          <enum>1.</enum>
          <header>Short title</header>
          <text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Strengthening Fishing Communities and Increasing Flexibility in Fisheries Management Act</short-title></quote>.</text>
        </section>
        <section id="HD6D74D90F71C4E1EB8D52F4B75C2BB81">
          <enum>2.</enum>
          <header>Definitions</header>
          <text display-inline="no-display-inline">In this Act, any term used that is defined in section 3 of the Magnuson-Stevens Fishery Conservation and Management Act (16 U.S.C. 1802) shall have the same meaning such term has under that section.</text>
        </section>

          <enum>3.</enum>
          <header>References</header>
          <text display-inline="no-display-inline">Except as otherwise specifically provided, whenever in this Act an amendment or repeal is expressed in terms of an amendment to, or repeal of, a provision, the reference shall be considered to be made to a provision of the Magnuson-Stevens Fishery Conservation and Management Act (16 U.S.C. 1801 et seq.).</text>
        </section>

          <enum>4.</enum>
          <header>Flexibility in rebuilding fish stocks</header>
          <subsection id="H2C2614FF51134C55BD4BC304FFB4EBD5">
            <enum>(a)</enum>
            <header>General requirements</header>
            <text>Section 304(e) (16 U.S.C. 1854(e)) is amended—</text>
            <paragraph id="H42C600D6E7E5454590277B2CB57693D6">
              <enum>(1)</enum>
              <text>in paragraph (4)—</text>
              <subparagraph id="HFEEBF6B5BA5943BC99EA31A9776BB9A4">
                <enum>(A)</enum>
                <text>in subparagraph (A)(i), by striking <quote>possible</quote> and inserting <quote>practicable</quote>;</text>
              </subparagraph>
              <subparagraph id="HF041C63799464B3386BC009E4A4F4C1F">
                <enum>(B)</enum>
                <text>by amending subparagraph (A)(ii) to read as follows:</text>
                <quoted-block id="HBFEC351114984DB99EECD10BE17FAC3C" style="OLC">
                  <clause id="HE99F33F71F5746E899B80B56C2B639EB">
                    <enum>(ii)</enum>
                    <text>may not exceed the time the stock would be rebuilt without fishing occurring plus one mean generation, except in a case in which—</text>

                      <enum>(I)</enum>
                      <text>the biology of the stock of fish, other environmental conditions, or management measures under an international agreement in which the United States participates dictate otherwise;</text>
                    </subclause>
                    <subclause id="H1515F2D5B1F641EB86055E8954CCA859">
                      <enum>(II)</enum>
                      <text>the Secretary determines that the cause of the stock being depleted is outside the jurisdiction of the Council or the rebuilding program cannot be effective only by limiting fishing activities;</text>
                    </subclause>
                    <subclause id="H925559B8D2944E4FB552864292F2C93B">
                      <enum>(III)</enum>
                      <text>the Secretary determines that one or more components of a mixed-stock fishery is depleted but cannot be rebuilt within that time- frame without significant economic harm to the fishery, or cannot be rebuilt without causing another component of the mixed-stock fishery to approach a depleted status;</text>
                    </subclause>
                    <subclause id="H734F4362AEA044D7BB6D21DC77CDA2DE">
                      <enum>(IV)</enum>
                      <text>the Secretary determines that recruitment, distribution, or life history of, or fishing activities for, the stock are affected by informal transboundary agreements under which management activities outside the exclusive economic zone by another country may hinder conservation and management efforts by United States fishermen; and</text>
                    </subclause>
                    <subclause id="HB200E370CFB94A6C9FCFDE66415E7F84">
                      <enum>(V)</enum>
                      <text>the Secretary determines that the stock has been affected by unusual events that make rebuilding within the specified time period improbable without significant economic harm to fishing communities;</text>
                    </subclause>
                  </clause>

              </subparagraph>
              <subparagraph id="H2D1AB2643E84441D8954917E4104714E">
                <enum>(C)</enum>
                <text>by striking <quote>and</quote> after the semicolon at the end of subparagraph (B), by redesignating subparagraphs (B) and (C) as subparagraphs (C) and (D), and by inserting after subparagraph (A) the following:</text>

                    <enum>(B)</enum>
                    <text>take into account environmental condition including predator/prey relationships;</text>

              </subparagraph>

                <enum>(D)</enum>
                <text>by striking the period at the end of subparagraph (D) (as so redesignated) and inserting <quote>; and</quote>, and by adding at the end the following:</text>

                    <enum>(E)</enum>
                    <text>specify a schedule for reviewing the rebuilding targets, evaluating environmental impacts on rebuilding progress, and evaluating progress being made toward reaching rebuilding targets.</text>
                  </subparagraph>
                  <after-quoted-block>; and</after-quoted-block>
                </quoted-block>
              </subparagraph>
            </paragraph>
            <paragraph id="H8DA34C9D45A04C7F9E4872F2461B310A">
              <enum>(2)</enum>
              <text>by adding at the end the following:</text>

                <paragraph id="H0E57B4DC71004FF9839B950FA136FF2C">
                  <enum>(8)</enum>
                  <text>A fishery management plan, plan amendment, or proposed regulations may use alternative rebuilding strategies, including harvest control rules and fishing mortality-rate targets to the extent they are in compliance with the requirements of this Act.</text>
                </paragraph>
                <paragraph id="H6AA6DB2239D7440C9B0A71EDE352F1D6">
                  <enum>(9)</enum>
                  <text>A Council may terminate the application of paragraph (3) to a fishery if the Council’s scientific and statistical committee determines and the Secretary concurs that the original determination that the fishery was depleted was erroneous, either—</text>
                  <subparagraph id="HF1CF42C9670343608323C09D255ACE6D">
                    <enum>(A)</enum>
                    <text>within the 2-year period beginning on the effective date a fishery management plan, plan amendment, or proposed regulation for a fishery under this subsection takes effect; or</text>
                  </subparagraph>
                  <subparagraph id="H02682AF54E644855A144FC56F9748D54">
                    <enum>(B)</enum>
                    <text>within 90 days after the completion of the next stock assessment after such determination.</text>
                  </subparagraph>
                </paragraph>

            </paragraph>
          </subsection>
          <subsection id="H2336601697F947FF8741DCFD03A6567F">
            <enum>(b)</enum>
            <header>Emergency regulations and interim measures</header>
            <text>Section 305(c)(3)(B) (16 U.S.C. 1855(c)(3)(B)) is amended by striking <quote>180 days after</quote> and all that follows through <quote>provided</quote> and inserting <quote>1 year after the date of publication, and may be extended by publication in the Federal Register for one additional period of not more than 1 year, if</quote>.</text>
          </subsection>
        </section>

          <enum>5.</enum>
          <header>Modifications to the annual catch limit requirement</header>
          <text display-inline="no-display-inline">Section 302 (16 U.S.C. 1852) is amended by adding at the end the following:</text>

              <enum>(m)</enum>
              <header>Considerations for modifications to annual catch limit requirements</header>
              <paragraph id="H4DB64E6EB7554A2ABC6DB7094B39A9C0">
                <enum>(1)</enum>
                <header>Consideration of ecosystem and economic impacts</header>
                <text>In establishing annual catch limits a Council may, consistent with section 302(h)(6), consider changes in an ecosystem and the economic needs of the fishing communities.</text>
              </paragraph>
              <paragraph id="H9B1D2B0A1A554417B9FCD9EFBB4DEF18">
                <enum>(2)</enum>
                <header>Limitations to annual catch limit requirement for special fisheries</header>
                <text>Notwithstanding subsection (h)(6), a Council is not required to develop an annual catch limit for—</text>
                <subparagraph id="H145B3767A9FC41108C43CEA4B403B19F">
                  <enum>(A)</enum>
                  <text>an ecosystem component species;</text>
                </subparagraph>
                <subparagraph id="H18B07DECB1E04556A5D9713075BA1BB6">
                  <enum>(B)</enum>
                  <text>a fishery for a species that has a life cycle of approximately 1 year, unless the Secretary has determined the fishery is subject to overfishing; or</text>
                </subparagraph>
                <subparagraph id="H58E1293B760B445995244D5BAEE29907">
                  <enum>(C)</enum>
                  <text>a stock for which—</text>
                  <clause id="H4FBCE0ABAB0F4DE2BD14FF2E73FD8AA7">
                    <enum>(i)</enum>
                    <text>more than half of a single-year class will complete their life cycle in less than 18 months; and</text>
                  </clause>
                  <clause id="H5E076B0FE5F84ED2BCA0220CBF220A93">
                    <enum>(ii)</enum>
                    <text>fishing mortality will have little impact on the stock.</text>
                  </clause>
                </subparagraph>
              </paragraph>
              <paragraph id="H702A239BEBEE49EBB7AEC2D845455DA7">
                <enum>(3)</enum>
                <header>Relationship to international fishery efforts</header>
                <text>Each annual catch limit may, consistent with section 302(h)(6), take into account—</text>
                <subparagraph id="HD984D01FB6D2463C9719700C6B90DFF2">
                  <enum>(A)</enum>
                  <text>management measures under international agreements in which the United States participates;</text>
                </subparagraph>
                <subparagraph id="H77998AE9F74D4046A350C14334CC0FD0">
                  <enum>(B)</enum>
                  <text>informal transboundary agreements under which fishery management activities by another country outside the exclusive economic zone may hinder conservation efforts by United States fishermen for a fish species for which any of the recruitment, distribution, life history, or fishing activities are transboundary; and</text>
                </subparagraph>
                <subparagraph id="H879E8E5C598F40F5B759AA464FDFBDDC">
                  <enum>(C)</enum>
                  <text display-inline="yes-display-inline">in instances in which no transboundary agreement exists, activities by another country outside the exclusive economic zone that may hinder conservation efforts by United States fisherman for a fish species for which any of the recruitment, distribution, life history, or fishing activities are transboundary.</text>
                </subparagraph>
              </paragraph>
              <paragraph commented="no" id="H6AEB730041D84325A2664F531D605921">
                <enum>(4)</enum>
                <header>Authorization for multispecies complexes and multiyear annual catch limits</header>
                <text>For purposes of subsection (h)(6), a Council may establish—</text>
                <subparagraph commented="no" id="H57197C571B934B24A6E6CDDDFF8716EF">
                  <enum>(A)</enum>
                  <text>an annual catch limit for a stock complex; or</text>
                </subparagraph>
                <subparagraph commented="no" id="HB8D97E23838444E18FBA2234FDC42BEA">
                  <enum>(B)</enum>
                  <text>annual catch limits for each year in any continuous period that is not more than three years in duration.</text>
                </subparagraph>
              </paragraph>
              <paragraph id="H50801D748D1244A9990C206C0C26ED38">
                <enum>(5)</enum>
                <header>Ecosystem component species defined</header>
                <text>In this subsection the term <quote>ecosystem component species</quote> means a stock of fish that is a nontarget, incidentally harvested stock of fish in a fishery, or a nontarget, incidentally harvested stock of fish that a Council or the Secretary has determined—</text>
                <subparagraph id="HD9AC5AAAC6C24917B1F01F1634BC40A8">
                  <enum>(A)</enum>
                  <text>is not subject to overfishing, approaching a depleted condition or depleted; and</text>
                </subparagraph>
                <subparagraph id="HAC3C70AA68B542D996C28CE9409EA2A2">
                  <enum>(B)</enum>
                  <text>is not likely to become subject to overfishing or depleted in the absence of conservation and management measures.</text>
                </subparagraph>
              </paragraph>
            </subsection>

        </section>

          <enum>6.</enum>
          <header>Distinguishing between overfished and depleted</header>
          <subsection id="H62572EDF600A43AB8CFD9AAB3218BAA6">
            <enum>(a)</enum>
            <header>Definitions</header>
            <text>Section 3 (16 U.S.C. 1802) is amended—</text>
            <paragraph id="HE5B8E002FD5046B2978C56EF4B5C90E6">
              <enum>(1)</enum>
              <text>in paragraph (34), by striking <quote>The terms <quote>overfishing</quote> and <quote>overfished</quote> mean</quote> and inserting <quote>The term <quote>overfishing</quote> means</quote>; and</text>
            </paragraph>

          </subsection>

            <enum>(b)</enum>
            <header>Substitution of term</header>
            <text>The Magnuson-Stevens Fishery Conservation and Management Act (16 U.S.C. 1801 et seq.) is amended—</text>
            <paragraph id="H4FD30A51EBCE4325ABB4075EB924398D">
              <enum>(1)</enum>
              <text>in the heading of section 304(e), by striking <quote><header-in-text level="subsection" style="OLC">Overfished</header-in-text></quote> and inserting <quote><header-in-text level="subsection" style="OLC">Depleted</header-in-text></quote>; and </text>
            </paragraph>
            <paragraph id="H74F049E5FD5E42CFB6033022D21E2F98">
              <enum>(2)</enum>
              <text>by striking <quote>overfished</quote> each place it appears and inserting <quote>depleted</quote>.</text>
            </paragraph>
          </subsection>
          <subsection id="HC27BB0493B204AE6B2EC843B756FF364">
            <enum>(c)</enum>
            <header>Clarity in annual report</header>
            <text>Section 304(e)(1) (16 U.S.C. 1854(e)(1)) is amended by adding at the end the following: <quote>The report shall distinguish between fisheries that are depleted (or approaching that condition) as a result of fishing and fisheries that are depleted (or approaching that condition) as a result of factors other than fishing. The report shall state, for each fishery identified as depleted or approaching that condition, whether the fishery is the target of directed fishing.</quote>.</text>
          </subsection>
        </section>

          <enum>7.</enum>
          <header>Transparency and public process</header>
          <subsection id="HB20FC6C2F2EA4F58BAA711EA0CD33EF0">
            <enum>(a)</enum>
            <header>Advice</header>
            <text>Section 302(g)(1)(B) (16 U.S.C. 1852(g)(1)(B)) is amended by adding at the end the following: <quote>Each scientific and statistical committee shall develop such advice in a transparent manner and allow for public involvement in the process.</quote>.</text>
          </subsection>
          <subsection id="H24DCD6DA0D6F46C7A7142747E5ED91DA">
            <enum>(b)</enum>
            <header>Meetings</header>
            <text>Section 302(i)(2) (16 U.S.C. 1852(i)(2)) is amended by adding at the end the following:</text>

              <subparagraph id="H49DCB5E986BA41A8988EC99D12BF243C" indent="up1">
                <enum>(G)</enum>
                <text>Each Council shall make available on the Internet Web site of the Council—</text>

                  <enum>(i)</enum>
                  <text>to the extent practicable, a Webcast, an audio recording, or a live broadcast of each meeting of the Council, and of the Council Coordination Committee established under subsection (l), that is not closed in accordance with paragraph (3); and</text>
                </clause>
                <clause id="HA13B47B3BD4E4D78A390C7F919762655">
                  <enum>(ii)</enum>
                  <text>audio, video (if the meeting was in person or by video conference), or a searchable audio or written transcript of each meeting of the Council and of the meetings of committees referred to in section 302(g)(1)(B) of the Council by not later than 30 days after the conclusion of the meeting.</text>
                </clause>
              </subparagraph>
              <subparagraph id="HA4BB4B1E720E43ED99F289C19C80E993" indent="up1">
                <enum>(H)</enum>
                <text>The Secretary shall maintain and make available to the public an archive of Council and scientific and statistical committee meeting audios, videos, and transcripts made available under clauses (i) and (ii) of subparagraph (G).</text>
              </subparagraph>

          </subsection>

            <enum>(c)</enum>
            <header>Fishery impact statements</header>

              <enum>(1)</enum>
              <header>Requirement</header>
              <text>Section 303 (16 U.S.C. 1853) is amended—</text>
              <subparagraph id="HE4C56A73E4B94B2F885017AD3B31E92B">
                <enum>(A)</enum>
                <text>in subsection (a), by striking paragraph (9) and redesignating paragraphs (10) through (15) as paragraphs (9) through (14), respectively; and</text>
              </subparagraph>
              <subparagraph id="HB4D30CCE479244D789BF3AF74A016236">
                <enum>(B)</enum>
                <text>by adding at the end the following:</text>

                      <enum>(1)</enum>
                      <text>Any fishery management plan (or fishery management plan amendment) prepared by any Council or by the Secretary pursuant to subsection (a) or (b), or proposed regulations deemed necessary pursuant to subsection (c), shall include a fishery impact statement which shall assess, specify and analyze the likely effects and impact of the proposed action on the quality of the human environment.</text>
                    </paragraph>
                    <paragraph id="H2F236CCC1C544A8EBABFF7960BA67C6F">
                      <enum>(2)</enum>
                      <text>The fishery impact statement shall describe—</text>
                      <subparagraph id="H3C893553D00D45CABEBDE3477CBC98A5">
                        <enum>(A)</enum>
                        <text>a purpose of the proposed action;</text>
                      </subparagraph>
                      <subparagraph id="H3F75099CA7F84A508C157D04C76073BF">
                        <enum>(B)</enum>
                        <text>the environmental impact of the proposed action;</text>
                      </subparagraph>
                      <subparagraph id="HD0AA915D277E49FEB68064D1629D00CA">
                        <enum>(C)</enum>
                        <text>any adverse environmental effects which cannot be avoided should the proposed action be implemented;</text>
                      </subparagraph>
                      <subparagraph id="HDD08522AE1144BA4ACCA54C194E707CB">
                        <enum>(D)</enum>
                        <text>a reasonable range of alternatives to the proposed action;</text>
                      </subparagraph>
                      <subparagraph id="H3440ABB797DD4FB6A0FBDC5D18BC06BB">
                        <enum>(E)</enum>
                        <text>the relationship between short-term use of fishery resources and the enhancement of long-term productivity;</text>
                      </subparagraph>
                      <subparagraph id="HAA230625A5C145A097D144AD9D902FED">
                        <enum>(F)</enum>
                        <text>the cumulative conservation and management effects; and</text>
                      </subparagraph>
                      <subparagraph id="H0A2A860A89FE45B3917FA240F44770DA">
                        <enum>(G)</enum>
                        <text>economic, and social impacts of the proposed action on—</text>
                        <clause id="H32B680D8C7FA4892986783492DEC3342">
                          <enum>(i)</enum>
                          <text>participants in the fisheries and fishing communities affected by the proposed action;</text>
                        </clause>
                        <clause id="H6E68BBA0B009480F877514D948E30BA7">
                          <enum>(ii)</enum>
                          <text>participants in the fisheries conducted in adjacent areas under the authority of another Council, after consultation with such Council and representatives of those participants; and</text>
                        </clause>
                        <clause id="HCBE6C2E589D44E3EBF05C1443B232E20">
                          <enum>(iii)</enum>
                          <text>the safety of human life at sea, including whether and to what extent such measures may affect the safety of participants in the fishery.</text>
                        </clause>
                      </subparagraph>
                    </paragraph>
                    <paragraph id="H9D5A1D40D5E24FD6A81A8FA93EFCBCA8">
                      <enum>(3)</enum>
                      <text>A substantially complete fishery impact statement, which may be in draft form, shall be available not less than 14 days before the beginning of the meeting at which a Council makes its final decision on the proposal (for plans, plan amendments, or proposed regulations prepared by a Council pursuant to subsection (a) or (c)). Availability of this fishery impact statement will be announced by the methods used by the council to disseminate public information and the public and relevant government agencies will be invited to comment on the fishery impact statement.</text>
                    </paragraph>
                    <paragraph id="H736BD616594F4ADAB22BFFDAB6912F63">
                      <enum>(4)</enum>
                      <text>The completed fishery impact statement shall accompany the transmittal of a fishery management plan or plan amendment as specified in section 304(a), as well as the transmittal of proposed regulations as specified in section 304(b).</text>
                    </paragraph>
                    <paragraph id="H6B5B0C98C10E4A1699E844CE0C9FF389">
                      <enum>(5)</enum>
                      <text>The Councils shall, subject to approval by the Secretary, establish criteria to determine actions or classes of action of minor significance regarding subparagraphs (A), (B), (D), (E), and (F) of paragraph (2), for which preparation of a fishery impact statement is unnecessary and categorically excluded from the requirements of this section, and the documentation required to establish the exclusion.</text>
                    </paragraph>
                    <paragraph id="HC091554C72B64A33A4D5E15CEEAF8077">
                      <enum>(6)</enum>
                      <text>The Councils shall, subject to approval by the Secretary, prepare procedures for compliance with this section that provide for timely, clear, and concise analysis that is useful to decisionmakers and the public, reduce extraneous paperwork and effectively involve the public, including—</text>
                      <subparagraph id="HC49167CCA3574CD9B3696F8CBD8604EC">
                        <enum>(A)</enum>
                        <text>using Council meetings to determine the scope of issues to be addressed and identifying significant issues related to the proposed action;</text>
                      </subparagraph>
                      <subparagraph id="H53F152AF2C2B4056BE7FA3F2422183BD">
                        <enum>(B)</enum>
                        <text>integration of the fishery impact statement development process with preliminary and final Council decisionmaking in a manner that provides opportunity for comment from the public and relevant government agencies prior to these decision points; and</text>
                      </subparagraph>
                      <subparagraph id="H27AF193DAC3543559D276C9200A12926">
                        <enum>(C)</enum>
                        <text>providing scientific, technical, and legal advice at an early stage of the development of the fishery impact statement to ensure timely transmittal and Secretarial review of the proposed fishery management plan, plan amendment, or regulations to the Secretary.</text>
                      </subparagraph>
                    </paragraph>
                    <paragraph id="H4BA2D7BA1F16487C842E4D0721A126EC">
                      <enum>(7)</enum>
                      <text display-inline="yes-display-inline">Actions taken in accordance with this section are deemed to fulfill the requirements of the National Environmental Policy Act of 1969 (42 U.S.C. 4321 et seq.) and all related implementing regulations.</text>

                    <text>The New England, Mid-Atlantic, South Atlantic, and Gulf of Mexico Councils may not submit a fishery management plan or amendment that creates a catch share program for a fishery, and the Secretary may not approve or implement such a plan or amendment submitted by such a Council or a secretarial plan or amendment under section 304(c) that creates such a program, unless the final program has been approved, in a referendum in accordance with this subparagraph, by a majority of the permit holders eligible to participate in the fishery. For multispecies permits in the Gulf of Mexico, any permit holder with landings from within the sector of the fishery being considered for the catch share program within the 5-year period preceding the date of the referendum and still active in fishing in the fishery shall be eligible to participate in such a referendum. If a catch share program is not approved by the requisite number of permit holders, it may be revised and submitted for approval in a subsequent referendum.</text>
                  </clause>
                  <clause id="HA7084BCA9E1B4E37B9D882E5FC715C9B">
                    <enum>(ii)</enum>
                    <text>The Secretary may, at the request of the New England Fishery Management Council, allow participation in such a referendum for a fishery under the Council’s authority, by fishing vessel crewmembers who derive a significant portion of their livelihood from such fishing.</text>
                  </clause>

                    <enum>(iii)</enum>
                    <text>The Secretary shall conduct a referendum under this subparagraph, including notifying all permit holders eligible to participate in the referendum and making available to them—</text>

                      <enum>(I)</enum>
                      <text>a copy of the proposed program;</text>
                    </subclause>
                    <subclause id="HF4EC3EE7FF984AEBB037410261209CBE">
                      <enum>(II)</enum>
                      <text>an estimate of the costs of the program, including costs to participants;</text>
                    </subclause>
                    <subclause id="H0008D633DA8E4A8B88DEEA9768BA6CC5">
                      <enum>(III)</enum>
                      <text>an estimate of the amount of fish or percentage of quota each permit holder would be allocated; and</text>
                    </subclause>

                      <text>information concerning the schedule, procedures, and eligibility requirements for the referendum process.</text>
                    </subclause>
                  </clause>

                    <enum>(iv)</enum>
                    <text>For the purposes of this subparagraph, the term <quote>permit holder eligible to participate</quote> only includes the holder of a permit for a fishery under which fishing has occurred in 3 of the 5 years preceding a referendum for the fishery, unless sickness, injury, or other unavoidable hardship prevented the permit holder from engaging in such fishing.</text>
                  </clause>
                  <clause id="HE1C1F519E75D468E98ED7877C42A5682">
                    <enum>(v)</enum>
                    <text>The Secretary may not implement any catch share program for any fishery managed exclusively by the Secretary unless first petitioned by a majority of those permit holders eligible to participate in the fishery.</text>

            </paragraph>
          </subsection>

                </clause>

              </subparagraph>
            </paragraph>

              <header>Implementation of monitoring</header>

                <text display-inline="yes-display-inline">Subject to subparagraph (B), and after the issuance of the final regulations, a Council, or the Secretary for fisheries referred to in section 302(a)(3) of the Magnuson-Stevens Fishery Conservation and Management Act (16 U.S.C. 1852(a)(3)), may, in accordance with the regulations, on a fishery-by-fishery basis and consistent with the existing objectives and management goals of a fishery management plan and the Act for a fishery issued by the Council or the Secretary, respectively, amend such plan—</text>

                  <enum>(i)</enum>
                  <text>to incorporate electronic monitoring as an alternative tool for data collection and monitoring purposes or for compliance and enforcement purposes (or both); and</text>
                </clause>

                  <enum>(ii)</enum>
                  <text>to allow for the replacement of a percentage of on-board observers with electronic monitoring.</text>
                </clause>
              </subparagraph>
              <subparagraph id="H9DB948697DA24EEA9B46F3D108888C86">
                <enum>(B)</enum>
                <header>Comparability</header>
                <text>Subparagraph (A) shall apply to a fishery only if the Council or Secretary, respectively, determines that such monitoring will yield comparable data collection and compliance results.</text>
              </subparagraph>
            </paragraph>
            <paragraph id="H0F78776F77B343DCA3339211F567E733">
              <enum>(3)</enum>
              <header>Pilot projects</header>
              <text>Before the issuance of final regulations, a Council, or the Secretary for fisheries referred to in section 302(a)(3), may, subject to the requirements of the Magnuson-Stevens Fishery Conservation and Management Act, on a fishery-by-fishery basis, and consistent with the existing objectives and management goals of a fishery management plan for a fishery issued by the Council or the Secretary, respectively, conduct a pilot project for the use of electronic monitoring for the fishery.</text>
            </paragraph>
            <paragraph id="HF910D02707BD421D9D8163C83CB0D7C4">
              <enum>(4)</enum>
              <header>Deadline</header>
              <text>The Secretary shall issue final regulations under this subsection by not later than 12 months after the date of enactment of this Act.</text>
            </paragraph>
          </subsection>
          <subsection id="H93B096B9EE434B11A0E07A8FCF1F4661">
            <enum>(b)</enum>
            <header>Video and acoustic survey technologies</header>
            <text>The Secretary shall work with the Regional Fishery Management Councils and nongovernmental entities to develop and implement the use pursuant to the Magnuson-Stevens Fishery Conservation and Management Act (16 U.S.C. 1801 et seq.) of video survey technologies and expanded use of acoustic survey technologies.</text>
          </subsection>

                    <text display-inline="yes-display-inline">The Secretary may not provide any vessel-specific or aggregate vessel information from a fishery that is collected for monitoring and enforcement purposes to any person for the purposes of coastal and marine spatial planning under Executive Order 13547, unless the Secretary determines that providing such information is important for maintaining or enhancing national security or for ensuring fishermen continued access to fishing grounds.</text>

            <header>Repeal</header>
            <text>Section 407 (16 U.S.C. 1883), and the item relating to such section in the table of contents in the first section, are repealed.</text>
          </subsection>
          <subsection id="HDB15AA8CC9F94333874C4C6E55E17238">
            <enum>(b)</enum>
            <header>Reporting and data collection program</header>
            <text>The Secretary of Commerce shall—</text>
            <paragraph id="HD68F9C5384B441CCAC67A51A33CB3525">
              <enum>(1)</enum>
              <text>in conjunction with the States, the Gulf of Mexico Fishery Management Council, and the recreational fishing sectors, develop and implement a real-time reporting and data collection program for the Gulf of Mexico red snapper fishery using available technology; and</text>
            </paragraph>
            <paragraph id="H1CCB519356AE43A4B442616766A1C355">
              <enum>(2)</enum>
              <text>make implementation of this subsection a priority for funds received by the Secretary and allocated to this region under section 2 of the Act of August 11, 1939 (commonly known as the <quote>Saltonstall-Kennedy Act</quote>) (15 U.S.C. 713c–3).</text>
            </paragraph>
          </subsection>
          <subsection id="HDFCC39F0209F4C2692C3912346950923">
            <enum>(c)</enum>
            <header>Fisheries Cooperative research program</header>
            <text>The Secretary of Commerce—</text>
            <paragraph id="H3B698FF16B0C4296842D6F6BCB0E27CF">
              <enum>(1)</enum>
              <text>shall, in conjunction with the States, the Gulf States Marine Fisheries Commission and the Atlantic States Marine Fisheries Commission, the Gulf of Mexico and South Atlantic Fishery Management Councils, and the commercial, charter, and recreational fishing sectors, develop and implement a cooperative research program authorized under section 318 for the fisheries of the Gulf of Mexico and South Atlantic regions, giving priority to those fisheries that are considered data-poor; and</text>
            </paragraph>
            <paragraph id="HAEB606258F704362AD8798966284F0E8">
              <enum>(2)</enum>
              <text>may, subject to the availability of appropriations, use funds received by the Secretary under section 2 of the Act of August 11, 1939 (commonly known as the <quote>Saltonstall-Kennedy Act</quote>) (15 U.S.C. 713c–3) to implement this subsection.</text>
            </paragraph>
          </subsection>
          <subsection id="H0660B4E490494D76A781A7F84F4464DE">
            <enum>(d)</enum>
            <header>Stock surveys and stock assessments</header>
            <text>The Secretary of Commerce, acting through the National Marine Fisheries Service Regional Administrator of the Southeast Regional Office, shall for purposes of the Magnuson-Stevens Fishery Conservation and Management Act (16 U.S.C. 1801 et seq.)—</text>
            <paragraph id="H64753D778E414069B742119531E5D026">
              <enum>(1)</enum>
              <text display-inline="yes-display-inline">develop a schedule of stock surveys and stock assessments for the Gulf of Mexico Region and the South Atlantic Region for the 5-year period beginning on the date of the enactment of this Act and for every 5-year period thereafter;</text>
            </paragraph>
            <paragraph id="H16E6C4F992F7419083712B794138EC21">
              <enum>(2)</enum>
              <text display-inline="yes-display-inline">direct the Southeast Science Center Director to implement such schedule; and</text>
            </paragraph>
            <paragraph id="HFB87DE6B1F8742ADAFEFE4DB34465C69">
              <enum>(3)</enum>
              <text>in such development and implementation—</text>
              <subparagraph id="HFADDF93F28F64D6E916F15DA0B605FFD">
                <enum>(A)</enum>
                <text>give priority to those stocks that are commercially or recreationally important; and</text>
              </subparagraph>
              <subparagraph id="H71BCC2A0989D45F7AC6B4FE6C6C36902">
                <enum>(B)</enum>
                <text>ensure that each such important stock is surveyed at least every 5 years.</text>
              </subparagraph>
            </paragraph>
          </subsection>
          <subsection id="HF9F455E9817747198A25D584C51A965E">
            <enum>(e)</enum>
            <header>Use of fisheries information in stock assessments</header>
            <text display-inline="yes-display-inline">The Southeast Science Center Director shall ensure that fisheries information made available through fisheries programs funded under Public Law 112–141 is incorporated as soon as possible into any fisheries stock assessments conducted after the date of the enactment of this Act.</text>
          </subsection>
          <subsection id="HEF74E0A01D0A47E4B3AD59007DEA67EC">
            <enum>(f)</enum>
            <header>State fisheries management in the Gulf of Mexico with respect to red snapper</header>
            <text>Section 306(b) (16 U.S.C. 1856(b)) is amended by adding at the end the following:</text>

            <text>The Secretary of Commerce and the Secretary of the Interior, acting through the Bureau of Ocean Energy Management, shall enter into a cooperative agreement for the funding of stock assessments that are necessitated by any action by the Bureau with respect to offshore oil rigs in the Gulf of Mexico that adversely impacts red snapper.</text>
          </subsection>

                    <text>priorities for improving recreational fishing data collection; and</text>
                  </clause>

                    <text>an explanation of any use of information collected by such State programs and by the Secretary, including a description of any consideration given to the information by the Secretary.</text>

                <header>Study on program implementation</header>
                <subparagraph id="HB48B5E21C63D400F8E2551209E2A85DE">
                  <enum>(A)</enum>
                  <header>In general</header>
                  <text>Not later than 60 days after the enactment of this paragraph, the Secretary shall enter into an agreement with the National Research Council of the National Academy of Sciences to study the implementation of the programs described in this section. The study shall—</text>
                  <clause id="H2FB843F6169149DFA4BCEA09D0E87EAA">
                    <enum>(i)</enum>
                    <text>provide an updated assessment of recreational survey methods established or improved since the publication of the Council’s report <quote>Review of Recreational Fisheries Survey Methods (2006)</quote>;</text>
                  </clause>
                  <clause id="H811BB289312B4F7A83AD208561319158">
                    <enum>(ii)</enum>
                    <text>evaluate the extent to which the recommendations made in that report were implemented pursuant to paragraph (3)(B); and</text>
                  </clause>
                  <clause id="H909393481B6F469292EDD10E0F77862C">
                    <enum>(iii)</enum>
                    <text>examine any limitations of the Marine Recreational Fishery Statistics Survey and the Marine Recreational Information Program established under paragraph (1).</text>
                  </clause>
                </subparagraph>
                <subparagraph id="H8058CC63450A49D6BED75207D4748FED">
                  <enum>(B)</enum>
                  <header>Report</header>
                  <text>Not later than 1 year after entering into an agreement under subparagraph (A), the Secretary shall submit a report to Congress on the results of the study under subparagraph (A).</text>

            <text>Title IV (16 U.S.C. 1881 et seq.) is amended by adding at the end the following:</text>

                <subsection id="H29BD09B261AA4D33BC08C02D1DF7941B">
                  <enum>(a)</enum>
                  <header>In general</header>
                  <text>The Gulf States Marine Fisheries Commission shall conduct all fishery stock assessments used for management purposes by the Gulf of Mexico Fishery Management Council for the fisheries managed under the Council’s Reef Fish Management Plan.</text>
                </subsection>
                <subsection id="H715CD1A224414C0D886F6A045A9C97C2">
                  <enum>(b)</enum>
                  <header>Use of other information and assets</header>
                  <paragraph id="HC17F41B67AEA42DAA70C77DCB2CE4FFF">
                    <enum>(1)</enum>
                    <header>In general</header>
                    <text>Such fishery assessments shall—</text>
                    <subparagraph id="H145C9EC04BBA4918816AE0A62D3AB3DA">
                      <enum>(A)</enum>
                      <text>incorporate fisheries survey information collected by university researchers; and</text>
                    </subparagraph>
                    <subparagraph id="H10EAE680D1B54E46A77FF8A4413A2CA1">
                      <enum>(B)</enum>
                      <text>to the extent practicable, use State, university, and private assets to conduct fisheries surveys.</text>
                    </subparagraph>
                  </paragraph>
                  <paragraph id="H47233DB9549E4375BAEB2BB3DE4A4875">
                    <enum>(2)</enum>
                    <header>Surveys at artificial reefs</header>
                    <text>Any such fishery stock assessment conducted after the date of the enactment of the Strengthening Fishing Communities and Increasing Flexibility in Fisheries Management Act shall incorporate fishery surveys conducted, and other relevant fisheries information collected, on and around natural and artificial reefs.</text>
                  </paragraph>
                </subsection>
                <subsection id="HD901E88187CD41B5869E0255B332C4E1">
                  <enum>(c)</enum>
                  <header>Constituent and stakeholder participation</header>
                  <text>Each such fishery assessment shall—</text>
                  <paragraph id="H072DEDD418484464ACB090BB91E70395">
                    <enum>(1)</enum>
                    <text>emphasize constituent and stakeholder participation in the development of the assessment;</text>
                  </paragraph>
                  <paragraph id="H22632B428C9A4E0FB7F9BCDAF3DFA907">
                    <enum>(2)</enum>
                    <text>contain all of the raw data used in the assessment and a description of the methods used to collect that data; and</text>
                  </paragraph>
                  <paragraph id="HA459213727F44CC5BD8B359802BF23D6">
                    <enum>(3)</enum>
                    <text>employ an assessment process that is transparent and includes—</text>
                    <subparagraph id="HBD5655A6C88B41E78C753FA58AD86B0C">
                      <enum>(A)</enum>
                      <text>includes a rigorous and independent scientific review of the completed fishery stock assessment; and</text>
                    </subparagraph>
                    <subparagraph id="H865354AF0D3D413381EC6B7341869945">
                      <enum>(B)</enum>
                      <text>a panel of independent experts to review the data and assessment and make recommendations on the most appropriate values of critical population and management quantities.</text>
                    </subparagraph>
                  </paragraph>

          <header>Prohibition on considering red snapper killed during removal of oil rigs</header>
          <text display-inline="no-display-inline">Any red snapper that are killed during the removal of any offshore oil rig in the Gulf of Mexico shall not be considered in determining under the Magnuson-Stevens Fishery Conservation and Management Act (16 U.S.C. 1801 et seq.) whether the total allowable catch for red snapper has been reached.</text>
        </section>

          <enum>22.</enum>
          <header>Prohibition on considering fish seized from foreign fishing</header>
          <text display-inline="no-display-inline">Any fish that are seized from a foreign vessel engaged in illegal fishing activities in the Exclusive Economic Zone shall not be considered in determining under the Magnuson-Stevens Fishery Conservation and Management Act (16 U.S.C. 1801 et seq.) the total allowable catch for that fishery.</text>

          <header>Subsistence fishing</header>

            <enum>(a)</enum>
            <header>Definition</header>
            <text>Section 3 (16 U.S.C. 1802) is amended by inserting after paragraph (43) the following:</text>

                  <text>The term <quote>subsistence fishing</quote> means fishing in which the fish harvested are intended for customary and traditional uses, including for direct personal or family consumption as food or clothing; for the making or selling of handicraft articles out of nonedible byproducts taken for personal or family consumption, for barter, or sharing for personal or family consumption; and for customary trade.</text>
                </subparagraph>

              <text display-inline="yes-display-inline">If the North Pacific Fishery Management Council issues a fishery management plan for the exclusive economic zone in the Arctic Ocean, or an amendment to the Fishery Management Plan for Fish Resources of the Arctic Management Area issued by such Council, that makes available to commercial fishing, and establishes a sustainable harvest level, for any part of such zone, the Council shall set aside not less than 10 percent of the total allowable catch therein as a community development quota for coastal villages located north and east of the Bering Strait.</text>
            </subsection>

          <header>Process for allocation review for South Atlantic and Gulf of Mexico mixed-use fisheries</header>

            <enum>(a)</enum>
            <header>Study of allocations in mixed-use fisheries</header>
            <text display-inline="yes-display-inline">Not later than 60 days after the date of the enactment of this Act, the Secretary of Commerce shall enter into an arrangement with the National Academy of Sciences to conduct a study of the South Atlantic and Gulf of Mexico mixed-use fisheries—</text>
            <paragraph id="H8186BEE6C489488F941876CB461D5A46">
              <enum>(1)</enum>
              <text>to provide guidance to Regional Fishery Management Councils established under section 302 of the Magnuson-Stevens Fishery Conservation and Management Act (16 U.S.C. 1852) on criteria that could be used for allocating fishing privileges, including consideration of the conservation and socioeconomic benefits of the commercial, recreational, and charter components of a fishery, in the preparation of a fishery management plan under that Act;</text>
            </paragraph>
            <paragraph id="HB75BED4595DE4AC58D191BD6804E0471">
              <enum>(2)</enum>
              <text>to identify sources of information that could reasonably support the use of such criteria in allocation decisions; and</text>
            </paragraph>
            <paragraph id="H39AD1CF45161422B9D8613B3C1B263B3">
              <enum>(3)</enum>
              <text>to develop procedures for allocation reviews and potential adjustments in allocations based on the guidelines and requirements established by this section.</text>
            </paragraph>
          </subsection>
          <subsection id="H07EC2BCE34084DEEB746A030F64D43FE">
            <enum>(b)</enum>
            <header>Process for allocation review and establishment</header>
            <text>The South Atlantic Fishery Management Council and the Gulf of Mexico Fishery Management Council shall—</text>
            <paragraph id="HBEA687B1E2414367A9A0C9B4260452C1">
              <enum>(1)</enum>
              <text>within 2 years after the date of the enactment of this Act, review the allocations of all mixed-use fisheries in the Councils’ respective jurisdictions; and</text>
            </paragraph>
            <paragraph id="HC0E279D51C8540FF929F79A90A90A739">
              <enum>(2)</enum>
              <text>every 3 years thereafter, perform subsequent reviews of such allocations; and</text>
            </paragraph>
            <paragraph id="H3DBF46F5829D465E93E2A360D09A887A">
              <enum>(3)</enum>
              <text>consider the conservation and socioeconomic benefits of each sector in any allocation decisions for such fisheries.</text>
            </paragraph>
          </subsection>
        </section>

          <enum>28.</enum>
          <header>Authorization of appropriations</header>
          <text display-inline="no-display-inline">Section 4 (16 U.S.C. 1803) is amended—</text>

            <enum>(1)</enum>
            <text>by striking <quote>this Act</quote> and all that follows through <quote>(7)</quote> and inserting <quote>this Act</quote>; and</text>
          </paragraph>

            <enum>(2)</enum>
            <text>by striking <quote>fiscal year 2013</quote> and inserting <quote>each of fiscal years 2015 through 2019</quote>.</text>
