            <enum>1.</enum>
            <header>Short title</header>
            <text display-inline="no-display-inline">This Act may be cited as the <quote><short-title>Electricity Security and Affordability Act</short-title></quote>.</text>
          </section>
          <section id="H1A1DB2D6AFE24252A59D84ECFFCB6E78">
            <enum>2.</enum>
            <header>Standards of performance for new fossil fuel-fired electric utility generating units</header>
            <subsection id="H1F523DD2386746EC8A6EAC9869313C2A">
              <enum>(a)</enum>
              <header>Limitation</header>
              <text>The Administrator of the Environmental Protection Agency may not issue, implement, or enforce any proposed or final rule under section 111 of the Clean Air Act (42 U.S.C. 7411) that establishes a standard of performance for emissions of any greenhouse gas from any new source that is a fossil fuel-fired electric utility generating unit unless such rule meets the requirements under subsections (b) and (c).</text>
            </subsection>
            <subsection id="H059E0340B79C48D681F02C7A84D88C1C">
              <enum>(b)</enum>
              <header>Requirements</header>
              <text>In issuing any rule under section 111 of the Clean Air Act (42 U.S.C. 7411) establishing standards of performance for emissions of any greenhouse gas from new sources that are fossil fuel-fired electric utility generating units, the Administrator of the Environmental Protection Agency (for purposes of establishing such standards)—</text>
              <paragraph id="H5D9A38F6D7704E51AF54EA0633101E1A">
                <enum>(1)</enum>
                <text display-inline="yes-display-inline">shall separate sources fueled with coal and natural gas into separate categories; and</text>
              </paragraph>
              <paragraph commented="no" id="HBDDF4C059FE846FB95AC25FF22736E0F">
                <enum>(2)</enum>
                <text>shall not set a standard based on the best system of emission reduction for new sources within the coal category unless—</text>
                <subparagraph commented="no" id="HA7F55BBFD17E44C89043EC962BC853EF">
                  <enum>(A)</enum>
                  <text>such standard has been achieved on average for at least one continuous 12-month period (excluding planned outages) by each of at least 6 units within such category—</text>
                  <clause id="HAE09A43417544C9686149A34C68BCD83">
                    <enum>(i)</enum>
                    <text>each of which is located at a different electric generating station in the United States;</text>
                  </clause>
                  <clause id="HC061B0C912AB4F05878AFEAC0B2E997C">
                    <enum>(ii)</enum>
                    <text display-inline="yes-display-inline">which, collectively, are representative of the operating characteristics of electric generation at different locations in the United States; and</text>
                  </clause>
                  <clause id="HE14B3ED32D224C07BAD731B897E1939C">
                    <enum>(iii)</enum>
                    <text>each of which is operated for the entire 12-month period on a full commercial basis; and</text>
                  </clause>
                </subparagraph>
                <subparagraph commented="no" id="H50B1229095A04CA98CEB77D9B91B46B1">
                  <enum>(B)</enum>
                  <text>no results obtained from any demonstration project are used in setting such standard.</text>
                </subparagraph>
              </paragraph>
            </subsection>
            <subsection commented="no" id="H31C5B1116B62433F9CD9AA6DF05FFEEC">
              <enum>(c)</enum>
              <header>Coal having a heat content of 8300 or less British Thermal Units per pound</header>
              <paragraph commented="no" id="H6557631D54314E7898FDFB50DD728BA0">
                <enum>(1)</enum>
                <header>Separate subcategory</header>
                <text display-inline="yes-display-inline">In carrying out subsection (b)(1), the Administrator of the Environmental Protection Agency shall establish a separate subcategory for new sources that are fossil fuel-fired electric utility generating units using coal with an average heat content of 8300 or less British Thermal Units per pound.</text>
              </paragraph>
              <paragraph commented="no" id="H47E0B8F4B08F4D9183CAB9AE6AADB2A7">
                <enum>(2)</enum>
                <header>Standard</header>
                <text display-inline="yes-display-inline">Notwithstanding subsection (b)(2), in issuing any rule under section 111 of the Clean Air Act (42 U.S.C. 7411) establishing standards of performance for emissions of any greenhouse gas from new sources in such subcategory, the Administrator of the Environmental Protection Agency shall not set a standard based on the best system of emission reduction unless—</text>
                <subparagraph commented="no" id="H18EA4657AB7141A1899BCA2F952293C8">
                  <enum>(A)</enum>
                  <text>such standard has been achieved on average for at least one continuous 12-month period (excluding planned outages) by each of at least 3 units within such subcategory—</text>
                  <clause commented="no" id="HA72FD84722C04248A338FBC59013A135">
                    <enum>(i)</enum>
                    <text>each of which is located at a different electric generating station in the United States;</text>
                  </clause>
                  <clause commented="no" id="H861CA1039D8B4BAC9819ABC2C065F8C9">
                    <enum>(ii)</enum>
                    <text>which, collectively, are representative of the operating characteristics of electric generation at different locations in the United States; and</text>
                  </clause>
                  <clause commented="no" id="HEABBB83E2F214397AEDB56E57D8CA582">
                    <enum>(iii)</enum>
                    <text>each of which is operated for the entire 12-month period on a full commercial basis; and</text>
                  </clause>
                </subparagraph>
                <subparagraph commented="no" id="H201C1331ED694C3B81717AF5C7BB8416">
                  <enum>(B)</enum>
                  <text>no results obtained from any demonstration project are used in setting such standard.</text>
                </subparagraph>
              </paragraph>
            </subsection>
          </section>
          <section id="H65CFEBA849A74C1FB293F1A2F2182C58">
            <enum>3.</enum>
            <header>Congress To set effective date for standards of performance for existing, modified, and reconstructed fossil fuel-fired electric utility generating units</header>
            <subsection id="H4A03911D801D4A5DBE975F8EC5F2C4CB">
              <enum>(a)</enum>
              <header>Applicability</header>
              <text display-inline="yes-display-inline">This section applies with respect to any rule or guidelines issued by the Administrator of the Environmental Protection Agency under section 111 of the Clean Air Act (42 U.S.C. 7411) that—</text>
              <paragraph id="HE74FD40F31334CEFBA150F558659F916">
                <enum>(1)</enum>
                <text>establish any standard of performance for emissions of any greenhouse gas from any modified or reconstructed source that is a fossil fuel-fired electric utility generating unit; or</text>
              </paragraph>
              <paragraph id="H15F5988E6FCA4A0C9FE45F84BD367353">
                <enum>(2)</enum>
                <text>apply to the emissions of any greenhouse gas from an existing source that is a fossil fuel-fired electric utility generating unit.</text>
              </paragraph>
            </subsection>
            <subsection id="HA4357418A8EC4C63828EC8EF1977D169">
              <enum>(b)</enum>
              <header>Congress To set effective date</header>
              <text display-inline="yes-display-inline">A rule or guidelines described in subsection (a) shall not take effect unless a Federal law is enacted specifying such rule’s or guidelines’ effective date.</text>
            </subsection>
            <subsection commented="no" id="H5266CEC28CD34FFF8ECFB47E7BA6B07A">
              <enum>(c)</enum>
              <header>Reporting</header>
              <text>A rule or guidelines described in subsection (a) shall not take effect unless the Administrator of the Environmental Protection Agency has submitted to Congress a report containing each of the following:</text>
              <paragraph commented="no" id="HC0C78E327C684F1C94558571A0FBFA28">
                <enum>(1)</enum>
                <text>The text of such rule or guidelines.</text>
              </paragraph>
              <paragraph commented="no" id="H45A8FFF09E044C0A99ABAF939D313A84">
                <enum>(2)</enum>
                <text>The economic impacts of such rule or guidelines, including the potential effects on—</text>
                <subparagraph id="H1D6801E16CD2497E9DD5D449246D5456">
                  <enum>(A)</enum>
                  <text>economic growth, competitiveness, and jobs in the United States; and</text>
                </subparagraph>
                <subparagraph id="HBA14A9F5E9884932BA34E784F528CB07">
                  <enum>(B)</enum>
                  <text>electricity ratepayers, including low-income ratepayers in affected States.</text>
                </subparagraph>
              </paragraph>
              <paragraph commented="no" id="HFFFF93DE61874C649CE1208793C950C9">
                <enum>(3)</enum>
                <text>The amount of greenhouse gas emissions that such rule or guidelines are projected to reduce as compared to overall global greenhouse gas emissions.</text>
              </paragraph>
            </subsection>
          </section>
          <section id="H3531EF912BCE40B794BBF525C5541960">
            <enum>4.</enum>
            <header>Repeal of earlier rules and guidelines</header>
            <text display-inline="no-display-inline">The following rules and guidelines shall be of no force or effect, and shall be treated as though such rules and guidelines had never been issued:</text>

              <enum>(1)</enum>
              <text display-inline="yes-display-inline">The proposed rule—</text>
              <subparagraph id="HCD95472E3EB2418B9B5F235DD4BEB89A">
                <enum>(A)</enum>
                <text>entitled <quote>Standards of Performance for Greenhouse Gas Emissions for New Stationary Sources: Electric Utility Generating Units</quote>, published at 77 Fed. Reg. 22392 (April 13, 2012); and</text>
              </subparagraph>
              <subparagraph id="HA144891CE6E04B0984805DB8FC81CCD3">
                <enum>(B)</enum>
                <text>withdrawn pursuant to the notice entitled <quote>Withdrawal of Proposed Standards of Performance for Greenhouse Gas Emissions for New Stationary Sources: Electric Utility Generating Units</quote>, signed by the Administrator of the Environmental Protection Agency on September 20, 2013, and identified by docket ID number EPA–HQ–OAR–2011–0660.</text>
              </subparagraph>
            </paragraph>
            <paragraph id="H3560ECF1F9BE4C2B8617EA4C9775768F">
              <enum>(2)</enum>
              <text display-inline="yes-display-inline">The proposed rule entitled <quote>Standards of Performance for Greenhouse Gas Emissions from New Stationary Sources: Electric Utility Generating Units</quote>, signed by the Administrator of the Environmental Protection Agency on September 20, 2013, and identified by docket ID number EPA–HQ–OAR–2013–0495.</text>
            </paragraph>
            <paragraph id="H1D2816326EB345F38B503B9CB1B3BB44">
              <enum>(3)</enum>
              <text>With respect to the proposed rule described in paragraph (1), any successor or substantially similar proposed or final rule that—</text>
              <subparagraph id="H7CF698E8F4814958957B9EB7BA6E3493">
                <enum>(A)</enum>
                <text>is issued prior to the date of the enactment of this Act;</text>
              </subparagraph>
              <subparagraph id="HA067A87CB78E4ECC91138C5FB395B55B">
                <enum>(B)</enum>
                <text>is applicable to any new source that is a fossil fuel-fired electric utility generating unit; and</text>
              </subparagraph>
              <subparagraph id="HAE475C7079C24A2ABB842E3D7578E0DF">
                <enum>(C)</enum>
                <text>does not meet the requirements under subsections (b) and (c) of section 2.</text>
              </subparagraph>
            </paragraph>
            <paragraph id="H32B8521F61AA4673869BFCAAD90D04E4">
              <enum>(4)</enum>
              <text>Any proposed or final rule or guidelines under section 111 of the Clean Air Act (42 U.S.C. 7411) that—</text>
              <subparagraph id="H5ED33CBC39E34C538A88C6AF547DB057">
                <enum>(A)</enum>
                <text>are issued prior to the date of the enactment of this Act; and</text>
              </subparagraph>
              <subparagraph id="HC47260D7BF3541578E57DBD07326120E">
                <enum>(B)</enum>
                <text display-inline="yes-display-inline">establish any standard of performance for emissions of any greenhouse gas from any modified or reconstructed source that is a fossil fuel-fired electric utility generating unit or apply to the emissions of any greenhouse gas from an existing source that is a fossil fuel-fired electric utility generating unit.</text>
              </subparagraph>
            </paragraph>
          </section>
          <section id="H2DC8AEB7C9874F6EA87CC0A2BBF1D1E1">
            <enum>5.</enum>
            <header>Definitions</header>
            <text display-inline="no-display-inline">In this Act:</text>
            <paragraph id="HBCA975073971401284559E2E9B059E34">
              <enum>(1)</enum>
              <header>Demonstration project</header>
              <text>The term <term>demonstration project</term> means a project to test or demonstrate the feasibility of carbon capture and storage technologies that has received government funding or financial assistance.</text>
            </paragraph>
            <paragraph id="H037671A4FAED4CF4BEA54515824B4CE2">
              <enum>(2)</enum>
              <header>Existing source</header>
              <text>The term <term>existing source</term> has the meaning given such term in section 111(a) of the Clean Air Act (42 U.S.C. 7411(a)), except such term shall not include any modified source.</text>
            </paragraph>

              <enum>(3)</enum>
              <header>Greenhouse gas</header>
              <text>The term <term>greenhouse gas</term> means any of the following:</text>
              <subparagraph id="H4572DE3951914536BA31C4067B3F9251">
                <enum>(A)</enum>
                <text>Carbon dioxide.</text>
              </subparagraph>
              <subparagraph id="HC7EFA39D62D645B3A9ED16107D38AE41">
                <enum>(B)</enum>
                <text>Methane.</text>
              </subparagraph>
              <subparagraph id="HC40D4402A8584548A5802D4B4B5F47F8">
                <enum>(C)</enum>
                <text>Nitrous oxide.</text>
              </subparagraph>
              <subparagraph id="H524D9DAE9AC1482BA46C58E435FBB180">
                <enum>(D)</enum>
                <text>Sulfur hexafluoride.</text>
              </subparagraph>
              <subparagraph id="HE94DDE87ED3C406FAF0CB6E3A8644536">
                <enum>(E)</enum>
                <text>Hydrofluorocarbons.</text>
              </subparagraph>
              <subparagraph id="H5FD169C765D848DABFBAF7B2589989FB">
                <enum>(F)</enum>
                <text>Perfluorocarbons.</text>
              </subparagraph>
            </paragraph>
            <paragraph id="HE03481D0B1F548048344495D8BCAA939">
              <enum>(4)</enum>
              <header>Modification</header>
              <text>The term <term>modification</term> has the meaning given such term in section 111(a) of the Clean Air Act (42 U.S.C. 7411(a)).</text>
            </paragraph>
            <paragraph id="H69E2426FCAF448B7BC51FBFCBB5C47F2">
              <enum>(5)</enum>
              <header>Modified source</header>
              <text>The term <term>modified source</term> means any stationary source, the modification of which is commenced after the date of the enactment of this Act.</text>
            </paragraph>
            <paragraph id="HFAEBD604B8594003AC4E8E75DC2416B9">
              <enum>(6)</enum>
              <header>New source</header>
              <text>The term <term>new source</term> has the meaning given such term in section 111(a) of the Clean Air Act (42 U.S.C. 7411(a)), except that such term shall not include any modified source.</text>
            </paragraph>
          </section>
