              <enum>101.</enum>
              <header>Limitation on authority to issue regulations under the Surface Mining Control and Reclamation Act of 1977</header>
              <text display-inline="no-display-inline">The Secretary of the Interior may not, before December 31, 2013, issue or approve any proposed or final regulation under the Surface Mining Control and Reclamation Act of 1977 (30 U.S.C. 1201 et seq.) that would—</text>
              <paragraph id="H1FDDD390D21C4D658AF4D78BA01EB531">
                <enum>(1)</enum>
                <text>adversely impact employment in coal mines in the United States; </text>
              </paragraph>
              <paragraph id="H70204CB3EA17439ABDC6E05D0A298081">
                <enum>(2)</enum>
                <text>cause a reduction in revenue received by the Federal Government or any State, tribal, or local government, by reducing through regulation the amount of coal in the United States that is available for mining;</text>
              </paragraph>
              <paragraph id="HA58E4EBDF01D416B874C263A5BA08608">
                <enum>(3)</enum>
                <text display-inline="yes-display-inline">reduce the amount of coal available for domestic consumption or for export; </text>
              </paragraph>
              <paragraph id="HD6714D13B07B4F2F8A48EB26654FC6EE">
                <enum>(4)</enum>
                <text>designate any area as unsuitable for surface coal mining and reclamation operations; or </text>
              </paragraph>
              <paragraph id="H5A74DDA482AA43C29E2965C751C2BA5F">
                <enum>(5)</enum>
                <text>expose the United States to liability for taking the value of privately owned coal through regulation.</text>
              </paragraph>
            </section>
          </title>

            <header>No greenhouse gas regulation under the Clean Air Act</header>
            <section id="H17BC9115E79B4D2AA79CD8B0C2125C1D">
              <enum>201.</enum>
              <header>No regulation of emissions of greenhouse gases</header>
              <text display-inline="no-display-inline">Title III of the Clean Air Act (42 U.S.C. 7601 et seq.) is amended by adding at the end the following:</text>

                  <header>No Regulation of emissions of greenhouse gases</header>

                    <enum>(a)</enum>
                    <header>Definition</header>
                    <text>In this section, the term <term>greenhouse gas</term> means any of the following:</text>

                      <enum>(1)</enum>
                      <text>Water vapor.</text>
                    </paragraph>
                    <paragraph id="H5B8F0495E99541B8A4420D967B0E006A">
                      <enum>(2)</enum>
                      <text>Carbon dioxide.</text>
                    </paragraph>
                    <paragraph id="HCA96A2BC27484D55AC88CAE2E216660C">
                      <enum>(3)</enum>
                      <text>Methane.</text>
                    </paragraph>
                    <paragraph id="HD3345937043144098873E2DD83641BC8">
                      <enum>(4)</enum>
                      <text>Nitrous oxide.</text>
                    </paragraph>

                      <enum>(5)</enum>
                      <text>Sulfur hexafluoride.</text>
                    </paragraph>

                    </paragraph>
                  </subsection>

                    <header>Limitation on agency action</header>

                      <enum>(1)</enum>
                      <header>Limitation</header>
                      <subparagraph commented="no" id="H8221942DAA3745DC8E2ABAC656A60EF4">
                        <enum>(A)</enum>
                        <header>In general</header>
                        <text>The Administrator may not, under this Act, promulgate any regulation concerning, take action relating to, or take into consideration the emission of a greenhouse gas to address climate change.</text>
                      </subparagraph>
                      <subparagraph commented="no" id="HA6EB195F66474A868C6DBF0F7FB8442B">
                        <enum>(B)</enum>
                        <header>Air pollutant definition</header>
                        <text>The definition of the term <term>air pollutant</term> in section 302(g) does not include a greenhouse gas. Notwithstanding the previous sentence, such definition may include a greenhouse gas for purposes of addressing concerns other than climate change.</text>
                      </subparagraph>
                    </paragraph>

                      <enum>(2)</enum>
                      <header>Exceptions</header>
                      <text>Paragraph (1) does not prohibit the following:</text>

                        <text display-inline="yes-display-inline">Notwithstanding paragraph (4)(B), implementation and enforcement of the rule entitled <quote>Light-Duty Vehicle Greenhouse Gas Emission Standards and Corporate Average Fuel Economy Standards</quote> (as published at 75 Fed. Reg. 25324 (May 7, 2010) and without further revision) and implementation and enforcement of the rule entitled <quote>Greenhouse Gas Emissions Standards and Fuel Efficiency Standards for Medium- and Heavy-Duty Engines and Vehicles</quote> (as published at 76 Fed. Reg. 57106 (September 15, 2011) and without further revision).</text>
                      </subparagraph>
                      <subparagraph commented="no" id="HE71095E094CD43E0AE3ED71CCCAEC1AF">
                        <enum>(B)</enum>
                        <text>Implementation and enforcement of section 211(o).</text>
                      </subparagraph>
                      <subparagraph id="HC072A337308340E5B546F96F6E86B9D5">

                        <text display-inline="yes-display-inline">Statutorily authorized Federal research, development, demonstration programs and voluntary programs addressing climate change.</text>
                      </subparagraph>
                      <subparagraph id="HE94E3AFF302E478E8901789C1711BC06">
                        <enum>(D)</enum>
                        <text>Implementation and enforcement of title VI to the extent such implementation or enforcement only involves one or more class I substances or class II substances (as such terms are defined in section 601).</text>
                      </subparagraph>
                      <subparagraph id="H7AACA1AB95804E02A2ACBB84C696622A">
                        <enum>(E)</enum>
                        <text>Implementation and enforcement of section 821 (42 U.S.C. 7651k note) of Public Law 101–549 (commonly referred to as the <quote>Clean Air Act Amendments of 1990</quote>).</text>
                      </subparagraph>
                    </paragraph>
                    <paragraph id="H39DB74E69027499F87B204D37C67AF9B">
                      <enum>(3)</enum>
                      <header>Inapplicability of provisions</header>
                      <text>Nothing listed in paragraph (2) shall cause a greenhouse gas to be subject to part C of title I (relating to prevention of significant deterioration of air quality) or considered an air pollutant for purposes of title V (relating to permits).</text>
                    </paragraph>

                      <enum>(4)</enum>
                      <header>Certain prior agency actions</header>
                      <text>The following rules and actions (including any supplement or revision to such rules and actions) are repealed and shall have no legal effect:</text>

                          <header>Provision defined</header>
                          <text>For purposes of clause (i), the term <term>provision</term> means any provision that—</text>

                            <enum>(I)</enum>
                            <text display-inline="yes-display-inline">is contained in a State implementation plan under section 110 and authorizes or requires a limitation on, or imposes a permit requirement for, the emission of a greenhouse gas to address climate change; or</text>

                            <enum>(II)</enum>

              <header>Preserving one national standard for automobiles</header>
              <text display-inline="no-display-inline">Section 209(b) of the Clean Air Act (42 U.S.C. 7543) is amended by adding at the end the following:</text>

                <header>Establishment</header>
                <text display-inline="yes-display-inline">The President shall establish a committee to be known as the Committee for the Cumulative Analysis of Regulations that Impact Energy and Manufacturing in the United States (in this Act referred to as the <term>Committee</term>) to analyze and report on the cumulative and incremental impacts of certain rules and actions of the Environmental Protection Agency, in accordance with sections 302 and 303.</text>
              </subsection>

                <enum>(b)</enum>
                <header>Members</header>

                <text display-inline="yes-display-inline">In conducting analyses under section 302 and preparing reports under section 303, the Committee shall consult with, and consider pertinent reports issued by, the Electric Reliability Organization certified under section 215(c) of the Federal Power Act (16 U.S.C. 824o(c)).</text>
              </subsection>

                <enum>(e)</enum>
                <header>Termination</header>
                <text display-inline="yes-display-inline">The Committee shall terminate 60 days after submitting its final report pursuant to section 303(c).</text>
              </subsection>
            </section>

              <enum>302.</enum>
              <header>Analyses</header>

                <enum>(a)</enum>
                <header>Scope</header>
                <text>The Committee shall conduct analyses, for each of the calendar years 2016, 2020, and 2030, of the following:</text>

                  <enum>(1)</enum>
                  <text display-inline="yes-display-inline">The cumulative impact of covered rules that are promulgated as final regulations on or before January 1, 2013, in combination with covered actions.</text>

                  <enum>(2)</enum>
                  <text display-inline="yes-display-inline">The cumulative impact of all covered rules (including covered rules that have not been promulgated as final regulations on or before January 1, 2013), in combination with covered actions.</text>

                <header>Contents</header>
                <text display-inline="yes-display-inline">The Committee shall include in each analysis conducted under this section the following:</text>

                    <text display-inline="yes-display-inline">other cumulative costs and cumulative benefits, including evaluation through a general equilibrium model approach;</text>

                    <enum>(C)</enum>
                    <text>any resulting change in national, State, and regional electricity prices;</text>
                  </subparagraph>
                  <subparagraph id="HAA0262E64C6C452DA1542EBCD802A182">
                    <enum>(D)</enum>
                    <text display-inline="yes-display-inline">any resulting change in national, State, and regional fuel prices;</text>
                  </subparagraph>
                  <subparagraph id="HEA6169FF01D84BE08011F04343314864">
                    <enum>(E)</enum>
                    <text display-inline="yes-display-inline">the impact on national, State, and regional employment during the 5-year period beginning on the date of enactment of this Act, and also in the long term, including secondary impacts associated with increased energy prices and facility closures; and</text>

                    <text>the reliability and adequacy of bulk power supply in the United States.</text>

                <header>Methods</header>
                <text display-inline="yes-display-inline">In conducting analyses under this section, the Committee shall use the best available methods, consistent with guidance from the Office of Information and Regulatory Affairs and the Office of Management and Budget Circular A–4.</text>
              </subsection>
              <subsection commented="no" display-inline="no-display-inline" id="H3F5C9B9D5AA94FAE9EFDB1628E07D491">
                <enum>(d)</enum>
                <header>Data</header>
                <text display-inline="yes-display-inline">In conducting analyses under this section, the Committee—</text>

                  <text>shall use the best data that are available to the public or supplied to the Committee by its members, including the most recent such data appropriate for this analysis representing air quality, facility emissions, and installed controls; and</text>

                <text display-inline="yes-display-inline">In this section, the term <term>covered action</term> means any action on or after January 1, 2009, by the Administrator of the Environmental Protection Agency, a State, a local government, or a permitting agency as a result of the application of part C of title I (relating to prevention of significant deterioration of air quality) or title V (relating to permitting) of the Clean Air Act (42 U.S.C. 7401 et seq.), if such application occurs with respect to an air pollutant that is identified as a greenhouse gas in <quote>Endangerment and Cause or Contribute Findings for Greenhouse Gases Under Section 202(a) of the Clean Air Act</quote>, published at 74 Fed. Reg. 66496 (December 15, 2009). </text>
              </subsection>
            </section>

              <enum>303.</enum>
              <header>Reports; public comment</header>

                <header>Preliminary report</header>
                <text>Not later than March 31, 2013, the Committee shall make public and submit to the Committee on Energy and Commerce of the House of Representatives and the Committee on Environment and Public Works of the Senate a preliminary report containing the results of the analyses conducted under section 302.</text>
              </subsection>
              <subsection id="HC799FF288F1E4858AE0077BADE6D09D2">
                <enum>(b)</enum>
                <header>Public comment period</header>
                <text>The Committee shall accept public comments regarding the preliminary report submitted under subsection (a) for a period of 120 days after such submission.</text>
              </subsection>

                <enum>(c)</enum>
                <header>Final report</header>
                <text>Not later than September 30, 2013, the Committee shall submit to Congress a final report containing the analyses conducted under section 302, including any revisions to such analyses made as a result of public comments, and a response to such comments.</text>
              </subsection>

              <header>Additional provisions relating to certain rules</header>

                <header>Cross-State Air Pollution rule/Transport rule</header>

                  <enum>(1)</enum>
                  <header>Earlier rules</header>
                  <text display-inline="yes-display-inline">The rule entitled <quote>Federal Implementation Plans: Interstate Transport of Fine Particulate Matter and Ozone and Correction of SIP Approvals</quote>, published at 76 Fed. Reg. 48208 (August 8, 2011), and any successor or substantially similar rule, shall be of no force or effect, and shall be treated as though such rule had never taken effect.</text>
                </paragraph>

                    <header>Issuance of new rules</header>
                    <text>The Administrator—</text>

                      <text>shall not issue any proposed or final rule under section 110(a)(2)(D)(i)(I) or section 126 of the Clean Air Act (42 U.S.C. 7410(a)(2)(D)(i)(I), 7426) relating to national ambient air quality standards for ozone or particulate matter (including any modification of the Clean Air Interstate Rule) before the date that is 3 years after the date on which the Committee submits the final report under section 303(c); and</text>

                      <text>in issuing any rule described in clause (i), shall base the rule on actual monitored (and not modeled) data and shall, notwithstanding section 110(a)(2)(D)(i)(I), allow the trading of emissions allowances among entities covered by the rule irrespective of the States in which such entities are located.</text>
                    </clause>
                  </subparagraph>

                    <enum>(B)</enum>
                    <header>Implementation schedule</header>
                    <text>In promulgating any final rule described in subparagraph (A)(i), the Administrator shall establish a date for State implementation of the standards established by such final rule that is not earlier than 3 years after the date of publication of such final rule.</text>

In conducting analyses under section 302(a), the Committee shall analyze the rule described in section 302(e)(1)(E) (including any successor or substantially similar rule) as if the preceding sentence did not apply to such rule. </text>

                  <header>Promulgation of final rules</header>
                  <text display-inline="yes-display-inline">In place of the rules described in paragraph (1), the Administrator shall—</text>

                    <text display-inline="yes-display-inline">issue regulations establishing national emission standards for coal-and oil-fired electric utility steam generating units under section 112 of the Clean Air Act (42 U.S.C. 7412) with respect to each hazardous air pollutant for which the Administrator finds such regulations are appropriate and necessary pursuant to subsection (n)(1)(A) of such section;</text>
                  </subparagraph>
                  <subparagraph id="H4CABDDAFD57D424DA111DD4164C7C7E3">
                    <enum>(B)</enum>
                    <text>issue regulations establishing standards of performance for fossil-fuel-fired electric utility, industrial-commercial-institutional, and small industrial-commercial-institutional steam generating units under section 111 of the Clean Air Act (42 U.S.C. 111); and</text>
                  </subparagraph>
                  <subparagraph id="H5FD5A830DDBD4E949366A79316A2282F" commented="no">
                    <enum>(C)</enum>
                    <text>issue the final regulations required by subparagraphs (A) and (B)—</text>

                      <text>after issuing proposed regulations under such subparagraphs;</text>
                    </clause>

                  <header>Compliance provisions</header>

                    <header>Establishment of compliance dates</header>
                    <text display-inline="yes-display-inline">In promulgating the regulations under paragraph (2), the Administrator—</text>

                      <enum>(i)</enum>
                      <text display-inline="yes-display-inline">shall establish a date for compliance with the standards and requirements under such regulations that is not earlier than 5 years after the effective date of the regulations; and </text>

                      <text>in establishing a date for such compliance, shall take into consideration—</text>

                        <enum>(III)</enum>
                        <text>the feasibility of implementing the standards and requirements, including the time needed to—</text>
                        <item id="HA34F23707390401EBB471E5608EB6572">
                          <enum>(aa)</enum>
                          <text display-inline="yes-display-inline">obtain necessary permit approvals; and </text>
                        </item>
                        <item id="HE1B8AC93F2564BBC85BB108F80F10F96">

                          <text>procure, install, and test control equipment;</text>
                        </item>
                      </subclause>
                      <subclause id="HB26954D207664D379E17A0956D58DB6C">

                        <text display-inline="yes-display-inline">the availability of equipment, suppliers, and labor, given the requirements of the regulations and other proposed or finalized regulations; and </text>

                        <text>potential net employment impacts. </text>
                      </subclause>
                    </clause>
                  </subparagraph>

                    <header>New sources</header>
                    <text display-inline="yes-display-inline">With respect to the regulations promulgated pursuant to paragraph (2)—</text>

                      <text display-inline="yes-display-inline">the date on which the Administrator proposes a regulation pursuant to paragraph (2)(A) establishing an emission standard under section 112 of the Clean Air Act (42 U.S.C. 7412) shall be treated as the date on which the Administrator first proposes such a regulation for purposes of applying the definition of a new source under section 112(a)(4) of such Act (42 U.S.C. 7412(a)(4));</text>
                    </clause>

                    </clause>
                    <clause id="HEC10952E9FEB47C3AD85528E78EEAA86" commented="no">
                      <enum>(iv)</enum>
                      <text display-inline="yes-display-inline">for purposes of clause (iii), the date of issuance of a preconstruction permit or other preconstruction approval is deemed to be the date on which such permit or approval is issued to the applicant irrespective of any administrative or judicial review occurring after such date.</text>
                    </clause>
                  </subparagraph>
                  <subparagraph id="H007EBED96FEF4BB7B196D7DDA5765355">
                    <enum>(C)</enum>
                    <header>Rule of construction</header>
                    <text>Nothing in this subsection shall be construed to restrict or otherwise affect the provisions of paragraphs (3)(B) and (4) of section 112(i) of the Clean Air Act (42 U.S.C. 7412(i)).</text>
                  </subparagraph>
                </paragraph>

                        <text>The best controlled similar source for a category or subcategory shall be the single source that is determined by the Administrator to be the best controlled, in the aggregate, for all of the hazardous air pollutants for which the Administrator intends to issue standards for such source category or subcategory, under actual operating conditions, taking into account the variability in actual source performance, source design, fuels, controls, ability to measure pollutant emissions, and operating conditions. </text>
                      </subclause>
                    </clause>

                      <text display-inline="yes-display-inline">With respect to existing sources:</text>

                        <text display-inline="yes-display-inline">The Administrator shall identify one group of sources that constitutes the best performing 12 percent of existing sources for each source category or subcategory. </text>

                        <text>The group constituting the best performing 12 percent of existing sources for a category or subcategory shall be the single group that is determined by the Administrator to be the best performing, in the aggregate, for all of the hazardous air pollutants for which the Administrator intends to issue standards for such source category or subcategory, under actual operating conditions, taking into account the variability in actual source performance, source design, fuels, controls, ability to measure pollutant emissions, and operating conditions. </text>

                    <enum>(B)</enum>
                    <header>Regulatory alternatives</header>
                    <text display-inline="yes-display-inline">For the regulations promulgated pursuant to paragraph (2) of this section, from among the range of regulatory alternatives authorized under the Clean Air Act (42 U.S.C. 7401 et seq.), including work practice standards under section 112(h) of such Act (42 U.S.C. 7412(h)), the Administrator shall impose the least burdensome, consistent with the purposes of such Act and Executive Order No. 13563 published at 76 Fed. Reg. 3821 (January 21, 2011).</text>
                  </subparagraph>
                </paragraph>

                <text>Subtitle D of the Solid Waste Disposal Act (42 U.S.C. 6941 et seq.) is amended by adding at the end the following:</text>

                        <text>Not later than 6 months after the date of enactment of this section (except as provided by the deadline identified under subsection (d)(3)(B)), the Governor of each State shall notify the Administrator, in writing, whether such State will adopt and implement a coal combustion residuals permit program.</text>
                      </paragraph>

                        <header>Certification</header>

                          <text>Not later than 36 months after the date of enactment of this section (except as provided in subsections (f)(1)(A) and (f)(1)(C)), in the case of a State that has notified the Administrator that it will implement a coal combustion residuals permit program, the head of the lead State agency responsible for implementing the coal combustion residuals permit program shall submit to the Administrator a certification that such coal combustion residuals permit program meets the specifications described in subsection (c).</text>
                        </subparagraph>
                        <subparagraph id="H42FDD8A96F984A9AA84BFDA898788AE8">
                          <enum>(B)</enum>
                          <header>Contents</header>
                          <text>A certification submitted under this paragraph shall include—</text>
                          <clause id="HDFBE06A53BD04242BDDA46F153DF297C">
                            <enum>(i)</enum>
                            <text>a letter identifying the lead State agency responsible for implementing the coal combustion residuals permit program, signed by the head of such agency;</text>
                          </clause>

                            <enum>(ii)</enum>
                            <text>identification of any other State agencies involved with the implementation of the coal combustion residuals permit program;</text>
                          </clause>
                          <clause id="H7E472A484C38469ABDD4321008B9FB8D">

                            <text>a narrative description that provides an explanation of how the State will ensure that the coal combustion residuals permit program meets the requirements of this section, including a description of the State’s—</text>

                              <text>process to inspect or otherwise determine compliance with such permit program;</text>
                            </subclause>

                            </subclause>
                            <subclause id="HF4342854F40D470E970599F29C5FA1E9">

                              <text>public participation process for the promulgation, amendment, or repeal of regulations for, and the issuance of permits under, such permit program; and</text>
                            </subclause>

                              <text>statutes, regulations, or policies pertaining to public access to information, such as groundwater monitoring data;</text>

                          <text>A State may update the certification as needed to reflect changes to the coal combustion residuals permit program.</text>
                        </subparagraph>

                        <enum>(3)</enum>
                        <header>Maintenance of 4005(c) or 3006 program</header>
                        <text>In order to adopt or implement a coal combustion residuals permit program under this section (including pursuant to subsection (f)), the State agency responsible for implementing a coal combustion residuals permit program in a State shall maintain an approved program under section 4005(c) or an authorized program under section 3006.</text>
                      </paragraph>
                    </subsection>

                      <header>Permit program specifications</header>

                          <text>A coal combustion residuals permit program shall apply the revised criteria described in paragraph (2) to owners or operators of structures, including surface impoundments, that receive coal combustion residuals.</text>
                        </subparagraph>

                          <header>Structural integrity</header>

                            <text>A coal combustion residuals permit program shall require that an independent registered professional engineer certify that—</text>

                              <text>the design of structures is in accordance with recognized and generally accepted good engineering practices for containment of the maximum volume of coal combustion residuals and liquids appropriate for the structure; and</text>
                            </subclause>
                            <subclause id="HB05513AC5A9742779F8D63B8D8D89397">
                              <enum>(II)</enum>
                              <text>the construction and maintenance of the structure will ensure dam stability.</text>
                            </subclause>
                          </clause>
                          <clause id="H89FF763B290041A0B737847102D895B6">
                            <enum>(ii)</enum>
                            <header>Inspection</header>
                            <text>A coal combustion residuals permit program shall require that structures that are surface impoundments be inspected not less than annually by an independent registered professional engineer to assure that the design, operation, and maintenance of the surface impoundment is in accordance with recognized and generally accepted good engineering practices for containment of the maximum volume of coal combustion residuals and liquids which can be impounded, so as to ensure dam stability.</text>
                          </clause>
                          <clause id="HA5C51A1074CF466DA5A3A76103CADC42">
                            <enum>(iii)</enum>
                            <header>Deficiency</header>
                            <subclause id="H77B2F20049264DAE9F0BD1FA2CE88A65">
                              <enum>(I)</enum>
                              <header>In general</header>
                              <text>If the head of the agency responsible for implementing the coal combustion residuals permit program determines that a structure is deficient with respect to the requirements in clauses (i) and (ii), the head of the agency has the authority to require action to correct the deficiency according to a schedule determined by the agency.</text>
                            </subclause>
                            <subclause id="H6504B0272F1B4F79BDAD3D2F6B381529">
                              <enum>(II)</enum>
                              <header>Uncorrected deficiencies</header>
                              <text>If a deficiency is not corrected according to the schedule, the head of the agency has the authority to require that the structure close in accordance with subsection (h).</text>
                            </subclause>
                          </clause>
                        </subparagraph>
                        <subparagraph id="H0F33DB2C06C6485590CF91ACCCC7DAF4">
                          <enum>(C)</enum>
                          <header>Location</header>
                          <text>Each structure that first receives coal combustion residuals after the date of enactment of this section shall be constructed with a base located a minimum of 2 feet above the upper limit of the water table, unless it is demonstrated to the satisfaction of the agency responsible for implementing the coal combustion residuals permit program that—</text>
                          <clause id="HB2DA5CAB17194DB2B267B0C65E3E1F62">
                            <enum>(i)</enum>
                            <text>the hydrogeologic characteristics of the structure and surrounding land would preclude such a requirement; and</text>
                          </clause>
                          <clause id="H1E5E896C8D104B558BC444D9ED71D0FC">
                            <enum>(ii)</enum>
                            <text>the function and integrity of the liner system will not be adversely impacted by contact with the water table.</text>
                          </clause>
                        </subparagraph>
                        <subparagraph id="H1886DA87535840358F8A6DC2E9424693">
                          <enum>(D)</enum>
                          <header>Wind dispersal</header>
                          <clause id="HD2CC062204514DE59789F5145243A9D5">
                            <enum>(i)</enum>
                            <header>In general</header>
                            <text>The agency responsible for implementing the coal combustion residuals permit program shall require that owners or operators of structures address wind dispersal of dust by requiring cover, or by wetting coal combustion residuals with water to a moisture content that prevents wind dispersal, facilitates compaction, and does not result in free liquids.</text>
                          </clause>

                            <enum>(ii)</enum>
                            <header>Alternative methods</header>
                            <text>Subject to the review and approval by the agency, owners or operators of structures may propose alternative methods to address wind dispersal of dust that will provide comparable or more effective control of dust.</text>
                          </clause>
                        </subparagraph>
                        <subparagraph id="HE63B5F05C56B4CFCA16EFA2568E8F04B">
                          <enum>(E)</enum>
                          <header>Permits</header>
                          <text>The agency responsible for implementing the coal combustion residuals permit program shall require that the owner or operator of each structure that receives coal combustion residuals after the date of enactment of this section apply for and obtain a permit incorporating the requirements of the coal combustion residuals permit program.</text>
                        </subparagraph>
                        <subparagraph id="H493E2A14C37C4968B9E953B0C8A9914B">
                          <enum>(F)</enum>
                          <header>State notification and groundwater monitoring</header>
                          <clause id="H548D668BD1084807881996F2C8EE0C9E">
                            <enum>(i)</enum>
                            <header>Notification</header>
                            <text>Not later than the date on which a State submits a certification under subsection (b)(2), the State shall notify owners or operators of structures within the State of—</text>

                              <enum>(I)</enum>
                              <text>the obligation to apply for and obtain a permit under subparagraph (E); and</text>
                            </subclause>

                              <text>the groundwater monitoring requirements applicable to structures under paragraph (2)(A)(ii).</text>
                            </subclause>
                          </clause>

                            <header>Groundwater monitoring</header>
                            <text>Not later than 1 year after the date on which a State submits a certification under subsection (b)(2), the State shall require the owner or operator of each structure to comply with the groundwater monitoring requirements under paragraph (2)(A)(ii).</text>
                          </clause>
                        </subparagraph>

                          <enum>(G)</enum>
                          <header>Agency requirements</header>
                          <text>Except for information described in section 1905 of title 18, United States Code, the agency responsible for implementing the coal combustion residuals permit program shall ensure that—</text>

                            <text>documents for permit determinations are made available for public review and comment under the public participation process described in subsection (b)(2)(B)(iii)(III);</text>
                          </clause>

                            <text>final determinations on permit applications are made known to the public; and</text>
                          </clause>

                            <text>groundwater monitoring data collected under paragraph (2) is publicly available.</text>
                          </clause>
                        </subparagraph>

                              <text>obtain information necessary to determine whether the owner or operator of a structure is in compliance with the coal combustion residuals permit program requirements of this section;</text>

                              <text>conduct or require monitoring and testing to ensure that structures are in compliance with the coal combustion residuals permit program requirements of this section; and</text>
                            </subclause>
                            <subclause id="H2270A2AAF76D4179B4899D15C7F37924">
                              <enum>(III)</enum>
                              <text>enter, at reasonable times, any site or premise subject to the coal combustion residuals permit program for the purpose of inspecting structures and reviewing records relevant to the operation and maintenance of structures.</text>
                            </subclause>
                          </clause>
                          <clause id="H625F0F1496FB4ABB8059BFAD1D9E3404">
                            <enum>(ii)</enum>
                            <header>Monitoring and testing</header>
                            <text>If monitoring or testing is conducted under clause (i)(II) by or for the agency responsible for implementing the coal combustion residuals permit program, the agency shall, if requested, provide to the owner or operator—</text>
                            <subclause id="H38397076EC2040FFAF1B6646C1827663">
                              <enum>(I)</enum>
                              <text>a written description of the monitoring or testing completed;</text>
                            </subclause>
                            <subclause id="H8B64EEDD347B4442A8093A3AE02DA2ED">
                              <enum>(II)</enum>
                              <text>at the time of sampling, a portion of each sample equal in volume or weight to the portion retained by or for the agency; and</text>
                            </subclause>
                            <subclause id="HC2747FF1C509441F8D314C43C20F9DBD">
                              <enum>(III)</enum>
                              <text>a copy of the results of any analysis of samples collected by or for the agency.</text>
                            </subclause>
                          </clause>
                        </subparagraph>
                        <subparagraph id="H00E7A867A2F54C6EAEFC73335039A702">
                          <enum>(I)</enum>
                          <header>State authority</header>
                          <text>A State implementing a coal combustion residuals permit program has the authority to—</text>
                          <clause id="H3AA667A8305C4C0793AA9CACE9BAB04D">
                            <enum>(i)</enum>
                            <text>inspect structures; and</text>
                          </clause>
                          <clause id="H03A3909F21154A0C9A7E4CAF089EB352">
                            <enum>(ii)</enum>
                            <text>implement and enforce the coal combustion residuals permit program.</text>
                          </clause>
                        </subparagraph>
                        <subparagraph id="H8AEE779E897A40238C52E218E8333F3B">
                          <enum>(J)</enum>
                          <header>Requirements for surface impoundments that do not meet certain criteria</header>
                          <clause id="H41AB60C82C3B401AB8F6FDC31BF8FFBA">
                            <enum>(i)</enum>
                            <header>In general</header>
                            <text>In addition to the groundwater monitoring and corrective action requirements described in paragraph (2)(A)(ii), a coal combustion residuals permit program shall require a surface impoundment that receives coal combustion residuals after the date of enactment of this section to—</text>

                              <text>comply with the requirements in clause (ii)(I)(aa) and subclauses (II) through (IV) of clause (ii) if the surface impoundment—</text>

                                <text>does not—</text>

                                </subitem>

                                  <text>meet the design criteria described in section 258.40(a)(1) of title 40, Code of Federal Regulations; and</text>
                                </subitem>
                              </item>

                                <text>within 10 years after the date of enactment of this section, is required under section 258.56(a) of title 40, Code of Federal Regulations, to undergo an assessment of corrective measures for any constituent identified in paragraph (2)(A)(ii) for which assessment groundwater monitoring is required; and</text>
                              </item>
                            </subclause>

                                <text>as of the date of enactment of this section, is subject to a State corrective action requirement.</text>
                              </item>
                            </subclause>
                          </clause>

                            <header>Requirements</header>

                                <text>Except as provided in subclause (IV), the groundwater protection standard for structures identified in clause (i)(II) established by the agency responsible for implementing the coal combustion residuals permit program under section 258.55(h) or 258.55(i) of title 40, Code of Federal Regulations, for any constituent for which corrective measures are required shall be met—</text>

                                  <text>as soon as practicable at the relevant point of compliance, as described in section 258.40(d) of title 40, Code of Federal Regulations; and</text>

                                  <text>not later than 8 years after the date of enactment of this section.</text>
                                </subitem>
                              </item>
                            </subclause>

                              <header>Closure</header>
                              <text>If the deadlines under clause (I) are not satisfied, the structure shall cease receiving coal combustion residuals and initiate closure under subsection (h).</text>
                            </subclause>

                              <enum>(III)</enum>
                              <header>Interim measures</header>
                              <item id="H94D4ACC5114345118D943A9E39215AB3">
                                <enum>(aa)</enum>
                                <header>In general</header>
                                <text>Except as provided in item (bb), not later than 90 days after the date on which the assessment of corrective measures is initiated, the owner or operator shall implement interim measures, as necessary, under the factors in section 258.58(a)(3) of title 40, Code of Federal Regulations.</text>
                              </item>

                                <enum>(bb)</enum>
                                <header>Impoundments subject to state corrective action requirements</header>
                                <text>Item (aa) shall only apply to surface impoundments subject to a State corrective action requirement as of the date of enactment of this section if the owner or operator has not implemented interim measures, as necessary, under the factors in section 258.58(a)(3) of title 40, Code of Federal Regulations.</text>
                              </item>
                            </subclause>
                            <subclause id="H9E033B40EB1949A7BA12F663D0CEE0C8">
                              <enum>(IV)</enum>
                              <header>Extension of deadline</header>
                              <item id="HC39BDE5B681C4ABFB376EE3719BEA117">
                                <enum>(aa)</enum>
                                <header>In general</header>
                                <text>Except as provided in item (bb), the deadline for meeting a groundwater protection standard under subclause (I) may be extended by the agency responsible for implementing the coal combustion residuals permit program, after opportunity for public notice and comment under the public participation process described in subsection (b)(2)(B)(iii)(III), based on—</text>

                                  <text>the effectiveness of any interim measures implemented by the owner or operator of the facility under section 258.58(a)(3) of title 40, Code of Federal Regulations;</text>

                                  <enum>(BB)</enum>
                                  <text>the level of progress demonstrated in meeting the groundwater protection standard;</text>
                                </subitem>
                                <subitem id="HC0654FAFCC7340078A3C2AC8DBCF7D9C">
                                  <enum>(CC)</enum>
                                  <text>the potential for other adverse human health or environmental exposures attributable to the contamination from the surface impoundment undergoing corrective action; and</text>
                                </subitem>
                                <subitem id="H9EEEE6E791574169B15E313CD95EA021">
                                  <enum>(DD)</enum>
                                  <text>the lack of available alternative management capacity for the coal combustion residuals and related materials managed in the impoundment at the facility at which the impoundment is located if the owner or operator has used best efforts, as necessary, to design, obtain any necessary permits, finance, construct, and render operational the alternative management capacity during the time period for meeting a groundwater protection standard in subclause (I).</text>
                                </subitem>
                              </item>
                              <item id="HEB304ED7ABD7491CA882FD3BBDA28B8D">
                                <enum>(bb)</enum>
                                <header>Exception</header>
                                <text>The deadlines under subclause (I) shall not be extended if there has been contamination of public or private drinking water systems attributable to a surface impoundment undergoing corrective action, unless the contamination has been addressed by providing a permanent replacement water system.</text>
                              </item>
                            </subclause>
                          </clause>

                            <enum>(iii)</enum>
                            <header>Subsequent closure</header>

                              <text>In addition to the groundwater monitoring and corrective action requirements described in paragraph (2)(A)(ii), a coal combustion residuals permit program shall require a surface impoundment that receives coal combustion residuals after the date of enactment of this section to comply with the requirements in subclause (II) if the surface impoundment—</text>

                              </item>

                                <text>is not subject to the requirements in clause (ii).</text>
                              </item>
                            </subclause>

                              <header>Requirements</header>
                              <item id="HCC5A34A30247430C96A6914856F3EE74">
                                <enum>(aa)</enum>
                                <header>Closure</header>
                                <text>The structures identified in subclause (I) shall cease receiving coal combustion residuals and initiate closure in accordance with subsection (h) after alternative management capacity for the coal combustion residuals and related materials managed in the impoundment at the facility is available.</text>
                              </item>
                              <item id="HFAA4D155D6774E928DDDEB910B852D1D">
                                <enum>(bb)</enum>
                                <header>Best efforts</header>
                                <text>The alternative management capacity shall be developed as soon as practicable with the owner or operator using best efforts to design, obtain necessary permits, finance, construct, and render operational the alternative management capacity.</text>
                              </item>
                              <item id="H8907AF81F1D040D58DF1E5ACF4876F1C">
                                <enum>(cc)</enum>
                                <header>Alternative management capacity plan</header>
                                <text>The owner or operator shall, in collaboration with the agency responsible for implementing the coal combustion residuals permit program, prepare a written plan that describes the steps necessary to develop the alternative management capacity and includes a schedule for completion.</text>
                              </item>
                              <item id="HC6AFF1701424439682BDF84DE7A2940F">
                                <enum>(dd)</enum>
                                <header>Public participation</header>
                                <text>The plan described in item (cc) shall be subject to public notice and comment under the public participation process described in subsection (b)(2)(B)(iii)(III).</text>
                              </item>
                            </subclause>
                          </clause>
                        </subparagraph>
                      </paragraph>
                      <paragraph id="H01EFC3E025D041419CF526690A8F6994">
                        <enum>(2)</enum>
                        <header>Revised criteria</header>
                        <text>The revised criteria described in this paragraph are—</text>
                        <subparagraph id="H503388A6E7E84587A31CECE427330C84">
                          <enum>(A)</enum>
                          <text>the revised criteria for design, groundwater monitoring, corrective action, closure, and post-closure, for structures, including—</text>
                          <clause id="H5BCF3AAA290D487BB286765586EF909F">
                            <enum>(i)</enum>
                            <text>for new structures, and lateral expansions of existing structures, that first receive coal combustion residuals after the date of enactment of this section, the revised criteria regarding design requirements described in section 258.40 of title 40, Code of Federal Regulations, except that the leachate collection system requirements described in section 258.40(a)(2) of title 40, Code of Federal Regulations do not apply to structures that are surface impoundments;</text>
                          </clause>
                          <clause id="H188BFC305D544016BFD6721EDFD55D7C">
                            <enum>(ii)</enum>
                            <text>for all structures that receive coal combustion residuals after the date of enactment of this section, the revised criteria regarding groundwater monitoring and corrective action requirements described in subpart E of part 258 of title 40, Code of Federal Regulations, except that, for the purposes of this paragraph, the revised criteria shall also include—</text>
                            <subclause id="H14B15CEB4A9749D2B0F5CA4D954E2177">
                              <enum>(I)</enum>
                              <text>for the purposes of detection monitoring, the constituents boron, chloride, conductivity, fluoride, mercury, pH, sulfate, sulfide, and total dissolved solids; and</text>
                            </subclause>
                            <subclause id="H09DC9C53FE704A7F87843A6B04049FF3">
                              <enum>(II)</enum>
                              <text>for the purposes of assessment monitoring, establishing a groundwater protection standard, and assessment of corrective measures, the constituents aluminum, boron, chloride, fluoride, iron, manganese, molybdenum, pH, sulfate, and total dissolved solids;</text>
                            </subclause>
                          </clause>
                          <clause id="H27380596AFD747EB89A72A8B2C2F6BC9">
                            <enum>(iii)</enum>
                            <text>for all structures that receive coal combustion residuals after the date of enactment of this section, in a manner consistent with subsection (h), the revised criteria for closure described in subsections (a) through (c) and (h) through (j) of section 258.60 of title 40, Code of Federal Regulations; and</text>
                          </clause>
                          <clause id="HBA7B4DDF683648638038C4350CBFBEBC">
                            <enum>(iv)</enum>
                            <text>for all structures that receive coal combustion residuals after the date of enactment of this section, the revised criteria for post-closure care described in section 258.61 of title 40, Code of Federal Regulations, except for the requirement described in subsection (a)(4) of that section;</text>
                          </clause>
                        </subparagraph>
                        <subparagraph id="HBAF5CFFC3E0A450FB49B6690FF195B59">
                          <enum>(B)</enum>
                          <text>the revised criteria for location restrictions described in—</text>
                          <clause id="H1C9797230F484323859C603183A6100A">
                            <enum>(i)</enum>
                            <text>for new structures, and lateral expansions of existing structures, that first receive coal combustion residuals after the date of enactment of this section, sections 258.11 through 258.15 of title 40, Code of Federal Regulations; and</text>
                          </clause>
                          <clause id="H2C50110A24EC4E25B40B4F949B6A3244">
                            <enum>(ii)</enum>
                            <text>for existing structures that receive coal combustion residuals after the date of enactment of this section, sections 258.11 and 258.15 of title 40, Code of Federal Regulations;</text>
                          </clause>
                        </subparagraph>
                        <subparagraph id="H4F862E8C936D48E6A3910050B886C357">
                          <enum>(C)</enum>
                          <text>for all structures that receive coal combustion residuals after the date of enactment of this section, the revised criteria for air quality described in section 258.24 of title 40, Code of Federal Regulations;</text>
                        </subparagraph>
                        <subparagraph id="HBD1F83AADC8F488A82E6CB7B4975E721">
                          <enum>(D)</enum>
                          <text>for all structures that receive coal combustion residuals after the date of enactment of this section, the revised criteria for financial assurance described in subpart G of part 258 of title 40, Code of Federal Regulations;</text>
                        </subparagraph>
                        <subparagraph id="H55F96310EB7644FBA31BDF317FD26219">
                          <enum>(E)</enum>
                          <text>for all structures that receive coal combustion residuals after the date of enactment of this section, the revised criteria for surface water described in section 258.27 of title 40, Code of Federal Regulations;</text>
                        </subparagraph>
                        <subparagraph id="H1D951523C35443028D4950C43467542F">
                          <enum>(F)</enum>
                          <text>for all structures that receive coal combustion residuals after the date of enactment of this section, the revised criteria for recordkeeping described in section 258.29 of title 40, Code of Federal Regulations;</text>
                        </subparagraph>
                        <subparagraph id="H81CC843A808E4770B4969CFBE46939D4">
                          <enum>(G)</enum>
                          <text>for landfills and other land-based units, other than surface impoundments, that receive coal combustion residuals after the date of enactment of this section, the revised criteria for run-on and run-off control systems described in section 258.26 of title 40, Code of Federal Regulations; and</text>
                        </subparagraph>
                        <subparagraph id="H1C1E844A1C2F46D9A993C91E800CDC35">
                          <enum>(H)</enum>
                          <text>for surface impoundments that receive coal combustion residuals after the date of enactment of this section, the revised criteria for run-off control systems described in section 258.26(a)(2) of title 40, Code of Federal Regulations.</text>
                        </subparagraph>
                      </paragraph>
                    </subsection>
                    <subsection id="H0941A78B576F4EBEB6D41976FF339DD6">
                      <enum>(d)</enum>
                      <header>Written notice and opportunity to remedy</header>
                      <paragraph id="HF00FB35A191349259D8D4B418F68465B">
                        <enum>(1)</enum>
                        <header>In general</header>
                        <text>The Administrator shall provide to a State written notice and an opportunity to remedy deficiencies in accordance with paragraph (2) if at any time the State—</text>
                        <subparagraph id="H60A65D0C4A574CA7BD1BF12A3A281428">
                          <enum>(A)</enum>
                          <text>does not satisfy the notification requirement under subsection (b)(1);</text>
                        </subparagraph>
                        <subparagraph id="H909102110B094EEB927DF1FFAF4D5966">
                          <enum>(B)</enum>
                          <text>has not submitted a certification under subsection (b)(2);</text>
                        </subparagraph>
                        <subparagraph id="HE623AD2138054A32A952D35DCF044DD6">
                          <enum>(C)</enum>
                          <text>does not satisfy the maintenance requirement under subsection (b)(3);</text>
                        </subparagraph>
                        <subparagraph id="H652F3C23E4D44505BEDAB266DAE08ACF">
                          <enum>(D)</enum>
                          <text>is not implementing a coal combustion residuals permit program that—</text>
                          <clause id="HDB4E12D7408C4FB8BC6E521826391513">
                            <enum>(i)</enum>
                            <text>meets the specifications described in subsection (c); or</text>
                          </clause>
                          <clause id="HC9A1EDECA7C042AF9448D4DC7A6D7FC7">
                            <enum>(ii)</enum>
                            <subclause id="H4E9AF55FED3B46DE83AEA6FD0FCAEBDA" display-inline="yes-display-inline">
                              <enum>(I)</enum>
                              <text>is consistent with the certification under subsection (b)(2)(B)(iii); and</text>
                            </subclause>
                            <subclause id="H405FDBDAF08C40C1A031B3C77D974D39">
                              <enum>(II)</enum>
                              <text>maintains fully effective statutes or regulations necessary to implement a coal combustion residuals permit program; or</text>
                            </subclause>
                          </clause>
                        </subparagraph>
                        <subparagraph id="HE7458414EBB84D43AAF37C4E591943A2">
                          <enum>(E)</enum>
                          <text>does not make available to the Administrator, within 90 days of a written request, specific information necessary for the Administrator to ascertain whether the State has complied with subparagraphs (A) through (D).</text>
                        </subparagraph>
                      </paragraph>
                      <paragraph id="HEACB75ABEF724473A90952631E79A071">
                        <enum>(2)</enum>
                        <header>Request</header>
                        <text>If the request described in paragraph (1)(E) is made pursuant to a petition of the Administrator, the Administrator shall only make the request if the Administrator does not possess the information necessary to ascertain whether the State has complied with subparagraphs (A) through (D) of paragraph (1).</text>
                      </paragraph>
                      <paragraph id="H29FBE90D57674704918C6EF259B41395">
                        <enum>(3)</enum>
                        <header>Contents of notice; deadline for response</header>
                        <text>A notice provided under this subsection shall—</text>
                        <subparagraph id="H86CEF9EA8C1846D382327A824507D5A2">
                          <enum>(A)</enum>
                          <text>include findings of the Administrator detailing any applicable deficiencies in—</text>
                          <clause id="HE8DE211E9BE94893A80A1D51E78B9DB4">
                            <enum>(i)</enum>
                            <text>compliance by the State with the notification requirement under subsection (b)(1);</text>
                          </clause>
                          <clause id="H9C4DB91AE7594D1FBB54D9A043928577">
                            <enum>(ii)</enum>
                            <text>compliance by the State with the certification requirement under subsection (b)(2);</text>
                          </clause>
                          <clause id="HE77EEB9C83EB4145AFF39F03EC5743EB">
                            <enum>(iii)</enum>
                            <text>compliance by the State with the maintenance requirement under subsection (b)(3);</text>
                          </clause>
                          <clause id="H7A824924023544E592EB35338F140003">
                            <enum>(iv)</enum>
                            <text>the State coal combustion residuals permit program in meeting the specifications described in subsection (c); and</text>
                          </clause>
                          <clause id="H6844097C115E487F98ABEB192277C2CB">
                            <enum>(v)</enum>
                            <text>compliance by the State with the request under paragraph (1)(E); and</text>
                          </clause>
                        </subparagraph>
                        <subparagraph id="HF8FF25C4048048A1A62F390DCF2082DF">
                          <enum>(B)</enum>
                          <text>identify, in collaboration with the State, a reasonable deadline, by which the State shall remedy the deficiencies detailed under subparagraph (A), which shall be—</text>
                          <clause id="HD71B25B754BF4CE38DD0E1A5B2B76177">
                            <enum>(i)</enum>
                            <text>in the case of a deficiency described in clauses (i) through (iv) of subparagraph (A), not earlier than 180 days after the date on which the State receives the notice; and</text>
                          </clause>

                      <header>Implementation by administrator</header>

                        <enum>(1)</enum>
                        <header>In general</header>
                        <text>The Administrator shall implement a coal combustion residuals permit program for a State only if—</text>
                        <subparagraph id="HAFC1DBFA7FF8463D9E3C0786C26F4D4F">
                          <enum>(A)</enum>
                          <text>the Governor of the State notifies the Administrator under subsection (b)(1) that the State will not adopt and implement a permit program;</text>
                        </subparagraph>
                        <subparagraph id="H229966B97E8C4E4384C5C4D06295E29A">
                          <enum>(B)</enum>
                          <text>the State has received a notice under subsection (d) and the Administrator determines, after providing a 30-day period for notice and public comment, that the State has failed, by the deadline identified in the notice under subsection (d)(3)(B), to remedy the deficiencies detailed in the notice under subsection (d)(3)(A); or</text>
                        </subparagraph>
                        <subparagraph id="H9DD513E6B23D4C2198348679D9E5CFE1">
                          <enum>(C)</enum>
                          <text>the State informs the Administrator, in writing, that such State will no longer implement such a permit program.</text>
                        </subparagraph>
                      </paragraph>

                        <enum>(2)</enum>
                        <header>Review</header>
                        <text>A State may obtain a review of a determination by the Administrator under this subsection as if the determination was a final regulation for purposes of section 7006.</text>
                      </paragraph>
                      <paragraph id="HED61610F88FD42BCB9C5A955BE9D9206">
                        <enum>(3)</enum>
                        <header>Other structures</header>
                        <text>For structures located on property within the exterior boundaries of a State for which the State does not have authority or jurisdiction to regulate, the Administrator shall implement a coal combustion residuals permit program only for those structures.</text>
                      </paragraph>

                        <enum>(4)</enum>
                        <header>Requirements</header>
                        <text>If the Administrator implements a coal combustion residuals permit program for a State under paragraph (1) or (3), the permit program shall consist of the specifications described in subsection (c).</text>

                          <text>If the Administrator implements a coal combustion residuals permit program for a State under paragraph (1)—</text>

                            <text>the authorities referred to in section 4005(c)(2)(A) shall apply with respect to coal combustion residuals and structures for which the Administrator is implementing the coal combustion residuals permit program; and</text>

                            <enum>(ii)</enum>
                            <text>the Administrator may use those authorities to inspect, gather information, and enforce the requirements of this section in the State.</text>

                          <enum>(B)</enum>
                          <header>Other structures</header>
                          <text>If the Administrator implements a coal combustion residuals permit program for a State under paragraph (3)—</text>

                            <enum>(i)</enum>
                            <text>the authorities referred to in section 4005(c)(2)(A) shall apply with respect to coal combustion residuals and structures for which the Administrator is implementing the coal combustion residuals permit program; and</text>

                            <enum>(ii)</enum>
                            <text>the Administrator may use those authorities to inspect, gather information, and enforce the requirements of this section for the structures for which the Administrator is implementing the coal combustion residuals permit program.</text>

                    </subsection>

                          <text>For a State for which the Administrator is implementing a coal combustion residuals permit program under subsection (e)(1)(A), the State may adopt and implement such a permit program by—</text>

                            <text>notifying the Administrator that the State will adopt and implement such a permit program;</text>
                          </clause>

                            </subclause>

                        </subparagraph>

                          <header>Remedying deficient permit program</header>
                          <text>For a State for which the Administrator is implementing a coal combustion residuals permit program under subsection (e)(1)(B), the State may adopt and implement such a permit program by—</text>

                            <enum>(i)</enum>
                            <text>remedying only the deficiencies detailed in the notice provided under subsection (d)(3)(A); and</text>
                          </clause>

                            <text>receiving from the Administrator—</text>

                          <header>Resumption of implementation by state</header>
                          <text>For a State for which the Administrator is implementing a coal combustion residuals permit program under subsection (e)(1)(C), the State may adopt and implement such a permit program by—</text>

                            <enum>(i)</enum>
                            <text>notifying the Administrator that the State will adopt and implement such a permit program;</text>
                          </clause>

                            <text>not later than 6 months after the date of such notification, submitting to the Administrator a certification under subsection (b)(2); and</text>
                          </clause>

                          <text>The Administrator shall make a determination under paragraph (1) not later than 90 days after the date on which the State submits a certification under paragraph (1)(A)(ii) or (1)(C)(ii), or notifies the Administrator that the deficiencies have been remedied pursuant to paragraph (1)(B)(i), as applicable.</text>

                          <text>Actions taken or orders issued pursuant to a coal combustion residuals permit program shall remain in effect if—</text>

                            <enum>(i)</enum>
                            <text>a State takes control of its coal combustion residuals permit program from the Administrator under paragraph (1); or</text>
                          </clause>
                          <clause id="H8ABFB8DC415746D4BF83B1B8091EFCDD">
                            <enum>(ii)</enum>
                            <text>the Administrator takes control of a coal combustion residuals permit program from a State under subsection (e).</text>
                          </clause>
                        </subparagraph>
                        <subparagraph id="HCC20A1C2862A46C7B33CF63D0E5351A8">
                          <enum>(B)</enum>
                          <header>Change in requirements</header>
                          <text>Subparagraph (A) shall apply to such actions and orders until such time as the Administrator or the head of the lead State agency responsible for implementing the coal combustion residuals permit program, as applicable—</text>
                          <clause id="H7B1EF21991F04419812C3CD2F12B751D">
                            <enum>(i)</enum>
                            <text>implements changes to the requirements of the coal combustion residuals permit program with respect to the basis for the action or order; or</text>
                          </clause>
                          <clause id="H7193A8DA8E1E4720BD25D6E31660B647">
                            <enum>(ii)</enum>
                            <text>certifies the completion of a corrective action that is the subject of the action or order.</text>
                          </clause>
                        </subparagraph>
                      </paragraph>
                      <paragraph id="HE22434A1242D443B9914C650D74C206C">
                        <enum>(4)</enum>
                        <header>Single permit program</header>
                        <text>If a State adopts and implements a coal combustion residuals permit program under this subsection, the Administrator shall cease to implement the permit program implemented under subsection (e)(1) for such State.</text>
                      </paragraph>
                    </subsection>
                    <subsection id="HB206B352106C49F68CC511FBF94B1BCA">
                      <enum>(g)</enum>
                      <header>Effect on determination under 4005(c) or 3006</header>
                      <text>The Administrator shall not consider the implementation of a coal combustion residuals permit program by the Administrator under subsection (e) in making a determination of approval for a permit program or other system of prior approval and conditions under section 4005(c) or of authorization for a program under section 3006.</text>
                    </subsection>
                    <subsection id="H0735330C63EC44669D07A58FD38F000B">
                      <enum>(h)</enum>
                      <header>Closure</header>
                      <paragraph id="HCB9282A8578E47A0A09B2FD4A63D749F">
                        <enum>(1)</enum>
                        <header>In general</header>
                        <text>If it is determined, pursuant to a coal combustion residuals permit program, that a structure should close, the time period and method for the closure of such structure shall be set forth in a closure plan that establishes a deadline for completion and that takes into account the nature and the site-specific characteristics of the structure to be closed.</text>
                      </paragraph>
                      <paragraph id="H9BAD561B7B42420DBB76BC2B944DAD10">
                        <enum>(2)</enum>
                        <header>Surface impoundment</header>
                        <text>In the case of a surface impoundment, the closure plan under paragraph (1) shall require, at a minimum, the removal of liquid and the stabilization of remaining waste, as necessary to support the final cover.</text>
                      </paragraph>
                    </subsection>
                    <subsection id="HFCAF6FE46AC04BF1B356C838001EEBFD">
                      <enum>(i)</enum>
                      <header>Authority</header>
                      <paragraph id="H25CA01D948B74745B1574955CC860E6C">
                        <enum>(1)</enum>
                        <header>State authority</header>
                        <text display-inline="yes-display-inline">Nothing in this section shall preclude or deny any right of any State to adopt or enforce any regulation or requirement respecting coal combustion residuals that is more stringent or broader in scope than a regulation or requirement under this section.</text>
                      </paragraph>

                        <enum>(2)</enum>
                        <header>Authority of the administrator</header>
                        <subparagraph id="H2D478F169DD546DD880DB6546372F2F0">
                          <enum>(A)</enum>
                          <header>In general</header>
                          <text display-inline="yes-display-inline">Except as provided in subsections (d) and (e) and section 6005, the Administrator shall, with respect to the regulation of coal combustion residuals, defer to the States pursuant to this section.</text>
                        </subparagraph>
                        <subparagraph id="HF686B1E7CFA844FEA566F6A27D28F86A">
                          <enum>(B)</enum>
                          <header>Imminent hazard</header>
                          <text>Nothing in this section shall be construed as affecting the authority of the Administrator under section 7003 with respect to coal combustion residuals.</text>
                        </subparagraph>
                        <subparagraph id="H55E1398BC405472486F1E7A71DD8B03D">
                          <enum>(C)</enum>
                          <header>Enforcement assistance only upon request</header>
                          <text>Upon request from the head of a lead State agency that is implementing a coal combustion residuals permit program, the Administrator may provide to such State agency only the enforcement assistance requested.</text>
                        </subparagraph>
                        <subparagraph id="HB3E322EC951D469D994D4A8BC6256433">
                          <enum>(D)</enum>
                          <header>Concurrent enforcement</header>
                          <text>Except as provided in subparagraph (C), the Administrator shall not have concurrent enforcement authority when a State is implementing a coal combustion residuals permit program.</text>
                        </subparagraph>
                        <subparagraph id="H092580ADAE244BC097FDA80DCD762BA6" commented="no">
                          <enum>(E)</enum>
                          <header>Other authority</header>
                          <text>The Administrator shall not have authority to finalize the proposed rule published at pages 35128 through 35264 of volume 75 of the Federal Register (June 21, 2010).</text>
                        </subparagraph>
                      </paragraph>
                      <paragraph id="H7E218ADA42D74643A8CFCF7CC9D607DA">
                        <enum>(3)</enum>
                        <header>Citizen suits</header>
                        <text>Nothing in this section shall be construed to affect the authority of a person to commence a civil action in accordance with section 7002.</text>
                      </paragraph>
                    </subsection>

                      <enum>(j)</enum>
                      <header>Mine reclamation activities</header>
                      <text>A coal combustion residuals permit program implemented by the Administrator under subsection (e) shall not apply to the utilization, placement, and storage of coal combustion residuals at surface mining and reclamation operations.</text>
                    </subsection>

                      <enum>(k)</enum>
                      <header>Definitions</header>
                      <text>In this section:</text>
                      <paragraph id="HAC2B07F0B9FD437593DBA660E14B34E9">
                        <enum>(1)</enum>
                        <header>Coal combustion residuals</header>
                        <text>The term <term>coal combustion residuals</term> means—</text>
                        <subparagraph id="H8A479AF00CF949FCA8A164A7A99818DD">
                          <enum>(A)</enum>
                          <text>the solid wastes listed in section 3001(b)(3)(A)(i), including recoverable materials from such wastes;</text>
                        </subparagraph>
                        <subparagraph id="H580A6DA656AB43B79A37EE8912FF0CFA">
                          <enum>(B)</enum>
                          <text>coal combustion wastes that are co-managed with wastes produced in conjunction with the combustion of coal, provided that such wastes are not segregated and disposed of separately from the coal combustion wastes and comprise a relatively small proportion of the total wastes being disposed in the structure;</text>
                        </subparagraph>
                        <subparagraph id="H36AB9695DC9044C6A1C74655275FC24B">
                          <enum>(C)</enum>
                          <text>fluidized bed combustion wastes;</text>
                        </subparagraph>
                        <subparagraph id="HFAB33E28762A4053B5E3E8A36619983E">
                          <enum>(D)</enum>
                          <text>wastes from the co-burning of coal with non-hazardous secondary materials, provided that coal makes up at least 50 percent of the total fuel burned; and</text>
                        </subparagraph>
                        <subparagraph id="H441DC57B22FB43F1AB5DA9FDB068F8CA">
                          <enum>(E)</enum>
                          <text>wastes from the co-burning of coal with materials described in subparagraph (A) that are recovered from monofills.</text>
                        </subparagraph>
                      </paragraph>
                      <paragraph id="H730344B55B1A4037938A5402EBA656BA">
                        <enum>(2)</enum>
                        <header>Coal combustion residuals permit program</header>
                        <text>The term <term>coal combustion residuals permit program</term> means all of the authorities, activities, and procedures that comprise the system of prior approval and conditions implemented by or for a State to regulate the management and disposal of coal combustion residuals.</text>
                      </paragraph>
                      <paragraph id="HC494EF2F813B4AEFB9C3C72B78DF5BE4">
                        <enum>(3)</enum>
                        <header>Code of federal regulations</header>
                        <text>The term <term>Code of Federal Regulations</term> means the Code of Federal Regulations (as in effect on the date of enactment of this section) or any successor regulations.</text>
                      </paragraph>
                      <paragraph id="H81DF0D20A40941758E2BD753E0747BC2">
                        <enum>(4)</enum>
                        <header>Permit; prior approval and conditions</header>
                        <text>The terms <term>permit</term> and <term>prior approval and conditions</term> mean any authorization, license, or equivalent control document that incorporates the requirements and revised criteria described in paragraphs (1) and (2) of subsection (c), respectively.</text>
                      </paragraph>

                        <header>Revised criteria</header>
                        <text>The term <term>revised criteria</term> means the criteria promulgated for municipal solid waste landfill units under section 4004(a) and under section 1008(a)(3), as revised under section 4010(c).</text>

              <text display-inline="no-display-inline">Nothing in this title, or the amendments made by this title, shall be construed to affect the authority of a State to request, or the Administrator of the Environmental Protection Agency to provide, technical assistance under the Solid Waste Disposal Act (42 U.S.C. 6901 et seq.).</text>

                <enum>(b)</enum>
                <header>Federal licenses and permits</header>
                <text>Section 401(a) of such Act (33 U.S.C. 1341(a)) is amended by adding at the end the following:</text>

                    <text>With respect to any discharge, if a State or interstate agency having jurisdiction over the navigable waters at the point where the discharge originates or will originate determines under paragraph (1) that the discharge will comply with the applicable provisions of sections 301, 302, 303, 306, and 307, the Administrator may not take any action to supersede the determination.</text>

                <enum>(c)</enum>
                <header>State NPDES permit programs</header>
                <text>Section 402(c) of such Act (42 U.S.C. 1342(c)) is amended by adding at the end the following:</text>

                    <enum>(5)</enum>
                    <header>Limitation on authority of Administrator to withdraw approval of State programs</header>
                    <text>The Administrator may not withdraw approval of a State program under paragraph (3) or (4), or limit Federal financial assistance for the State program, on the basis that the Administrator disagrees with the State regarding—</text>

                      <enum>(A)</enum>
                      <text>the implementation of any water quality standard that has been adopted by the State and approved by the Administrator under section 303(c); or</text>
                    </subparagraph>

                      <enum>(B)</enum>
                      <text>the implementation of any Federal guidance that directs the interpretation of the State’s water quality standards.</text>
                    </subparagraph>
                  </paragraph>

                <enum>(d)</enum>
                <header>Limitation on authority of Administrator To object to individual permits</header>
                <text>Section 402(d) of such Act (33 U.S.C. 1342(d)) is amended by adding at the end the following:</text>

                      <text>the Administrator’s interpretation of a water quality standard that has been adopted by the State and approved by the Administrator under section 303(c); or</text>
                    </subparagraph>
                    <subparagraph id="H79484F0FDC1E46068BA5CEBFBD4C2D8B">
                      <enum>(B)</enum>
                      <text>the implementation of any Federal guidance that directs the interpretation of the State’s water quality standards.</text>
                    </subparagraph>
                  </paragraph>

            </section>

              <enum>502.</enum>
              <header>Permits for dredged or fill material</header>

                <enum>(a)</enum>
                <header>Authority of EPA Administrator</header>
                <text>Section 404(c) of the Federal Water Pollution Control Act (33 U.S.C. 1344(c)) is amended—</text>

                  <enum>(1)</enum>
                  <text display-inline="yes-display-inline">by striking <quote>(c)</quote> and inserting <quote>(c)(1)</quote>; and</text>
                </paragraph>

                  <enum>(2)</enum>
                  <text>by adding at the end the following:</text>

                <enum>(b)</enum>
                <header>State permit programs</header>
                <text>The first sentence of section 404(g)(1) of such Act (33 U.S.C. 1344(g)(1)) is amended by striking <quote>The Governor of any State desiring to administer its own individual and general permit program for the discharge</quote> and inserting <quote>The Governor of any State desiring to administer its own individual and general permit program for some or all of the discharges</quote>.</text>
              </subsection>
            </section>
            <section id="H57BDE4F48658417EB3E614438484A5ED">
              <enum>503.</enum>
              <header>Deadlines for agency comments</header>
              <text display-inline="no-display-inline">Section 404 of the Federal Water Pollution Control Act (33 U.S.C. 1344) is amended—</text>
              <paragraph id="HA1A5A2D4E5534BAE87436BC1297D70AC">
                <enum>(1)</enum>
                <text>in subsection (m) by striking <quote>ninetieth day</quote> and inserting <quote>30th day (or the 60th day if additional time is requested)</quote>; and</text>
              </paragraph>
              <paragraph id="HD0D1F662958341F097C15BA41A315CB6">
                <enum>(2)</enum>
                <text>in subsection (q)—</text>

                  <enum>(A)</enum>

            </section>
            <section id="H396951D3E88245C7BC30D485FB72CBBE">
              <enum>504.</enum>
              <header>Applicability of amendments</header>
              <text display-inline="no-display-inline">The amendments made by this title shall apply to actions taken on or after the date of enactment of this Act, including actions taken with respect to permit applications that are pending or revised or new standards that are being promulgated as of such date of enactment.</text>
            </section>
            <section id="H8E6DAE2CFF6C4D92869FD8A74CB7A37B">
              <enum>505.</enum>
              <header>Reporting on harmful pollutants</header>
              <text display-inline="no-display-inline">Not later than 1 year after the date of enactment of this Act, and annually thereafter, the Administrator of the Environmental Protection Agency shall submit to Congress a report on any increase or reduction in waterborne pathogenic microorganisms (including protozoa, viruses, bacteria, and parasites), toxic chemicals, or toxic metals (such as lead and mercury) in waters regulated by a State under the provisions of this title, including the amendments made by this title.</text>
            </section>
            <section id="HA03E655BD4D7477CB88722DA47A65BB3">
              <enum>506.</enum>
              <header>Pipelines crossing streambeds</header>
              <text display-inline="no-display-inline">None of the provisions of this title, including the amendments made by this title, shall be construed to limit the authority of the Administrator of the Environmental Protection Agency, as in effect on the day before the date of enactment of this Act, to regulate a pipeline that crosses a streambed.</text>
            </section>

              <enum>507.</enum>
              <header>Impacts of EPA regulatory activity on employment and economic activity</header>
              <subsection id="H2E82907A57E4475CB2CC2882B6EBE0B4">
                <enum>(a)</enum>
                <header>Analysis of impacts of actions on employment and economic activity</header>
                <paragraph id="H6CE3A3C48CE44930AD3FA5D1420867F6">
                  <enum>(1)</enum>
                  <header>Analysis</header>
                  <text display-inline="yes-display-inline">Before taking a covered action, the Administrator shall analyze the impact, disaggregated by State, of the covered action on employment levels and economic activity, including estimated job losses and decreased economic activity.</text>
                </paragraph>
                <paragraph id="H6C39D16C49C24267B838D1AA15579F97">
                  <enum>(2)</enum>
                  <header>Economic models</header>
                  <subparagraph id="H49F3049CF4524D5DAD2604CA995DC9CD">
                    <enum>(A)</enum>
                    <header>In general</header>
                    <text>In carrying out paragraph (1), the Administrator shall utilize the best available economic models.</text>
                  </subparagraph>
                  <subparagraph id="HD5AC98B32314441FB8049EA89ACC3759">
                    <enum>(B)</enum>
                    <header>Annual GAO report</header>
                    <text>Not later than December 31st of each year, the Comptroller General of the United States shall submit to Congress a report on the economic models used by the Administrator to carry out this subsection.</text>
                  </subparagraph>
                </paragraph>
                <paragraph id="H5326CC6C32C24E68A1B0211666C9563C">
                  <enum>(3)</enum>
                  <header>Availability of information</header>
                  <text>With respect to any covered action, the Administrator shall—</text>
                  <subparagraph id="H277DFAF9CE1542048D577ACAC93A404A">
                    <enum>(A)</enum>
                    <text>post the analysis under paragraph (1) as a link on the main page of the public Internet Web site of the Environmental Protection Agency; and</text>
                  </subparagraph>
                  <subparagraph id="HA74464D1C5184A51BD9A5635042E2C66">
                    <enum>(B)</enum>
                    <text display-inline="yes-display-inline">request that the Governor of any State experiencing more than a de minimis negative impact post such analysis in the Capitol of such State.</text>
                  </subparagraph>
                </paragraph>
              </subsection>
              <subsection id="HF5C4CCFEC30642A38055A1B949A8EDDC">
                <enum>(b)</enum>
                <header>Public hearings</header>
                <paragraph id="H24C9039400A14EF8953CE56DAC7F4F28">
                  <enum>(1)</enum>
                  <header>In general</header>
                  <text display-inline="yes-display-inline">If the Administrator concludes under subsection (a)(1) that a covered action will have more than a de minimis negative impact on employment levels or economic activity in a State, the Administrator shall hold a public hearing in each such State at least 30 days prior to the effective date of the covered action.</text>
                </paragraph>
                <paragraph id="H8EC2856E96FC4E82A24A3B5098266A4F">
                  <enum>(2)</enum>
                  <header>Time, location, and selection</header>
                  <text>A public hearing required under paragraph (1) shall be held at a convenient time and location for impacted residents. In selecting a location for such a public hearing, the Administrator shall give priority to locations in the State that will experience the greatest number of job losses.</text>
                </paragraph>
              </subsection>
              <subsection id="H2D213FFD9D0743D58DDB9DBBA5D82F46">
                <enum>(c)</enum>
                <header>Notification</header>
                <text display-inline="yes-display-inline">If the Administrator concludes under subsection (a)(1) that a covered action will have more than a de minimis negative impact on employment levels or economic activity in any State, the Administrator shall give notice of such impact to the State’s Congressional delegation, Governor, and Legislature at least 45 days before the effective date of the covered action.</text>
              </subsection>
              <subsection id="HFB3C9C23F55F4DDD8360583CC8D8B097">
                <enum>(d)</enum>
                <header>Definitions</header>
                <text>In this section, the following definitions apply:</text>
                <paragraph id="H0C0932C0ADB74D2CBB76AAF742CD2B99">
                  <enum>(1)</enum>
                  <header>Administrator</header>
                  <text display-inline="yes-display-inline">The term <term>Administrator</term> means the Administrator of the Environmental Protection Agency.</text>
                </paragraph>
                <paragraph id="H76C84682B83943ABB7B348482F991595">
                  <enum>(2)</enum>
                  <header>Covered action</header>
                  <text>The term <term>covered action</term> means any of the following actions taken by the Administrator under the Federal Water Pollution Control Act (33 U.S.C. 1201 et seq.):</text>
                  <subparagraph id="HCAC5516357C94E5D959B969159735637">
                    <enum>(A)</enum>
                    <text display-inline="yes-display-inline">Issuing a regulation, policy statement, guidance, response to a petition, or other requirement.</text>
                  </subparagraph>
                  <subparagraph id="H095024880E884C1B8BCD278A339C431F">
                    <enum>(B)</enum>
                    <text display-inline="yes-display-inline">Implementing a new or substantially altered program.</text>
                  </subparagraph>
                </paragraph>
                <paragraph id="H54135F0739FC47B58751514C7862E0C5">
                  <enum>(3)</enum>
                  <header>More than a de minimis negative impact</header>
                  <text>The term <term>more than a de minimis negative impact</term> means the following:</text>
                  <subparagraph id="H08C4DD7E35C949F68909C8BAF36DFE5F">
                    <enum>(A)</enum>
                    <text>With respect to employment levels, a loss of more than 100 jobs. Any offsetting job gains that result from the hypothetical creation of new jobs through new technologies or government employment may not be used in the job loss calculation.</text>
                  </subparagraph>
                  <subparagraph id="H0A4CCB59FA7E498BBBF2B996BDBFE74A">
                    <enum>(B)</enum>
                    <text>With respect to economic activity, a decrease in economic activity of more than $1,000,000 over any calendar year. Any offsetting economic activity that results from the hypothetical creation of new economic activity through new technologies or government employment may not be used in the economic activity calculation.</text>
                  </subparagraph>
                </paragraph>
              </subsection>
            </section>
