            <enum>1.</enum>
            <header>Short title</header>
            <text display-inline="no-display-inline">This Act may be cited as the <quote>STEM Jobs Act of 2012</quote>.</text>
          </section>

            <enum>2.</enum>
            <header>Immigrant visas for certain advanced STEM graduates</header>
            <subsection id="H1A51DAF58FC24C4797F3C240A692D66E" commented="no">
              <enum>(a)</enum>
              <header>Worldwide level of immigration</header>
              <text display-inline="yes-display-inline">Section 201(d)(2) of the Immigration and Nationality Act (8 U.S.C. 1151(d)(2)) is amended by adding at the end the following:</text>
              <quoted-block style="traditional" id="H55DE467B8C244DBA9ED544F70759D9CC" display-inline="no-display-inline">
                <subparagraph id="HB90447AACBA24CE1907FC27C6F245139" indent="up2" commented="no">
                  <enum>(D)</enum>
                  <clause id="HC374C52D301B4C318D0A681D1E937AFA" display-inline="yes-display-inline">
                    <enum>(i)</enum>
                    <text>In addition to the increase provided under subparagraph (C), the number computed under this paragraph for fiscal year 2013 and subsequent fiscal years shall be further increased by the number specified in clause (ii), to be used in accordance with paragraphs (6) and (7) of section 203(b), except that—</text>
                    <subclause id="H9D381156EF9245C887662846BF245AFF" indent="up1">
                      <enum>(I)</enum>
                      <text display-inline="yes-display-inline">immigrant visa numbers made available under this subparagraph but not required for the classes specified in paragraphs (6) and (7) of section 203(b) shall not be counted for purposes of subsection (c)(3)(C); and</text>
                    </subclause>
                    <subclause id="H2E84C62B39074FDC8A4A80F6AA2AA2DC" indent="up1">
                      <enum>(II)</enum>
                      <text>for purposes of paragraphs (1) through (5) of section 203(b), the increase under this subparagraph shall not be counted for purposes of computing any percentage of the worldwide level under this subsection.</text>
                    </subclause>
                  </clause>
                  <clause id="H9B2FA0BBD93646D1B0FAC6586DF8C4CD" indent="up1" commented="no">
                    <enum>(ii)</enum>
                    <text display-inline="yes-display-inline">The number specified in this clause is 55,000, reduced for any fiscal year by the number by which the number of visas under section 201(e) would have been reduced in that year pursuant to section 203(d) of the Nicaraguan Adjustment and Central American Relief Act (8 U.S.C. 1151 note) if section 201(e) had not been repealed by section 3 of the STEM Jobs Act of 2012.</text>
                  </clause>
                  <clause id="H11B0AAE0DD2145D48003AAC09D8DE908" indent="up1">
                    <enum>(iii)</enum>
                    <text display-inline="yes-display-inline">Immigrant visa numbers made available under this subparagraph for fiscal year 2013, but not used for the classes specified in paragraphs (6) and (7) of section 203(b) in such year, may be made available in subsequent years as if they were included in the number specified in clause (ii) only to the extent of the cumulative number of petitions under section 204(a)(1)(F), and applications for a labor certification under section 212(a)(5)(A), filed in fiscal year 2013 with respect to aliens seeking a visa under paragraph (6) or (7) of section 203(b) up to, but not exceeding, the number specified in clause (ii) for such year. Such immigrant visa numbers may only be made available in fiscal years after fiscal year 2013 in connection with a petition under section 204(a)(1)(F), or an application for a labor certification under section 212(a)(5)(A), that was filed in fiscal year 2013.</text>
                  </clause>
                  <clause id="HB5DEB7F2383F4AE3B1CA77F21F0645BF" indent="up1">
                    <enum>(iv)</enum>
                    <text display-inline="yes-display-inline">Immigrant visa numbers made available under this subparagraph for fiscal year 2014, but not used for the classes specified in paragraphs (6) and (7) of section 203(b) during such year, may be made available in subsequent years as if they were included in the number specified in clause (ii) only to the extent of the cumulative number of petitions under section 204(a)(1)(F), and applications for a labor certification under section 212(a)(5)(A), filed in fiscal year 2014 with respect to aliens seeking a visa under paragraph (6) or (7) of section 203(b) up to, but not exceeding, the number specified in clause (ii) for such year. Such immigrant visa numbers may only be made available in fiscal years after fiscal year 2014 in connection with a petition under section 204(a)(1)(F), or an application for a labor certification under section 212(a)(5)(A), that was filed in fiscal year 2014.</text>
                  </clause>
                  <clause id="HEE251DAE50FF4548ABE955D15F137D02" indent="up1">
                    <enum>(v)</enum>
                    <text display-inline="yes-display-inline">Immigrant visa numbers made available under this subparagraph for fiscal year 2015, but not used for the classes specified in paragraphs (6) and (7) of section 203(b) in such year, may be made available in subsequent years as if they were included in the number specified in clause (ii), but only—</text>
                    <subclause id="HE363AF4EFACC4E478752CA9C32D9F222">
                      <enum>(I)</enum>
                      <text>to the extent of the cumulative number of petitions under section 204(a)(1)(F), and applications for a labor certification under section 212(a)(5)(A), filed in fiscal year 2015 with respect to aliens seeking a visa under paragraph (6) or (7) of section 203(b) up to, but not exceeding, the number specified in clause (ii) for such year;</text>
                    </subclause>
                    <subclause id="H585C6AF3581A4928A8E1A631495471C5">
                      <enum>(II)</enum>
                      <text>if the immigrant visa numbers used under this subparagraph for fiscal year 2014 with respect to aliens seeking a visa under paragraph (6) or (7) of section 203(b) were less than the number specified in clause (ii) for such year; and</text>
                    </subclause>
                    <subclause id="HFAFBFB192EF3417FAE8924BA8FAF813B">
                      <enum>(III)</enum>
                      <text>if the processing standards set forth in sections 204(a)(1)(F)(ii) and 212(a)(5)(A)(vi) were not met in fiscal year 2015.</text>
                    </subclause>
                    <continuation-text continuation-text-level="clause">Such immigrant visa numbers may only be made available in fiscal years after fiscal year 2015 in connection with a petition under section 204(a)(1)(F), or an application for a labor certification under section 212(a)(5)(A), that was filed in fiscal year 2015.</continuation-text>
                  </clause>
                  <clause id="H212FBD1E1C8F4B5C9DA000A923473E70" indent="up1">
                    <enum>(vi)</enum>
                    <text display-inline="yes-display-inline">Immigrant visa numbers made available under this subparagraph for fiscal year 2016, but not used for the classes specified in paragraphs (6) and (7) of section 203(b) in such year, may be made available in subsequent years as if they were included in the number specified in clause (ii), but only—</text>
                    <subclause id="H782959B809CD4FBE84ACC93D61552DAD">
                      <enum>(I)</enum>
                      <text>to the extent of the cumulative number of petitions under section 204(a)(1)(F), and applications for a labor certification under section 212(a)(5)(A), filed in fiscal year 2016 with respect to aliens seeking a visa under paragraph (6) or (7) of section 203(b) up to, but not exceeding, the number specified in clause (ii) for such year;</text>
                    </subclause>
                    <subclause id="H70BDE8AF73DD4B858746F3E9B98FECD0">
                      <enum>(II)</enum>
                      <text>if the immigrant visa numbers used under this subparagraph for fiscal year 2015 with respect to aliens seeking a visa under paragraph (6) or (7) of section 203(b) were less than the number specified in clause (ii) for such year; and</text>
                    </subclause>
                    <subclause id="H7C86809A9F934B55B955D732790199FB">
                      <enum>(III)</enum>
                      <text>if the processing standards set forth in sections 204(a)(1)(F)(ii) and 212(a)(5)(A)(vi) were not met in fiscal year 2016. </text>
                    </subclause>
                    <continuation-text continuation-text-level="clause">Such immigrant visa numbers may only be made available in fiscal years after fiscal year 2016 in connection with a petition under section 204(a)(1)(F), or an application for a labor certification under section 212(a)(5)(A), that was filed in fiscal year 2016.</continuation-text>
                  </clause>
                </subparagraph>

            </subsection>
            <subsection id="HCC7ADA825A804E678C92158254F19DD2">
              <enum>(b)</enum>
              <header>Numerical limitation to any single foreign state</header>
              <text>Section 202(a)(5)(A) of such Act (8 U.S.C. 1152(a)(5)(A)) is amended by striking <quote>or (5)</quote> and inserting <quote>(5), (6), or (7)</quote>.</text>
            </subsection>
            <subsection id="HA91F6EAB75EC40148F085AAB636B15A3">
              <enum>(c)</enum>
              <header>Preference allocation for employment-based immigrants</header>
              <text>Section 203(b) of such Act (8 U.S.C. 1153(b)) is amended—</text>
              <paragraph id="H8FE69EF09A2F459B9F78FAF6D0458F82">
                <enum>(1)</enum>
                <text>by redesignating paragraph (6) as paragraph (8); and</text>
              </paragraph>
              <paragraph id="H4F14CC58C42D4418A3950571B420DEF2">
                <enum>(2)</enum>
                <text>by inserting after paragraph (5) the following:</text>

                    <enum>(6)</enum>
                    <header>Aliens holding doctorate degrees from U.S. doctoral institutions of higher education in science, technology, engineering, or mathematics</header>
                    <subparagraph id="HE9AE74F3A56343D78D69A014A3414A24">
                      <enum>(A)</enum>
                      <header>In general</header>
                      <text display-inline="yes-display-inline">Visas shall be made available, in a number not to exceed the number specified in section 201(d)(2)(D)(ii), to qualified immigrants who—</text>
                      <clause id="H4A237C27B7F9474EBBBD6395B22FBC50">
                        <enum>(i)</enum>
                        <text display-inline="yes-display-inline">hold a doctorate degree in a field of science, technology, engineering, or mathematics from a United States doctoral institution of higher education; and</text>
                      </clause>
                      <clause id="H2AB4E4521FE84E3BBC3B3E610A47CE74">
                        <enum>(ii)</enum>
                        <text display-inline="yes-display-inline">have taken all doctoral courses in a field of science, technology, engineering, or mathematics, including all courses taken by correspondence (including courses offered by telecommunications) or by distance education, while physically present in the United States.</text>
                      </clause>
                    </subparagraph>
                    <subparagraph id="H8D96706B00B54D00AA02E8CA5EEBE7A5">
                      <enum>(B)</enum>
                      <header>Definitions</header>
                      <text>For purposes of this paragraph, paragraph (7), and sections 101(a)(15)(F)(i)(I) and 212(a)(5)(A)(iii)(III):</text>
                      <clause id="H02AE43CC95D943A5A2EFFF9B10C15073">
                        <enum>(i)</enum>
                        <text>The term <quote>distance education</quote> has the meaning given such term in section 103 of the Higher Education Act of 1965 (20 U.S.C. 1003).</text>
                      </clause>
                      <clause id="HF85F86B863D547A9A2777550C3FDB1B5">
                        <enum>(ii)</enum>
                        <text>The term <quote>field of science, technology, engineering, or mathematics</quote> means a field included in the Department of Education’s Classification of Instructional Programs taxonomy within the summary groups of computer and information sciences and support services, engineering, mathematics and statistics, and physical sciences.</text>
                      </clause>
                      <clause id="H36E736DF100E43619EF5FFE866965C96">
                        <enum>(iii)</enum>
                        <text display-inline="yes-display-inline">The term <quote>United States doctoral institution of higher education</quote> means an institution that—</text>
                        <subclause id="H2917F06AC97349B2A41966D2BADCAB32">
                          <enum>(I)</enum>
                          <text display-inline="yes-display-inline">is described in section 101(a) of the Higher Education Act of 1965 (20 U.S.C. 1001(a)) or is a proprietary institution of higher education (as defined in section 102(b) of such Act (20 U.S.C. 1002(b)));</text>
                        </subclause>
                        <subclause id="H8B24579390884DB39459E3F0FC176850">
                          <enum>(II)</enum>
                          <text display-inline="yes-display-inline">was classified by the Carnegie Foundation for the Advancement of Teaching on January 1, 2012, as a doctorate-granting university with a very high or high level of research activity or classified by the National Science Foundation after the date of enactment of this paragraph, pursuant to an application by the institution, as having equivalent research activity to those institutions that had been classified by the Carnegie Foundation as being doctorate-granting universities with a very high or high level of research activity;</text>
                        </subclause>
                        <subclause id="HBFF8D724A0D243FCB9E9D8136BDD6088">
                          <enum>(III)</enum>
                          <text>has been in existence for at least 10 years; and</text>
                        </subclause>
                        <subclause id="HDAF86653337D4499A626133E83B2862D">
                          <enum>(IV)</enum>
                          <text display-inline="yes-display-inline">is accredited by an accrediting body that is itself accredited either by the Department of Education or by the Council for Higher Education Accreditation.</text>
                        </subclause>
                      </clause>
                    </subparagraph>
                    <subparagraph id="H252A0D2484BF4BE3BA789F647786383B">
                      <enum>(C)</enum>
                      <header>Labor certification required</header>
                      <clause id="H0EF056BDFA3746FFB27A2274EBF64D6F">
                        <enum>(i)</enum>
                        <header>In general</header>
                        <text display-inline="yes-display-inline">Subject to clause (ii), the Secretary of Homeland Security may not approve a petition filed for classification of an alien under subparagraph (A) unless the Secretary of Homeland Security is in receipt of a determination made by the Secretary of Labor pursuant to the provisions of section 212(a)(5)(A), except that the Secretary of Homeland Security may, when the Secretary deems it to be in the national interest, waive this requirement.</text>
                      </clause>
                      <clause id="H348558E26DAB4622869C370334E4C96D">
                        <enum>(ii)</enum>
                        <header>Requirement deemed satisfied</header>
                        <text>The requirement of clause (i) shall be deemed satisfied with respect to an employer and an alien in a case in which a certification made under section 212(a)(5)(A)(i) has already been obtained with respect to the alien by that employer.</text>
                      </clause>
                    </subparagraph>
                  </paragraph>
                  <paragraph id="H1E445F12AFF6448FAF06B0EBB9E67E6A">
                    <enum>(7)</enum>
                    <header>Aliens holding master’s degrees from U.S. doctoral institutions of higher education in science, technology, engineering, or mathematics</header>
                    <subparagraph id="H54DB80B6DFD24C28B42AED72C98F2698">
                      <enum>(A)</enum>
                      <header>In general</header>
                      <text display-inline="yes-display-inline">Any visas not required for the class specified in paragraph (6) shall be made available to the class of aliens who—</text>
                      <clause id="H307ECA5740744BD6B2ED1893698E1D77">
                        <enum>(i)</enum>
                        <text display-inline="yes-display-inline">hold a master’s degree in a field of science, technology, engineering, or mathematics from a United States doctoral institution of higher education that was either part of a master’s program that required at least 2 years of enrollment or part of a 5-year combined baccalaureate-master’s degree program in such field;</text>
                      </clause>
                      <clause id="HCAD8E4BD98D1468393020CD232AD075F">
                        <enum>(ii)</enum>
                        <text display-inline="yes-display-inline">have taken all master’s degree courses in a field of science, technology, engineering, or mathematics, including all courses taken by correspondence (including courses offered by telecommunications) or by distance education, while physically present in the United States; and</text>
                      </clause>
                      <clause id="H39BAB2BD26A34CBA9E7F3EB3BB156784">
                        <enum>(iii)</enum>
                        <text display-inline="yes-display-inline">hold a baccalaureate degree in a field of science, technology, engineering, or mathematics or in a field included in the Department of Education’s Classification of Instructional Programs taxonomy within the summary group of biological and biomedical sciences.</text>
                      </clause>
                    </subparagraph>
                    <subparagraph id="H006C7C4C57574FC1A08C257ADA6CAECC">
                      <enum>(B)</enum>
                      <header>Labor certification required</header>
                      <clause id="H2B68F3A784FE477BADDDA12018B588A2">
                        <enum>(i)</enum>
                        <header>In general</header>
                        <text display-inline="yes-display-inline">Subject to clause (ii), the Secretary of Homeland Security may not approve a petition filed for classification of an alien under subparagraph (A) unless the Secretary of Homeland Security is in receipt of a determination made by the Secretary of Labor pursuant to the provisions of section 212(a)(5)(A), except that the Secretary of Homeland Security may, when the Secretary deems it to be in the national interest, waive this requirement.</text>
                      </clause>
                      <clause id="HA580DFCE17A34ED59908A8FB37AA85E0">
                        <enum>(ii)</enum>
                        <header>Requirement deemed satisfied</header>
                        <text>The requirement of clause (i) shall be deemed satisfied with respect to an employer and an alien in a case in which a certification made under section 212(a)(5)(A)(i) has already been obtained with respect to the alien by that employer.</text>
                      </clause>
                    </subparagraph>
                    <subparagraph id="H32CDA39A798D482F9F1F8B3EF5AC9072">
                      <enum>(C)</enum>
                      <header>Definitions</header>
                      <text>The definitions in paragraph (6)(B) shall apply for purposes of this paragraph.</text>
                    </subparagraph>
                  </paragraph>

              </paragraph>
            </subsection>
            <subsection id="HF9B3306859144787B8C7E77DC841F86F">
              <enum>(d)</enum>
              <header>Procedure for granting immigrant status</header>
              <text>Section 204(a)(1)(F) of such Act (8 U.S.C. 1154(a)(1)(F)) is amended—</text>
              <paragraph id="H424917638C8A496CAE5DA898697A7158">
                <enum>(1)</enum>
                <text>by striking <quote>(F)</quote> and inserting <quote>(F)(i)</quote>; </text>
              </paragraph>
              <paragraph id="H01AF852AE60545EF805ACA6DE3B07E2F">
                <enum>(2)</enum>
                <text>by striking <quote>or 203(b)(3)</quote> and inserting <quote>203(b)(3), 203(b)(6), or 203(b)(7)</quote>;</text>
              </paragraph>
              <paragraph id="H96E7ADB8A23D4F1789166FA1257E09FB">
                <enum>(3)</enum>
                <text>by striking <quote>Attorney General</quote> and inserting <quote>Secretary of Homeland Security</quote>; and</text>
              </paragraph>
              <paragraph id="H45A432DDEDC74CDCA29708BF93B51C66">
                <enum>(4)</enum>
                <text>by adding at the end the following:</text>
                <quoted-block style="traditional" id="HD39A5E812D9C4D839C4179994970D036" display-inline="no-display-inline">
                  <clause id="H748E050C7D7E49BCA4AC41D1D28F3598" indent="up3">
                    <enum>(ii)</enum>
                    <text display-inline="yes-display-inline">The following processing standards shall apply with respect to petitions under clause (i) relating to alien beneficiaries qualifying under paragraph (6) or (7) of section 203(b):</text>
                    <subclause id="HA8D123B279D942D2855807602F7CB392">
                      <enum>(I)</enum>
                      <text display-inline="yes-display-inline">The Secretary of Homeland Security shall adjudicate such petitions not later than 60 days after the date on which the petition is filed. In the event that additional information or documentation is requested by the Secretary during such 60-day period, the Secretary shall adjudicate the petition not later than 30 days after the date on which such information or documentation is received.</text>
                    </subclause>
                    <subclause id="HC66A3E055EA34155BC0306E51616A4F3">
                      <enum>(II)</enum>
                      <text display-inline="yes-display-inline">The petitioner shall be notified in writing within 30 days of the date of filing if the petition does not meet the standards for approval. If the petition does not meet such standards, the notice shall include the reasons therefore and the Secretary shall provide an opportunity for the prompt resubmission of a modified petition.</text>
                    </subclause>
                  </clause>

              </paragraph>
            </subsection>
            <subsection id="HAE3810A4FB6440DBA9743B0A4DF33234" commented="no">
              <enum>(e)</enum>
              <header>Labor certification and qualification for certain immigrants</header>
              <text>Section 212(a)(5) of such Act (8 U.S.C. 1182(a)(5)) is amended—</text>

                <enum>(1)</enum>
                <text>in subparagraph (A)—</text>
                <subparagraph id="HB405DE6CD064410EA7152A38394DDA53" commented="no">
                  <enum>(A)</enum>
                  <text>in clause (ii)—</text>
                  <clause id="HC11E68151678459083A2432832CA402A" commented="no">
                    <enum>(i)</enum>
                    <text>in subclause (I), by striking <quote>, or</quote> at the end and inserting a semicolon;</text>
                  </clause>

                    <text>in subclause (II), by striking the period at the end and inserting <quote>; or</quote>; and</text>

                    <text>by adding at the end the following:</text>

                        <text display-inline="yes-display-inline">holds a doctorate degree in a field of science, technology, engineering, or mathematics from a United States doctoral institution of higher education (as defined in section 203(b)(6)(B)(iii)).</text>
                      </subclause>

                    </quoted-block>
                  </clause>
                </subparagraph>

                      <text display-inline="yes-display-inline">The following processing standards shall apply with respect to applications under clause (i) relating to alien beneficiaries qualifying under paragraph (6) or (7) of section 203(b):</text>

                        <enum>(I)</enum>
                        <text display-inline="yes-display-inline">The Secretary of Labor shall adjudicate such applications not later than 180 days after the date on which the application is filed. In the event that additional information or documentation is requested by the Secretary during such 180-day period, the Secretary shall adjudicate the application not later than 60 days after the date on which such information or documentation is received.</text>

                        <enum>(II)</enum>
                        <text display-inline="yes-display-inline">The applicant shall be notified in writing within 60 days of the date of filing if the application does not meet the standards for approval. If the application does not meet such standards, the notice shall include the reasons therefore and the Secretary shall provide an opportunity for the prompt resubmission of a modified application.</text>

              <text display-inline="yes-display-inline">Not later than June 30, 2017, the Comptroller General of the United States shall provide to the Congress the results of a study on the use by the National Science Foundation of the classification authority provided under section 203(b)(6)(B)(iii)(II) of the Immigration and Nationality Act (8 U.S.C. 1153(b)(6)(B)(iii)(II)), as added by this section.</text>
            </subsection>
            <subsection id="H9613DF0DB6644C0EB1AC5D266AEEECF0" commented="no">
              <enum>(g)</enum>
              <header>Public information</header>
              <text>The Secretary of Homeland Security shall make available to the public on the official website of the Department of Homeland Security, and shall update not less than monthly, the following information (which shall be organized according to month and fiscal year) with respect to aliens granted status under paragraph (6) or (7) of section 203(b) of the Immigration and Nationality Act (8 U.S.C. 1153(b)), as added by this section:</text>
              <paragraph id="HFCDB147583494FA78CCD4D2765A83F95" commented="no">
                <enum>(1)</enum>
                <text>The name, city, and State of each employer who petitioned pursuant to either of such paragraphs on behalf of one or more aliens who were granted status in the month and fiscal year to date.</text>
              </paragraph>
              <paragraph id="H09F0DFA5694D4B71AB8A230CCF5B909C" commented="no">
                <enum>(2)</enum>
                <text>The number of aliens granted status under either of such paragraphs in the month and fiscal year to date based upon a petition filed by such employer.</text>
              </paragraph>
              <paragraph id="H3F5B5616FB8147118DBE0E0D15F306DA" commented="no">
                <enum>(3)</enum>
                <text>The occupations for which such alien or aliens were sought by such employer and the job titles listed by such employer on the petition. </text>
              </paragraph>
            </subsection>

              <enum>(h)</enum>
              <header>Effective date</header>
              <text display-inline="yes-display-inline">The amendments made by this section shall take effect on October 1, 2012, and shall apply with respect to fiscal years beginning on or after such date.</text>

            <header>Permanent priority dates</header>

              <text>Section 203 of the Immigration and Nationality Act (8 U.S.C. 1153) is amended by adding at the end the following:</text>

                    <text>Subject to subsection (h)(3) and paragraph (2), the priority date for any employment-based petition shall be the date of filing of the petition with the Secretary of Homeland Security (or the Secretary of State, if applicable), unless the filing of the petition was preceded by the filing of a labor certification with the Secretary of Labor, in which case that date shall constitute the priority date.</text>
                  </paragraph>
                  <paragraph id="HE6DACE32227C4E46937B40978C49BFAD">
                    <enum>(2)</enum>
                    <header>Subsequent employment-based petitions</header>
                    <text display-inline="yes-display-inline">Subject to subsection (h)(3), an alien who is the beneficiary of any employment-based petition that was approvable when filed (including self-petitioners) shall retain the priority date assigned with respect to that petition in the consideration of any subsequently filed employment-based petition (including self-petitions).</text>

            </subsection>
          </section>

            <header>Student visa reform</header>
            <subsection id="H15EE12E2436E4F2594F771119F15C0CD">
              <enum>(a)</enum>
              <header>In general</header>
              <text>Section 101(a)(15)(F) of the Immigration and Nationality Act (8 U.S.C. 1101(a)(15)(F)) is amended to read as follows:</text>

                    <subclause id="H96536438CF614AE59FA1CEE8DFDA4587">
                      <enum>(I)</enum>
                      <text display-inline="yes-display-inline">is a bona fide student qualified to pursue a full course of study in a field of science, technology, engineering, or mathematics (as defined in section 203(b)(6)(B)(ii)) leading to a bachelors or graduate degree and who seeks to enter the United States for the purpose of pursuing such a course of study consistent with section 214(m) at an institution of higher education (as described in section 101(a) of the Higher Education Act of 1965 (20 U.S.C. 1001(a))) or a proprietary institution of higher education (as defined in section 102(b) of such Act (20 U.S.C. 1002(b))) in the United States, particularly designated by the alien and approved by the Secretary of Homeland Security, after consultation with the Secretary of Education, which institution shall have agreed to report to the Secretary of Homeland Security the termination of attendance of each nonimmigrant student, and if any such institution fails to make reports promptly the approval shall be withdrawn; or</text>
                    </subclause>
                    <subclause id="H12146194247E4B9FBBA13C9D9D6983AA">
                      <enum>(II)</enum>
                      <text>is engaged in temporary employment for optional practical training related to such alien’s area of study following completion of the course of study described in subclause (I);</text>
                    </subclause>
                  </clause>
                  <clause id="HCAFCD7EE8F10446495D6DB7DD048E857">
                    <enum>(ii)</enum>
                    <text>who has a residence in a foreign country which the alien has no intention of abandoning, who is a bona fide student qualified to pursue a full course of study, and who seeks to enter the United States temporarily and solely for the purpose of pursuing such a course of study consistent with section 214(m) at an established college, university, seminary, conservatory, academic high school, elementary school, or other academic institution or in a language training program in the United States, particularly designated by the alien and approved by the Secretary of Homeland Security, after consultation with the Secretary of Education, which institution of learning or place of study shall have agreed to report to the Secretary of Homeland Security the termination of attendance of each nonimmigrant student, and if any such institution of learning or place of study fails to make reports promptly the approval shall be withdrawn;</text>
                  </clause>
                  <clause id="HB2E0437968564A2696C58FBA8AFDDFE0">
                    <enum>(iii)</enum>
                    <text>who is the spouse or minor child of an alien described in clause (i) or (ii) if accompanying or following to join such an alien; or</text>
                  </clause>
                  <clause id="H6B539BF04A334441A6013CC5DDAD198E">
                    <enum>(iv)</enum>
                    <text display-inline="yes-display-inline">who is a national of Canada or Mexico, who maintains actual residence and place of abode in the country of nationality, who is described in clause (i) or (ii) except that the alien’s qualifications for and actual course of study may be full or part-time, and who commutes to the United States institution or place of study from Canada or Mexico.</text>
                  </clause>
                </subparagraph>

            </subsection>

              <enum>(c)</enum>
              <header>Conforming amendment</header>
              <text>Section 214(m)(1) of the Immigration and Nationality Act (8 U.S.C. 1184(m)(1)) is amended, in the matter preceding subparagraph (A), by striking <quote>(i) or (iii)</quote> and inserting <quote>(i), (ii), or (iv)</quote>.</text>
            </subsection>

            </subsection>

            <header>Expansion of the <quote>V</quote> nonimmigrant visa program for spouses and children of permanent residents awaiting the availability of an immigrant visa</header>

              <header>In general</header>

              <paragraph id="HDB783D2C49AD41AFAE594101304F8659">
                <enum>(2)</enum>
                <text>is the beneficiary of a classification petition filed under section 204 of the Immigration and Nationality Act (8 U.S.C. 1154) before, on, or after the date of the enactment of this Act.</text>
              </paragraph>
            </subsection>
