2016</short-title>, and not less frequently than once every 180 days thereafter, the President shall submit to the appropriate congressional committees a certification that each person listed in an annex of United Nations Security Council Resolution 1737 (2006), 1747 (2007), or 1929 (2010) is not directly or indirectly facilitating, supporting, or involved with the development of or transfer to Iran of ballistic missiles or technology, parts, components, or technology information relating to ballistic missiles.</text>
                </subsection>
                <subsection id="H11824FC438DE44D7A510EAD0292FFCAC">
                  <enum>(b)</enum>
                  <header>Blocking of property</header>
                  <text>If the President is unable to make a certification under subsection (a) with respect to a person and the person is not currently subject to sanctions with respect to Iran under any other provision of law, the President shall, not later than 15 days after that certification would have been required under that subsection—</text>
                  <paragraph id="HF284C16FFB9E41C0BDF4DA8D9A99E587">
                    <enum>(1)</enum>
                    <text>in accordance with the International Emergency Economic Powers Act (50 U.S.C. 1701 et seq.), block and prohibit all transactions in all property and interests in property of that person if such property and interests in property are in the United States, come within the United States, or are or come within the possession or control of a United States person; and</text>
                  </paragraph>
                  <paragraph id="H51D7D112F82F4C9A9AD4B56494EBC0B5">
                    <enum>(2)</enum>
                    <text>publish in the Federal Register a report describing the reason why the President was unable to make a certification with respect to that person.</text>
                  </paragraph>
                </subsection>
                <subsection id="H7BF81487FA1C406AA2F4128A8B61166F">
                  <enum>(c)</enum>
                  <header>Exclusion from United States </header>

                    <enum>(1)</enum>

                    <text>Not later than 120 days after the date of the enactment of the <short-title>Iran Accountability Act of 2016</short-title>, and not less frequently than once every 180 days thereafter, the President shall submit to the appropriate congressional committees and publish in the Federal Register a list of the sectors of the economy of Iran that are directly or indirectly facilitating, supporting, or involved with the development of or transfer to Iran of ballistic missiles or technology, parts, components, or technology information relating to ballistic missiles.</text>
                  </paragraph>
                  <paragraph id="HDA1B2CF33A5F4F448908C1A938855AC6">
                    <enum>(2)</enum>
                    <header>Certain sectors</header>
                    <subparagraph id="H0D763EA168DB47AFB13BDC1B9C31EE5F">
                      <enum>(A)</enum>
                      <header>In general</header>
                      <text>Not later than 120 days after the date of enactment of the <short-title>Iran Accountability Act of 2016</short-title>, the President shall submit to the appropriate congressional committees a determination as to whether each of the chemical, computer science, construction, electronic, metallurgy, mining, research (including universities and research institutions), and telecommunications sectors of Iran meet the criteria specified in paragraph (1).</text>
                    </subparagraph>
                    <subparagraph id="H4BCAF42256DF4297B8D71380DEC46EC4">
                      <enum>(B)</enum>
                      <header>Inclusion in initial list</header>
                      <text>If the President determines under subparagraph (A) that the sectors of the economy of Iran specified in such subparagraph meet the criteria specified in paragraph (1), that sector shall be included in the initial list submitted and published under that paragraph.</text>
                    </subparagraph>
                  </paragraph>
                </subsection>

                    <text display-inline="yes-display-inline">The President shall, in accordance with the International Emergency Economic Powers Act (50 U.S.C. 1701 et seq.), block and prohibit all transactions in all property and interests in property of any person described in paragraph (4) if such property and interests in property are in the United States, come within the United States, or are or come within the possession or control of a United States person.</text>

                    <header>Exclusion from United States</header>

                      <text>Except as provided in subparagraph (B), the Secretary of State shall deny a visa to, and the Secretary of Homeland Security shall exclude from the United States, any alien that is a person described in paragraph (4).</text>

                      <enum>(B)</enum>
                      <header>Compliance with United Nations headquarters agreement</header>
                      <text>Subparagraph (A) shall not apply to the head of state of Iran, or necessary staff of that head of state, if admission to the United States is necessary to permit the United States to comply with the Agreement regarding the Headquarters of the United Nations, signed at Lake Success June 26, 1947, and entered into force November 21, 1947, between the United Nations and the United States.</text>

                    <enum>(3)</enum>
                    <header display-inline="yes-display-inline">Facilitation of certain transactions</header>
                    <text display-inline="yes-display-inline">Except as provided in this section, the President shall prohibit the opening, and prohibit or impose strict conditions on the maintaining, in the United States of a correspondent account or a payable-through account by a foreign financial institution that the President determines knowingly, on or after the date that is 180 days after the date of the enactment of the <short-title>Iran Accountability Act of 2016</short-title>, conducts or facilitates a significant financial transaction for a person described in paragraph (4).</text>
                  </paragraph>

                    <enum>(4)</enum>
                    <header>Persons described</header>
                    <text>A person is described in this paragraph if the President determines that the person, on or after the date that is 180 days after the date of the enactment of the <short-title>Iran Accountability Act of 2016</short-title>—</text>
                    <subparagraph id="H9E457A26A6A64507816928039D85D8F0">
                      <enum>(A)</enum>
                      <text>operates in a sector of the economy of Iran included in the most recent list published by the President under subsection (a);</text>
                    </subparagraph>
                    <subparagraph id="H3B47C9E69C4C421FA27D879D4560F6DC">
                      <enum>(B)</enum>
                      <text>knowingly provides significant financial, material, technological, or other support to, or goods or services in support of, any activity or transaction on behalf of or for the benefit of a person described in subparagraph (A); or</text>
                    </subparagraph>
                    <subparagraph id="H03CCC8E80FBB4EADBD1A988F85F77D01">
                      <enum>(C)</enum>
                      <text>is owned or controlled by a person described in subparagraph (A).</text>
                    </subparagraph>
                  </paragraph>
                </subsection>

                  <enum>(c)</enum>
                  <header>Humanitarian exception</header>
                  <text>The President may not impose sanctions under this section with respect to any person for conducting or facilitating a transaction for the sale of agricultural commodities, food, medicine, or medical devices to Iran or for the provision of humanitarian assistance to the people of Iran.</text>

                <header>Identification of foreign persons that support the ballistic missile program of Iran in certain sectors of Iran</header>

                  <text>Not later than 120 days after the date of the enactment of the <short-title>Iran Accountability Act of 2016</short-title>, and not less frequently than annually thereafter, the President shall submit to the appropriate congressional committees and publish in the Federal Register a list of all foreign persons that have, based on credible information, directly or indirectly facilitated, supported, or been involved with the development of ballistic missiles or technology, parts, components, or technology information related to ballistic missiles in the following sectors of the economy of Iran during the period specified in subsection (b):</text>

            <text display-inline="yes-display-inline">A covered financial institution shall apply special due diligence measures to correspondent accounts of the financial institution that are reasonably designed to guard against the improper indirect use of such accounts by Iranian banking institutions.</text>

              <text display-inline="yes-display-inline">notifying the holders of such accounts that the covered financial institution knows or has reason to know provide services to Iranian banking institutions, that such holders generally may not provide Iranian banking institutions with access to such accounts; and</text>
            </subparagraph>
            <subparagraph id="HCFDBF24037184E6687955A9D7AB741EB">
              <enum>(B)</enum>
              <text display-inline="yes-display-inline">taking reasonable steps to identify any indirect use of such accounts by Iranian banking institutions, to the extent that such indirect use can be determined from transactional records maintained by the covered financial institution in the normal course of business.</text>
            </subparagraph>
          </paragraph>
          <paragraph id="HE2535A3E7D614EB79442201BFD4994A9">
            <enum>(3)</enum>
            <header>Risk-based approach</header>
            <text display-inline="yes-display-inline">A covered financial institution shall take a risk-based approach when deciding what, if any, other due diligence measures the financial institution should adopt to guard against the improper indirect use of its correspondent accounts by Iranian banking institutions.</text>
          </paragraph>
          <paragraph id="H37052D70D81F4E59A9C46C93D978DF0F">
            <enum>(4)</enum>
            <header>Response to indirect access by Iranian banking institutions</header>
            <text display-inline="yes-display-inline">A covered financial institution that obtains credible information that a correspondent account is being used by a foreign bank to provide indirect access to an Iranian banking institution, shall—</text>
            <subparagraph id="HE408AC9BEB5C4CE0945110D99EB09432">
              <enum>(A)</enum>
              <text display-inline="yes-display-inline">take all appropriate steps to prevent such indirect access, including notifying the holder of the account under paragraph (1)(A); and</text>
            </subparagraph>
            <subparagraph id="H687A18603FB14F92966EE47D827F8F20">
              <enum>(B)</enum>
              <text display-inline="yes-display-inline">where necessary, terminate the account.</text>
            </subparagraph>
          </paragraph>
        </subsection>
        <subsection id="H7E57CC2B734C4CF792F9896EF0C8F2B0">
          <enum>(c)</enum>
          <header>Recordkeeping and reporting</header>
          <paragraph id="H5E3FC26D8D1F4AE9A708B5BDAF2FBD4A">
            <enum>(1)</enum>
            <header>In general</header>
            <text display-inline="yes-display-inline">A covered financial institution shall document its compliance with the notice requirement set forth in subsection (b)(2)(A).</text>
          </paragraph>
          <paragraph commented="no" id="H7F08BD66DC4F40218B50580245228200">
            <enum>(2)</enum>
            <header>Rule of construction</header>
            <text display-inline="yes-display-inline">Nothing in this section shall require a covered financial institution to report any information not otherwise required to be reported by law or regulation.</text>
          </paragraph>
        </subsection>
        <subsection commented="no" id="H71A0FB4E1DEF4D63AE6A6515757A84F8">
          <enum>(d)</enum>
          <header>Termination</header>
          <text display-inline="yes-display-inline">This section shall terminate on the date that is 30 days after the date on which the President submits to Congress—</text>

            <enum>(1)</enum>
            <text>the certification described in section 401(a) of the Comprehensive Iran Sanctions, Accountability, and Divestment Act of 2010 (22 U.S.C. 8551(a)); and</text>
          </paragraph>
          <paragraph id="H228B0A5BE3F14DB28776931673E41F74">
            <enum>(2)</enum>
            <text>a certification that the Financial Action Task Force has lifted its call for countermeasures against Iran and Iran has become a member of a regional body of the Financial Action Task Force.</text>
          </paragraph>
        </subsection>

          <enum>(e)</enum>
          <header>Definitions</header>
          <text display-inline="yes-display-inline">In this section:</text>

            <enum>(1)</enum>
            <header>Correspondent account</header>
            <text display-inline="yes-display-inline">The term <term>correspondent account</term> has the meaning given that term in section 1010.605 of title 31, Code of Federal Regulations (as in effect on the day before the date of the enactment of this Act).</text>
          </paragraph>
          <paragraph id="HE271D9A6C4B645328DC4E8292915BE36">
            <enum>(2)</enum>
            <header>Covered financial institution</header>
            <text display-inline="yes-display-inline">The term <term>covered financial institution</term> has the meaning given that term under paragraphs (1) and (2) of section 1010.605(e) of title 31, Code of Federal Regulations (as in effect on the day before the date of the enactment of this Act).</text>
          </paragraph>

            <text display-inline="yes-display-inline">The term <term>Iranian banking institution</term> means—</text>

              <enum>(A)</enum>
              <text display-inline="yes-display-inline">any foreign bank chartered by Iran, including—</text>
              <clause id="H63623DDE80214322B76EEA5451E41272">
                <enum>(i)</enum>
                <text display-inline="yes-display-inline">any branches, offices, or subsidiaries of such a bank operating in any jurisdiction; and</text>
              </clause>
              <clause id="HFFE23E6A551D4802B4EBEB7B574CC7BD">
                <enum>(ii)</enum>
                <text display-inline="yes-display-inline">any branch or office within Iran of any foreign bank licensed by Iran;</text>
              </clause>
            </subparagraph>

              <enum>(B)</enum>
              <text display-inline="yes-display-inline">the Central Bank of Iran; and</text>
            </subparagraph>

              <text display-inline="yes-display-inline">any foreign bank of which more than 50 percent of the voting stock or analogous interest is owned by 2 or more foreign banks chartered by Iran.</text>

              </subsection>

                <enum>(c)</enum>
                <header>Exclusion from united states</header>
                <text>Except as provided in subsection (f), the Secretary of State shall deny a visa to, and the Secretary of Homeland Security shall exclude from the United States, any alien who is on the list required by subsection (a).</text>
              </subsection>
              <subsection id="HF715B969C1FE41FF80ED7776662792EF">
                <enum>(d)</enum>
                <header>Blocking of property</header>
                <text>Except as provided in subsection (f), the President shall, in accordance with the International Emergency Economic Powers Act (50 U.S. C. 1701 et seq.), block and prohibit all transactions in all property and interests in property of any individual who is on the list required by subsection (a) if such property and interests in property are in the United States, come within the United States, or are or come within the possession or control of a United States person.</text>
              </subsection>

                <enum>(e)</enum>
                <header>Report</header>
                <paragraph id="H79CFBD80A2594A4794E012EE29E49226">
                  <enum>(1)</enum>
                  <header>In general</header>
                  <text>Not later than 90 days after the date of the enactment of the <short-title>Iran Accountability Act of 2016</short-title>, and every 90 days thereafter, the President shall submit to the appropriate congressional committees a report that describes the efforts the President has taken during the 90 days preceding the submission of the report to locate and block all property and interests in property of any individual who is on the list required by subsection (a).</text>
                </paragraph>
                <paragraph commented="no" display-inline="no-display-inline" id="H06D085F1A8414DFC9AD52A8F9C5DB468">
                  <enum>(2)</enum>
                  <header display-inline="yes-display-inline">Form of report</header>
                  <text display-inline="yes-display-inline">Each report required by paragraph (1) shall be submitted in unclassified form, but may include a classified annex if necessary.</text>
                </paragraph>
              </subsection>

                <enum>(f)</enum>
                <header>Exceptions</header>

                  <text>The President may not include an individual on the list required by subsection (a) if the President determines that, during the 10-year period preceding the determination, the individual has not in any way engaged in, facilitated, or otherwise supported—</text>

                    <enum>(A)</enum>
                    <text>human rights abuses;</text>
                  </subparagraph>
                  <subparagraph id="H997BBE459CCB43D38C9C928174B32F95">
                    <enum>(B)</enum>
                    <text>acts of international terrorism; or</text>
                  </subparagraph>
                  <subparagraph id="H45524E76D6544D588C7F7D02E69D1D09">
                    <enum>(C)</enum>
                    <text>the proliferation of weapons of mass destruction.</text>
                  </subparagraph>
                </paragraph>
                <paragraph id="HB65B6A6F9C3F404381F27D180C5630EB">
                  <enum>(2)</enum>
                  <header>Compliance with united nations headquarters agreement</header>
                  <text>Subsection (c) shall not apply to the head of state of Iran, or necessary staff of that head of state, if admission to the United States is necessary to permit the United States to comply with the Agreement regarding the Headquarters of the United Nations, signed at Lake Success June 26, 1947, and entered into force November 21, 1947, between the United Nations and the United States.</text>
                </paragraph>
              </subsection>

                <enum>(g)</enum>
                <header>Waiver</header>
                <paragraph id="H830791620E3343A88C549C7CA5F80695">
                  <enum>(1)</enum>
                  <header>In general</header>
                  <text>The President may waive the application of subsection (c) or (d) with respect to an individual for a period of 180 days, and may renew that waiver for additional periods of 180 days, if the President—</text>
                  <subparagraph id="H957D73D9312E4DBDAB13F54CD0EFEF53">
                    <enum>(A)</enum>
                    <text>determines that the waiver is vital to the national security of the United States; and</text>
                  </subparagraph>
                  <subparagraph id="H86C79FEBAD764BE18D5281D3D8383AEF">
                    <enum>(B)</enum>
                    <text>not less than 7 days before the waiver or the renewal of the waiver, as the case may be, takes effect, submits a report to the appropriate congressional committees on the waiver and the reason for the waiver.</text>
                  </subparagraph>
                </paragraph>

                  <enum>(2)</enum>
                  <header>Form of report</header>
                  <text>Each report submitted under paragraph (1)(B) shall be submitted in unclassified form, but may include a classified annex if necessary.</text>

                    <enum>(A)</enum>
                    <text display-inline="yes-display-inline">to hold more than 25 percent of the equity interest by vote or value in the entity;</text>
                  </subparagraph>
                  <subparagraph commented="no" display-inline="no-display-inline" id="H566FEFD7E63A4A7A9842EDB7C966BDD3">
                    <enum>(B)</enum>
                    <text display-inline="yes-display-inline">to hold any seats on the board of directors of the entity; or</text>

                    <enum>(C)</enum>
                    <text display-inline="yes-display-inline">to otherwise control the actions, policies, or personnel decisions of the entity.</text>

                  <header>Significant foreign political figure</header>

                    <text display-inline="yes-display-inline">The term <term>significant foreign political figure</term> includes a current or former senior political figure, the immediate family of such a figure, and close associates of such a figure.</text>
                  </subparagraph>

                    <enum>(B)</enum>
                    <header>Additional definitions</header>
                    <text>For purposes of subparagraph (A):</text>

                      <text>The term <term>close associate</term>, with respect to a senior political figure—</text>

                        <text>means an individual who is widely and publicly known to maintain an unusually close relationship with the senior political figure; and</text>
                      </subclause>

                <text>The President shall prohibit the opening, and prohibit or impose strict conditions on the maintaining, in the United States of a correspondent account or a payable-through account by any foreign financial institution that has knowingly conducted or facilitated a significant financial transaction on behalf of an individual who is on the list required by section 221(a).</text>

                  <text>to support the efforts of the people of Iran to promote the establishment of basic freedoms in Iran;</text>

                  <text>to lay the foundation for the emergence of a freely elected, open, and democratic political system in Iran that is not a threat to its neighbors or to the United States and to work with all citizens of Iran who seek to establish such a political system;</text>

                  <text>to advocate on behalf of those in Iran persecuted for their religion or belief;</text>

                  <text>to assist the people of Iran to produce, access, and share information freely and safely through the Internet and other media; and</text>

                  <text>to defeat all attempts by the Government of Iran to jam or otherwise obstruct international satellite broadcast signals.</text>
                </paragraph>
              </subsection>

                <enum>(b)</enum>
                <header>Sense of Congress</header>
                <text>It is the sense of Congress that—</text>
                <paragraph id="H25A191C364094C41BB1CFD21D621B762" commented="no">
                  <enum>(1)</enum>
                  <text>the United States should support citizens of Iran that actively work to advance political, economic, and social reforms, including freedom of the press, freedom of assembly, freedom of religion, and representative government;</text>
                </paragraph>
                <paragraph id="H03F706A30F024442A41D8D456A5AF0C7" commented="no">
                  <enum>(2)</enum>
                  <text>the President should use all available nonviolent means to support citizens of Iran that advocate for pluralistic, prosperous, and participatory societies;</text>
                </paragraph>
                <paragraph id="H19FE3B37806A4DF8B96498C8C2DB494C" commented="no">
                  <enum>(3)</enum>
                  <text>programs of the Department of State to support reform in Iran have not resulted in a more democratic Iran;</text>
                </paragraph>
                <paragraph id="H808FC69F564E450A8EAFF9A238AEC00C" commented="no">
                  <enum>(4)</enum>
                  <text>the Government of Iran continues to play a pernicious role in the Middle East, undermining democratic consolidation in Iraq, supporting international terrorism through Hezbollah, and aiding the autocratic regime of Bashar al-Assad in Syria;</text>
                </paragraph>
                <paragraph id="HB421BEB43396421D8DDAE1F6ABAB34A5" commented="no">
                  <enum>(5)</enum>
                  <text>the Secretary of State should make every effort to deliver support directly to people working in Iran to implement programs carried out using assistance provided by the Department of State when possible and all possible means of delivering such assistance should be used; and</text>
                </paragraph>
                <paragraph id="H7EE31B239E404B059F1D512011F69AB5" commented="no">
                  <enum>(6)</enum>
                  <text>oversight, management, and implementation of programs of the Department of State to support reform in Iran should be under the direction of the Special Coordinator on Human Rights and Democracy in Iran established under section 406 of the <short-title>Iran Accountability Act of 2016</short-title>, in consultation with the Assistant Secretary of State for Democracy, Human Rights, and Labor.</text>
                </paragraph>
              </subsection>
              <subsection id="HF4C7C798AFBF49D89E53D8252FD7056C" commented="no">
                <enum>(c)</enum>
                <header>Assistance to support reform in Iran</header>
                <paragraph id="H63DF263C13074BC5838DD9CB700D4DC0" commented="no">
                  <enum>(1)</enum>
                  <header>Assistance authorized</header>
                  <text>Notwithstanding any other provision of law, the Secretary of State may provide assistance (including through the award of grants) to individuals and entities working in Iran for the purpose of supporting and promoting the rule of law, good governance, civil society, and economic opportunity in Iran.</text>
                </paragraph>
                <paragraph id="HA7FAAFB31EEF4DFC9ED07197DE5378DF" commented="no">
                  <enum>(2)</enum>
                  <header>Eligibility for assistance</header>
                  <text>Assistance authorized under this subsection should be provided only to a person that—</text>
                  <subparagraph id="HDE5C8B79CF634C8DA1438AF6A9287D7B" commented="no">
                    <enum>(A)</enum>
                    <text>officially opposes the use of violence and terrorism and has not been designated as a foreign terrorist organization under section 219 of the Immigration and Nationality Act (8 U.S.C. 1189) at any time during the 4-year period ending on the date of the enactment of the <short-title>Iran Accountability Act of 2016</short-title>;</text>
                  </subparagraph>
                  <subparagraph id="HA96FBB022045418886E5E9E79C171890" commented="no">
                    <enum>(B)</enum>
                    <text>advocates the adherence by Iran to nonproliferation regimes for nuclear, chemical, and biological weapons and materiel, and ballistic missiles;</text>
                  </subparagraph>
                  <subparagraph id="H8E51177D4DBF423AB6373D31957F4681" commented="no">
                    <enum>(C)</enum>
                    <text>is dedicated to democratic values and supports the adoption of a democratic form of government in Iran;</text>
                  </subparagraph>
                  <subparagraph id="H45C28777132D4366AC904CA18855E49F" commented="no">
                    <enum>(D)</enum>
                    <text>is dedicated to respect for human rights, including the fundamental equality of women; and</text>
                  </subparagraph>
                  <subparagraph id="HC4647B10A9804865B725680925EF4D1E" commented="no">
                    <enum>(E)</enum>
                    <text>supports freedom of the press, freedom of speech, freedom of association, and freedom of religion.</text>
                  </subparagraph>
                </paragraph>
                <paragraph id="H2C6F99DE0B234ED888AB497A739C96DB" commented="no">
                  <enum>(3)</enum>
                  <header>Notification requirement</header>
                  <text>Not later than 15 days before each obligation of assistance under this subsection, the Secretary of State shall notify the Committee on Foreign Relations and the Committee on Appropriations of the Senate and the Committee on Foreign Affairs and the Committee on Appropriations of the House of Representatives in accordance with the procedures applicable to reprogramming notifications under section 634A of the Foreign Assistance Act of 1961 (22 U.S.C. 2394–1).</text>
                </paragraph>
                <paragraph id="H79E5D7B2A1FB4627B9C12DFE78AC84DE" commented="no">
                  <enum>(4)</enum>
                  <header>Termination</header>
                  <text>The authority to provide assistance under this subsection shall expire on December 31, 2020.</text>
                </paragraph>
              </subsection>

                <header>Reports</header>

                  <header>In general</header>
                  <text>Not later than 60 days after the date of the enactment of the <short-title>Iran Accountability Act of 2016</short-title>, and every 180 days thereafter, the Secretary of State shall submit to the appropriate congressional committees a report on the implementation of this section that includes the following:</text>
                  <subparagraph id="H8E6A8E76269D4139B44974A18EC1C030" commented="no">
                    <enum>(A)</enum>
                    <text>An identification of the actions the President has taken during the 180-day period immediately preceding the submission of the report to advance each of the policies described in subsection (a).</text>
                  </subparagraph>
                  <subparagraph id="HAF40040EBC914341BD80FD71B9BA75D9" commented="no">
                    <enum>(B)</enum>
                    <text>A clear strategy for advancing political, economic, and social reform in Iran that includes benchmarks for success that lead to a set of identified discrete goals and objectives.</text>
                  </subparagraph>
                  <subparagraph id="H1C519F522FF54632966BE15717A9E533" commented="no">
                    <enum>(C)</enum>
                    <text>A plan to monitor and evaluate the effectiveness of the provision of assistance authorized under subsection (c), including measures of effectiveness.</text>
                  </subparagraph>

                    <enum>(D)</enum>
                    <text>The status of the programming of assistance under subsection (c).</text>
                  </subparagraph>

                    <text>An analysis of any past programming of assistance under subsection (c) and its effectiveness with respect to supporting and promoting the rule of law, good governance, civil society, and economic opportunity in Iran.</text>

          <header>Designation</header>
          <text>The President shall designate within the Department of State a Special Coordinator on Human Rights and Democracy in Iran (in this section referred to as the <quote>Special Coordinator</quote>).</text>
        </subsection>
        <subsection id="H19270B7905964155B6EF0233D825C07F">
          <enum>(b)</enum>
          <header>Consultation and qualifications</header>
          <text>Before the President designates a Special Coordinator under subsection (a), the Secretary of State shall consult with the chairmen and ranking members of the appropriate congressional committees. The role of Special Coordinator should be filled by an official of the Department of State appointed by and serving at the pleasure of the President in a position not lower than Under Secretary on the day before the date of the enactment of this Act. </text>
        </subsection>
        <subsection id="H1879FC15BED34045BF00A418CD1CC43F">
          <enum>(c)</enum>
          <header>Duties</header>
          <text>The Special Coordinator shall carry out the following duties:</text>
          <paragraph id="HBEF2EDB43E354E4282C00D8E94FD3F01">
            <enum>(1)</enum>
            <text>Coordinate the activities of the United States Government that promote human rights, democracy, political freedom, and religious freedom inside Iran.</text>
          </paragraph>
          <paragraph id="H35400BB189094638BE8744584FC6B555">
            <enum>(2)</enum>
            <text>Coordinate the activities of the United States Government that promote human rights, political freedom, and religious freedom for Iranian refugees and asylees living outside Iran.</text>
          </paragraph>
          <paragraph id="HB8DCAB5049BB4461952553A46DED9977">
            <enum>(3)</enum>
            <text>Ensure the comprehensive investigation and designation of Iranian human rights abusers in accordance with section 105 of the Comprehensive Iran Sanctions, Accountability, and Divestment Act of 2010 (22 U.S.C. 8514).</text>
          </paragraph>
          <paragraph id="H5DE08087A89D43ADB351370502021800">
            <enum>(4)</enum>
            <text>Coordinate the documentation and publicizing of political dissidents and cases of human rights abuse inside Iran.</text>

            <text>Coordinate multilateral efforts to build international support for the promotion of human rights, democracy, political freedom, and religious freedom in Iran, including broadcasting, Internet access, and dissemination of information.</text>

            <enum>(6)</enum>
            <text>Encourage the United Nations, multilateral organizations, and human rights nongovernmental organizations to more robustly investigate and report on human rights abuses in Iran.</text>
          </paragraph>
          <paragraph id="HE5344D6064024F7D9C14829275323180">
            <enum>(7)</enum>
            <text>Encourage foreign governments to downgrade or sever diplomatic relations with the Government of Iran, enact economic sanctions, and assist Iranian dissidents in response to the continued violations of human rights by the Government of Iran.</text>
          </paragraph>
          <paragraph id="H910B5A8BF6EF4B8D9CFEAC4C38A76650">
            <enum>(8)</enum>
            <text>Encourage foreign governments to expel Iran from international fora and organizations with a human rights component, including the United Nations Commission on the Status of Women, the United Nations Educational, Scientific and Cultural Organization, the United Nations Children’s Fund, and the International Labour Organization.</text>
          </paragraph>

            <header>Coordination of activities</header>
            <text>The Special Coordinator shall coordinate all activities related to Iran carried out by the Bureau of Near Eastern Affairs, the Bureau of Democracy, Human Rights and Labor, and the Bureau of Population, Refugees and Migration of the Department of State, the Ambassador-at-Large for International Religious Freedom, the Special Envoy to Monitor and Combat Anti-Semitism, the United States Commission on International Religious Freedom, the National Endowment for Democracy, and the Broadcasting Board of Governors.</text>
          </paragraph>
          <paragraph id="H1448DFDF766549CA8D96F09695A028B0">
            <enum>(2)</enum>
            <header>Coordination of use of funds</header>
            <text>The Special Coordinator shall coordinate and oversee the obligation and expenditure of funds related to human rights, democracy, Internet freedom, and broadcasting activities in Iran, including funds made available for such purposes to the Middle East Partnership Initiative, the United States Commission on International Religious Freedom, the Broader Middle East and North Africa Initiative, the Human Rights and Democracy Fund, and the Near Eastern Regional Democracy Fund.</text>
          </paragraph>
        </subsection>
        <subsection id="HA262D4740EF54A5DBDFF4ECDC076592D">
          <enum>(e)</enum>
          <header>Diplomatic representation</header>
          <text>Subject to the direction of the President and the Secretary of State, the Special Coordinator shall represent the United States in matters and cases relevant to the promotion of human rights, democracy, political freedom, and religious freedom in Iran in—</text>
          <paragraph id="H8A397E5C76DF4A3E9EDDCAC8F85DD315">
            <enum>(1)</enum>
            <text>contacts with foreign governments, intergovernmental organizations, and specialized agencies of the United Nations, the Organization for Security and Co-operation in Europe, and other international organizations of which the United States is a member; and</text>
          </paragraph>
          <paragraph id="H92DB9F87BEEE4B5E8F236CF5B3929E26">
            <enum>(2)</enum>
            <text>multilateral conferences and meetings relevant to the promotion of human rights, democracy, political freedom, and religious freedom in Iran.</text>
          </paragraph>
        </subsection>
        <subsection id="HCC2019432E8D4D4CAADFD17F92595B0A">
          <enum>(f)</enum>
          <header>Consultations</header>
          <text>The Special Coordinator shall consult with Congress, domestic and international nongovernmental organizations, labor organizations, and multilateral organizations and institutions as the Special Coordinator considers appropriate to fulfill the purposes of this section.</text>
        </subsection>

          <enum>(g)</enum>
          <header>Appropriate congressional committees defined</header>
          <text>In this section, the term <term>appropriate congressional committees</term> means—</text>
          <paragraph id="H21E133CB376847F3B6B369BB99AF1905">
            <enum>(1)</enum>
            <text>the Committee on Foreign Relations and the Committee on Appropriations of the Senate; and</text>
          </paragraph>
          <paragraph id="HE917528A1492458BA7E9664D4B002A93">
            <enum>(2)</enum>
            <text>the Committee on Foreign Affairs and the Committee on Appropriations of the House of Representatives.</text>
          </paragraph>
        </subsection>
      </section>

        <enum>407.</enum>
        <header>Broadcasting to Iran</header>
        <subsection id="HD178527C353D428E994DEAD8E6CAE101">
          <enum>(a)</enum>
          <header>In general</header>
          <text>Radio Free Europe/Radio Liberty and the Voice of America services broadcasting to Iran shall—</text>
          <paragraph id="H6C564881F9504E739434BC5CF604C8B5">
            <enum>(1)</enum>
            <text>provide news and information that is accessible, credible, comprehensive, and accurate;</text>
          </paragraph>
          <paragraph id="H5B7A1D7A3E8846E68ABF684EEBD91C44">
            <enum>(2)</enum>
            <text>emphasize investigative and analytical journalism provided by Iranian or pro-Iranian media outlets; and</text>
          </paragraph>
          <paragraph id="H9131B8DC8B74402C8A55927358837BCD">
            <enum>(3)</enum>
            <text>strengthen civil society by promoting democratic processes, respect for human rights, and freedom of the press and expression.</text>
          </paragraph>
        </subsection>
        <subsection id="H4A83F5BF19C9435D8BBAB6A178DC1D13">
          <enum>(b)</enum>
          <header>Programming surge</header>
          <text>Radio Free Europe/Radio Liberty and Voice of America programming to Iran shall—</text>
          <paragraph id="HD687394D3AC34AD1ADB4BB991B12142B">
            <enum>(1)</enum>
            <text>provide programming content 24 hours a day and 7 days a week to target populations using all available and effective distribution outlets, including at least 12 hours a day of original television and video content, not including live video streaming of breaking news;</text>
          </paragraph>
          <paragraph id="H352246916A794F1CA9852A30F3F6BB52">
            <enum>(2)</enum>
            <text>create mobile platforms with an embedded proxy to offer the people of Iran the opportunity to securely listen to programming;</text>
          </paragraph>
          <paragraph id="H2E90805210A14341BD78002CA9581D47">
            <enum>(3)</enum>
            <text>increase number of staffers based in the region to allow for more direct contact with the people of Iran;</text>
          </paragraph>
          <paragraph id="H6578C0D132F249A3A96166354EBF0175">
            <enum>(4)</enum>
            <text>expand the use, audience, and audience engagement of mobile news and multimedia platforms by the Voice of America and the Radio Farda service of Radio Free Europe/Radio Liberty, including through Internet-based social networking platforms; and</text>
          </paragraph>
          <paragraph id="HC5440330ECFA405B9AAC4A77C4B047E2">
            <enum>(5)</enum>
            <text>establish fellowships for Iranian journalists who have fled the country to learn about free, competitive media and be trained in surrogate reporting.</text>
          </paragraph>
        </subsection>
      </section>

        <enum>408.</enum>
        <header>Report on United States citizens detained by Iran</header>
        <subsection id="H440DE56B57654520B637F975584D7CBC">
          <enum>(a)</enum>
          <header>In general</header>
          <text display-inline="yes-display-inline">Not later than 90 days after the date of the enactment of this Act, and every 180 days thereafter, the President shall submit to the appropriate congressional committees a report on United States citizens, including dual citizens, detained by Iran or groups supported by Iran that includes—</text>
          <paragraph id="H782347AF455D4F16AB32AA389201EEFD">
            <enum>(1)</enum>
            <text display-inline="yes-display-inline">information regarding any officials of the Government of Iran involved in any way in the detentions; and</text>
          </paragraph>
          <paragraph id="HB49ECFA774284467BBF0FD9D616DAD26">
            <enum>(2)</enum>
            <text display-inline="yes-display-inline">a summary of efforts the United States Government has taken to secure the swift release of those United States citizens, including United States citizens who are also citizens of other countries.</text>
          </paragraph>
        </subsection>
        <subsection id="H074E7B3253784301BE539F7ED17ABA8B">
          <enum>(b)</enum>
          <header>Form of report</header>
          <text display-inline="yes-display-inline">The report required by subsection (a) shall be submitted in unclassified form, but may include a classified annex if necessary.</text>
        </subsection>
        <subsection id="HE66B12280E954D1CA79A4D8961E0C403">
          <enum>(c)</enum>
          <header>Appropriate congressional committees defined</header>
          <text>In this section, the term <term>appropriate congressional committees</term> has the meaning given that term in section 14 of the Iran Sanctions Act of 1996 (Public Law 104–172; 50 U.S.C. 1701 note).</text>
        </subsection>
      </section>

        <enum>409.</enum>
        <header>Sense of Congress on role of the United Nations in promoting human rights in Iran</header>
        <text display-inline="no-display-inline">It is the sense of Congress that—</text>
        <paragraph id="H5EC731F21F68431B9916666E7EB7C55A">
          <enum>(1)</enum>
          <text>the United Nations has a significant role to play in promoting and improving human rights in Iran;</text>
        </paragraph>
        <paragraph id="H36FE9BCD066C4988886992C56E115A5E">
          <enum>(2)</enum>
          <text>the United States should continue to support the work of the United Nations Special Rapporteur on the situation of human rights in the Islamic Republic of Iran; and</text>
        </paragraph>
        <paragraph id="H1BBF94EF495344E3BE47C6DABC848E38">
          <enum>(3)</enum>
          <text>the egregious human rights violations in Iran warrant country-specific attention and continued reporting by the Special Rapporteur on the situation of human rights in the Islamic Republic of Iran, the Special Rapporteur on torture and other cruel, inhuman, or degrading treatment or punishment, the Working Group on Arbitrary Detention, the Special Rapporteur on extrajudicial, summary, or arbitrary executions, the Special Rapporteur on the promotion and protection of the right to freedom of opinion and expression, the Special Rapporteur on freedom of religion or belief, and the Special Rapporteur on violence against women, its causes, and consequences, of the United Nations.</text>
        </paragraph>
      </section>
