            <header>Agency discretion to secure information technology and information systems</header>
            <subsection id="H1320D9DDA7864EC99638DB9304E6D72D">
              <enum>(a)</enum>
              <header>In general</header>
              <text>In carrying out section 3554 of title 44, United States Code, any action taken by the head of an agency that is necessary to limit, restrict, or prohibit access to any website the head of the agency determines to present a current or future security weakness or risk to the information technology or information system under the control of the agency, and any impact or implementation of such action, shall not be subject to chapter 71 of title 5, United States Code.</text>
            </subsection>

              <enum>(b)</enum>
              <header>Definitions</header>
              <text>In this section—</text>

                <enum>(1)</enum>
                <text>the terms <quote>agency</quote> and <quote>information system</quote> have the meanings given the terms in section 3502 of title 44, United States Code; and</text>
              </paragraph>

                <enum>(2)</enum>
                <text>the term <quote>information technology</quote> has the meaning given the term in section 3552 of title 44, United States Code.</text>

            </subsection>
          </section>
        </title>

          <enum>II</enum>
          <header>Eliminating pornography from agencies</header>
          <section id="H27C1843F56BF4A28A0017676E64368EF">
            <enum>201.</enum>
            <header>Prohibition on accessing pornographic web sites from federal computers</header>
            <subsection id="H09F855D7A43C426BBA109CEB4B573B9E">
              <enum>(a)</enum>
              <header>Prohibition</header>
              <text>Except as provided in subsection (b), not later than 90 days after the date of the enactment of this Act, the Director of the Office of Management and Budget shall issue guidelines that prohibit the access of a pornographic or other explicit web site from a Federal computer.</text>
            </subsection>
            <subsection id="H523DACE9DA8644348225998B33E17D37">
              <enum>(b)</enum>
              <header>Exception</header>
              <text>The prohibition described in subsection (a) shall not apply to any Federal computer that is used for an investigative purpose that requires accessing a pornographic web site.</text>
            </subsection>
          </section>
        </title>

          <enum>III</enum>
          <header>Extension of probationary period for career employees</header>
          <section id="H8B15DCE4FC424129AB7690EC527B3DA0" section-type="subsequent-section">
            <enum>301.</enum>
            <header>Extension of probationary period for positions within the competitive service</header>
            <subsection id="H3C2877FBDD9B4D91A08E476318C13D20">
              <enum>(a)</enum>
              <header>In general</header>
              <text>Section 3321 of title 5, United States Code, is amended—</text>
              <paragraph id="H6B2354CD322942C4AF73567AE20A1B49">
                <enum>(1)</enum>
                <text>in subsection (a), by striking <quote>The President</quote> and inserting <quote>Subject to subsections (c) and (d), the President</quote>;</text>
              </paragraph>
              <paragraph id="H073EABF8834D48EE97181CEA8BD1F9E7">
                <enum>(2)</enum>
                <text>by redesignating subsection (c) as subsection (e); and</text>
              </paragraph>
              <paragraph id="H7E02DED90EAC43CDA2A0FA3D821A27BE">
                <enum>(3)</enum>
                <text>by inserting after subsection (b) the following:</text>

                    <enum>(c)</enum>
                    <paragraph commented="no" display-inline="yes-display-inline" id="HBD1FCF865B474C09B6A1655E34A9E440">
                      <enum>(1)</enum>
                      <text>Except as provided in paragraph (2), the length of a probationary period established under paragraph (1) or (2) of subsection (a) shall be—</text>
                      <subparagraph id="HEA27DD083D4741F88E8F1B0904928101" indent="up1">
                        <enum>(A)</enum>
                        <text>with respect to any position that requires formal training, a period of 2 years beginning on the date that such formal training is completed;</text>
                      </subparagraph>
                      <subparagraph id="H99A83E09C8754D31AFA1B88132BDA2E6" indent="up1">
                        <enum>(B)</enum>
                        <text display-inline="yes-display-inline">with respect to any position that requires a license, a period of 2 years beginning on the date that such license is granted; and</text>
                      </subparagraph>
                      <subparagraph id="H702B545B935042DFAA232AB113C44E49" indent="up1">
                        <enum>(C)</enum>
                        <text display-inline="yes-display-inline">with respect to any position not covered by subparagraph (A) or (B), not less than 2 years.</text>
                      </subparagraph>
                    </paragraph>
                    <paragraph id="H4C40ABD40D1B44268088F104BC1001EC" indent="up1">
                      <enum>(2)</enum>
                      <text display-inline="yes-display-inline">The length of a probationary period established under paragraph (1) or (2) of subsection (a) in the case of a preference eligible shall be not longer than—</text>
                      <subparagraph id="H008D509A08564C80A2C7FECB08728590">
                        <enum>(A)</enum>
                        <text>if the appointment (as referred to in subsection (a)(1)) or the initial appointment (as referred to in subsection (a)(2)) is to a position that exists on the effective date of this subsection, the length of the probationary period which applies to such position as of such effective date; or</text>
                      </subparagraph>
                      <subparagraph id="HD6E7134954B541D6B2539AB48342DA37">
                        <enum>(B)</enum>
                        <text>if the appointment (as referred to in subsection (a)(1)) or the initial appointment (as referred to in subsection (a)(2)) is to a position that does not exist on the effective date of this subsection, such length of time as the President may establish, consistent with the purposes of this subparagraph.</text>
                      </subparagraph>
                    </paragraph>
                    <paragraph id="H2AB0195BADB24A81B441CCD4B829499C" indent="up1">
                      <enum>(3)</enum>
                      <text>In paragraph (1)—</text>
                      <subparagraph id="H7365D0E702214FEDA61A54FB50A92471">
                        <enum>(A)</enum>
                        <text>the term <quote>formal training</quote> means, with respect to any position, a training program required by law, rule, or regulation, or otherwise required by the employing agency, to be completed by the employee before the employee is able to successfully execute the duties of the applicable position; and</text>
                      </subparagraph>
                      <subparagraph id="HD506F10AACA64BA3AF8826068B87A038">
                        <enum>(B)</enum>
                        <text display-inline="yes-display-inline">the term <quote>license</quote> means a license, certification, or other grant of permission to engage in a particular activity.</text>
                      </subparagraph>
                    </paragraph>
                  </subsection>
                  <subsection id="H47F8B359FBD945C0AD558D4B2F0C42F6">
                    <enum>(d)</enum>
                    <text display-inline="yes-display-inline">The head of each agency shall, in the administration of this section, take appropriate measures to ensure that—</text>
                    <paragraph id="H4DFA600F7B034A8B8D8675F59AEE9FFF">
                      <enum>(1)</enum>
                      <text display-inline="yes-display-inline">any announcement of a vacant position within such agency and any offer of appointment made to any individual with respect to any such position shall clearly state the terms and conditions of the probationary period applicable to such position;</text>
                    </paragraph>
                    <paragraph id="H66D0FB5598E04DC78752CD4703564E83">
                      <enum>(2)</enum>
                      <text display-inline="yes-display-inline">any individual who is required to complete a probationary period under this section shall receive timely notice of the performance and other requirements which must be met in order to successfully complete the probationary period; and</text>
                    </paragraph>
                    <paragraph id="HE592C366B37D4AC5B4DD0F56C7EC4F55">
                      <enum>(3)</enum>
                      <text display-inline="yes-display-inline">upon successful completion of a probationary period under this section, certification to that effect shall be made, supported by a brief statement of the basis for that certification, in such form and manner as the President may by regulation prescribe.</text>
                    </paragraph>
                  </subsection>

            </subsection>
            <subsection id="HE7145AAF893447D1A48E1CDA5C662E01">
              <enum>(b)</enum>
              <header>Technical amendment</header>
              <text display-inline="yes-display-inline">Section 3321(e) of title 5, United States Code (as so redesignated by subsection (a)(2)) is amended by striking <quote>Subsections (a) and (b)</quote> and inserting <quote>Subsections (a) through (d)</quote>.</text>
            </subsection>
            <subsection id="H95F319AB724249C6BEB5B542BE31967F">
              <enum>(c)</enum>
              <header>Effective date</header>
              <text>This section and the amendments made by this section—</text>
              <paragraph id="HC361F9CAC8A147098CA477254CD65E2B">
                <enum>(1)</enum>
                <text>shall take effect 180 days after the date of enactment of this Act; and</text>
              </paragraph>
              <paragraph id="H090F2B6B7CD4498981B70901D21A63DF">
                <enum>(2)</enum>
                <text>shall apply in the case of any appointment (as referred to in section 3321(a)(1) of title 5, United States Code) and any initial appointment (as referred to in section 3321(a)(2) of such title) taking effect on or after the date on which this section takes effect.</text>
              </paragraph>
            </subsection>
          </section>

            <enum>302.</enum>
            <header>Appeals from adverse actions</header>
            <subsection commented="no" id="H460AADBE50CE4316B138D3052498ED59">
              <enum>(a)</enum>
              <header>Subchapter I of chapter 75 of title 5</header>
              <text>Section 7501(1) of title 5, United States Code, is amended—</text>
              <paragraph commented="no" id="H531990B2A8BB41428B7ED4E34EED7ED0">
                <enum>(1)</enum>
                <text>by striking <quote>1 year</quote> the first place it appears and inserting <quote>not less than 2 years</quote>; and</text>
              </paragraph>
              <paragraph commented="no" id="H0828C5C68C7741D59F3BBF6EC63729E1">
                <enum>(2)</enum>
                <text>by striking <quote>1 year</quote> the second place it appears and inserting <quote>2 years</quote>.</text>
              </paragraph>
            </subsection>

              <enum>(b)</enum>
              <header>Subchapter II of chapter 75 of title 5</header>
              <text>Section 7511(a)(1) of title 5, United States Code, is amended—</text>

                <enum>(1)</enum>
                <text>in subparagraph (A)(ii), by striking <quote>1 year</quote> the first place it appears and inserting <quote>not less than 2 years</quote>; and</text>

                <enum>(2)</enum>
                <text>in subparagraph (C)(ii), by striking <quote>2 years</quote> the first place it appears and inserting <quote>not less than 2 years</quote>.</text>

              <header>Effective date</header>
              <text>The amendments made by subsections (a) and (b)—</text>

                <text>shall take effect 180 days after the date of enactment of this Act; and</text>
              </paragraph>

                <text>shall apply in the case of any individual whose period of continuous service (as referred to in the provision of law amended by paragraph (1) or (2) of subsection (b), as the case may be) commences on or after the date on which this section takes effect.</text>

          <enum>IV</enum>
          <header>Senior Executive Service accountability</header>
          <section id="H7E3C94FDB8BE4CBD8665F933F5109860">
            <enum>401.</enum>
            <header>Biennial justification of Senior Executive Service positions</header>
            <text display-inline="no-display-inline">Section 3133(a)(2) of title 5, United States Code, is amended by inserting after <quote>positions</quote> the following: <quote>, with a justification for each position (by title and organizational location) and the specific result expected from each position, including the impact of such result on the agency mission,</quote>.</text>
          </section>

            <enum>402.</enum>
            <header>Extension of probationary period for career appointees</header>
            <subsection id="HCBD10597D91F436CBB01AA8248F346E9">
              <enum>(a)</enum>
              <header>In general</header>
              <text display-inline="yes-display-inline">Section 3393(d) of title 5, United States Code, is amended by striking <quote>1-year</quote> and inserting <quote>2-year</quote>.</text>
            </subsection>

              <header>Conforming amendment</header>
              <text display-inline="yes-display-inline">Section 3592(a)(1) of such title is amended by striking <quote>1-year</quote> and inserting <quote>2-year</quote>.</text>

            <enum>403.</enum>
            <header>Modification of pay retention for career appointees removed for under performance</header>
            <text display-inline="no-display-inline">Section 3594(c)(1)(B) of title 5, United States Code, is amended to read as follows:</text>

              <subparagraph id="HA2C4DDD494DF45339CA1B266986C1E2E" indent="up1">
                <enum>(B)</enum>
                <clause commented="no" display-inline="yes-display-inline" id="H270AAD7CBED94E5FBBB5D55F2FF0D1F0" indent="up1">
                  <enum>(i)</enum>
                  <text display-inline="yes-display-inline">any career appointee placed under subsection (a) or (b)(2) of this section shall be entitled to receive basic pay at the highest of—</text>
                  <subclause id="H6DB7F4BC19434234AB1BE7D6807A8494" indent="up1">
                    <enum>(I)</enum>
                    <text>the rate of basic pay in effect for the position in which placed;</text>
                  </subclause>
                  <subclause id="H1AD1DC50D1D2407D851A532C6BC3839E" indent="up1">
                    <enum>(II)</enum>
                    <text display-inline="yes-display-inline">the rate of basic pay in effect at the time of the placement for the position the career appointee held in the civil service immediately before being appointed to the Senior Executive Service; or</text>
                  </subclause>
                  <subclause id="H04555E4F6B974AAF84DA8DF7D7C4A98E" indent="up1">
                    <enum>(III)</enum>
                    <text display-inline="yes-display-inline">the rate of basic pay in effect for the career appointee immediately before being placed under subsection (a) or (b) of this section; and</text>
                  </subclause>

                  <enum>(ii)</enum>
                  <text>any career appointee placed under subsection (b)(1) of this section shall be entitled to receive basic pay at the rate of basic pay in effect for the position in which placed; and</text>

              <enum>(1)</enum>
              <text>by striking <quote>on or</quote> and inserting <quote>not later than 30 calendar days</quote>; and</text>
            </paragraph>

              <text>by inserting <quote>in writing</quote> after <quote>communicated</quote>.</text>

                    <text display-inline="yes-display-inline">Under regulations prescribed by the Office of Personnel Management, an agency may place an employee on mandatory leave for misconduct, neglect of duty, malfeasance, or such cause as would promote the efficiency of the service.</text>
                  </subsection>
                  <subsection commented="no" id="H6A2BC211374A4EEBB139F0FCEF90A47E">
                    <enum>(c)</enum>
                    <text>If an agency determines that an employee should be placed on mandatory leave under subsection (b), such leave shall begin no earlier than the date on which the employee received written notice of a removal under subchapter V of chapter 75.</text>
                  </subsection>

                    <enum>(d)</enum>
                    <text>If a final order or decision is issued in favor of such employee with respect to removal under subchapter V of chapter 75 by the agency, the Merit Systems Protection Board, or the United States Court of Appeals for the Federal Circuit, any annual leave that is charged to an employee by operation of this section shall be restored to the applicable leave account of such employee.</text>

                    <header>Cause and procedure</header>
                    <subsection id="H800A07CA5E014BB8B71462C3992B778D">
                      <enum>(a)</enum>
                      <paragraph commented="no" display-inline="yes-display-inline" id="H45F505B5914946A5BC279A170966257C">
                        <enum>(1)</enum>
                        <text display-inline="yes-display-inline">Under regulations prescribed by the Office of Personnel Management, the head of an agency may remove an employee of the agency from the Senior Executive Service if the head determines that the performance or misconduct of the individual warrants such removal. If the head so removes such an individual, the head may—</text>
                        <subparagraph id="HB4CB819B5D104365B29BB972E48A746C" indent="up1">
                          <enum>(A)</enum>
                          <text display-inline="yes-display-inline">remove the individual from the civil service; or</text>
                        </subparagraph>
                        <subparagraph id="H9FBAE9C19961424EBA9181D3F766B0F0" indent="up1">
                          <enum>(B)</enum>
                          <text display-inline="yes-display-inline">in the case of an employee described in paragraph (2), transfer the employee from the Senior Executive Service to a General Schedule position at any grade of the General Schedule for which the employee is qualified and that the head determines is appropriate.</text>
                        </subparagraph>
                      </paragraph>
                      <paragraph id="H6045EC9AFE564C3AA1861D0A7E11EF27" indent="up1">
                        <enum>(2)</enum>
                        <text display-inline="yes-display-inline">An employee described in this paragraph is an individual who—</text>
                        <subparagraph id="HEDFFD244B82B42F29FB39C424B477599">
                          <enum>(A)</enum>
                          <text display-inline="yes-display-inline">previously occupied a permanent position within the competitive service;</text>
                        </subparagraph>
                        <subparagraph id="HECCB18F7EB154E97B167FA02A500B023">
                          <enum>(B)</enum>
                          <text display-inline="yes-display-inline">previously occupied a permanent position within the excepted service; or</text>
                        </subparagraph>
                        <subparagraph id="HD2C8B68E1F44460F920543107A195A0B">
                          <enum>(C)</enum>
                          <text display-inline="yes-display-inline">prior to employment as a career appointee at the agency, did not occupy any position within the Federal Government.</text>
                        </subparagraph>
                      </paragraph>
                      <paragraph id="H282F3DA3F4F84ADEB24CC912293FDC17" indent="up1">
                        <enum>(3)</enum>
                        <text>An employee against whom an action is proposed under paragraph (1) is entitled to 5 days’ advance written notice.</text>
                      </paragraph>
                    </subsection>
                    <subsection id="HF10FDDBF774B47EE99E27AB89C559CB7">
                      <enum>(b)</enum>
                      <paragraph commented="no" display-inline="yes-display-inline" id="HAC16D9247B034366A4C41182C44CCF22">
                        <enum>(1)</enum>
                        <text display-inline="yes-display-inline">Notwithstanding any other provision of law, including section 3594, any employee transferred to a General Schedule position under subsection (a)(1)(B) shall, beginning on the date of such transfer, receive the annual rate of pay applicable to such position.</text>
                      </paragraph>
                      <paragraph commented="no" id="HE430D2AA16C2414AB8E72535DB8BA197" indent="up1">
                        <enum>(2)</enum>
                        <text display-inline="yes-display-inline">An employee so transferred may not be placed on administrative leave or any other category of paid leave during the period during which an appeal (if any) under this section is ongoing, and may only receive pay if the individual reports for duty. If an employee so transferred does not report for duty, such employee shall not receive pay or other benefits pursuant to section 7554(e).</text>
                      </paragraph>
                    </subsection>
                    <subsection commented="no" id="HF7DFFF67CD4140D7A58F2FC7E51DA205">
                      <enum>(c)</enum>
                      <text display-inline="yes-display-inline">Not later than 30 days after removing or transferring an employee under subsection (a), the applicable head of the agency shall submit to Congress notice in writing of such removal or transfer and the reason for such removal or transfer.</text>
                    </subsection>
                    <subsection id="HA4EFD2C409FD49E48B84B275009E7905">
                      <enum>(d)</enum>
                      <text display-inline="yes-display-inline">Section 3592(b)(1) does not apply to an action to remove or transfer an employee under this section.</text>
                    </subsection>
                    <subsection id="HCBC3134312184B82BA31A5D67C019EDD">
                      <enum>(e)</enum>
                      <text display-inline="yes-display-inline">Subject to the requirements of section 7554, an employee may appeal a removal or transfer under subsection (a) to the Merit Systems Protection Board under section 7701, but only if such appeal is made not later than seven days after the date of such removal or transfer.</text>
                    </subsection>
                  </section>
                  <section id="H6188E5416B0D4F5EBF4A4F0C4720911A">
                    <enum>7554.</enum>
                    <header>Expedited review of appeal</header>
                    <subsection id="HA91843F22A9D4340A6C7C0609741D455">
                      <enum>(a)</enum>
                      <text display-inline="yes-display-inline">Upon receipt of an appeal under section 7553(d), the Merit Systems Protection Board shall refer such appeal to an administrative judge pursuant to section 7701(b)(1). The administrative judge shall—</text>
                      <paragraph id="H2FBCB8344AF34549B87B34F28D544066">
                        <enum>(1)</enum>
                        <text>expedite any such appeal under such section; and</text>
                      </paragraph>
                      <paragraph id="H1D51BCDC0BBA4A3E9F962EE0B39FD970">
                        <enum>(2)</enum>
                        <text>in any such case, issue a decision not later than 21 days after the date of the appeal.</text>
                      </paragraph>
                    </subsection>
                    <subsection id="H6B809E23075E4F4E8720946C5FC0215E">
                      <enum>(b)</enum>
                      <text display-inline="yes-display-inline">Notwithstanding any other provision of law, including section 7703, the decision of an administrative judge under subsection (a) shall be final and shall not be subject to any further appeal.</text>
                    </subsection>
                    <subsection id="H1B2CFF933D824A479340C72782F83A3D">
                      <enum>(c)</enum>
                      <text display-inline="yes-display-inline">In any case in which the administrative judge cannot issue a decision in accordance with the 21-day requirement under subsection (a)(2), the removal or transfer is final. In such a case, the Merit Systems Protection Board shall, within 14 days after the date that such removal or transfer is final, submit to Congress a report that explains the reasons why a decision was not issued in accordance with such requirement.</text>
                    </subsection>
                    <subsection id="H63FB5ABB447D44FBB7C8D2C37E3DA87E">
                      <enum>(d)</enum>
                      <text display-inline="yes-display-inline">The Merit Systems Protection Board or administrative judge may not stay any removal or transfer under this section.</text>
                    </subsection>
                    <subsection commented="no" id="HEB364D1A76BF4237B90AE560C8C171B3">
                      <enum>(e)</enum>
                      <text display-inline="yes-display-inline">During the period beginning on the date on which an employee appeals a removal from the civil service under section 7553(d) and ending on the date that the administrative judge issues a final decision on such appeal, such employee may not receive any pay, awards, bonuses, incentives, allowances, differentials, student loan repayments, special payments, or benefits.</text>
                    </subsection>

          <header>OPM Report on Official Time</header>

            <enum>501.</enum>
            <header>Reporting requirement</header>
            <subsection id="HC10D6CA95D994515902450D78956AC3C">
              <enum>(a)</enum>
              <header>In general</header>
              <text display-inline="yes-display-inline">Section 7131 of title 5, United States Code, is amended by adding at the end the following:</text>

                  <enum>(e)</enum>
                  <paragraph id="H2C23F0DA468648CFAD1F0DB4E2F92923" display-inline="yes-display-inline">
                    <enum>(1)</enum>
                    <subparagraph id="H0EF2A1D4723E4620B7D9FA12905C5846" display-inline="yes-display-inline">
                      <enum>(A)</enum>
                      <text>Not later than March 31 of each calendar year, the Office of Personnel Management, in consultation with the Office of Management and Budget, shall submit to each House of Congress a report on the operation of this section during the fiscal year last ending before the start of such calendar year.</text>
                    </subparagraph>
                    <subparagraph id="HFDDDBC46517C419DBD5EBAA06850A6D3" indent="up2">
                      <enum>(B)</enum>
                      <text>Not later than December 31 of each calendar year, each agency (as defined by section 7103(a)(3)) shall furnish to the Office of Personnel Management the information which such Office requires, with respect to such agency, for purposes of the report which is next due under subparagraph (A).</text>
                    </subparagraph>
                  </paragraph>
                  <paragraph id="H824D634B461141208997111843DC017A" indent="up1">
                    <enum>(2)</enum>
                    <text>Each report by the Office of Personnel Management under this subsection shall include, with respect to the fiscal year described in paragraph (1)(A), at least the following information:</text>
                    <subparagraph id="HC217C0C992984E3AABBF3A1390C25542">
                      <enum>(A)</enum>
                      <text>The total amount of official time granted to employees.</text>
                    </subparagraph>
                    <subparagraph id="H669EB6178193421C94EC2D01736BA49D">
                      <enum>(B)</enum>
                      <text>The average amount of official time expended per bargaining unit employee.</text>
                    </subparagraph>
                    <subparagraph id="H34C5486740B847E281E3A1CC6795CE05">
                      <enum>(C)</enum>
                      <text>The specific types of activities or purposes for which official time was granted, and the impact which the granting of such official time for such activities or purposes had on agency operations.</text>
                    </subparagraph>
                    <subparagraph id="H97AF806930D34647B0B1E276896CBEA0">
                      <enum>(D)</enum>
                      <text>The total number of employees to whom official time was granted, and, of that total, the number who were not engaged in any activities or purposes except activities or purposes involving the use of official time.</text>
                    </subparagraph>
                    <subparagraph id="HBEAC9FD099834E7DA5F22CEA571DFCD0">
                      <enum>(E)</enum>
                      <text>The total amount of compensation (including fringe benefits) afforded to employees in connection with activities or purposes for which they were granted official time.</text>
                    </subparagraph>
                    <subparagraph id="H97CF60D451C84CAAAC17908CD8ACA92C">
                      <enum>(F)</enum>
                      <text display-inline="yes-display-inline">A description of any room or space designated at the agency (or its subcomponent) where official time activities will be conducted, including the square footage of any such room or space.</text>
                    </subparagraph>
                  </paragraph>
                  <paragraph id="H1D6894DA653B4C9C9810BD3E56165A55" indent="up1">
                    <enum>(3)</enum>
                    <text>All information included in a report by the Office of Personnel Management under this subsection with respect to a fiscal year—</text>
                    <subparagraph id="HC272830ED3294ADF92B7EB27D63F1046">
                      <enum>(A)</enum>
                      <text>shall be shown both agency-by-agency and for all agencies; and</text>
                    </subparagraph>
                    <subparagraph id="H56B1C15144074C9E97C6C2F7954888F4">
                      <enum>(B)</enum>
                      <text>shall be accompanied by the corresponding information (submitted by the Office in its report under this subsection) for the fiscal year before the fiscal year to which such report pertains, together with appropriate comparisons and analyses.</text>
                    </subparagraph>
                  </paragraph>
                  <paragraph id="H49DF891E14B54E85B678565B48D62668" indent="up1">
                    <enum>(4)</enum>
                    <text>For purposes of this subsection, the term <term>official time</term> means any period of time, regardless of agency nomenclature—</text>
                    <subparagraph id="H4BF729B6917A4D029BB09BC538680238">
                      <enum>(A)</enum>
                      <text>which may be granted to an employee under this chapter (including a collective bargaining agreement entered into under this chapter) to perform representational or consultative functions; and</text>
                    </subparagraph>
                    <subparagraph id="H9D9F34468E2F4AA59361AFB5866C67EB">
                      <enum>(B)</enum>
                      <text>during which the employee would otherwise be in a duty status.</text>
                    </subparagraph>
                  </paragraph>
                </subsection>

            </subsection>
            <subsection id="H181986E46F054732A889500427B1F36C">
              <enum>(b)</enum>
              <header>Applicability</header>
              <text>The amendment made by subsection (a) shall be effective beginning with the report which, under the provisions of such amendment, is first required to be submitted by the Office of Personnel Management to each House of Congress by a date which occurs at least 6 months after the date of the enactment of this Act.</text>
            </subsection>
          </section>
        </title>

          <enum>VI</enum>
          <header>Midnight rule relief</header>
          <section id="H1F1BA5623AC64B8E88156545FED1A00A">
            <enum>601.</enum>
            <header>Moratorium on midnight rules</header>
            <text display-inline="no-display-inline">Except as provided under sections 603 and 604, during the moratorium period, an agency may not propose or adopt any midnight rule unless the Administrator finds the midnight rule will not result in any of the following:</text>
            <paragraph id="H78664C0D4EED4B0899E8CEAB6A020103">
              <enum>(1)</enum>
              <text>An annual effect on the economy of $100,000,000 or more.</text>
            </paragraph>
            <paragraph id="H7895CCAE1C494C2E80ED88E484789D32">
              <enum>(2)</enum>
              <text>A major increase in costs or prices for consumers, individual industries, Federal, State, or local government agencies, or geographic regions.</text>
            </paragraph>
            <paragraph id="H864D36539A044B37BCDD662FD2497EBD">
              <enum>(3)</enum>
              <text>Significant adverse effects on competition, employment, wages, investment, productivity, innovation, or on the ability of United States-based enterprises to compete with foreign-based enterprises in domestic and export markets.</text>
            </paragraph>
            <paragraph id="H5C53D281FD87455FAB717EAD21829B94">
              <enum>(4)</enum>
              <text>A significant economic impact on a substantial number of small entities.</text>
            </paragraph>
          </section>
          <section id="HDEF35875B83F49DFA9F4ACD6A0078B03">
            <enum>602.</enum>
            <header>Special rule on statutory, regulatory, and judicial deadlines</header>
            <subsection id="H4E9ADEAB0D674112860BA75F79F33BD0">
              <enum>(a)</enum>
              <header>In general</header>
              <text>Section 602 shall not apply with respect to any midnight rule required by statute, other regulation, or judicial order to be proposed or adopted by a deadline that—</text>
              <paragraph id="H59EEBDA38600420C9E07F77CC53BBD97">
                <enum>(1)</enum>
                <text>was established before the beginning of the moratorium period; and</text>
              </paragraph>
              <paragraph id="H57EF613B8645401A96458E7AFDA63000">
                <enum>(2)</enum>
                <text>occurs during the moratorium period.</text>
              </paragraph>
            </subsection>
            <subsection id="HE438A278D53B4671A4619F99B69615A9">
              <enum>(b)</enum>
              <header>Publication of deadlines</header>
              <text>Not later than 30 days after the beginning of a moratorium period, the Administrator shall identify and publish in the Federal Register a list of midnight rules covered by subsection (a).</text>
            </subsection>
          </section>
          <section id="HBE7D314D3BEF458D8235EFD04DDE7612">
            <enum>603.</enum>
            <header>Exception</header>
            <subsection id="H473712D0F5674F1BB5A2C3E411736697">
              <enum>(a)</enum>
              <header>Emergency exception</header>
              <text>Section 602 shall not apply to a midnight rule if the President determines by Executive order that the midnight rule is—</text>
              <paragraph id="HE992C97989674263A54D29D754C8544D">
                <enum>(1)</enum>
                <text>necessary because of an emergency;</text>
              </paragraph>
              <paragraph id="H8A9ED11B8C87488DB0303E1E6621A637">
                <enum>(2)</enum>
                <text>necessary for the enforcement of criminal laws;</text>
              </paragraph>
              <paragraph id="H710FBA63F4524EC9ACE2FA5663CE7006">
                <enum>(3)</enum>
                <text>necessary for the national security of the United States; or</text>
              </paragraph>
              <paragraph id="H03C03CD362B54EA38161DDD029C048F8">
                <enum>(4)</enum>
                <text>issued pursuant to any statute implementing an international trade agreement.</text>
              </paragraph>
            </subsection>
            <subsection id="H91348FED43A0453B898C900BAFE70C5B">
              <enum>(b)</enum>
              <header>Deregulatory exception</header>
              <text>Section 602 shall not apply to a midnight rule that the Administrator finds is limited to repealing an existing rule and certifies such finding in writing. The certification shall be published in the Federal Register.</text>
            </subsection>
          </section>

            <enum>604.</enum>
            <header>Judicial review</header>
            <text display-inline="no-display-inline">Any person or entity subject to the any midnight rule promulgated in violation of this title is entitled to judicial review.</text>
          </section>

            <enum>605.</enum>
            <header>Definitions</header>
            <text display-inline="no-display-inline">In this title:</text>
            <paragraph id="HD23F39E85A72440F9BC4EB50DAC19555">
              <enum>(1)</enum>
              <header>Administrator</header>
              <text>The term <quote>Administrator</quote> means the Administrator of the Office of Information and Regulatory Affairs within the Office of Management and Budget.</text>
            </paragraph>
            <paragraph id="HAC3A333CCFF84704BE72410FDE9CC98C">
              <enum>(2)</enum>
              <header>Agency</header>
              <text>The term <quote>agency</quote> has the meaning given that term under section 551 of title 5, United States Code, except such term does not include—</text>
              <subparagraph id="H8804AFD639364F6BA9AD4650219D642E">
                <enum>(A)</enum>
                <text>the Federal Election Commission;</text>
              </subparagraph>
              <subparagraph id="HB94B22A49D4D42848DB4671CFC81C340">
                <enum>(B)</enum>
                <text>the Board of Governors of the Federal Reserve System;</text>
              </subparagraph>
              <subparagraph id="HA2A400EFB217485DAF480A96AF35AC3A">
                <enum>(C)</enum>
                <text>the Federal Deposit Insurance Corporation; or</text>
              </subparagraph>
              <subparagraph id="H11A279DC849F45E4A5621C51F78C821F">
                <enum>(D)</enum>
                <text>the United States Postal Service.</text>
              </subparagraph>
            </paragraph>
            <paragraph id="HAC5122506A004715AD9DE27760AC9D0E">
              <enum>(3)</enum>
              <header>Deadline</header>
              <text>The term <quote>deadline</quote> means any date certain for fulfilling any obligation or exercising any authority established by or under any Federal statute or rule, or by or under any court order implementing any Federal statute, regulation, or rule.</text>
            </paragraph>
            <paragraph id="H7B67233C5BCD42E3884577C02AF56EDD">
              <enum>(4)</enum>
              <header>Emergency</header>
              <text>The term <quote>emergency</quote> means a declaration by the President of a state of emergency.</text>
            </paragraph>

              <enum>(5)</enum>
              <header>Midnight rule</header>
              <text>The term <quote>midnight rule</quote> means a rule proposed or adopted during the moratorium period.</text>
            </paragraph>
            <paragraph id="HCF52F6195854480EB0D374963B6CA054">
              <enum>(6)</enum>
              <header>Moratorium period</header>
              <text>The term <quote>moratorium period</quote> means the day after the day referred to in section 1 of title 3, United States Code, through January 20 of the following year, in which a President is not serving a consecutive term.</text>
            </paragraph>

              <header>Rule</header>
              <text>The term <quote>rule</quote> has the meaning given that term under section 551 of title 5, United States Code.</text>

              <header>Small entity</header>
              <text>The term <quote>small entity</quote> has the meaning given the term <quote>small business</quote> under section 601 of title 5, United States Code.</text>

              <enum>(a)</enum>
              <header>Amendment</header>
              <text>Chapter 31 of title 44, United States Code, is amended by adding at the end the following new section:</text>

                  <enum>3108.</enum>
                  <header>Requirement to maintain records</header>
                  <subsection id="HBB0933487A81434CBC8C92112BC715A0">
                    <enum>(a)</enum>
                    <header>In general</header>
                    <text>If the Internal Revenue Service obtains a preserved record, the Internal Revenue Service shall preserve for not less than 3 years from the date on which the record was obtained—</text>
                    <paragraph id="H693808444C0347EBBD9E77E8F3BF38FB">
                      <enum>(1)</enum>
                      <text>the preserved record or a copy of the preserved record; and</text>
                    </paragraph>
                    <paragraph id="H7A5B9023249F4347AE79416252ED6276">
                      <enum>(2)</enum>
                      <text>all records related to the preserved record.</text>
                    </paragraph>
                  </subsection>
                  <subsection id="HC5F1F9C4A30F4A14B2C8927A8F37DB7C">
                    <enum>(b)</enum>
                    <header>Preserved record defined</header>
                    <text>In this section, the term <quote>preserved record</quote> means any record that is maintained by a person other than the Federal Government pursuant to a rule, guidance, or other directive from the Internal Revenue Service that requires or recommends the person maintain records for a particular period of time on a particular matter.</text>
                  </subsection>
                  <subsection id="H6D28F0AE574A4F5FAEEB94222402E443">
                    <enum>(c)</enum>
                    <header>Rule of construction</header>
                    <text>Nothing in this section shall be construed as—</text>
                    <paragraph id="H06015EE9B25C4B10AD6B5D6182195D0B">
                      <enum>(1)</enum>
                      <text>limiting the preservation of a preserved record for a longer period of time than is required by this section; or</text>
                    </paragraph>
                    <paragraph id="H1BF6E11CBAF84DE68A694A2D23F4F058">
                      <enum>(2)</enum>
                      <text>shortening the period of time a preserved record is otherwise required to be maintained.</text>
                    </paragraph>
                  </subsection>
                </section>
