        <section id="H2016DAD3588A49519DA4F0F471CE4EEF" section-type="section-one">
          <enum>1.</enum>
          <header>Short title</header>
          <text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Veteran Access to Care Act of 2014</short-title></quote>.</text>
        </section>
        <section id="H0C11EDBB7A7D4C02BEBE5809F689F737">
          <enum>2.</enum>
          <header>Provision of hospital care and medical services at non-Department of Veterans Affairs facilities for Department of Veterans Affairs patients with extended waiting times for appointments at Department facilities</header>
          <subsection id="H3C83F0916C6E48E499ED297F454F858B">
            <enum>(a)</enum>
            <header>In general</header>
            <text display-inline="yes-display-inline">As authorized by section 1710 of title 38, United States Code, the Secretary of Veterans Affairs (in this Act referred to as the <quote>Secretary</quote>) shall enter into contracts with such non-Department facilities as may be necessary in order to furnish hospital care and medical services to covered veterans who are eligible for such care and services under chapter 17 of title 38, United States Code. To the greatest extent possible, the Secretary shall carry out this section using contracts entered into before the date of the enactment of this Act.</text>
          </subsection>
          <subsection id="HC33D00126FD547D28C7D0CC0D0436607">
            <enum>(b)</enum>
            <header>Covered veterans</header>
            <text>For purposes of this section, the term <quote>covered veteran</quote> means a veteran—</text>
            <paragraph id="HC24D2FAF2D89456897C6FEF91505A068">
              <enum>(1)</enum>
              <text>who is enrolled in the patient enrollment system under section 1705 of title 38, United States Code;</text>
            </paragraph>
            <paragraph id="HB41FDE78374A4F7DB94AEE9C9BE2D7AE">
              <enum>(2)</enum>
              <text>who—</text>
              <subparagraph id="H3B7779B309C74179AA8761D9A0C93CC0">
                <enum>(A)</enum>
                <text>has waited longer than the wait-time goals of the Veterans Health Administration (as of June 1, 2014) for an appointment for hospital care or medical services in a facility of the Department;</text>
              </subparagraph>
              <subparagraph id="HD623202E3D444203B29257B5298C4BE0">
                <enum>(B)</enum>
                <text>has been notified by a facility of the Department that an appointment for hospital care or medical services is not available within such wait-time goals; or</text>
              </subparagraph>
              <subparagraph id="H67CD78E592BA4D6CB783D6154593C181">
                <enum>(C)</enum>
                <text display-inline="yes-display-inline">resides more than 40 miles from the medical facility of the Department of Veterans Affairs, including a community-based outpatient clinic, that is closest to the residence of the veteran; and</text>
              </subparagraph>
            </paragraph>
            <paragraph id="HF64F34FCA98942A9A41B8768E399B558">
              <enum>(3)</enum>
              <text>who makes an election to receive such care or services in a non-Department facility.</text>
            </paragraph>
          </subsection>
          <subsection id="H22AF22D411D549F5BCE767929094C7C3">
            <enum>(c)</enum>
            <header>Follow-Up care</header>
            <text display-inline="yes-display-inline">In carrying out this section, the Secretary shall ensure that, at the election of a covered veteran who receives hospital care or medical services at a non-Department facility in an episode of care under this section, the veteran receives such hospital care and medical services at such non-Department facility through the completion of the episode of care (but for a period not exceeding 60 days), including all specialty and ancillary services deemed necessary as part of the treatment recommended in the course of such hospital care or medical services.</text>
          </subsection>
          <subsection id="H3F9625FFD9C84EDC86705F9E31686475">
            <enum>(d)</enum>
            <header>Report</header>
            <text>The Secretary shall submit to Congress a quarterly report on hospital care and medical services furnished pursuant to this section. Such report shall include information, for the quarter covered by the report, regarding—</text>
            <paragraph id="HE444FC050C824F22A369D76E27493528">
              <enum>(1)</enum>
              <text>the number of veterans who received care or services at non-Department facilities pursuant to this section;</text>
            </paragraph>
            <paragraph id="H25EB3FA854A645C3BFEA206E8C8FB750">
              <enum>(2)</enum>
              <text>the number of veterans who were eligible to receive care or services pursuant to this section but who elected to continue waiting for an appointment at a Department facility;</text>
            </paragraph>
            <paragraph id="H9C75D70D858F43CB9391AA61B69695CB">
              <enum>(3)</enum>
              <text>the purchase methods used to provide the care and services at non-Department facilities, including the rate of payment for individual authorizations for such care and services; and</text>
            </paragraph>
            <paragraph id="HA7272EA395844B7C84864B6A1C08E7AB">
              <enum>(4)</enum>
              <text>any other matters the Secretary determines appropriate.</text>
            </paragraph>
          </subsection>
          <subsection id="H19D2A6EE828343938B3E86567084DD5B">
            <enum>(e)</enum>
            <header>Definitions</header>
            <text>For purposes of this section, the terms <quote>facilities of the Department</quote>, <quote>non-Department facilities</quote>, <quote>hospital care</quote>, and <quote>medical services</quote> have the meanings given such terms in section 1701 of title 38, United States Code.</text>
          </subsection>
          <subsection id="HB5EC4D7DF96445F49D02F6B2F4E721F7">
            <enum>(f)</enum>
            <header>Implementation</header>
            <text>The Secretary shall begin implementing this section on the date of the enactment of this Act.</text>
          </subsection>
          <subsection commented="no" id="HFF2128BE70B846CB8E317C870F63D041">
            <enum>(g)</enum>
            <header>Construction</header>
            <text>Nothing in this section shall be construed to authorize payment for care or services not otherwise covered under chapter 17 of title 38, United States Code.</text>
          </subsection>
          <subsection id="H38A154647DED471494B7E1CFE15195ED">
            <enum>(h)</enum>
            <header>Termination</header>
            <text>The authority of the Secretary under this section shall terminate with respect to any hospital care or medical services furnished after the end of the 2-year period beginning on the date of the enactment of this Act, except that in the case of an episode of care for which hospital care or medical services is furnished in a non-Department facility pursuant to this section before the end of such period, such termination shall not apply to such care and services furnished during the remainder of such episode of care but not to exceed a period of 60 days.</text>
          </subsection>
        </section>
        <section id="HED8FDC0A2320484292561F839D314F6E">
          <enum>3.</enum>
          <header>Expanded access to hospital care and medical services</header>
          <subsection id="H923DE7E7EB8D41C8A8D732B869D8335A">
            <enum>(a)</enum>
            <header>In general</header>
            <text display-inline="yes-display-inline">To the extent that appropriations are available for the Veterans Health Administration of the Department of Veterans Affairs for medical services, to the extent that the Secretary of Veterans Affairs is unable to provide access, within the wait-time goals of the Veterans Health Administration (as of June 1, 2014), to hospital care or medical services to a covered veteran who is eligible for such care or services under chapter 17 of title 38, United States Code, under contracts described in section 2, the Secretary shall reimburse any non-Department facility with which the Secretary has not entered into a contract to furnish hospital care or medical services for furnishing such hospital care or medical services to such veteran, if the veteran elects to receive such care or services from the non-Department facility. The Secretary shall reimburse the facility for the care or services furnished to the veteran at the greatest of the following rates:</text>
            <paragraph id="HF254271D27944F3C9BBE888AEC2ADBE7">
              <enum>(1)</enum>
              <header>VA payment rate</header>
              <text>The rate of reimbursement for such care or services established by the Secretary of Veterans Affairs.</text>
            </paragraph>
            <paragraph id="H5E917F13C2BB4648A3ABC79DE15699C2">
              <enum>(2)</enum>
              <header>Medicare payment rate</header>
              <text>The payment rate for such care or services or comparable care or services under the Medicare program under title XVIII of the Social Security Act.</text>
            </paragraph>
            <paragraph id="H4CBE6758DE1B40EEAAE0CF76E68C517D">
              <enum>(3)</enum>
              <header>TRICARE payment rate</header>
              <text>The reimbursement rate for such care or services furnished to a member of the Armed Forces under chapter 55 of title 10, United States Code.</text>
            </paragraph>
          </subsection>
          <subsection id="H39AFD30595E446FA9B8C9D47102414B2">
            <enum>(b)</enum>
            <header>Covered veterans</header>
            <text>For purposes of this section, the term <quote>covered veteran</quote> means a veteran—</text>
            <paragraph id="H65EDA05397A945D2850B68EED5F46BBC">
              <enum>(1)</enum>
              <text>who is enrolled in the patient enrollment system under section 1705 of title 38, United States Code; and</text>
            </paragraph>
            <paragraph id="HCBC679AB668B4B71975528D399BEACD2">
              <enum>(2)</enum>
              <text>who—</text>
              <subparagraph id="HFA183948B672415687346D095D3CAD46">
                <enum>(A)</enum>
                <text display-inline="yes-display-inline">has waited longer than the wait-time goals of the Veterans Health Administration (as of June 1, 2014) for an appointment for hospital care or medical services in a facility of the Department;</text>
              </subparagraph>
              <subparagraph id="HF894064826DB4B9FB7FB7446ED530CF4">
                <enum>(B)</enum>
                <text display-inline="yes-display-inline">has been notified by a facility of the Department that an appointment for hospital care or medical services is not available within such wait-time goals after the date for which the veteran requests the appointment; or</text>
              </subparagraph>
              <subparagraph id="H48FF8B73407D443199D1A51B7072937E">
                <enum>(C)</enum>
                <text display-inline="yes-display-inline">who resides more than 40 miles from the medical facility of the Department of Veterans Affairs, including a community-based outpatient clinic, that is closest to the residence of the veteran.</text>
              </subparagraph>
            </paragraph>
          </subsection>
          <subsection display-inline="no-display-inline" id="HEE1EBB5433984F45B1099EF8F53EC7D1">
            <enum>(c)</enum>
            <header>Definitions</header>
            <text>For purposes of this section, the terms <quote>facilities of the Department</quote>, <quote>non-Department facilities</quote>, <quote>hospital care</quote>, and <quote>medical services</quote> have the meanings given such terms in section 1701 of title 38, United States Code.</text>
          </subsection>
          <subsection id="HC48FE565CFA341BC984860B47453B06A">
            <enum>(d)</enum>
            <header>Implementation</header>
            <text>The Secretary shall begin implementing this section on the date of the enactment of this Act.</text>
          </subsection>
          <subsection id="H49C4AA9B3C5A44AD96E700E4717757CA">
            <enum>(e)</enum>
            <header>Construction</header>
            <text>Nothing in this section shall be construed to authorize payment for care or services not otherwise covered under chapter 17 of title 38, United States Code.</text>
          </subsection>
          <subsection id="HF8E357579E9D4F3498F68E63E9FB3E91">
            <enum>(f)</enum>
            <header>Termination</header>
            <text>The authority of the Secretary under this section shall terminate with respect to care or services furnished after the date that is 2 years after the date of the enactment of this Act.</text>
          </subsection>
        </section>
        <section id="H6DE11DF5C70D4A26AE500DB184EA3A3A">
          <enum>4.</enum>
          <header>Independent assessment of Veterans Health Administration performance</header>
          <subsection id="H9FD8B44C88C343EFBE7D4103D19E616C">
            <enum>(a)</enum>
            <header>Independent assessment required</header>
            <text>Not later than 120 days after the date of the enactment of this Act, the Secretary of Veterans Affairs shall enter into a contract or contracts with a private sector entity or entities with experience in the delivery systems of the Veterans Health Administration and the private sector and in health care management to conduct an independent assessment of hospital care and medical services furnished in medical facilities of the Department of Veterans Affairs. Such assessment shall address each of the following:</text>
            <paragraph id="H2F60CD963DF0448DA49460B17D6D1068">
              <enum>(1)</enum>
              <text display-inline="yes-display-inline">The current and projected demographics and unique care needs of the patient population served by the Department of Veterans Affairs.</text>
            </paragraph>
            <paragraph id="HCFDD50E06A734841B672AA599E0B8878">
              <enum>(2)</enum>
              <text>The current and projected health care capabilities and resources of the Department, including hospital care and medical services furnished by non-Department facilities under contract with the Department, to provide timely and accessible care to eligible veterans.</text>
            </paragraph>
            <paragraph id="H01B708B5345F4A6B9DF48BEE3CC0BB51">
              <enum>(3)</enum>
              <text>The authorities and mechanisms under which the Secretary may furnish hospital care and medical services at non-Department facilities, including an assessment of whether the Secretary should have the authority to furnish such care and services at such facilities through the completion of episodes of care.</text>
            </paragraph>
            <paragraph id="HB664A2BEE373463FB1912883C27A881A">
              <enum>(4)</enum>
              <text>The appropriate system-wide access standard applicable to hospital care and medical services furnished by and through the Department of Veterans Affairs and recommendations relating to access standards specific to individual specialties and standards for post-care rehabilitation.</text>
            </paragraph>
            <paragraph id="HD60DB169A6FF4BCCB21D1945023B450E">
              <enum>(5)</enum>
              <text>The current organization, processes, and tools used to support clinical staffing and documentation.</text>
            </paragraph>
            <paragraph id="HD332F0029DA4401693F3D29092A9E21D">
              <enum>(6)</enum>
              <text>The staffing levels and productivity standards, including a comparison with industry performance percentiles.</text>
            </paragraph>
            <paragraph id="HE027E99907C5408A9FC6801D35161098">
              <enum>(7)</enum>
              <text>Information technology strategies of the Veterans Health Administration, including an identification of technology weaknesses and opportunities, especially as they apply to clinical documentation of hospital care and medical services provided in non-Department facilities.</text>
            </paragraph>
            <paragraph id="H462A8390AB14419CB4638E3BFC161DDF">
              <enum>(8)</enum>
              <text>Business processes of the Veterans Health Administration, including non-Department care, insurance identification, third-party revenue collection, and vendor reimbursement.</text>
            </paragraph>
          </subsection>
          <subsection id="H44A9B13D16D246679399DC0E3B4EE2C6">
            <enum>(b)</enum>
            <header>Assessment outcomes</header>
            <text>The assessment conducted pursuant to subsection (a) shall include the following:</text>
            <paragraph id="H04A7F57D76B544BF9DD88B0634838615">
              <enum>(1)</enum>
              <text>An identification of improvement areas outlined both qualitatively and quantitatively, taking into consideration Department of Veterans Affairs directives and industry benchmarks from outside the Federal Government.</text>
            </paragraph>
            <paragraph id="H8CD7371D49F94CBD96649FB4744796DC">
              <enum>(2)</enum>
              <text>Recommendations for how to address the improvement areas identified under paragraph (1) relating to structure, accountability, process changes, technology, and other relevant drivers of performance.</text>
            </paragraph>
            <paragraph id="HFEA3C09C9EB2420EA46D366922C6F354">
              <enum>(3)</enum>
              <text>The business case associated with making the improvements and recommendations identified in paragraphs (1) and (2).</text>
            </paragraph>
            <paragraph id="H038E310DB4CE4C46A56DF8A6C9FD436F">
              <enum>(4)</enum>
              <text>Findings and supporting analysis on how credible conclusions were established.</text>
            </paragraph>
          </subsection>
          <subsection id="HD86F54147F2F4B9EA494C7EA8F02C5A0">
            <enum>(c)</enum>
            <header>Program integrator</header>
            <text>If the Secretary enters into contracts with more than one private sector entity under subsection (a), the Secretary shall designate one such entity as the program integrator. The program integrator shall be responsible for coordinating the outcomes of the assessments conducted by the private entities pursuant to such contracts.</text>
          </subsection>
          <subsection id="HCBD1F27DC1A145138D6F01F604AC0800">
            <enum>(d)</enum>
            <header>Submittal of reports to Congress</header>
            <paragraph id="HB4BC42ABCA0F4593B0F05A67457AF773">
              <enum>(1)</enum>
              <header>Report on independent assessment</header>
              <text>Not later than 10 months after entering into the contract under subsection (a), the Secretary shall submit to the Committees on Veterans’ Affairs of the Senate and House of Representatives the findings and recommendations of the independent assessment required by such subsection.</text>
            </paragraph>
            <paragraph id="H3E2CE4B26A7D47668FEE93E84E5E62B9">
              <enum>(2)</enum>
              <header>Report on VA action plan to implement recommendations in assessment</header>
              <text display-inline="yes-display-inline">Not later than 120 days after the date of submission of the report under paragraph (1), the Secretary shall submit to such Committees on the Secretary’s response to the findings of the assessment and shall include an action plan, including a timeline, for fully implementing the recommendations of the assessment.</text>
            </paragraph>
          </subsection>
        </section>
        <section id="H021052F37EAC481087615730C620FD4E">
          <enum>5.</enum>
          <header>Limitation on awards and bonuses to employees of Department of Veterans Affairs</header>
          <text display-inline="no-display-inline">For each of fiscal years 2014 through 2016, the Secretary of Veterans Affairs may not pay awards or bonuses under chapter 45 or 53 of title 5, United States Code, or any other awards or bonuses authorized under such title.</text>
        </section>
        <section id="H3246C43034FB42AF8B2344A0C1F516D9">
          <enum>6.</enum>
          <header>OMB estimate of budgetary effects and needed transfer authority</header>
          <text display-inline="no-display-inline">Not later than 30 days after the date of the enactment of this Act, the Director of the Office of Management and Budget shall transmit to the Committees on Appropriations, the Budget, and Veterans’ Affairs of the House of Representatives and of the Senate—</text>
          <paragraph id="HE79DDD471A8F433B9ACD4B6591842A24">
            <enum>(1)</enum>
            <text>an estimate of the budgetary effects of sections 2 and 3;</text>
          </paragraph>
          <paragraph id="H93A4A21C7FD34A4CB921BD4E56887E54">
            <enum>(2)</enum>
            <text>any transfer authority needed to utilize the savings from section 5 to satisfy such budgetary effects; and</text>
          </paragraph>
          <paragraph id="H18D2E8A582AF4D65A329D7D51851C69B">
            <enum>(3)</enum>
            <text display-inline="yes-display-inline">if necessary, a request for any additional budgetary resources, or transfers or reprogramming of existing budgetary resources, necessary to provide funding for sections 2 and 3.</text>
          </paragraph>
        </section>
        <section id="HA9A3E38C4B764B68BEAEDC8A9898CD41">
          <enum>7.</enum>
          <header>Removal of Senior Executive Service employees of the Department of Veterans Affairs for performance</header>
          <subsection id="H6FCD82E3C26347E49D44833E2F0E0F07">
            <enum>(a)</enum>
            <header>In general</header>
            <text>Chapter 7 of title 38, United States Code, is amended by adding at the end the following new section:</text>

              <section id="HC9D3DCE6D12D4A8C8C7B43F7B1AF95E2">
                <enum>713.</enum>
                <header>Senior Executive Service: removal based on performance</header>
                <subsection id="H88ABC3B8D3EE44FDBDC77CFDD302D671" display-inline="no-display-inline">
                  <enum>(a)</enum>
                  <header>In general</header>
                  <text>Notwithstanding any other provision of law, the Secretary may remove any individual from the Senior Executive Service if the Secretary determines the performance of the individual warrants such removal. If the Secretary so removes such an individual, the Secretary may—</text>
                  <paragraph id="H39742DD4BA2F49998C8280D243C56158">
                    <enum>(1)</enum>
                    <text>remove the individual from Federal service; or</text>
                  </paragraph>
                  <paragraph id="H0208AAFF22A74AB885302987E824567B">
                    <enum>(2)</enum>
                    <text>transfer the individual to a General Schedule position at any grade of the General Schedule the Secretary determines appropriate.</text>
                  </paragraph>
                </subsection>
                <subsection id="H507E7A4FA8284C70806FADFB7BD3832C">
                  <enum>(b)</enum>
                  <header>Notice to Congress</header>
                  <text>Not later than 30 days after removing an individual from the Senior Executive Service under paragraph (1), the Secretary shall submit to the Committees on Veterans’ Affairs of the Senate and House of Representatives notice in writing of such removal and the reason for such removal.</text>
                </subsection>
                <subsection id="HE8BD240BB2FD4203859436D596137892">
                  <enum>(c)</enum>
                  <header>Manner of removal</header>
                  <text>A removal under this section shall be done in the same manner as the removal of a professional staff member employed by a Member of Congress.</text>
                </subsection>
              </section>

          </subsection>

            <enum>(b)</enum>
            <header>Clerical amendment</header>
            <text>The table of sections at the beginning of such chapter is amended by adding at the end the following new item:</text>

          <enum>8.</enum>
          <header>Budgetary effects of Act</header>
          <text display-inline="no-display-inline">The budgetary effects of this Act, for the purpose of complying with the Statutory Pay-As-You-Go-Act of 2010, shall be determined by reference to the latest statement titled <quote>Budgetary Effects of PAYGO Legislation</quote> for this Act, submitted for printing in the Congressional Record by the Chairman of the House Budget Committee, provided that such statement has been submitted prior to the vote on passage.</text>
        </section>
